<section id="H4E81F6B2E1794300BCD7A71F9F458593" section-type="section-one"><enum>1.</enum><header>Expensing of certain replacement underground electric transmission lines</header> 
<subsection id="H5F61114FC31F486CB391BAB6103A650"><enum>(a)</enum><header>In general</header><text>Part VI of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to itemized deductions for individuals and corporations) is amended by inserting after section 179D the following new section:</text>

<section id="H2D472CD6802247C38BE19BDFFE3308FB"><enum>179E.</enum><header>Election to expense certain replacement underground electric transmission lines</header> 
<subsection id="HD2C702B6C0414E6B96A001D8CC4D1649"><enum>(a)</enum><header>In general</header><text>A qualified public electric utility may elect to treat the cost of any qualified underground transmission line as an expense which is not chargeable to capital account. Any cost so treated shall be allowed as a deduction for the taxable year in which the qualified underground transmission line is placed in service.</text></subsection> 
<subsection id="H13C23E8DF7F6498F8CCB86E6AD26DE95"><enum>(b)</enum><header>Qualified underground transmission line</header><text>For purposes of this section, the term <quote>qualified underground transmission line</quote> means any line for the transmission of electricity—</text> 
<paragraph id="HAD01C6BEA9F64DBFBDB8D0AF7535CF42"><enum>(1)</enum><text>which is run underground,</text></paragraph> 
<paragraph id="HCC8E9E0531C04D239496E5501960FF39"><enum>(2)</enum><text>which replaces a line for the transmission of electricity which is run above ground,</text></paragraph> 
<paragraph id="HA826D4C4A97C4916BF560526E8F2C976"><enum>(3)</enum><text>which is section 179 property, and</text></paragraph> 
<paragraph id="H18BBC579D96045F38F96D3D82AEF66B"><enum>(4)</enum><text>the original use of which commences with the taxpayer.</text></paragraph></subsection> 
<subsection id="H8102BFD2234741B8B87C10E954B31580"><enum>(c)</enum><header>Qualified public electric utility</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>qualified public electric utility</quote> means any person engaged in the sale of electricity to residential, commercial, or industrial customers for use by such customers.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2F5AA36825DB40D4AC61B21F2C1972C7"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for part VI of subchapter B of chapter 1 of such Code is amended by adding at the end the following new item:</text>

<subsection id="HBB31A639495B4CBCB6DDF720C1008178"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property placed in service after the date of the enactment of this Act.</text> </subsection></section>
