<legis-type>A BILL</legis-type> 
<official-title>To amend titles XVIII and XIX of the Social Security Act to establish minimum requirements for nurse staffing in nursing facilities receiving payments under the Medicare or Medicaid Program.</official-title>

<section section-type="section-one" id="H37734B5F1BAA405AAFEBF1D4E8B4287" display-inline="no-display-inline"><enum>1.</enum><header>Short title; purpose</header> 
<subsection id="H67FCD0D53B2D4D37BFADCCBF1000F19"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Nursing Home Staffing Act of 2005</short-title></quote>.</text></subsection> 
<subsection id="HCF168EE8EBE442CF85A4F90A1988B00"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to improve the quality of care received by residents of nursing facilities through the implementation of the minimum nurse staffing levels identified by the Secretary of Health and Human Services in a report to Congress submitted on March 21, 2002.</text></subsection></section> 
<section id="H1C6BDC6C3F61440CA85F98C7EDE1ED92"><enum>2.</enum><header>Implementation of nurse staffing standards</header> 
<subsection id="HAD571D9E275940038B0077A08F1B15F3"><enum>(a)</enum><header>In general</header><text>Sections 1819(b)(4) and 1919(b)(4) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)(4)</external-xref>; 1396r(b)(4)) are each amended by adding at the end the following new subparagraph:</text> 
<quoted-block act-name="Social Security Act" id="H0B8E028F79A74EBCBACE2FDD137B00E0"> 
<subparagraph id="H8A8334EC7E254D2600B0C8E523A33374"><enum>(D)</enum><header>Minimum staffing requirements</header> 
<clause id="HDF6207AD3AFA4AF7B8C4234174CD7D0"><enum>(i)</enum><header>Deadline for Compliance with minimum standards</header><text>With respect to facility services provided after the date that is the end of the 2-year period beginning on the date of the enactment of this subparagraph, a facility shall comply with the minimum staffing levels promulgated by the Secretary under clause (ii).</text></clause> 
<clause id="HC446C6E9A3414B658020EF435FD2437"><enum>(ii)</enum><header>Final regulations</header> 
<subclause id="H3B36633262344FE8B659C658E67E6D14"><enum>(I)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this subparagraph, and consistent with the provisions of this clause, the Secretary shall promulgate standards for minimum staffing levels for facilities. Such standards shall provide for sufficient staffing levels during day, evening, and night shifts to ensure that residents of nursing facilities receive the level of care necessary to meet the objectives of subsection (b)(2), and shall provide for appropriate adjustments to account for resident case mix.</text></subclause> 
<subclause id="HB9681C6E8F8442A5BBD4648EA482CDD3"><enum>(II)</enum><header>Minimum standards</header><text>Subject to subclause (III), standards promulgated under subclause (I) shall be, at a minimum, the HHS minimum nurse staffing ratios (as defined in clause (iii)).</text></subclause> 
<subclause id="H986432999CE144479D121D00C28B77AB"><enum>(III)</enum><header>Authority to phase in facility Compliance with standards</header><text>If the Secretary determines that compliance with the HHS minimum nurse staffing ratios is not feasible for nursing facilities by the end of the 2-year period applicable under clause (i), the Secretary may delay the implementation of the HHS minimum nurse staffing ratios until the date that is the end of the 5-year period that begins on the date of the enactment of this subparagraph. If the Secretary delays implementation of the HHS minimum nurse staffing ratios under the previous sentence, the Secretary shall phase in over such 5-year period alternative minimum staffing standards that gradually increase in each of the years of the phase-in until such standards meet the HHS minimum nurse staffing ratios.</text></subclause> 
<subclause id="H99013BF600B54DD0AD95254BCA976C1F"><enum>(IV)</enum><header>Counting</header><text>In determining compliance with the staffing levels under this subparagraph, an individual may not be counted while performing services that are not direct nursing care, such as administrative services, food preparation, housekeeping, laundry, maintenance services, or other activities that are not direct nursing care.</text></subclause></clause> 
<clause id="H95B340219E92410F81AB9337B383E4B2"><enum>(iii)</enum><header>HHS minimum nurse staffing ratios</header><text>The term <term>HHS minimum nurse staffing ratios</term> means the minimum staffing levels identified in the report to Congress entitled <quote>Appropriateness of Minimum Nurse Staffing Ratios in Nursing Homes, Report to Congress: Phase II Final</quote> submitted by the Secretary on March 21, 2002, which require—</text> 
<subclause id="H2A5F23118A8C424782D74FF5D9CE691B"><enum>(I)</enum><text>from 2.4 to 2.8 hours of care per resident per day by a certified nurse aide;</text></subclause> 
<subclause id="H1BBC952D7FA8421DA2A1D1E43231910"><enum>(II)</enum><text>from 1.15 to 1.3 hours of care per resident per day by a licensed practical nurse, a licensed vocational nurse, or a registered nurse; and</text></subclause> 
<subclause id="H247A0BC6B3414305B4CF001F00817D71"><enum>(III)</enum><text>from 0.55 to 0.75 hours of care per resident per day by a registered nurse.</text></subclause></clause> 
<clause id="HCD5C6EAE7F9240A591EBC2BB623CA7B5"><enum>(iv)</enum><header>Construction</header> 
<subclause id="HD03A79D307C340DE8F1CCA7053D7D9C"><enum>(I)</enum><header>Nonpreemption</header><text>Nothing in this subparagraph shall be construed as prohibiting the Secretary or a State (in the case of title XIX) from imposing higher minimum staffing levels on facilities than those imposed under this subparagraph.</text></subclause> 
<subclause id="H9CCB04892F7F4B119C5CDF900E29CD8"><enum>(II)</enum><header>Minimum standards only</header><text>Compliance with the staffing requirements imposed under this subparagraph alone shall not be construed as complying with the requirement under paragraph (2) to provide services to attain or maintain the highest practicable physical, mental, and psychosocial well-being of each resident.</text></subclause> 
<subclause id="HCDC603753A1541249CBEDAD2BED368E"><enum>(III)</enum><header>Supplementary requirements</header><text>The staffing requirements of this subparagraph are in addition to the requirements of subparagraph (C).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2E94C9D83A914EA08BCDF31208FF96B0"><enum>(b)</enum><header>Posting of staffing information</header> 
<paragraph id="H891ECBEC17FD494FB57744C2A74C99D4"><enum>(1)</enum><header>In general</header><text>The first sentence of subparagraph (A) of sections 1819(b)(8) and 1919(b)(8) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)(8)</external-xref>; 1396r(b)(8)) are each amended by inserting before the period the following: <quote>, a description of the minimum staffing requirements under paragraph (4)(D), and the average number of hours of nursing care that residents of the facility have received for each of the four previous calendar quarters</quote>.</text></paragraph> 
<paragraph id="HBE5A64203DDE4545B9AA00875C8D00C2"><enum>(2)</enum><header>Reports</header><text>Such sections are each amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H3F607583FED84230827C6B2939F0C767"><enum>(C)</enum><header>Reports of staffing data</header><text>A facility shall maintain records on nurse staffing, and shall submit such reports of such records to the Secretary as the Secretary may require for the administration and enforcement of this section. Such records shall be reviewed for accuracy as part of a standard survey required under subsection (g)(2)(A).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H2B1C87DC6508410E86E3203F055BD5F"><enum>3.</enum><header>Increased resources</header> 
<subsection id="HC83BCA5B0FA1423C00C60000AF1D91C"><enum>(a)</enum><header>Reinstitution of boren amendment payment methodology</header> 
<paragraph id="H8D91AD5046AC4262BE9744BF6B68EE00"><enum>(1)</enum><header>In general</header><text>Section 1902(a)(13) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(13)</external-xref>) is amended to read as follows:</text> 
<quoted-block act-name="Social Security Act" id="H376EE76D38504342B34EAE713CF03D00"> 
<paragraph id="H7789BE2CE1A945DD9BDE78DD2B8351C9"><enum>(13)</enum><text>provide for payment of services through the use of rates determined pursuant to the criteria under this paragraph as in effect on August 1, 1997;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5B94CCD0D9594E939D87E081B51F431E"><enum>(2)</enum><header>Establishment of safe harbor rates</header><text>Section 1902 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended by adding at the end the following: <quote>The Secretary may, by regulation, promulgate standards or methodologies for determining rates that comply with paragraph (13), and a State that pays rates that meet such standards or methodologies is deemed to be in compliance with paragraph (13).</quote>.</text></paragraph> 
<paragraph id="HBAF2ADD9554C4A3BA15681A4823F732D"><enum>(3)</enum><header>Effective date</header><text>The amendment made by this subsection shall apply to services furnished on or after the date that is one year after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HB6BE0CDFBB804D5AAE48FA970200E79E"><enum>(b)</enum><header>Permanent 1.5 percent increase of medicaid FMAP beginning with fiscal year 2006</header><text>Section 1905(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(b)</external-xref>) is amended by adding at the end the following: <quote>With respect to calendar quarters beginning after October 1, 2005, the Federal medical assistance percentage for a State determined under the first sentence shall be increased by 1.50 percentage points.</quote>.</text></subsection> 
<subsection id="H189D785ADB7C4FE696B66787574349D2"><enum>(c)</enum><header>Financial accountability</header> 
<paragraph id="H5B613BCDBB5F4802A02DB1953EFDA952"><enum>(1)</enum><header>In general</header><text>Sections 1819(g)(2) and 1919(g)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(g)(2)</external-xref>; 1396r(g)(2)) are each amended—</text> 
<subparagraph id="H1E563FE2AE3941FDB2C0A6FCEA073726"><enum>(A)</enum><text>by redesignating subparagraphs (C), (D), and (E) as subparagraphs (D), (E), and (F); and</text></subparagraph> 
<subparagraph id="HECF87FE790E0449FA9A8D8D620097A7"><enum>(B)</enum><text>by inserting after subparagraph (B) the following new subparagraph:</text>

<subparagraph id="H06F975641FC943A9AD4C33006FEB0800"><enum>(C)</enum><header>Financial accountability</header><text>A standard or an extended survey may include an examination of the financial records of a facility to determine whether payments made to the facility under this section for services furnished to residents are being used in a manner consistent with this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H9C84DCCD3727426392233438D87F53EB"><enum>(2)</enum><header>Composition of multidisciplinary team</header><text>Sections 1819(g)(2)(E)(i) and 1919(g)(2)(E)(i) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(g)(2)(E)(i)</external-xref>; 1396r(g)(2)(E)(i)) are each amended by inserting after the period the following: <quote>This multidisciplinary team may include professionals trained in financial accounting and auditing.</quote></text></paragraph> 
<paragraph id="H36DBDC0517314508BBFBB24340D1F46F"><enum>(3)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall apply to surveys conducted on or after the date of the enactment of this Act.</text></paragraph></subsection></section>
