<official-title display="yes">To direct the Secretary of the Interior to transfer ownership of the American River Pump Station Project, and for other purposes.</official-title>

<section id="H96ADD8FD8B29460FA7CDF594CF35511" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American River Pump Station Project Transfer Act of 2006</short-title></quote>.</text></section> 
<section id="H32D5412114E8452896BF250057CB4FB0"><enum>2.</enum><header>Authority to transfer</header><text display-inline="no-display-inline">The Secretary of the Interior (hereafter in this Act referred to as the <quote>Secretary</quote>) shall transfer ownership of the American River Pump Station Project located at Auburn, California, which includes the Pumping Plant, associated facilities, and easements necessary for permanent operation of the facilities, to the Placer County Water Agency, in accordance with the terms of Contract No. 02–LC–20–7790 between the United States and Placer County Water Agency and the terms and conditions established in this Act.</text></section> 
<section id="H5B556B6958884BF2A21DDA02D11C5E05"><enum>3.</enum><header>Federal costs nonreimbursable</header><text display-inline="no-display-inline">Federal costs associated with construction of the American River Pump Station Project located at Auburn, California, are nonreimbursable.</text></section> 
<section id="H04AC87BEC4C54F2ABDADFE6D00C6FFC2"><enum>4.</enum><header>Grant of real property interest</header><text display-inline="no-display-inline">The Secretary is authorized to grant title to Placer County Water Agency as provided in section 2 in full satisfaction of the United States’ obligations under Land Purchase Contract 14–06-859-308 to provide a water supply to the Placer County Water Agency.</text></section> 
<section id="H45260E15BE424DA28024D33052B2E50"><enum>5.</enum><header>Compliance with environmental laws</header> 
<subsection id="HE4959DC1762C41C6B9C6FF45C8857614"><enum>(a)</enum><header>In general</header><text>Before conveying land and facilities pursuant to this Act, the Secretary shall comply with all applicable requirements under—</text> 
<paragraph id="H88053A7FA35D4762A660339B3CA6003C"><enum>(1)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></paragraph> 
<paragraph id="HC6D62285C4124F7F00AA2D36C00D5D8"><enum>(2)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></paragraph> 
<paragraph id="H3F4C4B80EBE9419D82E0BE0936D9148E"><enum>(3)</enum><text>any other law applicable to the land and facilities.</text></paragraph></subsection> 
<subsection id="H1F0EE200D77444458C39C8BBECA59E12"><enum>(b)</enum><header>Effect</header><text>Nothing in this Act modifies or alters any obligations under—</text> 
<paragraph id="H13D3253B2CBE4C408CB47B0086A5CDFC"><enum>(1)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); or</text></paragraph> 
<paragraph id="H881C647F8B9B40FB8889289100487D91"><enum>(2)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph></subsection></section> 
<section id="HA1652CC3A90E450F82EB3E76A2CA0073"><enum>6.</enum><header>Release from liability</header><text display-inline="no-display-inline">Effective on the date of transfer to the Placer County Water Agency of any land or facility under this Act, the United States shall not be liable for damages arising out of any act, omission, or occurrence relating to the land and facilities, consistent with Article 9 of Contract No. 02–LC–20-7790 between the United States and Placer County Water Agency.</text></section>
