<official-title>To provide for enhanced border security enforcement and detention facilities, and for other purposes.</official-title>

<section id="HEDC9131E4C574F7F8D1660DEF319313E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Security Enforcement and Detention Act of 2005</short-title></quote>. </text> </section> 
<section id="H73448A58BA144D238201A7E7DB003BD3" commented="no"><enum>2.</enum><header>Mandatory detention for aliens apprehended at or between ports of entry</header> 
<subsection id="HFF4B59B99A0B466DA5A8370130640017" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on October 1, 2006, an unlawful alien who is apprehended at a United States port of entry or along the international land and maritime border of the United States shall be detained until removed or a final decision granting admission has been determined, if the alien—</text> 
<paragraph id="H4CCAF4980655424FB69523FBFF985B9E" commented="no"><enum>(1)</enum><text>is permitted to withdraw an application for admission under section 235(a)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(a)(4)</external-xref>) and does not immediately depart from the United States pursuant to such section; or</text></paragraph> 
<paragraph id="HDED778635C00434FA5101E3D9C3DE060" commented="no"><enum>(2)</enum><text>is ordered removed from the United States under section 235(b)(1)(A)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(A)(i)</external-xref>) without further hearing or review.</text></paragraph></subsection> 
<subsection id="H1ED72339ECBF4044AB238C023E84A37B" commented="no"><enum>(b)</enum><header>Requirements during interim period</header><text display-inline="yes-display-inline">Beginning 60 days after the date of the enactment of this Act and before October 1, 2006, an alien described in subsection (a) may be released with a notice to appear only if—</text> 
<paragraph id="HD48E593B97114B1100C08923A3571515" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security determines, after conducting all appropriate background and security checks on the alien, that the alien does not pose a national security risk; and</text></paragraph> 
<paragraph id="H5D200BB7430A4209B3407CC2C0778298" commented="no"><enum>(2)</enum><text>the alien provides a bond of not less than $5,000.</text></paragraph></subsection> 
<subsection id="H8859E4C8FDDF4B3EAD005FADA083A0C5"><enum>(c)</enum><header>Use of bond</header><text>In the case of an alien who forfeits a bond provided in accordance with subsection (b)(2), the Secretary of Homeland Security may use the bond for the purpose of funding alien absconder investigations carried out by the Department of Homeland Security.</text></subsection></section> 
<section id="HB3E3189375444B0CB575B968AF680417" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Expansion and effective management of detention facilities</header> 
<subsection id="H9FE13E4D7E1441EF801528B3928B78B9" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Secretary of Homeland Security shall fully utilize all available detention facilities operated or contracted by the Department of Homeland Security. </text></subsection> 
<subsection id="HE9223AA799E74804B88606C42F8C61CF"><enum>(b)</enum><header>Analysis of options to increase bed space</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary shall conduct a comprehensive analysis of all possible options to cost effectively increase available detention capacities, including the use of State and local correctional facilities, temporary detention facilities, private space, and secure alternatives to detention.</text></subsection> 
<subsection id="H05457CCC2E81428C977329D7729939BC"><enum>(c)</enum><header>Use of temporary detention facilities</header><text>The Secretary shall, as expeditiously as practicable, expand the use of temporary detention facilities to increase detention capacity during the period in which the Secretary is conducting the comprehensive analysis required under subsection (b).</text></subsection> 
<subsection id="HA317DAE18B794060AC53D4E4FC8BA00"><enum>(d)</enum><header>Implementation</header><text>Not later than October 1, 2008, the Secretary shall implement the options to cost effectively increase available detention capacities determined pursuant to the comprehensive analysis required under subsection (b).</text></subsection> </section> 
<section id="HDADE6EF7CBBC42928F921E1FDDE9B34D" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>Denial of admission to nationals of country denying or delaying accepting alien</header><text display-inline="no-display-inline">Section 243(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1253">8 U.S.C. 1253(d)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HE3F0F64F707B4A62BD464846951B1B13" display-inline="no-display-inline"> 
<subsection id="HE6AEE13CFC9A44B5A54711EC54305200"><enum>(d)</enum><header>Denial of admission to nationals of country denying or delaying accepting alien</header><text display-inline="yes-display-inline">Whenever the Secretary of Homeland Security determines that the government of a foreign country has denied or unreasonably delayed accepting an alien who is a citizen, subject, national, or resident of that country after the alien has been ordered removed, the Secretary, after consultation with the Secretary of State, may deny admission to any citizen, subject, national, or resident of that country until the country accepts the alien who was ordered removed.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF70E50FC632549E900C979DAA931B4A7" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header>Border patrol agents</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary of Homeland Security such sums as may be necessary for each of fiscal years 2007 through 2010 to carry out section 5202 of the Intelligence Reform and Terrorism Prevention Act of 2004 (requiring the Secretary to increase the number of positions for full-time active-duty border patrol agents) (<external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>;118 Stat. 3734).</text></section> 
<section id="H4827BAD59C634CA1AA000051E255724E"><enum>6.</enum><header>Report on financial burden of repatriation</header><text display-inline="no-display-inline">Not later than October 31 of each year, the Secretary of Homeland Security shall submit to the Secretary of State and Congress a report that details the cost to the Department of Homeland Security of repatriation of aliens to their countries of nationality or last habitual residence, including details relating to cost per country.</text></section>
