<legis-type>A BILL</legis-type> 
<official-title>To establish a grant and fee program through the Environmental Protection Agency to encourage and promote the recycling of used computers and to promote the development of a national infrastructure for the recycling of used computers, and for other purposes.</official-title>

<section section-type="section-one" id="H1BB70C0BC5D843EC9E7D1CE663561BC0" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Computer Recycling Act</short-title></quote>.</text></section> 
<section id="HB182B874233347A09F5E2FC774220027"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text> 
<paragraph id="H7C2330EB0F95418884C026E77F835569"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the Environmental Protection Agency;</text></paragraph> 
<paragraph id="HFA30220D68334D0EA45731E477003FED"><enum>(2)</enum><text>the term <term>cathode ray tube</term> means a vacuum tube or picture tube used to convert an electronic signal into a visual image;</text></paragraph> 
<paragraph id="HC9144B5090A74197BA883544DE7F8153"><enum>(3)</enum><text>the term <term>central processing unit</term> includes a case and all of its contents, such as the primary printed circuit board and its components, additional printed circuit boards, one or more disc drives, a transformer, interior wire, and a power cord;</text></paragraph> 
<paragraph id="HDAF34CA0B5B647938CAAC5BF42154F4"><enum>(4)</enum><text>the term <term>computer</term> means an electronic, magnetic, optical, electrochemical, or other high speed data processing device performing logical, arithmetic, or storage functions, and may include both a central processing unit and a monitor, but such term does not include an automated typewriter or typesetter, a portable hand held calculator, or other similar device;</text></paragraph> 
<paragraph id="HC7B0F3C8856C42CA00D8EB78DE34A136"><enum>(5)</enum><text>the term <term>hazardous waste</term> has the meaning given that term in section 1004(5) of the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903</external-xref>);</text></paragraph> 
<paragraph id="HC0CD91B45EF84CD9AA10943CEA6E9C00"><enum>(6)</enum><text>the term <term>monitor</term> means a separate visual display component of a computer, whether sold separately or together with a central processing unit, and includes a cathode ray tube or liquid crystal display, its case, interior wires and circuitry, cable to the central processing unit, and power cord; and</text></paragraph> 
<paragraph id="H42194C1C867548528F24C713BC8EFF71"><enum>(7)</enum><text>the term <term>nonprofit organization</term> means an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code.</text></paragraph></section> 
<section id="HB8E59921EEED48169D006DF1F09C6C0"><enum>3.</enum><header>Fee</header> 
<subsection id="HB713BE6E862443B60092F918CF6B1B21"><enum>(a)</enum><header>Requirement</header><text>Effective 180 days after the transmittal to the Congress of the results of the study conducted under section 6(a), the Administrator shall require that a fee be assessed on the sale (including a sale through the Internet or a catalogue) to an end-user of any computer, monitor, or other electronic device designated by the Administrator under subsection (c). The Administrator shall establish procedures for the collection of such fee. The requirement under this subsection shall not apply to a sale by an end-user to a subsequent end-user.</text></subsection> 
<subsection id="HBADBCA2463C74E9BA2AADB465ED90C4"><enum>(b)</enum><header>Fee amount</header><text>The amount of the fee required under subsection (a) shall—</text> 
<paragraph id="HAD6C46FAC4B04C9F927842AC09FB7F00"><enum>(1)</enum><text>be an amount sufficient to cover the costs of carrying out section 4(a) and subsection (c) of this section;</text></paragraph> 
<paragraph id="HAA3F2D4C83614AE7811EBA13C490018"><enum>(2)</enum><text>be uniform—</text> 
<subparagraph id="HDBF0E60781D0473ABA48F2698E8DBC87"><enum>(A)</enum><text>for each computer with a central processing unit and monitor integrated in a single device;</text></subparagraph> 
<subparagraph id="H3F5EDA4E011D432D86E4FBD4AB040056"><enum>(B)</enum><text>for each central processing unit;</text></subparagraph> 
<subparagraph id="H34B4B4413A394A51B723E6FF9F056F99"><enum>(C)</enum><text>for each monitor; and</text></subparagraph> 
<subparagraph id="H90B4487466D84518A3D17874D1E61500"><enum>(D)</enum><text>for each class of other devices designated by the Administrator under subsection (c);</text></subparagraph></paragraph> 
<paragraph id="HC64CF2A387C0450CA89570C1A78F61D7"><enum>(3)</enum><text>not exceed $10 per computer, monitor, or other designated device; and</text></paragraph> 
<paragraph id="HCEE5675A088146E89FB0C38DA08D5336"><enum>(4)</enum><text>be clearly indicated on the label, external packing materials, or sales receipt of the computer, monitor, or device.</text></paragraph></subsection> 
<subsection id="H55E4652C5D334897BAA1161386AFA593"><enum>(c)</enum><header>Administrative costs</header><text>Persons required by the Administrator to collect a fee under this section may retain 3 percent of amounts so collected to pay the costs of administering the fee collection program.</text></subsection> 
<subsection id="H4FE9CF6AF21D4E7B96FE01F039DC2E2F"><enum>(d)</enum><header>Exempted sales</header><text>The requirement of a fee under this section shall not apply to a sale of a used computer, monitor, or device by a nonprofit organization.</text></subsection> 
<subsection id="HD23CCBAA58D04A95858036BC767EED9E"><enum>(e)</enum><header>Additional exemption</header><text>The Administrator may exempt from the requirement of a fee under this section any sale made under a contract or an arrangement that the Administrator determines is likely to result in the maximum reuse of significant components of the computer, monitor, or device, and the disposal of the remaining components—</text> 
<paragraph id="HB803956D49E64B569358D0FB5BF0B66E"><enum>(1)</enum><text>in an environmentally sound and responsible manner;</text></paragraph> 
<paragraph id="HF50EC5AF137044928663B580F8D83697"><enum>(2)</enum><text>without violation of any Federal or State law; and</text></paragraph> 
<paragraph id="H19B5641AC16E4A4785D2C4634E106DEE"><enum>(3)</enum><text>without reliance on funding from State or local governments,</text></paragraph><continuation-text continuation-text-level="subsection">when the computer, monitor, or device is no longer of use to the end-user.</continuation-text></subsection> 
<subsection id="H83EBA1CEC9E74C43B6D52BBF02C65B62"><enum>(f)</enum><header>Designation of electronic devices</header><text>The Administrator may designate additional electronic devices to which the fee under subsection (a) shall apply if those electronic devices—</text> 
<paragraph id="H713D221861F246CAB69DD32A41323CB"><enum>(1)</enum><text>contain a significant amount of material that, when disposed of, would be hazardous waste; and</text></paragraph> 
<paragraph id="H52D049B8248E4649A39BAB13A343A104"><enum>(2)</enum><text>include one or more liquid crystal displays, cathode ray tubes, or circuit boards.</text></paragraph></subsection></section> 
<section id="HC76FEF2202414FD6A50126FDE266713F"><enum>4.</enum><header>Grants</header> 
<subsection id="H02014C81E6A544219087FD69CF09CE49"><enum>(a)</enum><header>Uses of fee amounts</header><text>Amounts collected under section 3 shall be used, to the extent provided in advance in appropriations Acts, by the Administrator for—</text> 
<paragraph id="H603815B4A18C4FAFA7BFE33EB6BB6F80"><enum>(1)</enum><text>covering the costs of administration of this Act; and</text></paragraph> 
<paragraph id="H97FBB0ACB845420FA0601F65E64117CA"><enum>(2)</enum><text>making grants under subsection (b).</text></paragraph><continuation-text continuation-text-level="subsection">Not more than 10 percent of the funds available pursuant to this Act for any fiscal year may be used for costs described in paragraph (1).</continuation-text></subsection> 
<subsection id="HAF1727454D6F45308600269CCC8D55E"><enum>(b)</enum><header>Grant purposes</header><text>The Administrator shall make grants with funds collected under section 3 to individuals or organizations (including units of local government) for—</text> 
<paragraph id="H66E8EADF012C440ABD00E4EDD15D4D33"><enum>(1)</enum><text>collecting or processing used computers, monitors, or other designated devices for recycling purposes;</text></paragraph> 
<paragraph id="HA3E58CCAB8704DCF826D855F49B2A02D"><enum>(2)</enum><text>reusing or reselling such computers, monitors, or devices, or components thereof; and</text></paragraph> 
<paragraph id="H41F1159981304558AA002CD37D194DD1"><enum>(3)</enum><text>extracting and using, or selling for reuse, raw materials from such computers, monitors, or devices.</text></paragraph></subsection> 
<subsection id="HF640BEBB02EF45ABBDB7E6AE484338B1"><enum>(c)</enum><header>Eligibility</header><text>An individual or organization shall be eligible for a grant under subsection (b) only if the individual or organization provides assurances to the satisfaction of the Administrator that it will carry out the grant purposes in a manner that complies with all applicable Federal and State environmental and health laws.</text></subsection> 
<subsection id="H9F164E1C98174AFA00D1F0229BCEAEC"><enum>(d)</enum><header>Selection criteria</header><text>In selecting proposals for grants under subsection (b), the Administrator shall consider—</text> 
<paragraph id="HCDF46AE154594BAC9303443EAA0053CA"><enum>(1)</enum><text>the quantity of used computers, monitors, or other designated devices that will be diverted from landfills;</text></paragraph> 
<paragraph id="H4A30156521944D379DB24F1B6383C569"><enum>(2)</enum><text>the estimated cost per unit of the collection, processing, reuse, or sale proposed;</text></paragraph> 
<paragraph id="HA4A642E29B704EBFAFCC1FBFE26EAF90"><enum>(3)</enum><text>the availability of, and potential for, markets for recycled materials;</text></paragraph> 
<paragraph id="HDBD1F01A5CD143BDA3D99DC955CBC315"><enum>(4)</enum><text>the degree to which the proposal mitigates or avoids harmful environmental or health effects;</text></paragraph> 
<paragraph id="H60B22DF180754ECAB8494BF8198577EC"><enum>(5)</enum><text>the degree to which the proposal employs innovative recycling technologies; and</text></paragraph> 
<paragraph id="H72A379627804416186DD11D147003225"><enum>(6)</enum><text>the demonstrated history of the grant applicant in disposing of or providing for the reuse of computers, monitors, or devices in an environmentally sound and responsible manner without violation of any Federal or State law.</text></paragraph><continuation-text continuation-text-level="subsection">The Administrator shall ensure that grants are provided to a geographically diverse group of recipients.</continuation-text></subsection></section> 
<section id="H5016155517024AA384F88DAC6098B8"><enum>5.</enum><header>Consultation</header><text display-inline="no-display-inline">In carrying out this Act, the Administrator shall consult with representatives of the computer manufacturing, retail, and recycling industries, waste management professionals, environmental and consumer groups, and other appropriate individuals and organizations (including units of local government).</text></section> 
<section id="HCC357C3E7116451F82DD45249F3661EE"><enum>6.</enum><header>Study and reports</header> 
<subsection id="H49AD97C30BCA4686BCD6823E45E6B95C"><enum>(a)</enum><header>Study</header><text>Not later than 6 months after the date of the enactment of this Act, the Administrator shall transmit to the Congress the results of a study that—</text> 
<paragraph id="H82EFA1447C5341FFBDB43EB8004E7B7B"><enum>(1)</enum><text>identifies waste materials in used computers that may be hazardous to human health or the environment;</text></paragraph> 
<paragraph id="HD19186D53E98488E811D52158E10D061"><enum>(2)</enum><text>estimates the quantities of such materials that exist or will exist in the future, including a separate estimate of the quantities of such materials that are exported from the United States;</text></paragraph> 
<paragraph id="HF6588A75E65846DAA95B12CA96D2A34"><enum>(3)</enum><text>estimates the costs of transporting, collecting, and processing computers, monitors, and other designated devices;</text></paragraph> 
<paragraph id="H20E78C2C879E4B4ABADBE677856442B1"><enum>(4)</enum><text>describes current management of such waste materials;</text></paragraph> 
<paragraph id="H6BE3B832C2E44E1FAA8900ECD2572605"><enum>(5)</enum><text>makes recommendations for the management of electronic products containing such waste materials at the end of their useful lives; and</text></paragraph> 
<paragraph id="HD7A78BD7C62D46959B76B86C1D0065FF"><enum>(6)</enum><text>estimates the demand for materials from recycled computers, and make recommendations for increasing the markets for such materials.</text></paragraph></subsection> 
<subsection id="H2DD0C8C4E9B643A9AF796F97721E06CC"><enum>(b)</enum><header>Reports</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter for 4 additional years, the Administrator shall transmit to the Congress a report on the status of computer recycling. Such report shall include a description of the amount of fees collected under section 3, and a description of the amount of administrative costs paid for and grants made under section 4 with funds collected through such fees.</text></subsection></section>
