<section id="H4FAAFDAE6EE3459994DE8817A17CF2C" section-type="section-one"><enum>1.</enum><header>Short title; amendments to Immigration and Nationality Act; table of contents</header> 
<subsection id="H5B181505020D4CD180DF06C386C67D9C"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Secure America Act of 2005</short-title></quote>.</text></subsection> 
<subsection id="HA674193B10AB4FFBBCD7F140347F16C0"><enum>(b)</enum><header>Amendments to Immigration and Nationality Act</header><text display-inline="yes-display-inline">Except as otherwise specifically provided, whenever in this Act an amendment is expressed in terms of an amendment to or repeal of a section or other provision, the reference shall be considered to be made to that section or other provision of the Immigration and Nationality Act.</text></subsection> 
<subsection id="H4BBD838A79864BD8B2A9931C8D43CCF7"><enum>(c)</enum><header>Table of contents</header><text>The table of contents of this Act is as follows:</text>

<section id="HEAADBF0A039E4E078CC17199A2857CD7"><enum>2.</enum><header>Expedited removal</header> 
<subsection id="H14437E7712C34FE49E14186908C1001E"><enum>(a)</enum><header>In general</header><text>Section 235(b)(1)(A)(iii) (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(A)(iii)</external-xref>) is amended—</text> 
<paragraph id="H8DC73833F5B44BB0A85DAF76BCFC2E1"><enum>(1)</enum><text>in subclause (I), by striking <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland Security</quote> each place it appears; and</text></paragraph> 
<paragraph id="H08AD3D5745DC456EA2F9006326D0846C"><enum>(2)</enum><text>by adding at the end the following new subclause:</text> 
<quoted-block style="OLC" id="HEAE3B8C4890A4678BC0031657C048814" display-inline="no-display-inline"> 
<subparagraph id="H5375FF18D5B9471D97FBBF4719994704"><enum>(III)</enum><header>Exception</header><text>Notwithstanding subclauses (I) and (II), the Secretary of Homeland Security shall apply clauses (i) and (ii) of this subparagraph to any alien (other than an alien described in subparagraph (F)) who is not a national of a country contiguous to the United States, who has not been admitted or paroled into the United States, and who is apprehended within 100 miles of an international land border of the United States and within 14 days of entry.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H89EF04C0230C43A79336BADDDEB16EBC"><enum>(b)</enum><header>Exceptions</header><text>Section 235(b)(1)(F) (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(F)</external-xref>) is amended by inserting before the period at the end the following: <quote>or in any manner at or between a land border port of entry</quote>.</text></subsection> 
<subsection id="H31F58810CC27441CA190ACD9A847CCA8"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to all aliens apprehended on or after such date.</text> </subsection></section> 
<section section-type="subsequent-section" id="H94360862EEC44788A54765C956487592" display-inline="no-display-inline"><enum>3.</enum><header>Increased criminal sentences and fines for alien smuggling</header> 
<subsection id="H885B442090E845BB8CC963A563ADCBE8"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), pursuant to its authority under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994(p)</external-xref> of title 28, United States Code, the United States Sentencing Commission shall promulgate sentencing guidelines or amend existing sentencing guidelines for smuggling, transporting, harboring, or inducing aliens under sections 274(a)(1)(A) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)(1)(A)</external-xref>) so as to—</text> 
<paragraph id="H203D4CD641864B389B2F85189488E401"><enum>(1)</enum><text>triple the minimum term of imprisonment under that section for offenses involving the smuggling, transporting, harboring, or inducing of—</text> 
<subparagraph id="H0854EA9CB97044478C02A236775D85F"><enum>(A)</enum><text>1 to 5 aliens from 10 months to 30 months;</text></subparagraph> 
<subparagraph id="HD468292401154C1D9FC934C1B0DAEF93"><enum>(B)</enum><text>6 to 24 aliens from 18 months to 54 months;</text></subparagraph> 
<subparagraph id="H64CEAC0FA06242D699A4C928004345F"><enum>(C)</enum><text>25 to 100 aliens from 27 months to 81 months; and</text></subparagraph> 
<subparagraph id="H27CA6D6555F84E94A027DC62EC35466F"><enum>(D)</enum><text>101 or more aliens from 37 months to 111 months;</text></subparagraph></paragraph> 
<paragraph id="H8D0FC395A93D4A2AAF994CEDA628508"><enum>(2)</enum><text>increase the minimum level of fines for each of the offenses described in subparagraphs (A) through (D) of paragraph (1) to the greater of $25,000 per alien or 3 times the amount the defendant received or expected to receive as compensation for the illegal activity;</text></paragraph> 
<paragraph id="HCEA8D9036A97460D95FBC298B67B4EE2"><enum>(3)</enum><text>increase by at least 2 offense levels above the applicable enhancement in effect on the date of the enactment of this Act the sentencing enhancements for intentionally or recklessly creating a substantial risk of serious bodily injury or causing bodily injury, serious injury, or permanent or life threatening injury;</text></paragraph> 
<paragraph id="H67BE26493AF14B028D00BE64B450CF8F"><enum>(4)</enum><text>for actions causing death, increase the offense level to be equivalent to that for involuntary manslaughter under <external-xref legal-doc="usc" parsable-cite="usc/28/1112">section 1112</external-xref> of title 28, United States Code; and</text></paragraph> 
<paragraph id="H1CFA4D839C054398AB0381A0C484B21C"><enum>(5)</enum><text>for corporations or other business entities that knowingly benefit from such offenses, increase the minimum level of fines for each of the offenses described in subparagraphs (A) through (D) of paragraph (1) to $50,000 per alien employed directly, or indirectly through contract, by the corporation or entity.</text></paragraph></subsection> 
<subsection id="H8168F09B7BC64FFE8009BAB400087CD2"><enum>(b)</enum><header>Exception</header><text>Subsection (a) shall not apply to an offense that involved the smuggling, transporting, or harboring only of the defendant’s spouse or child (or both the defendant’s spouse and child).</text></subsection> 
<subsection id="H6F6301CE162E44B686A97FEFB09000B5"><enum>(c)</enum><header>Deadline</header><text>The United States Sentencing Commission shall carry out subsection (a) not later than the date that is 6 months after the date of the enactment of this Act.</text></subsection> 
<subsection id="H0FEFD2A480F0495E87D31B06B83CC9CB"><enum>(d)</enum><header>Amendments to criminal penalties</header><text>Section 274(a) (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)</external-xref>) is amended—</text> 
<paragraph id="HF64D19B16DD84343BD9DD7CFEB158631"><enum>(1)</enum><text>in paragraph (1)(B)—</text> 
<subparagraph id="H939209AF3B3E4A3188971E4B7BD8F85E"><enum>(A)</enum><text>in clause (i), by striking <quote>10 years</quote> and inserting <quote>15 years</quote>;</text></subparagraph> 
<subparagraph id="H1E7B1455EBCF4593884B04ACCC23E7D"><enum>(B)</enum><text>in clause (ii), by striking <quote>5 years</quote> and inserting <quote>10 years</quote>; and</text></subparagraph> 
<subparagraph id="H9564A6DEE02A48B4A236CA22992727B"><enum>(C)</enum><text>in clause (iii), by striking <quote>20 years</quote> and inserting <quote>40 years</quote>;</text></subparagraph></paragraph> 
<paragraph id="HB0849F9DE79543A6893500E750B3DB69"><enum>(2)</enum><text>in paragraph (2)—</text> 
<subparagraph id="HDE3E2CC9D14B4699BC1CC516A71857FA"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>one year, or both; or</quote> and inserting <quote>3 years, or both;</quote>;</text></subparagraph> 
<subparagraph id="H0CD1AFD796D44F45ACB9E4FB1E653C53"><enum>(B)</enum><text>in subparagraph (B)—</text> 
<clause id="H6059E46E878D44B49CD81441788B5C53"><enum>(i)</enum><text>in clause (i), by adding at the end the following: <quote>be fined under title 18, United State Code, and imprisoned not less than 5 years nor more than 25 years;</quote>;</text></clause> 
<clause id="HF7273F86EED74040A3DB59B1090212C0"><enum>(ii)</enum><text>in clause (ii), by striking <quote>or</quote> at the end and inserting the following: <quote>be fined under title 18, United States Code, and imprisoned not less than 3 years nor more than 20 years; or</quote>; and</text></clause> 
<clause id="HC0DC0E5184B24423B8EEEF8DD9973F8"><enum>(iii)</enum><text>in clause (iii), by adding at the end the following: <quote>be fined under title 18, United States Code, and imprisoned not more than 15 years; or</quote>; and</text></clause></subparagraph> 
<subparagraph id="H11B66971F57142209EBF17A211E311A0"><enum>(C)</enum><text>by striking the matter following clause (iii) and inserting the following:</text> 
<quoted-block style="OLC" id="H9B39D044CDA14D25AAB035BDCBCD88F0" display-inline="no-display-inline"> 
<subparagraph id="H4A10B92CC8E94E57821672F48F23C922"><enum>(C)</enum><text>in the case of a third or subsequent offense described in subparagraph (B) and for any other violation, shall be fined under title 18, United States Code, and imprisoned not less than 5 years nor more than 15 years.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H8A93F1E821D2420DA15212C7CD5F47E"><enum>(3)</enum><text>in paragraph (3)(A), by striking <quote>5 years</quote> and inserting <quote>10 years</quote>; and</text></paragraph> 
<paragraph id="H97A83DA03C5D48B6B170CFCAD1603FA9"><enum>(4)</enum><text>in paragraph (4), by striking <quote>10 years</quote> and inserting <quote>20 years</quote>.</text></paragraph></subsection> 
<subsection id="HC3C62A871E604E6B8290D023A9AA7BB7"><enum>(e)</enum><header>Effective date</header><text>The amendments made by subsection (d) shall take effect on the date of enactment of this Act and shall apply to offenses committed after such date.</text></subsection></section> 
<section id="H7F7833F8D227450FBD005BCCA518BD64"><enum>4.</enum><header>Enhanced penalties for persons committing offenses while armed</header> 
<subsection id="H2D2FC93918F040C3A80638E0ADE8C0AA"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/924">Section 924(c)(1)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HC41342E312A94CDEB84893BD2E8392B1"><enum>(1)</enum><text>in subparagraph (A)—</text> 
<subparagraph id="H5444FD58D40C4D44983BBB63ED159FFE"><enum>(A)</enum><text>by inserting after <quote>device)</quote> the following: <quote>or any violation of section 274(a)(1)(A) of the Immigration and Nationality Act</quote>; and</text></subparagraph> 
<subparagraph id="H38ED268317B14D61BCBB382CD77EA06F"><enum>(B)</enum><text>by striking <quote>or drug trafficking crime—</quote> and inserting <quote>, drug trafficking crime, or violation of section 274(a)(1)(A) of the Immigration and Nationality Act—</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H8BB9B8FBC4464023007D898C03A2C339"><enum>(2)</enum><text>in subparagraph (D)(ii), by striking <quote>or drug trafficking crime</quote> and inserting <quote>, drug trafficking crime, or violation of section 274(a)(1)(A) of the Immigration and Nationality Act</quote>.</text></paragraph></subsection> 
<subsection id="H09AD8FBE37DA47E29B86D19525BA4B71"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to offenses committed after such date.</text></subsection></section> 
<section id="HF6D5308CBF4B46E9A92497C780630657"><enum>5.</enum><header>Use of Army and Air Force to secure the border</header> 
<subsection id="H0E882E97DD554A18AC1D407CF233E0B2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1385">Section 1385</external-xref> of title 18, United States Code, is amended by inserting after <quote>execute the laws</quote> the following: <quote>other than at or near a border of the United States in order to prevent aliens not permitted by law to enter the United States, terrorists, and drug smugglers from entering the United States</quote>.</text></subsection> 
<subsection id="HB0662FC7A12B4BC5913EE50077DBF44"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment this Act. </text></subsection></section> 
<section id="H954012B1203A48D8A1498D9FE8CE14E6"><enum>6.</enum><header>Mandatory sentencing ranges for reentering aliens</header> 
<subsection id="HD67F89FF0B1B495989B54E781C97395" commented="no"><enum>(a)</enum><header>Mandatory sentencing ranges for reentering aliens</header><text>Section 276 (<external-xref legal-doc="usc" parsable-cite="usc/8/1326">8 U.S.C. 1326</external-xref>) is amended—</text> 
<paragraph id="HFA64D1B31F8E4265BDAFAF743FF3D5CD" commented="no"><enum>(1)</enum><text>in subsection (a), in the matter following paragraph (2), by striking <quote>imprisoned not more than 2 years,</quote> and inserting <quote>imprisoned for a term of not less than 1 year and not more than 2 years,</quote>; and</text></paragraph> 
<paragraph id="H5AA84704B5C64DA2847BDEBE73002C95" commented="no"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="HCEAC61D5DFD54899B3D351655620F048" commented="no"><enum>(A)</enum><text>in paragraph (1), by striking <quote>imprisoned not more than 10 years,</quote> and inserting <quote>imprisoned for a term of not less than 5 years and not more than 10 years,</quote>;</text></subparagraph> 
<subparagraph id="H61A8BD6B0A0541DCA2C5B653821EF362" commented="no"><enum>(B)</enum><text>in paragraph (2), by striking <quote>imprisoned not more than 20 years,</quote> and inserting <quote>imprisoned for a term of not less than 10 years and not more than 20 years,</quote>; and</text></subparagraph> 
<subparagraph id="HA6FC1266140840B90099A5FCB613AAA2" commented="no"><enum>(C)</enum><text>in paragraph (4), by striking <quote>imprisoned for not more than 10 years,</quote> and inserting <quote>imprisoned for a term of not less than 5 years and not more than 10 years,</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HE1B55F5A63D946179400CB28901097"><enum>(b)</enum><header>Mandatory sentencing ranges for persons aiding or assisting certain reentering aliens</header><text>Section 277 (<external-xref legal-doc="usc" parsable-cite="usc/8/1327">8 U.S.C. 1327</external-xref>) is amended—</text> 
<paragraph id="H93C2AA40253B41C4A2FBE71036A13BA7"><enum>(1)</enum><text>by striking <quote>Any person</quote> and inserting <quote>(a) Subject to subsection (b), any person</quote>; and</text></paragraph> 
<paragraph id="H254C53A2DEA647B0A82802ADB004145"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="HD66593BCD37A466CB5CD4F112B9356A2"><enum>(b)</enum> 
<paragraph id="H76F0A403CBAF4C3C918EE0503403FE59" display-inline="yes-display-inline"><enum>(1)</enum><text>Any person who knowingly aids or assists any alien violating section 276(b) to reenter the United States, or who connives or conspires with any person or persons to allow, procure, or permit any such alien to reenter the United States, shall be fined under title 18, United States Code, or imprisoned for a term imposed under paragraph (2), or both.</text></paragraph> 
<paragraph id="HEE555D5192CF4F18B3A06E326F885C13" indent="up1"><enum>(2)</enum><text>The term of imprisonment imposed under paragraph (1) shall be within the range to which the reentering alien is subject under section 276(b).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H96975A06DAA64274A5A2B5B8B762355"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section are effective on the date of enactment of this Act and shall apply to sentences entered on or after such date.</text></subsection></section> 
<section id="H8D2932624A994BA2AC48EE82B97D16F7"><enum>7.</enum><header>Penalty for countries that do not accept return of nationals</header> 
<subsection id="H994484EBAA8C4E86906C347BE2896697"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"> Section 243(d) (<external-xref legal-doc="usc" parsable-cite="usc/8/1253">8 U.S.C. 1253(d)</external-xref>) is amended—</text> 
<paragraph id="HAB742528A0434C4C8EDBAEBB09649100"><enum>(1)</enum><text>by striking <quote>On being notified</quote> and inserting the following:</text>

<paragraph id="HFA0429A8AEE94E609F1561858B7CE9E9"><enum>(2)</enum><header>Denial of admission</header><text>The Secretary of Homeland Security, after making a determination that the government of a foreign country has denied or unreasonably delayed accepting an alien who is a citizen, subject, national, or resident of that country after the alien has been ordered removed, and after consultation with the Secretary of State, may deny admission to any citizen, subject, national or resident of that country until the country accepts the alien that was ordered removed.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H62A42ADF684B453098CD34EBFF2FC400"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) effective on the date of enactment of this Act.</text></subsection></section> 
<section id="HB279F6040F93416CA2FA8484CF47E911" section-type="subsequent-section"><enum>8.</enum><header>Bureau of Immigration Enforcement</header> 
<subsection id="H6096C3084C884603B331C957CCB3C628"><enum>(a)</enum><header>In general</header><text>Section 442 of <external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref> is amended—</text>

<paragraph id="HDE652FF1DDFD4B949407B9C32D557631"><enum>(3)</enum><text>by striking subsection (a)(2) and inserting the following:</text>

<subparagraph id="H201ADE2681004AAAA7EB1C5713D1731F"><enum>(A)</enum><text>by striking <quote>Assistant Secretary of the Bureau of Border Security</quote> and inserting <quote>Assistant Secretary of the Bureau of Immigration Enforcement</quote>;</text></subparagraph>

<subsection id="H9E2A4FBCBA5E48C9A96B9B0743BC13BE"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Sections 443, 444, 451, and 471 of such Public Law are each amended by striking <quote>Bureau of Border Security</quote> and inserting <quote>Bureau of Immigration Enforcement</quote> each place it appears.</text></subsection> 
<subsection id="H6778AF23877E4D59AEDD50E8E9E5F627"><enum>(c)</enum><header>Limitation on functions</header><text>Section 471(b) of such Public Law, as amended by this section, is further amended by adding at the end the following: <quote>In addition, the authority provided by section 1502 may not be used to add functions of the Bureau of Immigration Enforcement not listed in section 441 to the Bureau of Immigration Enforcement.</quote>.</text></subsection></section>
