<official-title>To amend the Tariff Act of 1930 and the Internal Revenue Code of 1986 relating to importation of tobacco products.</official-title>

<section id="H20B1330990FF4BB6B861B0AEC7CC988B" section-type="section-one"><enum>1.</enum><header>Compliance with Tariff Act of 1930</header> 
<subsection id="H17175AFCE78745AC889B84123529EA41"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 801 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1681">19 U.S.C. 1681</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H00BCCBBD9DC449829F2CBA43C003E1D" display-inline="no-display-inline"> 
<paragraph id="HE45C1C70CF74421B8666C656CD00AF73"><enum>(3)</enum><header>Delivery sale</header><text display-inline="yes-display-inline">The term <quote>delivery sale</quote> means any sale of cigarettes or a smokeless tobacco product to a consumer if—</text> 
<subparagraph id="HFE33A7539AD04B93AD2D07F3B6D2811E"><enum>(A)</enum><text display-inline="yes-display-inline">the consumer submits the order for such sale by means of a telephone or other method of voice transmission, the mail, or the Internet or other online service, or the seller is otherwise not in the physical presence of the buyer when the request for purchase or order is made; or</text></subparagraph> 
<subparagraph id="HE7A425BB93764A2F8DFE5444BA75F866"><enum>(B)</enum><text display-inline="yes-display-inline">the cigarettes or smokeless tobacco product is delivered by use of a common carrier, private delivery service, or the mail, or the seller is not in the physical presence of the buyer when the buyer obtains personal possession of the delivered cigarettes or smokeless tobacco product.</text></subparagraph></paragraph> 
<paragraph id="H1183B9722F0A4630A745C261EDE33707"><enum>(4)</enum><header>Indian tribe</header><text display-inline="yes-display-inline">The terms <quote>Indian tribe</quote> and <quote>tribal</quote> refer to an Indian tribe as defined in the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b(e)</external-xref>) or as listed pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a-1">25 U.S.C. 479a–1</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H31A4DCF19AE7423BBC61727181E7307"><enum>(b)</enum><header>Inapplicability of exemptions from requirements for entry of certain cigarettes and smokeless tobacco products</header><text>Section 802(b)(1) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1681a">19 U.S.C. 1681a(b)(1)</external-xref>) is amended by adding at the end the following new sentence: <quote>The preceding sentence shall not apply to any cigarettes or smokeless tobacco products sold in connection with a delivery sale.</quote>.</text></subsection> 
<subsection id="HA6E2546923E042318C47957E00AA1D88"><enum>(c)</enum><header>State access to customs certifications</header><text>Section 802 of that Act is further amended by adding at the end the following new subsection:</text> 
<quoted-block id="HCD3CD8C8FF0B419AA7DEA9BF7D24C1BE" style="OLC"> 
<subsection id="HB0353817365B43F68F9E380000F00059"><enum>(d)</enum><header>State access to customs certifications</header><text>A State, through its Attorney General, shall be entitled to obtain copies of any certification required under subsection (c) directly—</text> 
<paragraph id="H3BFA2FA2A65949679399B31B3BC8B434"><enum>(1)</enum><text>upon request to the agency of the United States responsible for collecting such certification; or</text></paragraph> 
<paragraph id="H5CCEF1BCC8744EDDBE382230B4434C7F"><enum>(2)</enum><text>upon request to the importer, manufacturer, or authorized official of such importer or manufacturer.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF95BDA6972914D5483C24D6E4C17C6C1"><enum>(d)</enum><header>Enforcement provisions</header><text>Section 803 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/19/1681b">19 U.S.C. 1681b</external-xref>) is amended—</text> 
<paragraph id="H6F35AD11183C4E55BFD8AA36539C65A1"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H2DE605CF5A5847DD93E63EEF2304272"><enum>(A)</enum><text>in the first sentence, by inserting before the period the following: <quote>, or to any State in which such tobacco product, cigarette papers, or tube is found</quote>; and </text></subparagraph> 
<subparagraph id="HE6407B9ED59C41D091DCCFD500176C7C"><enum>(B)</enum><text>in the second sentence, by inserting <quote>, or to any State,</quote> after <quote>the United States</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HA326F69311A745C48345C8A7596DF4D0"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="HDE74DD6BAC90454285B6A9DB70375FF1"><enum>(c)</enum><header>Actions by states and others</header> 
<paragraph id="HAD37C971E6294295B966E017F447B27E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who holds a permit under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/52">chapter 52</external-xref> of the Internal Revenue Code of 1986 may bring an action in the United States district courts against any person, other than a State, local, or tribal government, to prevent and restrain violations of this title—</text> 
<subparagraph id="H7244D727270342F4A00083B6D05EBB6F"><enum>(A)</enum><text>by that person; or</text></subparagraph> 
<subparagraph id="HBF1A5FF1711440D69ED67517504BA180"><enum>(B)</enum><text>by another person controlled by that person.</text></subparagraph></paragraph> 
<paragraph id="HB2F0A2548B6C497893825C3337943898"><enum>(2)</enum><header>Relief for state and local governments</header><text>A State, acting through its attorney general, or a local government, acting through its chief law enforcement officer (or a designee thereof), may bring a civil action under this title against any person—</text> 
<subparagraph id="H53A377311F214A37B451F1A8C6ECE00"><enum>(A)</enum><text>to prevent and restrain violations of this title—</text> 
<clause id="H141DD7C845CE43D183DFF8863CE79D00"><enum>(i)</enum><text>by that person; or</text></clause> 
<clause id="HB7E23AB61370426DB06648088BFE44A0"><enum>(ii)</enum><text>by another person controlled by that person; or</text></clause></subparagraph> 
<subparagraph id="HDBBB2A0B1303496E8344D2BA48697F03"><enum>(B)</enum><text>to obtain any other appropriate relief for violations of this title—</text> 
<clause id="H8D4E6833C37E41679975C8DAF58798C"><enum>(i)</enum><text>by that person, or</text></clause> 
<clause id="HA546889B5F90493AA8B084F14CDF0061"><enum>(ii)</enum><text>by another person controlled by that person,</text></clause><continuation-text continuation-text-level="subparagraph">including civil penalties, money damages, and injunctive or other equitable relief.</continuation-text></subparagraph></paragraph> 
<paragraph id="HD02B20C7FCE34480B42348E3F694E300"><enum>(3)</enum><header>Construction generally</header> 
<subparagraph id="H1E723C766C9A47D2BA5C47BDA5CEEBD"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection shall be deemed to abrogate or constitute a waiver of any sovereign immunity of a State or local government or an Indian tribe against any unconsented lawsuit under this title or to otherwise restrict, expand, or modify any sovereign immunity of a State or local government or an Indian tribe.</text></subparagraph> 
<subparagraph id="H0DD79AC390F14DACB84079AE9CDE33F0"><enum>(B)</enum><header>Construction with other relief</header><text>The remedies available under this subsection are in addition to any other remedies available under Federal, State, local, or other law.</text></subparagraph></paragraph> 
<paragraph id="H83988B93E32842B7ABC73DCD6B36C8CF"><enum>(4)</enum><header>Construction with forfeiture provisions</header><text>Nothing in this subsection shall be construed to require a State to first bring an action under paragraph (2) when pursuing relief under subsection (b).</text></paragraph></subsection> 
<subsection id="H3B73C90821054914BAFD20982C53EC99"><enum>(d)</enum><header>Construction with state authorities</header><text>Nothing in this title shall be construed to expand, restrict, or otherwise modify the right of an authorized State official from proceeding in any State court, or taking other enforcement actions, on the basis of alleged violation of State or other law.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB30F031C9BF6428B8CC1F6BE1EC2F700"><enum>(e)</enum><header>Inclusion of smokeless tobacco</header> 
<paragraph id="HD2CDCD50A8B24FFAB8C85E8332891714"><enum>(1)</enum><text>Sections 802 and 803(a) of that Act (other than the last sentence of section 802(b)(1), as added by subsection (b) of this section) are further amended by inserting <quote>or smokeless tobacco products</quote> after <quote>cigarettes</quote> each place it appears.</text></paragraph> 
<paragraph id="H2C0F131081DA4B218F23F8E6984636CE"><enum>(2)</enum><text>Section 802 of such Act is further amended—</text> 
<subparagraph id="HCEDE2D63AD004A29005611333DCB3D73"><enum>(A)</enum><text>in subsection (a)—</text> 
<clause id="HA0DFE77508C3410996D746A0FDBAB40"><enum>(i)</enum><text>in paragraph (1), by inserting <quote>or section 4 of the Comprehensive Smokeless Tobacco Health Education Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/15/4403">15 U.S.C. 4403</external-xref>), as the case may be</quote> after <quote>section 7 of the Federal Cigarette Labeling and Advertising Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1335a">15 U.S.C. 1335a</external-xref>)</quote>;</text></clause> 
<clause id="HD16A4829EAAA484E95E85628FB92DE94"><enum>(ii)</enum><text>in paragraph (2), by inserting <quote>or section 3 of the Comprehensive Smokeless Tobacco Health Education Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/15/4402">15 U.S.C. 4402</external-xref>), as the case may be,</quote> after <quote>section 4 of the Federal Cigarette Labeling and Advertising Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1333">15 U.S.C. 1333</external-xref>)</quote>; and</text></clause> 
<clause id="H6B61D5C07F674C42975057C395876694"><enum>(iii)</enum><text>in paragraph (3), by inserting <quote>or section 3(d) of the Comprehensive Smokeless Tobacco Health Education Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/15/4402">15 U.S.C. 4402(d)</external-xref>), as the case may be,</quote> after <quote>section 4(c) of the Federal Cigarette Labeling and Advertising Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1333">15 U.S.C. 1333(c)</external-xref>)</quote>;</text></clause></subparagraph> 
<subparagraph id="H337A809669C64E5B00661B1D3478EAC6"><enum>(B)</enum><text>in subsection (b)—</text> 
<clause id="H354C9D04228943D30011F7FDE93EBFB"><enum>(i)</enum><text>in the paragraph caption of paragraph (1), by inserting <quote><header-in-text level="paragraph" style="OLC">or smokeless tobacco</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">cigarettes</header-in-text></quote>; and</text></clause> 
<clause id="HB0B5586C8CB74A6A9055AA02E6F2516B"><enum>(ii)</enum><text>in the paragraph caption of paragraphs (2) and (3), by inserting <quote><header-in-text level="paragraph" style="OLC">or smokeless tobacco</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">cigarettes</header-in-text></quote>; and</text></clause></subparagraph> 
<subparagraph id="H9EDE6EC37EB04F8ABAB61B104400F4AF"><enum>(C)</enum><text>in subsection (c)—</text> 
<clause id="HC09E8331287D408FA1D688891F366BEF"><enum>(i)</enum><text>in the subsection caption, by inserting <quote><header-in-text level="subsection" style="OLC">or Smokeless Tobacco</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Cigarette</header-in-text></quote>;</text></clause> 
<clause id="HEFB1155E9957418FBBCB4B0041F2899"><enum>(ii)</enum><text>in paragraph (1), by inserting <quote>or section 4 of the Comprehensive Smokeless Tobacco Health Education Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/15/4403">15 U.S.C. 4403</external-xref>), as the case may be</quote> after <quote>section 7 of the Federal Cigarette Labeling and Advertising Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1335a">15 U.S.C. 1335a</external-xref>)</quote>;</text></clause> 
<clause id="H584679DD21CF4039BF2116CE153CA965"><enum>(iii)</enum><text>in paragraph (2)(A), by inserting <quote>or section 3 of the Comprehensive Smokeless Tobacco Health Education Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/15/4402">15 U.S.C. 4402</external-xref>), as the case may be,</quote> after <quote>section 4 of the Federal Cigarette Labeling and Advertising Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1333">15 U.S.C. 1333</external-xref>)</quote>; and</text></clause> 
<clause id="H2045BE65B06C40ED986EA8064FBBDF1B"><enum>(iv)</enum><text>in paragraph (2)(B), by inserting <quote>or section 3(d) of the Comprehensive Smokeless Tobacco Health Education Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/15/4402">15 U.S.C. 4402(d)</external-xref>), as the case may be</quote> after <quote>section 4(c) of the Federal Cigarette Labeling and Advertising Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1333">15 U.S.C. 1333(c)</external-xref>)</quote>.</text></clause></subparagraph></paragraph> 
<paragraph id="H81338497B40147C3B985379D234C5658"><enum>(3)</enum><text>Section 803(b) of that Act, as amended by subsection (d)(1) of this section, is further amended by inserting <quote>, or any smokeless tobacco product,</quote> after <quote>or tube</quote> the first place it appears.</text></paragraph> 
<paragraph id="HC7167DDDCFE8433189C0A844C9777BAF"><enum>(4)</enum> 
<subparagraph id="H379F242CDC634877A4D6A18E6D17B993" display-inline="yes-display-inline"><enum>(A)</enum><text>The heading of title VIII of such Act is amended by inserting <quote><header-in-text level="title" style="OLC">AND SMOKELESS TOBACCO</header-in-text></quote> after <quote><header-in-text level="title" style="OLC">CIGARETTES</header-in-text></quote>.</text></subparagraph> 
<subparagraph id="HEA8D38C522774A398B70E1290298008F" indent="up1"><enum>(B)</enum><text>The heading of section 802 of such Act is amended by inserting <quote><header-in-text level="section" style="OLC">and smokeless tobacco</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">cigarettes</header-in-text></quote>.</text></subparagraph></paragraph></subsection></section> 
<section id="H35B63F6A00484778953700D8EB5172E7"><enum>2.</enum><header>Application of civil penalties to relandings of tobacco products sold in a delivery sale</header> 
<subsection id="HEED48065C2294D54B200457E5099D3EF"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5761">Section 5761</external-xref> of the Internal Revenue Code of 1986 (relating to civil penalties) is amended by redesignating subsections (d) and (e) as subsections (e) and (f), respectively, and inserting after subsection (c) the following new subsection:</text> 
<quoted-block style="OLC" id="H7255EDAA759A462E9300B0137CA28D6F" display-inline="no-display-inline"> 
<subsection id="HB817349FCA954954A2288C25BEA4BA22"><enum>(d)</enum><header>Personal use quantities</header> 
<paragraph id="H394963C1FB80475D8DFC88557E4D7333"><enum>(1)</enum><header>In general</header><text>No quantity of tobacco products other than the quantity referred to in paragraph (2) may be relanded or received as a personal use quantity.</text></paragraph> 
<paragraph id="HE2988859C87F403F8342B566EF4898"><enum>(2)</enum><header>Exception for personal use quantity</header><text display-inline="yes-display-inline">Subsection (c) and section 5754 shall not apply to any person who relands or receives tobacco products in the quantity allowed entry free of tax and duty under chapter 98 of the Harmonized Tariff Schedule of the United States, and such person may voluntarily relinquish to the Secretary at the time of entry any excess of such quantity without incurring the penalty under subsection (c).</text></paragraph> 
<paragraph id="HA4CAD00C6E3B41A194A49F1D8F9F3600"><enum>(3)</enum><header>Special rule for delivery sales</header> 
<subparagraph id="H99E186D0EF1744A6BD7F72309EF32798"><enum>(A)</enum><header>In general</header><text>Paragraph (2) shall not apply to any tobacco product sold in connection with a delivery sale.</text></subparagraph> 
<subparagraph id="H82B5C43ECC71457982BA5CCC50B7386E"><enum>(B)</enum><header>Delivery sale</header><text>For purposes of subparagraph (A), the term <quote>delivery sale</quote> means any sale of a tobacco product to a consumer if—</text> 
<clause id="H4E99974647F040D69F5C847F5369B211" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the consumer submits the order for such sale by means of a telephone or other method of voice transmission, the mail, or the Internet or other online service, or the seller is otherwise not in the physical presence of the buyer when the request for purchase or order is made, or</text></clause> 
<clause id="HDEA03B7F85BA4FC1004CE2A3395EA9C"><enum>(ii)</enum><text display-inline="yes-display-inline">the tobacco product is delivered by use of a common carrier, private delivery service, or the mail, or the seller is not in the physical presence of the buyer when the buyer obtains personal possession of the tobacco product.</text></clause></subparagraph> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4A54AEC417DA4CC9897C86B2F4827498"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="HED2DBCD9FEC24C4C9DA2443BDA63DA51"><enum>(1)</enum><text>Subsection (c) of section 5761 of such Code is amended by striking the last two sentences.</text></paragraph> 
<paragraph id="H1C02A7F2CF914DB88E67E5CA961E5E00"><enum>(2)</enum><text>Paragraph (1) of section 5754(c) of such Code is amended by striking <quote>section 5761(c)</quote> and inserting <quote>section 5761(d)</quote>.</text></paragraph></subsection></section>
