<section id="H3C561F5839D54129A1FA0778AEE0907" section-type="section-one"><enum>1.</enum><header>Veterans benefits for merchant mariners who served during the Vietnam Era in the Southeast Asia theater of operations</header> 
<subsection id="H9923C555C60D4E12966561002FC35957"><enum>(a)</enum><header>Eligibility for veterans benefits</header><text>Notwithstanding any other provision of law, the service of an eligible individual described in subsection (b)(1) shall be considered to be active duty in determining the individual’s eligibility for veterans benefits under all laws administered by the Secretary of Veterans Affairs.</text></subsection> 
<subsection id="HCAA6A0D1584346BE84C73B278982F4E2"><enum>(b)</enum><header>Eligible individual</header><text>In this Act, the term <quote>eligible individual</quote> means an individual in the United States merchant marine who—</text> 
<paragraph id="H89BEBE5035694D209871981BD2E008A2"><enum>(1)</enum><text>served as a crewmember of a vessel that was in oceangoing service during the Vietnam Era in the Southeast Asia theater of operations; and</text></paragraph> 
<paragraph id="HDD5B88B76D8D42F081A397DF8A39F83"><enum>(2)</enum><text>receives a certificate of honorable discharge under subsection (c).</text></paragraph></subsection> 
<subsection id="HDF8CDBB398664D5EA78B3CA2E2B7CF74"><enum>(c)</enum><header>Documentation of service</header> 
<paragraph id="H6E2103EA21BF42AC8C0000ACB12FEEE"><enum>(1)</enum><header>Certificate of honorable discharge</header><text>The Secretary of Defense shall, upon application, issue a certificate of honorable discharge to an individual in the United States merchant marine who served as a crewmember of a vessel that was in oceangoing service during the Vietnam Era in the Southeast Asia theater of operations who, as determined by the Secretary, engaged in service of a nature and duration that warrants issuance of the certificate.</text></paragraph> 
<paragraph id="H9DA8C1686C5B4F37938645468848A32E"><enum>(2)</enum><header>Standards relating to service</header><text>In carrying out paragraph (1), the Secretary shall apply the same standards relating to the nature and duration of service that apply to the issuance of honorable discharges under section 401(a)(1)(B) of the GI Bill Improvement Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/38/106">38 U.S.C. 106</external-xref> note).</text></paragraph></subsection> 
<subsection id="H7BAB9EA8D51C48178C95B0EB3800899D"><enum>(d)</enum><header>Definitions</header><text>In this Act, the following definitions apply:</text> 
<paragraph id="H0F82D18452F54697A1A6BFBC7BD962B8"><enum>(1)</enum><header>Individual in the United States merchant marine</header><text>The term <quote>individual in the United States merchant marine</quote> means any citizen or resident alien of the United States serving as a civilian or civil service member of the United States merchant marine. </text></paragraph> 
<paragraph id="H9D7F7E145B164C6FA4D599B1BA5D2D8"><enum>(2)</enum><header>Vietnam Era</header><text>The term <quote>Vietnam Era</quote> means—</text> 
<subparagraph id="HCFD8CD099930451FB1A7B6693B66003D"><enum>(A)</enum><text display-inline="yes-display-inline">the period beginning on February 28, 1961, and ending on May 7, 1975, in the case of an individual in the United States merchant marine who served in the Republic of Vietnam during that period; and</text></subparagraph> 
<subparagraph id="HD6B32093290C493F9B2C4246BD3BCE"><enum>(B)</enum><text>the period beginning on August 5, 1964, and ending on May 7, 1975, in all other cases.</text></subparagraph></paragraph></subsection></section> 
<section id="H75AB21CC03A849FC9199CDEF6C16C8BD"><enum>2.</enum><header>Retroactive applicability</header><text display-inline="no-display-inline">Section 1 shall apply to an individual eligible for veterans benefits under subsection (a) of such section as if such section had been in effect as of the last date of the individual’s service described in subsection (b)(1) of such section.</text> </section>
