<official-title>To ensure that States do not accept an individual taxpayer identification number as proof of identification or legal residence.</official-title>

<section id="H3437E7AB178C4A4A8FAB899D60B600AA" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation Revenue Ultimatum Enforcement ID Act of 2005</short-title></quote>. </text></section> 
<section id="H0F07F2FE568142D6003508B8EF87DEA4"><enum>2.</enum><header>Prohibition on the acceptance of taxpayer identification number as proof of identification or legal residence</header> 
<subsection id="H4C68542E1D334325AEFD8EFC5C726DD0"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, a State shall not accept as proof of personal identification or legal residence an individual taxpayer identification number for the purposes of issuing a State-issued driver’s license or personal identification card.</text></subsection> 
<subsection id="HCBA843F20F73451AABAF6F4E746282D2"><enum>(b)</enum><header>Withholding and transfer of funds for noncompliance</header><text display-inline="yes-display-inline">If a State fails to comply with the requirements of subsection (a) by the date specified—</text> 
<paragraph id="HC3008718FE9C4B8B879069244F0125A3"><enum>(1)</enum><text>the Secretary shall withhold 100 percent of the amount required to be apportioned to any State under paragraphs (1), (2) and (3) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code; and</text></paragraph> 
<paragraph id="H844D5000FE944DC38B8E818154BA67E"><enum>(2)</enum><text>transfer an amount equal to 100 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code, to the apportionment of the State under the State Criminal Alien Assistance Program under section 241(i) of the Immigration and National Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(i)</external-xref>).</text></paragraph></subsection> 
<subsection id="H85749525140C43D4A12381CE21AA8720"><enum>(c)</enum><header>Definitions</header><text>For purposes of this Act, the following definitions apply:</text> 
<paragraph id="H61FECB69E4564AAFA7D1A731CF1C6989"><enum>(1)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the United States Department of Transportation.</text></paragraph> 
<paragraph id="HBDAA428F8AAC45B993D73B6809B6F1A0"><enum>(2)</enum><header>State</header><text>The term <quote>State</quote> means each of the 50 States, the District of Columbia, Puerto Rico, the Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, and any other territory or possession of the United States.</text></paragraph> 
<paragraph id="H93811573C34148A1A7F400B21C0018B8"><enum>(3)</enum><header>State authorities</header><text>The term <quote>State authorities</quote> means heads of State transportation agencies.</text></paragraph> 
<paragraph id="HAF1129C5319E46438E184F78AB3DFAD3"><enum>(4)</enum><header>Drivers license</header><text>The term <quote>driver’s license</quote> means a motor vehicle operator’s license, as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/30301">section 30301</external-xref> of title 49, United States Code.</text></paragraph> 
<paragraph id="H4E34FB5044DB4454AE54D6F800479869"><enum>(5)</enum><header>Individual taxpayer identification number</header><text>The term <quote>individual taxpayer identification number</quote> means an identification number as described in <external-xref legal-doc="usc" parsable-cite="usc/26/1609">section 1609</external-xref> of the Internal Revenue Code of 1986 (26 U.S.C.).</text></paragraph></subsection></section>
