<official-title>To amend the Controlled Substances Act to provide an affirmative defense for the medical use of marijuana in accordance with the laws of the various States, and for other purposes.</official-title>

<section section-type="section-one" id="HDB2373F92E494B8EA2AD9268C52B84B4" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Steve McWilliams Truth in Trials Act</short-title></quote>.</text></section> 
<section id="H3B60B2133FF34C2A80A3000923FFBE6C"><enum>2.</enum><header>Providing an affirmative defense for the medical use of marijuana; seizure of property</header><text display-inline="no-display-inline">The <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended by inserting after section 423 the following:</text> 
<quoted-block style="traditional" act-name="Controlled Substances Act" id="HF22006CC8FE24A8A9DBA828DB5423B85"> 
<section id="HC2AF78C986FD477286C134A6B4B11837"><enum>424.</enum><header>Affirmative defense for conduct regarding the medical use of marijuana</header> 
<subsection display-inline="yes-display-inline" id="HD621C103C97D4CA4AC9C02787192F7EC"><enum>(a)</enum><text>Any person facing prosecution or a proceeding for any marijuana-related offense under this title shall have the right to introduce evidence demonstrating that the marijuana-related activities for which the person stands accused were performed in compliance with State law regarding the medical use of marijuana, or that the property which is subject to a proceeding was possessed in compliance with State law regarding the medical use of marijuana.</text></subsection> 
<subsection id="HAA4A499E9552456EB28528F5E7EE8752"><enum>(b)</enum> 
<paragraph display-inline="yes-display-inline" id="H33CEE8D83725471790AFE49448D13875"><enum>(1)</enum><text>It is an affirmative defense, to a prosecution or proceeding under this title for marijuana-related activities, if the proponent establishes by a preponderance of the evidence, that such activities comply with State law regarding the medical use of marijuana.</text></paragraph> 
<paragraph indent="up1" id="HC0063C41F3454CC98C39F0DF5109E7A7"><enum>(2)</enum><text>In a prosecution or a proceeding under this title, should a finder of fact determine, based on State law regarding the medical use of marijuana, that a defendant’s marijuana-related activity was performed primarily, but not exclusively, for medical purposes, the defendant may be found guilty of a lesser offense under this title corresponding to the amount of marijuana determined to be for nonmedical purposes.</text></paragraph></subsection> 
<subsection id="H1F6DAAB06FD741FE9BF79164232C1C07"><enum>(c)</enum><text>Any property seized in connection with a prosecution or proceeding under this title, with respect to which a person successfully makes a defense under this section, shall be returned to the owner promptly, minus such material necessarily destroyed for testing purposes.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H1BB349AD5F594D4088E700727B5E8C72"><enum>3.</enum><header>Seizure and custody of marijuana in cases involving possible medical use</header> 
<subsection id="HFD7922CCC9544678AAEC8C59EA089D00"><enum>(a)</enum><header>Limitation on authority for seizure</header><text>Section 511(g)(2) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/881">21 U.S.C. 881(g)(2)</external-xref>) is amended by inserting <quote>or either a recommendation by a physician or an order of a State or municipal agency in accordance with State law regarding the medical use of marijuana</quote> after <quote>appropriate registration,</quote>.</text></subsection> 
<subsection id="HC1ABCFC96167488AA82592D9C1C127BB"><enum>(b)</enum><header>Retention of certain seized plants</header><text>Section 511(g)(3) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/881">21 U.S.C. 881(g)(3)</external-xref>) is amended by adding at the end the following: <quote>Any marijuana seized shall be retained and not destroyed pending resolution of the forfeiture claim, if not later than 30 days after seizure the owner of the property notifies the Attorney General, or his duly authorized agent, that a person with an ownership interest in the property is asserting an affirmative defense for the medical use of marijuana. If the possession of such marijuana is found to have been in compliance with State law pursuant to section 424, it shall be returned not later than 10 days after such finding.</quote>.</text></subsection></section>
