<section id="H0F028959CEF84ECABF8CB8E6F6260042" section-type="section-one"><enum>1.</enum><header>Short title; purposes</header> 
<subsection id="H3D51A8C74B9D42BF9CD49CFE07BF9DBA"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Environmental Justice Act of 2005</short-title></quote>.</text></subsection> 
<subsection id="H7F9E20F87B8940B78BC8CB6CD975EB2C"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> 
<paragraph id="H003635C61F134A0A8CE8441F561C4182"><enum>(1)</enum><text>to focus Federal agency attention on the environmental and human health conditions in minority, low-income, and Native American communities;</text></paragraph> 
<paragraph id="H076EADF405E6467194C97DE00264BBB0"><enum>(2)</enum><text>to ensure that all Federal agencies develop practices that promote environmental justice;</text></paragraph> 
<paragraph id="HEC38A50992FE471BA1469F3EF5A1E6D4"><enum>(3)</enum><text>to increase cooperation and coordination among Federal agencies as they seek to achieve environmental justice;</text></paragraph> 
<paragraph id="H13D879899B8D4799A72F48B15D26BFC3"><enum>(4)</enum><text>to provide minority, low-income, and Native American communities greater access to public information and opportunity for participation in decisionmaking affecting human health and the environment;</text></paragraph> 
<paragraph id="HDA75F1F7005A4AFE944D4B37FBDD4B"><enum>(5)</enum><text>to mitigate the inequitable distribution of the burdens and benefits of Federal programs having significant impact on human health and the environment; and</text></paragraph> 
<paragraph id="H1DD4C9DC972C46CABF5D5FB6970863B3"><enum>(6)</enum><text>to hold Federal agencies accountable for the effects of their projects and programs on all communities.</text></paragraph></subsection></section> 
<section id="H31DFA90D1ABB4710004EB850C6CAD93D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text> 
<paragraph id="H01A280BF7470401895CA5CF3689635BF"><enum>(1)</enum><header>Environmental justice</header> 
<subparagraph display-inline="yes-display-inline" id="H7A8B646C86AE4F658B7B06E1F432C405"><enum>(A)</enum><text>The term <term>environmental justice</term> means the fair treatment of people of all races, cultures, and socioeconomic groups with respect to the development, adoption, implementation, and enforcement of laws, regulations, and policies affecting the environment.</text></subparagraph> 
<subparagraph indent="up1" id="H4BF566EDB46F4EC583B94EBF45797CF3"><enum>(B)</enum><text>The term <term>fair treatment</term> means policies and practices that will minimize the likelihood that a minority, low-income, or Native American community will bear a disproportionate share of the adverse environmental consequences, or be denied reasonable access to the environmental benefits, resulting from implementation of a Federal program or policy.</text></subparagraph></paragraph> 
<paragraph id="H58C4FEF60826478780755FC84127AAB2"><enum>(2)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> means—</text> 
<subparagraph id="HE8400184602F48B2868681AE245D700"><enum>(A)</enum><text>each Federal entity represented on the Working Group;</text></subparagraph> 
<subparagraph id="H9EF2848F8F344BBABA22734172001266"><enum>(B)</enum><text>any other entity that conducts any Federal program or activity that substantially affects human health or the environment; and</text></subparagraph> 
<subparagraph id="HB794468BC9DD4B10ABAB8CE001E3652"><enum>(C)</enum><text>each Federal agency that implements any program, policy, or activity applicable to Native Americans.</text></subparagraph></paragraph> 
<paragraph id="HF8D85EB14CC8422B9565A5F5F020171B"><enum>(3)</enum><header>Working Group</header><text>The term <term>Working Group</term> means the interagency working group established by section 4.</text></paragraph> 
<paragraph id="HEBA82492BAFD4D1092078E6900C6C8C6"><enum>(4)</enum><header>Advisory Committee</header><text>The term <term>the Advisory Committee</term> means the advisory committee established by section 6.</text></paragraph></section> 
<section id="HACD08B9412C0440EA6D80081DF9D75BB"><enum>3.</enum><header>Environmental justice responsibilities of Federal agencies</header> 
<subsection id="H1DA6AB74002E438AA6BC44BE202BB5F0"><enum>(a)</enum><header>Environmental justice mission</header><text>To the greatest extent practicable, the head of each Federal agency shall make achieving environmental justice part of its mission by identifying and addressing, as appropriate, disproportionately high and adverse human health or environmental effects of its programs, policies, and activities on minority, low-income, and Native American populations in the United States and its territories and possessions, including the District of Columbia, the Commonwealth of Puerto Rico, and the Commonwealth of the Mariana Islands.</text></subsection> 
<subsection id="H49BD99ADF4CE48379D694926768BEBA8"><enum>(b)</enum><header>Nondiscrimination</header><text>Each Federal agency shall conduct its programs, policies, and activities in a manner that ensures that such programs, policies, and activities do not have the effect of excluding any person or group from participation in, denying any person or group the benefits of, or subjecting any person or group to discrimination under, such programs, policies, and activities, because of race, color, national origin, or income.</text></subsection> 
<subsection id="H56898D3B723F4B76A37900A00045F95"><enum>(c)</enum><header>Environmental analyses</header> 
<paragraph display-inline="yes-display-inline" id="H1D6C6457AE8445A682B90721CDA1EAC"><enum>(1)</enum><text>Each analysis of environmental effects of Federal actions required by the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/321">42 U.S.C. 321 et seq.</external-xref>) shall include analysis of the effects of such action on human health and any economic and social effects on minority, low-income, and Native American communities.</text></paragraph> 
<paragraph indent="up1" id="HFFDA0D3DC8E14637A3BEEC4514EDEBB3"><enum>(2)</enum><text>So far as feasible, any environmental assessment, environmental impact statement, or record of decision prepared pursuant to the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/321">42 U.S.C. 321 et seq.</external-xref>) shall include measures to mitigate any significant and adverse environmental effects of proposed Federal actions on minority, low-income, and Native American communities.</text></paragraph> 
<paragraph indent="up1" id="HB59BA087CEAB4BE5AD0072AF9E5B867F"><enum>(3)</enum><text>Each Federal agency shall provide opportunities for community input in processes under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/321">42 U.S.C. 321 et seq.</external-xref>), including identifying potential effects and mitigation measures in consultation with affected communities and improving the accessibility of meetings, crucial documents, and notices.</text></paragraph></subsection></section> 
<section id="H26C3220DB53D474D8B29205F4078002E"><enum>4.</enum><header>Interagency environmental justice Working Group</header> 
<subsection id="H6927A120782B46C0B33FA060B4CA0000"><enum>(a)</enum><header>Creation and composition</header><text>There is hereby established the Interagency Working Group on Environmental Justice, comprising the heads of the following executive agencies and offices, or their designees:</text> 
<paragraph id="H1D3CF724F29742F7B6BAF5C0C8BBB836"><enum>(1)</enum><text>The Department of Defense.</text></paragraph> 
<paragraph id="H11A92D811F494CBFA0E411E3CE45B400"><enum>(2)</enum><text>The Department of Health and Human Services.</text></paragraph> 
<paragraph id="HFECA48EC1CF949D2A06700BDA72073A0"><enum>(3)</enum><text>The Department of Housing and Urban Development.</text></paragraph> 
<paragraph id="HC40BC117C8224FF8ABD000FE98FA23F"><enum>(4)</enum><text>The Department of Labor.</text></paragraph> 
<paragraph id="H1F7A181A4F5A4263A6A09567A78C11C"><enum>(5)</enum><text>The Department of Agriculture.</text></paragraph> 
<paragraph id="HF5063AE8B5BD4C46A5744E232963F6A3"><enum>(6)</enum><text>The Department of Transportation.</text></paragraph>

<paragraph id="H8A1FC3A5E25E4E90A3C4D74900EB45DF"><enum>(17)</enum><text>The Council of Economic Advisers.</text></paragraph> 
<paragraph id="H0883FC7BECB8412EA37F70F8FEAA6C8"><enum>(18)</enum><text>Any other official of the United States that the President may designate.</text></paragraph></subsection> 
<subsection id="H5078BA4A6C444AC8B0A37689216354B"><enum>(b)</enum><header>Functions</header><text>The Working Group shall—</text> 
<paragraph id="H2617D7FA666F4541A0C208D4000733E8"><enum>(1)</enum><text>provide guidance to Federal agencies on criteria for identifying disproportionately high and adverse human health or environmental effects on minority, low-income, and Native American populations;</text></paragraph> 
<paragraph id="HB4211B0FD3AC4302ABBDDDA2CAA063E7"><enum>(2)</enum><text>coordinate with, provide guidance to, and serve as a clearinghouse for, each Federal agency as it develops or revises an environmental justice strategy as required by this Act, in order to ensure that the administration, interpretation and enforcement of programs, activities, and policies are undertaken in a consistent manner;</text></paragraph> 
<paragraph id="H6ACC935C1DDD4B5ABD89B091A6A4A813"><enum>(3)</enum><text>assist in coordinating research by, and stimulating cooperation among, the Environmental Protection Agency, the Department of Health and Human Services, the Department of Housing and Urban Development, and other Federal agencies conducting research or other activities in accordance with section 7;</text></paragraph> 
<paragraph id="H124E597F6CB0435AAA0908EAC24D0A5"><enum>(4)</enum><text>assist in coordinating data collection, maintenance, and analysis required by this Act;</text></paragraph> 
<paragraph id="H18F132DD55954AA79E11DA018EEB2930"><enum>(5)</enum><text>examine existing data and studies on environmental justice;</text></paragraph> 
<paragraph id="H99A5F891BE1E48CE8CE69EF8E46D556E"><enum>(6)</enum><text>hold public meetings and otherwise solicit public participation and consider complaints as required under subsection (c);</text></paragraph> 
<paragraph id="H3603863DAA28426CB4500037BC6E910"><enum>(7)</enum><text>develop interagency model projects on environmental justice that evidence cooperation among Federal agencies; and</text></paragraph> 
<paragraph id="H683F9ADC193D4698A1CC8F32E34394BE"><enum>(8)</enum><text>in coordination with the Department of the Interior and after consultation with tribal leaders, coordinate steps to be taken pursuant to this Act that affect or involve federally-recognized Indian Tribes.</text></paragraph></subsection> 
<subsection id="HE174C633C2C14A30AAAD00C31DAC633"><enum>(c)</enum><header>Public participation</header><text>The Working Group shall—</text> 
<paragraph id="H9ED684BECBFF4061A4E0E827A75350E4"><enum>(1)</enum><text>hold public meetings and otherwise solicit public participation, as appropriate, for the purpose of fact-finding with regard to implementation of this Act, and prepare for public review a summary of the comments and recommendations provided; and</text></paragraph> 
<paragraph id="H87B73CF149674B25B89EB2B25E03B600"><enum>(2)</enum><text>receive, consider, and in appropriate instances conduct inquiries concerning complaints regarding environmental justice and the implementation of this Act by Federal agencies.</text></paragraph></subsection> 
<subsection id="H478FD36595FF498F8EC9485F81EC8DB9"><enum>(d)</enum><header>Annual reports</header> 
<paragraph display-inline="yes-display-inline" id="H6D888AD60C5843199F8000D7DBFC33B"><enum>(1)</enum><text>Each fiscal year following enactment of this Act, the Working Group shall submit to the President, through the Office of the Deputy Assistant to the President for Environmental Policy and the Office of the Assistant to the President for Domestic Policy, a report that describes the implementation of this Act, including, but not limited to, a report of the final environmental justice strategies described in section 6 of this Act and annual progress made in implementing those strategies.</text></paragraph> 
<paragraph indent="up1" id="H22FA7DFF878F4621A348BB19936E39C8"><enum>(2)</enum><text>The President shall transmit to the Speaker of the House of Representatives and the President of the Senate a copy of each report submitted to the President pursuant to paragraph (1).</text></paragraph></subsection> 
<subsection id="H79F52829CD694359A3999350008682A1"><enum>(e)</enum><header>Conforming change</header><text>The Interagency Working Group on Environmental Justice established under Executive Order No. 12898, dated February 11, 1994, is abolished.</text></subsection></section> 
<section id="H3D9A980488E947BC00EA936015ACD3B"><enum>5.</enum><header>Federal agency strategies</header> 
<subsection id="H3888C7DBBD1040D795AADC73B6FDDA99"><enum>(a)</enum><header>Agency-wide strategies</header><text>Each Federal agency shall develop an agency-wide environmental justice strategy that identifies and addresses disproportionally high and adverse human health or environmental effects or disproportionally low benefits of its programs, policies, and activities with respect to minority, low-income, and Native American populations.</text></subsection> 
<subsection id="HF710DFB19B0442BFAB84FB09B445E7C4"><enum>(b)</enum><header>Revisions</header><text>Each strategy developed pursuant to subsection (a) shall identify programs, policies, planning, and public participation processes, rulemaking, and enforcement activities related to human health or the environment that should be revised to—</text> 
<paragraph id="H34DF44642F0B426EAC432FD481E65DC3"><enum>(1)</enum><text>promote enforcement of all health and environmental statutes in areas with minority, low-income, or Native American populations;</text></paragraph> 
<paragraph id="H82E2DBBC4CFD44108CDCBBF6F268E9E5"><enum>(2)</enum><text>ensure greater public participation;</text></paragraph> 
<paragraph id="HD71EB50E46DE4AA79C13B70853ED3BCB"><enum>(3)</enum><text>improve research and data collection relating to the health of and environment of minority, low-income, and Native American populations; and</text></paragraph> 
<paragraph id="H9D1799FBECC34714A84BA8A4D9075FAF"><enum>(4)</enum><text>identify differential patterns of use of natural resources among minority, low-income, and Native American populations.</text></paragraph></subsection> 
<subsection id="HA11A233216584CACA48837BCD3006894"><enum>(c)</enum><header>Timetables</header><text>Each strategy developed pursuant to subsection (a) shall include, where appropriate, a timetable for undertaking revisions identified pursuant to subsection (b).</text></subsection></section> 
<section id="H4818B2D484734E93A4F42CCF40AC541F"><enum>6.</enum><header>Federal Environmental Justice Advisory Committee</header> 
<subsection id="HE5C1C0A7F7D54284A112445E6DFD76E2"><enum>(a)</enum><header>Establishment</header><text>There is established a committee to be known as the <quote>Federal Environmental Justice Advisory Committee</quote>.</text></subsection> 
<subsection id="HD4A88B2BE4B94FD1BE3C259C206195A0"><enum>(b)</enum><header>Duties</header><text>The Advisory Committee shall provide independent advice and recommendations to the Environmental Protection Agency and the Working Group on areas relating to environmental justice, which may include any of the following:</text> 
<paragraph id="H2AC0757C1A3547DA96F03A8ED331745"><enum>(1)</enum><text>Advice on Federal agencies’ framework development for integrating socioeconomic programs into strategic planning, annual planning, and management accountability for achieving environmental justice results agency-wide.</text></paragraph> 
<paragraph id="HC2F69534787D4B138029BBB16F6914"><enum>(2)</enum><text>Advice on measuring and evaluating agencies’ progress, quality, and adequacy in planning, developing, and implementing environmental justice strategies, projects, and programs.</text></paragraph> 
<paragraph id="HAB765B9FB5AD485897763FE9B500E83D"><enum>(3)</enum><text>Advice on agencies’ existing and future information management systems, technologies, and data collection, and the conduct of analyses that support and strengthen environmental justice programs in administrative and scientific areas.</text></paragraph> 
<paragraph id="H8CEE4176F0C440BBB1502E6F97267E7F"><enum>(4)</enum><text>Advice to help develop, facilitate, and conduct reviews of the direction, criteria, scope, and adequacy of the Federal agencies’ scientific research and demonstration projects relating to environmental justice.</text></paragraph> 
<paragraph id="HF78133E5666A4F1EBBC4D3327474691"><enum>(5)</enum><text>Advice for improving how the environmental protection agency and others participate, cooperate, and communicate within that agency and between other Federal agencies, State or local governments, federally recognized Tribes, environmental justice leaders, interest groups, and the public.</text></paragraph> 
<paragraph id="H20706DE514994FE8A8116521EC2380D7"><enum>(6)</enum><text>Advice regarding the Environmental Protection Agency’s administration of grant programs relating to environmental justice assistance (not to include the review or recommendations of individual grant proposals or awards).</text></paragraph> 
<paragraph id="H01FB6E7FF9F54FEE00C49473F09C50CB"><enum>(7)</enum><text>Advice regarding agencies’ awareness, education, training, and other outreach activities involving environmental justice.</text></paragraph></subsection> 
<subsection id="HF7AEB42CDCB148A39F8091AE45A162D9"><enum>(c)</enum><header>Advisory Committee</header><text>The Advisory Committee shall be considered an advisory committee within the meaning of the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.).</text></subsection> 
<subsection id="H0A2C59F57D5B45CCB96D33AE89B6004F"><enum>(d)</enum><header>Membership</header><text>The Advisory Committee shall be composed of at least 25 members appointed by the President. Members shall include representatives of—</text> 
<paragraph id="H80E7D674A96346168D8F403F8DCFE9"><enum>(1)</enum><text>community-based groups;</text></paragraph> 
<paragraph id="H69B05CC80F114D3391CD75D15BB4C7D0"><enum>(2)</enum><text>industry and business;</text></paragraph> 
<paragraph id="HECCA1135189F4995B427D5C2643B1D4C"><enum>(3)</enum><text>academic and educational institutions;</text></paragraph> 
<paragraph id="H699F62C965EA48C481CB9B682406A3F5"><enum>(4)</enum><text>State and local governments, federally recognized tribes, and indigenous groups; and</text></paragraph> 
<paragraph id="HC5AD8FE6453140CF8CFE51AE6BE1867D"><enum>(5)</enum><text>nongovernmental and environmental groups.</text></paragraph></subsection> 
<subsection id="H4AEADA57CFBC414C8935DB9096F52148"><enum>(e)</enum><header>Meetings</header><text>The Advisory Committee shall meet at least twice annually. Meetings shall occur as needed and approved by the Director of the Office of Environmental Justice of the Environmental Protection Agency, who shall serve as the officer required to be appointed under section 10(e) of the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) with respect to the Committee (in this subsection referred to as the <quote>Designated Federal Officer</quote>). The Administrator of the Environmental Protection Agency may pay travel and per diem expenses of members of the Advisory Committee when determined necessary and appropriate. The Designated Federal Officer or a designee of such Officer shall be present at all meetings, and each meeting will be conducted in accordance with an agenda approved in advance by such Officer. The Designated Federal Officer may adjourn any meeting when the Designated Federal Officer determines it is in the public interest to do so. As required by the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name>, meetings of the Advisory Committee shall be open to the public unless the President determines that a meeting or a portion of a meeting may be closed to the public in accordance with subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5, United States Code. Unless a meeting or portion thereof is closed to the public, the Designated Federal Officer shall provide an opportunity for interested persons to file comments before or after such meeting or to make statements to the extent that time permits.</text></subsection> 
<subsection id="HEB6AE1AA114B470F8900F9DA60021DF"><enum>(f)</enum><header>Duration</header><text>The Advisory Committee shall remain in existence until otherwise provided by law.</text></subsection></section> 
<section id="H234C6DF9521245D38EBCDF746316184B"><enum>7.</enum><header>Human health and environmental research, data collection and analysis</header> 
<subsection id="HF97E4C2E4D0B4DD0B125DB661BB80297"><enum>(a)</enum><header>Disproportionate impact</header><text>To the extent permitted by other applicable law, including <external-xref legal-doc="usc" parsable-cite="usc/5/552a">section 552a</external-xref> of title 5, United States Code, popularly known as the Privacy Act of 1974, the Administrator of the Environmental Protection Agency, or the head of such other Federal agency as the President may direct, shall collect, maintain, and analyze information assessing and comparing environmental and human health risks borne by populations identified by race, national origin, or income. To the extent practical and appropriate, Federal agencies shall use this information to determine whether their programs, policies, and activities have disproportionally high and adverse human health or environmental effects on, or disproportionally low benefits for, minority, low-income, and Native American populations.</text></subsection> 
<subsection id="H864DA368875D40C5AF141642A2EA0082"><enum>(b)</enum><header>Information related to non-federal facilities</header><text>In connection with the development and implementation of agency strategies in section 4, the Administrator of the Environmental Protection Agency, or the head of such other Federal agency as the President may direct, shall collect, maintain, and analyze information on the race, national origin, and income level, and other readily accessible and appropriate information, for areas surrounding facilities or sites expected to have a substantial environmental, human health, or economic effect on the surrounding populations, if such facilities or sites become the subject of a substantial Federal environmental administrative or judicial action.</text></subsection> 
<subsection id="HDBDAC246D3D848F6A769A598C6537490"><enum>(c)</enum><header>Impact from Federal facilities</header><text>The Administrator of the Environmental Protection Agency, or the head of such other Federal agency as the President may direct, shall collect, maintain, and analyze information on the race, national origin, and income level, and other readily accessible and appropriate information, for areas surrounding Federal facilities that are—</text> 
<paragraph id="H6CC336B15147437AB306CCA56E632B63"><enum>(1)</enum><text>subject to the reporting requirements under the Emergency Planning and Community Right-to-Know Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11001">42 U.S.C. 11001 et seq.</external-xref>) as mandated in Executive Order No. 12856; and</text></paragraph> 
<paragraph id="HC6083367FA2A4CB694C91249D312E237"><enum>(2)</enum><text>expected to have a substantial environmental, human health, or economic effect on surrounding populations.</text></paragraph></subsection> 
<subsection id="H69942A750E864B3F8108C8E3DA698FAB"><enum>(d)</enum><header>Information sharing</header> 
<paragraph display-inline="yes-display-inline" id="H0CEB6068CFF649FAB64E99F2627CDE00"><enum>(1)</enum><text>In carrying out the responsibilities in this section, each Federal agency, to the extent practicable and appropriate, shall share information and eliminate unnecessary duplication of efforts through the use of existing data systems and cooperative agreements among Federal agencies and with State, local, and tribal governments.</text></paragraph> 
<paragraph indent="up1" id="HB708E41E72024194B7ADB4631F59E9B"><enum>(2)</enum><text>Except as prohibited by other applicable law, information collected or maintained pursuant to this section shall be made available to the public.</text></paragraph></subsection> 
<subsection id="H39000B09A0F542C4AFC6BF79165B75F7"><enum>(e)</enum><header>Public comment</header><text>Federal agencies shall provide minority, low-income, and Native American populations the opportunity to participate in the development, design, and conduct of activities undertaken pursuant to this section.</text></subsection></section>
