<official-title display="yes">To improve the ability of the Secretary of Agriculture and the Secretary of the Interior to promptly implement recovery treatments in response to catastrophic events affecting Federal lands under their jurisdiction, including the removal of dead and damaged trees and the implementation of reforestation treatments, to support the recovery of non-Federal lands damaged by catastrophic events, to revitalize Forest Service experimental forests, and for other purposes. </official-title>

<section id="H5FFCF1585E88491D8F00468C3BBDECE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="HC67C3ACE497C46268C27352FC30587DB"><enum>(1)</enum><text display-inline="yes-display-inline">The number and severity of catastrophic events causing resource damage to Federal land has significantly increased over the last 20 years, and such catastrophic events also create serious adverse environmental, social, and economic consequences for Federal land and adjacent non-Federal land and communities.</text></paragraph>
<paragraph id="H56EE32E4F9C040E793EFF077889488B0"><enum>(2)</enum><text display-inline="yes-display-inline">Catastrophic events often devastate forest or rangeland ecosystems and eliminate sources of seed for desired tree and plant species, which—</text>
<subparagraph id="HAC271731797D4229A44720A0EEF1C226"><enum>(A)</enum><text>delays or even precludes the reestablishment of appropriate forest or plant cover on millions of acres of Federal land;</text></subparagraph>
<subparagraph id="HB046120581004109AD3930C700004B28"><enum>(B)</enum><text display-inline="yes-display-inline">increases the susceptibility of the damaged land to wildfire and noxious or harmful species and reduces the economic value of the damaged land’s resources;</text></subparagraph>
<subparagraph id="H5C21585EA7A1481C00F1EFD6B574E102"><enum>(C)</enum><text display-inline="yes-display-inline">increases the susceptibility of adjacent undamaged land to insect infestations, disease, and noxious weeds;</text></subparagraph>
<subparagraph id="H129D4AC202A14F43B195A1D6B5AD62A2"><enum>(D)</enum><text>pollutes municipal water supplies and damages water delivery infrastructure;</text></subparagraph>
<subparagraph id="HEB596723A4C44D2FB0E6F0D116EAA5FC"><enum>(E)</enum><text>exacerbates sediment production that adversely impacts native fish habitat and soil productivity;</text></subparagraph>
<subparagraph id="H65366F3255624AB28748954B729B6F16"><enum>(F)</enum><text>results in unsafe campgrounds, trails, roads, and other infrastructure; and</text></subparagraph>
<subparagraph id="H3BF2493E92DE4E8FA7C38C8C15DB5700"><enum>(G)</enum><text display-inline="yes-display-inline">adversely impacts the sustainability of ecosystems and the well-being of adjacent communities.</text></subparagraph></paragraph>
<paragraph id="H0B5AE88E3D374A848DD4CD5E3449CA37"><enum>(3)</enum><text display-inline="yes-display-inline">Program authorities and funding mechanisms currently available to the Secretary of Agriculture and the Secretary of the Interior to respond to catastrophic events on forested Federal land do not provide for consistent and timely response activities.</text></paragraph>
<paragraph id="H560C702E48A3494B858CA1E8BF44631"><enum>(4)</enum><text display-inline="yes-display-inline">The Council on Environmental Quality has approved on an infrequent basis the use of alternative arrangements to respond to catastrophic events on forested Federal land, but, when used in the past, such alternative arrangements have encouraged expedited and successful recovery outcomes.</text></paragraph>
<paragraph id="H0E96F0F8BBA04DDE9FCA355BCE3D18DE"><enum>(5)</enum><text display-inline="yes-display-inline">A prompt and standardized management response to a catastrophic event, which is also adaptive to the unique characteristics of each catastrophic event, is needed—</text>
<subparagraph id="H30F3BE0565784D13AB33BDF900C64BEE"><enum>(A)</enum><text>to effectively recover the area damaged by the catastrophic event,</text></subparagraph>
<subparagraph id="H8D91D4B2D1B1425B9E4819113CD5694E"><enum>(B)</enum><text>to minimize the impact on the resources of the area and adjacent communities adversely affected by the catastrophic event; and</text></subparagraph>
<subparagraph id="HE98470E165BF4DBC83373D9253006553"><enum>(C)</enum><text>to recover damaged, but still merchantable, material before it loses its economic value.</text></subparagraph></paragraph>
<paragraph id="HBE30ABF98CD2490BADCCCA00B7D98CBD"><enum>(6)</enum><text display-inline="yes-display-inline">Reforestation treatments on forested Federal land after a catastrophic event helps to restore appropriate forest cover, which provides multiple renewable resource benefits, including—</text>
<subparagraph id="H7C468A0513D545868E9F1CDD40D3AE51"><enum>(A)</enum><text>protecting soil and water resources;</text></subparagraph>
<subparagraph id="HF008FE09CE5445F598FF708D249F3940"><enum>(B)</enum><text>providing habitat for wildlife and fish;</text></subparagraph>
<subparagraph id="H5211B2210E8E4E8B00FAAAD3335B04A2"><enum>(C)</enum><text>contributing to aesthetics and enhancing the recreational experience for visitors;</text></subparagraph>
<subparagraph id="H19B6701D237F40DE8015FF8C8D89D567"><enum>(D)</enum><text>providing a future source of timber for domestic use; and</text></subparagraph>
<subparagraph id="H7939617FFF784A589E1161A6824B0480"><enum>(E)</enum><text>ensuring the health and resiliency of affected ecosystems for present and future generations.</text></subparagraph></paragraph>
<paragraph id="H170D2AA37D704617A9BCDDE7DC8C1401"><enum>(7)</enum><text>According to the Comptroller General, the reforestation backlog for Federal land has increased since 2000 as a result of natural disturbances, such as wildland fires, insect infestations, and diseases.</text></paragraph>
<paragraph id="H1C44CF136E2F45FBB8B4EA658E39AF31"><enum>(8)</enum><text>Additional scientific and monitoring information is needed regarding the effectiveness of recovery treatments to improve subsequent recovery proposals in response to future catastrophic events.</text></paragraph>
<paragraph id="HC2ACCC3454844789BFD22CF91DF1476F"><enum>(9)</enum><text display-inline="yes-display-inline">State, tribal, and local governments, local communities, and other entities play a critical role in restoring landscapes damaged by a catastrophic event and in reducing the risks associated with the catastrophic event.</text></paragraph>
<paragraph id="HEFC231051F344FB58877F3E4B6118BD"><enum>(10)</enum><text>Greater resources and adaptive arrangements must be made available to land managers to facilitate the prompt implementation of recovery treatments, including reforestation, following catastrophic events.</text></paragraph></section>
<section id="H11BD50D8D734428CAD4C00564FD2D3A4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H5FC0CF6C8C6741F6AF90F412BFF2F5E"><enum>(1)</enum><header>Burned area emergency response</header><text display-inline="yes-display-inline">The term <term>burned area emergency response</term> means the process used by the Secretary concerned to plan and implement emergency stabilization actions on Federal land in response to a catastrophic event in order to minimize threats to life or property or to stabilize and prevent unacceptable degradation to natural and cultural resources resulting from the effects of the catastrophic event.</text></paragraph>
<paragraph id="HD120AAE4B0FB49A7BEFFC75C3FBE43ED"><enum>(2)</enum><header>Catastrophic event</header><text display-inline="yes-display-inline">The term <term>catastrophic event</term> means any natural disaster or any fire, flood, or explosion, regardless of cause, that the Secretary concerned determines has caused or will cause damage of significant severity and magnitude to Federal land or, in the case of title II, non-Federal land. A natural disaster may include a hurricane, tornado, windstorm, snow or ice storm, rain storm, high water, wind-driven water, tidal wave, earthquake, volcanic eruption, landslide, mudslide, drought, or insect or disease outbreak.</text></paragraph>
<paragraph id="H9B6596F8C5094103AA1E0474C1598233"><enum>(3)</enum><header>Catastrophic event recovery</header><text display-inline="yes-display-inline">The term <term>catastrophic event recovery</term>, with respect to an area of Federal land damaged by a catastrophic event, means—</text>
<subparagraph id="HCA8482A9B32A46F19C0066212700AD00"><enum>(A)</enum><text display-inline="yes-display-inline">if the catastrophic event involved fire, the rehabilitation and restoration activities (other than any emergency stabilization treatments undertaken as part of the burned area emergency response) that are undertaken on the damaged Federal land, including any infrastructure or facilities thereon, in response to the catastrophic event;</text></subparagraph>
<subparagraph id="H33334C65A8804A7AB31552DC076DAD8C"><enum>(B)</enum><text display-inline="yes-display-inline">if the catastrophic event did not involve fire, the emergency stabilization and rehabilitation and restoration activities that are undertaken on the damaged Federal land, including infrastructure or facilities thereon, in response to the catastrophic event; or</text></subparagraph>
<subparagraph id="HF7482B4C70474A1CB846A109D24F315E"><enum>(C)</enum><text display-inline="yes-display-inline"> the reforestation or revegetation, consistent with the applicable land and resource management plan, of the damaged Federal land in response to the catastrophic event using, to the extent practicable and preferable, native or beneficial plants to avoid creation of plantation forests and the recovery of trees on the damaged Federal land, through the use of timber harvesting and other appropriate methods of forest regeneration.</text></subparagraph></paragraph>
<paragraph id="HBCD61F848FD546BEA8007F87D3102748"><enum>(4)</enum><header>Catastrophic event recovery evaluation</header><text display-inline="yes-display-inline">The term <term>catastrophic event recovery evaluation</term>, with respect to an area of Federal land damaged by a catastrophic event, means an evaluation of the damaged Federal land that is conducted in accordance with section 102.</text></paragraph>
<paragraph id="HBB2706389F094C01B4F5F888612D773" display-inline="no-display-inline"><enum>(5)</enum><header>Catastrophic event recovery proposal</header><text display-inline="yes-display-inline">The term <term>catastrophic event recovery proposal</term> means the list and brief description of catastrophic event recovery projects, catastrophic event research projects, and pre-approved management practices that are—</text>
<subparagraph id="H1D3E7487DB8040999822CD63A3344846"><enum>(A)</enum><text>identified as part of the catastrophic event recovery evaluation of an area of Federal land damaged by a catastrophic event; and</text></subparagraph>
<subparagraph id="HAFF9D706EC244CF48012F78CCE8E3496"><enum>(B)</enum><text display-inline="yes-display-inline">proposed to be undertaken to facilitate the catastrophic event recovery of the area or evaluate the effects and effectiveness of such recovery efforts.</text></subparagraph></paragraph>
<paragraph id="H2383B3CC02A54151BBBB277B19EF3878"><enum>(6)</enum><header>Catastrophic event recovery project</header><text display-inline="yes-display-inline">The term <term>catastrophic event recovery project</term> means an individual activity or a series of activities identified in a catastrophic event recovery proposal for an area of Federal land damaged by a catastrophic event and proposed to be undertaken in response to the catastrophic event to promote catastrophic event recovery.</text></paragraph>
<paragraph id="H63B5EDD953434D0500D9596496ECF169"><enum>(7)</enum><header>Catastrophic event research project</header><text display-inline="yes-display-inline">The term <term>catastrophic event research project</term> means a scientifically designed study of the effects and effectiveness of—</text>
<subparagraph id="H17EAD82914574CC495CFD3B139428B00"><enum>(A)</enum><text display-inline="yes-display-inline">any catastrophic event recovery projects undertaken in an area of land damaged by a catastrophic event; and</text></subparagraph>
<subparagraph id="H9CE1E7166E7446AA83B2E44DEB3480BF"><enum>(B)</enum><text display-inline="yes-display-inline">any emergency stabilization treatments undertaken as part of a burned area emergency response in the area of land damaged by a catastrophic event.</text></subparagraph></paragraph>
<paragraph id="HDF6839A2F34A4D70944F25C9C9502A5" display-inline="no-display-inline"><enum>(8)</enum><header>Community wildfire protection plan</header><text display-inline="yes-display-inline">The term <term>community wildfire protection plan</term> has the meaning given that term in section 101(3) of the Healthy Forest Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511(3)</external-xref>).</text></paragraph>
<paragraph id="H3D54307301E74242A867E4F952F1277D"><enum>(9)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term>, for purposes of providing assistance under subtitle B of title II, means a State Forester or equivalent State official, an Indian tribe, local government, community-based organization, or other person.</text></paragraph>
<paragraph id="HD913BF66604B492BA811836D00235905"><enum>(10)</enum><header>Federal land</header><text display-inline="yes-display-inline">The term <term>Federal land</term> means land in the National Forest System and public lands. The term does not include any land contained in a component of the National Wilderness Preservation System or designated as a national monument.</text></paragraph>
<paragraph id="H3F75A6781C8E418CA9C38F68E82784EE"><enum>(11)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph>
<paragraph id="HAFEA2502CA3046339C93E593F4795FD5" display-inline="no-display-inline"><enum>(12)</enum><header>Land and resource management plan</header><text>The term <quote>land and resource management plan</quote> means—</text>
<subparagraph id="HB9795FE2BAD14708B14707E77F3300D5"><enum>(A)</enum><text display-inline="yes-display-inline">a land and resource management plan developed for a unit of the National Forest System under section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>); or</text></subparagraph>
<subparagraph id="H2D3CE1017B5C4A7F9C7730D57D3978D"><enum>(B)</enum><text display-inline="yes-display-inline">a land use plan developed for an area of the public lands under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></subparagraph></paragraph>
<paragraph id="HD5E8FE73764449CE8917E38686425216"><enum>(13)</enum><header>Land-grant colleges and universities</header><text display-inline="yes-display-inline">The term <quote>land-grant colleges and universities</quote> has the meaning given that term in section 1404(11) of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103(11)</external-xref>).</text></paragraph>
<paragraph id="H9C76241F5F0D45BF8CB57E73746F22B" display-inline="no-display-inline"><enum>(14)</enum><header>Landscape assessment</header><text>The term <term>landscape assessment</term> means an assessment describing catastrophic event conditions and recovery needs and opportunities on non-Federal land affected by a catastrophic event and including a list of proposed special recovery projects to address those needs and opportunities.</text></paragraph>
<paragraph id="H5B499F6D47E245A7002E67C3312D4EEB"><enum>(15)</enum><header>National forest system</header><text display-inline="yes-display-inline">The term <quote>National Forest System</quote> has the meaning given that term in section 11(a) of the <act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph>
<paragraph id="H2A5F55180B264BE198E3ACDE000A8A5"><enum>(16)</enum><header>Pre-approved management practice</header><text display-inline="yes-display-inline">The term <quote>pre-approved management practice</quote> means a management practice identified by the Secretary concerned under section 104(a) that may be immediately implemented as part of a catastrophic event recovery project or catastrophic event research project to facilitate the catastrophic event recovery of an area of Federal land damaged by a catastrophic event.</text></paragraph>
<paragraph id="H30B3B2DFA8BD43AB8FF606B32474BF3"><enum>(17)</enum><header>Public lands</header><text display-inline="yes-display-inline">The term <quote>public lands</quote> has the meaning given that term in section 103(e) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702(e)</external-xref>).</text></paragraph>
<paragraph id="HD93A4A18AD294ECB97D99F7874027004"><enum>(18)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text>
<subparagraph id="H4828D2950EF54A4388A3F12FD3997121"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System land; and</text></subparagraph>
<subparagraph id="HBAFC68FDEA964403A4216B8F0606A46"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of the Interior, with respect to public lands.</text></subparagraph></paragraph>
<paragraph id="H26AD0F467A81404A8C608D1D7DAE9611"><enum>(19)</enum><header>Special recovery project</header><text display-inline="yes-display-inline">The term <term>special recovery project</term> means an individual activity or a series of activities proposed to be undertaken to rehabilitate, repair, and restore non-Federal land damaged by a catastrophic event, community infrastructure and facilities on the land, and economic, social, and cultural conditions affected by the catastrophic event.</text></paragraph></section>

<section id="HAC1014DA33E7408C84A4D60374D24F0"><enum>101.</enum><header>Development of research protocols and use in catastrophic event research projects</header>
<subsection id="H027A009AF1564A34A3E7003657A4C88F"><enum>(a)</enum><header>Development of protocols; purpose</header><text display-inline="yes-display-inline">For the purpose of conducting and evaluating the effectiveness and effects of a catastrophic event recovery project and of emergency stabilization treatments undertaken as part of a burned area emergency response, the Secretary concerned shall develop research protocols consisting of—</text>
<paragraph id="H34952889D2EB41A6A47BC7301F9D78E"><enum>(1)</enum><text display-inline="yes-display-inline">a research approach that is specifically designed to improve knowledge, understanding, and predictive capabilities—</text>
<subparagraph id="H4922D1FBB07A4384A6DF732EB954A15B"><enum>(A)</enum><text>to increase the long-term benefits of management activities, including natural and artificial regeneration of vegetation; and</text></subparagraph>
<subparagraph id="H1F99CB9A1A604235A435C02EB53ED70"><enum>(B)</enum><text>to decrease the short-term impacts of such management activities;</text></subparagraph></paragraph>
<paragraph id="HF95BC0A508F84E3D97B38917779B988E"><enum>(2)</enum><text>an appropriate and scientifically sound experimental design or set of sampling procedures; and</text></paragraph>
<paragraph id="H8B63573729EF4FFBA5A488C235C294CF"><enum>(3)</enum><text>accompanying methods of data analysis and interpretation.</text></paragraph></subsection>
<subsection id="HDCD3F19297B2412CB1C690B37E146644"><enum>(b)</enum><header>Peer review</header><text display-inline="yes-display-inline">The research protocols developed under subsection (a), and any subsequent modification thereof, shall be subject to peer review, including independent, third-party peer review, by scientific and land management experts.</text></subsection>
<subsection id="H1013A7D81C2345FC8294FF94038DC85"><enum>(c)</enum><header>Time for completion; modification</header><text display-inline="yes-display-inline">The research protocols required by this section shall be submitted to Congress not later than 180 days after the date of the enactment of this Act. The Secretary concerned may modify the research protocols, as the Secretary determines necessary, after their submission to Congress. The Secretary concerned shall notify Congress regarding any such modification. </text></subsection>
<subsection id="HB3576C0EBF5F4B618D9793C0EAF4E2DD"><enum>(d)</enum><header>Catastrophic event research projects</header><text display-inline="yes-display-inline">In accordance with the research protocols developed under this section, the Secretary concerned may conduct one or more catastrophic event research projects in an area of land damaged by a catastrophic event. The Secretary may develop a proposed catastrophic event research project as part of a catastrophic event recovery proposal or develop a catastrophic event research project independently of the catastrophic event recovery proposal during the catastrophic event recovery in response to changing conditions in the area damaged by the catastrophic event.</text></subsection>
<subsection id="HFDE0A7EECB6E4B8D853ECE7422CE3293"><enum>(e)</enum><header>Public access</header>
<paragraph id="H8D742077A18F4393B720FD664DB68DC1"><enum>(1)</enum><header>Protocols</header><text display-inline="yes-display-inline">The Secretary concerned shall make the research protocols developed under subsection (a), including any modification thereof, publicly available, in a form determined to be appropriate by the Secretary.</text></paragraph>
<paragraph id="HA7E13F0E883C4C5497A3F591924892C7"><enum>(2)</enum><header>Research results</header><text display-inline="yes-display-inline">After completion of the peer review required by subsection (b), the Secretary concerned shall make the results of catastrophic event research projects publicly available, in a form determined to be appropriate by the Secretary.</text></paragraph></subsection>
<subsection id="H94C02F4EA18846D696AD783D5DE817C5" commented="no"><enum>(f)</enum><header>Forest health partnerships</header><text display-inline="yes-display-inline">In developing and using the research protocols required by this section, the Secretary concerned shall enter into cooperative agreements with land-grant colleges and universities and other institutions of higher education to form forest health partnerships, including regional institutes, to utilize their education, research, and outreach capacity to address the catastrophic event recovery of forested land. A forest health partnership may be aligned with the current network of Cooperative Ecosystem Studies Units. </text></subsection></section>
<section id="H738521E1E16A4F78BB22FA8DB351865E"><enum>102.</enum><header>Catastrophic event recovery evaluations</header>
<subsection id="H4F56AF821DB24E8C88F4344C07E2F0C5" commented="no"><enum>(a)</enum><header>Commencement</header>
<paragraph id="H7DD35E08D8E04C2FA34012612139F4F1" commented="no"><enum>(1)</enum><header>Evaluation required</header><text>In response to a catastrophic event affecting 1,000 or more acres of Federal land, the Secretary concerned shall conduct a catastrophic event recovery evaluation of the damaged Federal land.</text></paragraph>
<paragraph id="H0C082B15639A48C1951F9138F3C4C7CB" commented="no"><enum>(2)</enum><header>Evaluation authorized</header><text>If a catastrophic event affects more than 250 acres of Federal land, but less than 1,000 acres, the Secretary concerned is authorized, but not required, to conduct a catastrophic event recovery evaluation of the damaged Federal land.</text></paragraph></subsection>
<subsection id="HBC43EFBD437147EA93747861C9F62737"><enum>(b)</enum><header>Time for commencement</header>
<paragraph id="H2D5B92C9CDAB4D60BA95937828622000"><enum>(1)</enum><header>When evaluation required</header><text display-inline="yes-display-inline">When a catastrophic event recovery evaluation is required under subsection (a)(1), the Secretary concerned shall commence the catastrophic event recovery evaluation for the Federal land damaged by the catastrophic event—</text>
<subparagraph id="HFD6A27E0A1E7489AAA59BC7D07001D4C"><enum>(A)</enum><text display-inline="yes-display-inline">as soon as practicable during or after the conclusion of the catastrophic event to facilitate prompt decision-making with regard to the catastrophic event recovery of the damaged Federal land; but</text></subparagraph>
<subparagraph id="H286AFF6167F849B2AAD67822EF6130C3"><enum>(B)</enum><text>in no event later than 30 days after the conclusion of the catastrophic event.</text></subparagraph></paragraph>
<paragraph id="HE2D25005C74C45508BE82D4B58D7A490" display-inline="no-display-inline"><enum>(2)</enum><header>When evaluation discretionary</header><text display-inline="yes-display-inline">When a catastrophic event recovery evaluation is simply discretionary under subsection (a)(2), the Secretary concerned shall make a final decision whether to commence a catastrophic event recovery evaluation for the Federal land damaged by the catastrophic event, and, if the final decision is to commence a catastrophic event recovery evaluation, actually commence the evaluation—</text>
<subparagraph id="HC7E6789815A24C9FA51B2F4505AFFBB3"><enum>(A)</enum><text display-inline="yes-display-inline">as soon as practicable during or after the conclusion of the catastrophic event to facilitate prompt decision-making with regard to the catastrophic event recovery of the damaged Federal land; but</text></subparagraph>
<subparagraph id="H984AE9A1260F42E3A6B97BA255171B6B"><enum>(B)</enum><text>in no event later than 30 days after the conclusion of the catastrophic event.</text></subparagraph></paragraph></subsection>
<subsection id="HB3C446DBC17C47BAAE001D2F58933744"><enum>(c)</enum><header>Completion</header>
<paragraph id="H9C0E4FE6773046E4B9FC3C86663E81D6"><enum>(1)</enum><header>Time for completion</header><text display-inline="yes-display-inline">To facilitate prompt implementation of catastrophic event recovery projects on Federal land damaged by a catastrophic event when a catastrophic event recovery evaluation is undertaken under subsection (a), whether because the evaluation is required under paragraph (1) of such subsection or because the Secretary concerned makes a decision to conduct an evaluation under paragraph (2) of such subsection, the Secretary concerned shall complete the catastrophic event recovery evaluation for the damaged Federal land not later than 30 days after the date on which Secretary commenced the catastrophic event recovery evaluation.</text></paragraph>
<paragraph id="H3DEF371C3561497385C71991E388EE08"><enum>(2)</enum><header>Extension</header><text display-inline="yes-display-inline">The Secretary concerned may extend the completion date for a catastrophic event recovery evaluation, on a case-by-case basis, when the Secretary concerned determines that additional time is necessary to evaluate a complex catastrophic event, an on-going catastrophic event, or a series of catastrophic events. Only a single extension may be provided for any catastrophic event recovery evaluation, and the extension shall not be longer than 60 days after the date on which the evaluation was otherwise required to be completed under paragraph (1).</text></paragraph></subsection>
<subsection id="H714457C41F68465BA0F1350054833B12"><enum>(d)</enum><header>Elements of catastrophic event evaluation</header><text display-inline="yes-display-inline">In conducting the catastrophic event recovery evaluation for an area of Federal land damaged by a catastrophic event, the Secretary concerned shall prepare the following:</text>
<paragraph id="H32996E88727D4ADE9242816FA6EE72E0"><enum>(1)</enum><text display-inline="yes-display-inline">A description of catastrophic event conditions on the damaged Federal land, recovery needs and opportunities, and the areas where management intervention would be helpful to achieve the catastrophic event recovery of the damaged Federal land.</text></paragraph>
<paragraph id="H44E2E97442304C13A355B4E920706D72"><enum>(2)</enum><text>A preliminary determination of any catastrophic event research projects that best fit the circumstances of the particular catastrophic event environment or would enhance scientific understanding relevant to the damaged area.</text></paragraph>
<paragraph id="HF09CD88222FA459680E2F1EA40F71D29"><enum>(3)</enum><text>A catastrophic event recovery proposal containing possible catastrophic event recovery projects and catastrophic event research projects for the damaged area and describing the anticipated size and scope of these projects.</text></paragraph>
<paragraph id="H394F205CB9F645F5A35700052BDDB42"><enum>(4)</enum><text>One or more maps detailing the area of damaged Federal land and the location of catastrophic event recovery proposals.</text></paragraph>
<paragraph id="H5C1D7A01B591448D891BE83788319142"><enum>(5)</enum><text display-inline="yes-display-inline">A preliminary estimate of the funding that would be needed to complete the catastrophic event recovery projects and catastrophic event research projects contained in the catastrophic event recovery proposal.</text></paragraph>
<paragraph id="H4B7AA7C7C6334E919409E6B2200979D4"><enum>(6)</enum><text display-inline="yes-display-inline">A preliminary estimate of the receipts, including receipts from biomass and other forest products, to be derived from the catastrophic event recovery projects and catastrophic event research projects contained in the catastrophic event recovery proposal, and, to the maximum extent practicable, an estimate of revenues likely to be lost if action is not taken in a timely manner.</text></paragraph>
<paragraph id="H7D6439C93B024333AF51B9F2257C2D36"><enum>(7)</enum><text display-inline="yes-display-inline">A preliminary schedule showing the timing of possible catastrophic event recovery projects and catastrophic event research projects by fiscal year, assuming funding is available to undertake the projects.</text></paragraph></subsection>
<subsection id="H96159DC7302744C592B682E4C605A889" commented="no"><enum>(e)</enum><header>Use of pre-approved management practices or emergency procedures</header>
<paragraph id="HA8184D966E2947A7001478EEB021AC09" commented="no"><enum>(1)</enum><header>Determination</header><text display-inline="yes-display-inline">In addition to complying with the requirements specified in subsection (d) for each catastrophic event recovery evaluation, the Secretary concerned shall make a determination of—</text>
<subparagraph id="HE6EEEF24E30943AE9669047F5B007645"><enum>(A)</enum><text display-inline="yes-display-inline">whether or not any pre-approved management practices should be immediately implemented under section 104 to facilitate the catastrophic event recovery of the area covered by the catastrophic event recovery evaluation; and</text></subparagraph>
<subparagraph id="HEA49F5A60FB64FF58FFE670448827262"><enum>(B)</enum><text display-inline="yes-display-inline">whether or not any catastrophic event recovery project or catastrophic event research project, or portion of such a project, contained in the catastrophic event recovery proposal should be developed and carried out using the emergency procedures authorized by section 105.</text></subparagraph></paragraph>
<paragraph id="H03C736431276418C9CD4D49C4EC30035" commented="no"><enum>(2)</enum><header>Factors</header><text display-inline="yes-display-inline">In making any determination under paragraph (1)(B) to develop and carry out a catastrophic event recovery project or catastrophic event research project, or portion of such a project, using emergency procedures under section 105, the Secretary concerned shall consider at a minimum the following:</text>
<subparagraph id="H348D512BB25548DE80293BB239BFA87" commented="no"><enum>(A)</enum><text>The necessity of promptly responding to the catastrophic event on the damaged Federal land.</text></subparagraph>
<subparagraph id="H2BED6D8C5A1349A7981BA69944C28004" commented="no"><enum>(B)</enum><text>The recovery needs and opportunities identified under subsection (d)(1) with respect to the damaged Federal land.</text></subparagraph>
<subparagraph id="HBB4A0427488C400E8F0028C64EA11710"><enum>(C)</enum><text display-inline="yes-display-inline">The lack of pre-approved management practices authorized by section 104 applicable to the damaged Federal land.</text></subparagraph>
<subparagraph id="H7EC924EC9201429AAF72471C1FE150E1" commented="no"><enum>(D)</enum><text>The threat to public health and safety.</text></subparagraph>
<subparagraph id="H49EFCCEF51C941D388CD973BFB667C8C" commented="no"><enum>(E)</enum><text>The likelihood of substantial loss of adjacent private and public property or other substantial economic losses.</text></subparagraph></paragraph>
<paragraph id="H66DF5E606EAF4D2EBCF3833EC08CD748" commented="no"><enum>(3)</enum><header>CEQ notification</header><text>The Secretary concerned shall make the determination under paragraph (1) after notification of the Council on Environmental Quality, but the determination remains in the sole discretion of the Secretary.</text></paragraph></subsection>
<subsection id="H4267ED567490400183437049A81FB53"><enum>(f)</enum><header>Interdisciplinary approach</header><text display-inline="yes-display-inline">To conduct the catastrophic event recovery evaluation of an area of Federal land damaged by a catastrophic event, the Secretary concerned shall use a systematic, interdisciplinary approach that insures the integrated use of appropriate natural and social sciences.</text></subsection>
<subsection id="HDF5CB1E2C19244EF9E49A826D9AC936F"><enum>(g)</enum><header>Coordination with other activities</header>
<paragraph id="HE327733E9BC24CE689A7DFD179FB42C0"><enum>(1)</enum><header>Related assessment of non-Federal land</header><text>The Secretary concerned may combine the preparation of a catastrophic event recovery evaluation of Federal land with the preparation of a landscape assessment for non-Federal land in the vicinity of the damaged Federal land prepared under subtitle B of title II or subsection (c) of section 10A of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2106c">16 U.S.C. 2106c</external-xref>), as added by section 201.</text></paragraph>
<paragraph id="H1DA33503F5C6420584EACD40F0D35332"><enum>(2)</enum><header>Related community wildfire protection plans</header><text>During preparation of a catastrophic event recovery evaluation for an area of Federal land damaged by a catastrophic event involving wildfire, the Secretary concerned shall consider post-fire management recommendations, if any, contained in any community wildfire protection plan addressing the damaged Federal land.</text></paragraph></subsection>
<subsection id="H06DC048D4D1E472CB8B20240DEA790F5" display-inline="no-display-inline"><enum>(h)</enum><header>Public collaboration</header><text display-inline="yes-display-inline">To encourage meaningful participation during the preparation of catastrophic event recovery projects, the Secretary concerned shall facilitate collaboration among State and local governments, Indian tribes, land-grant colleges and universities, and interested persons during the preparation of catastrophic event recovery evaluations and catastrophic event recovery proposals.</text></subsection>
<subsection id="H086F98EEC6E542199161A78F53C648BD"><enum>(i)</enum><header>Public notice</header>
<paragraph id="H511A3F22AB554A89AB00F7E226BFF7E6" commented="no"><enum>(1)</enum><header>Notice of evaluation</header><text display-inline="yes-display-inline">The Secretary concerned shall provide public notice of each catastrophic event recovery evaluation, including the catastrophic event recovery proposal prepared as part of the evaluation. The notice shall be provided in a form determined to be appropriate by the Secretary concerned.</text></paragraph>
<paragraph id="H96A365E333C34667BF55F42FE9F672F2"><enum>(2)</enum><header>Notice of public meetings</header><text display-inline="yes-display-inline">The Secretary concerned shall provide notice of public meetings conducted in connection with a catastrophic event recovery evaluation and the availability of preliminary analyses or documents prepared as part of the evaluation. The notice shall be provided at such times and in such a manner as the Secretary concerned considers appropriate.</text></paragraph></subsection></section>
<section id="H50EE68C7EC684D19B153B5A49C2EF368"><enum>103.</enum><header>Compliance with National Environmental Policy Act</header>
<subsection id="H90279ED0403F4601A100B7002BE87594"><enum>(a)</enum><header>Compliance required</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the Secretary concerned shall comply with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>), its implementing regulations, and other applicable laws in designing and conducting catastrophic event recovery projects and catastrophic event research projects.</text></subsection>
<subsection id="H5B32E9BEFE9D49F5A51D1D5D9261CBB4"><enum>(b)</enum><header>Satisfaction of NEPA requirements</header><text display-inline="yes-display-inline">The following activities are deemed to satisfy the requirements of section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332 et seq.</external-xref>) and its implementing regulations:</text>
<paragraph id="HC9399E6F809548FBA63CB270AD47F62"><enum>(1)</enum><text>The preparation of the list of pre-approved management practices under section 104.</text></paragraph>
<paragraph id="HE701827A159541178B211E4F3ECFF29B"><enum>(2)</enum><text>The use of pre-approved management practices on the list in the manner provided in section 104.</text></paragraph>
<paragraph id="H8BF10878369C4F398271785B5321769C"><enum>(3)</enum><text display-inline="yes-display-inline">The use of emergency procedures in the manner provided in section 105.</text></paragraph></subsection></section>
<section id="H77E58460E23842A4ADB1799889DEF50"><enum>104.</enum><header>Availability and use of pre-approved management practices</header>
<subsection id="H5DA4FF8987F545A39077938111269D02"><enum>(a)</enum><header>List of available pre-approved management practices</header><text>The Secretary concerned shall prepare a list of management practices, by forest type or plant association group, that may be immediately implemented as part of a catastrophic event recovery project or catastrophic event research project to facilitate the catastrophic event recovery of an area of Federal land damaged by a catastrophic event. The list of pre-approved management practices shall be prepared using notice and comment rule making under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code.</text></subsection>
<subsection id="HB0F68790C54F4034A82C00C64D465000" display-inline="no-display-inline"><enum>(b)</enum><header>Peer review</header><text display-inline="yes-display-inline">Before a management practice may be included on the list of pre-approved management practices, the management practice shall be subject to peer review, including independent, third-party peer review, by scientific and land management experts. The results of the peer review shall be available to the public during the comment period.</text></subsection>
<subsection id="H3DD1EFB566E047CFA7556FB2E80034CA"><enum>(c)</enum><header>Revision or amendment of list</header><text display-inline="yes-display-inline">The Secretary concerned may amend or revise the list of pre-approved management practices as necessary whenever new scientific and managerial information becomes available. Subsections (a) and (b) shall apply to the amendment or revision process.</text></subsection>
<subsection id="HDF911917B3DE441B00D7303672E437B" commented="no"><enum>(d)</enum><header>Use for certain activities prohibited</header>
<paragraph id="HC391E55790DF4CF0BC52F01D477C8009" commented="no"><enum>(1)</enum><header>Road construction</header><text display-inline="yes-display-inline">A pre-approved management practice may not authorize any permanent road building. Any temporary road constructed as part of a pre-approved management practice shall be obliterated upon conclusion of the practice and the road area restored to the extent practicable.</text></paragraph>
<paragraph id="H71AA63FA0F914277AB16DD2F0048BF88" commented="no"><enum>(2)</enum><header>Timber harvesting</header><text display-inline="yes-display-inline">Timber harvesting carried out as part of a pre-approved management practice shall be limited to trees—</text>
<subparagraph id="H73595B328B3E43A6B4CDE99FC646DE73" commented="no"><enum>(A)</enum><text>that are already down, dead, broken, or severely root sprung; </text></subparagraph>
<subparagraph id="H703127BD5F7541FBB1C1F79C717EC58E" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">regarding which mortality is highly probable within five years after the end of the catastrophic event; or </text></subparagraph>
<subparagraph id="HA859FE94F4854DF5AA49B787EB7C7BAF" commented="no"><enum>(C)</enum><text>that are required to be removed for worker or public safety.</text></subparagraph></paragraph></subsection>
<subsection id="HC6687B0E7916454ABBADDB173700B867" display-inline="no-display-inline"><enum>(e)</enum><header>Compliance with other laws</header>
<paragraph id="H87D00BC7A65849D482EE51C3BB2C17F" commented="no"><enum>(1)</enum><header>ESA consultation</header><text display-inline="yes-display-inline">In the case of the proposed use of a pre-approved management practice included on the list prepared under subsection (a), the Secretary concerned may use the emergency procedures described in <external-xref legal-doc="regulation" parsable-cite="cfr/50/402.05">section 402.05</external-xref> of title 50, Code of Federal Regulations, to comply with section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>). At the conclusion of the consultation, the statement required by subsection (b)(4) of such section shall be issued for any incidental taking that may occur while using the pre-approved management practice, which shall be effective beginning on the date the Secretary concerned initiates the practice and shall apply to all persons assisting or cooperating with the Secretary in using the practice.</text></paragraph>
<paragraph id="HDA94FA531D6A412B910069672909CDA3"><enum>(2)</enum><header>Other required consultation</header><text display-inline="yes-display-inline">Any consultation required under other laws, such as the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>), may proceed simultaneously with the implementation of a pre-approved management practice. Results of consultation shall be immediately incorporated into the practice, to the extent feasible, practical, and consistent with the response, recovery, and rehabilitation objectives of the project.</text></paragraph>
<paragraph id="H4F5DA77D528140E69EEBD7125C1E9E54"><enum>(3)</enum><header>Federal water pollution control act compliance</header><text display-inline="yes-display-inline">Compliance with any applicable requirements of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) may proceed simultaneously with the implementation of a pre-approved management practice.</text></paragraph></subsection>
<subsection id="H5FEE7482818D47F7929E19F5402DD11B" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Issuance of decision document</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Secretary concerned makes the determination under section 102(e) to use a pre-approved management practice to facilitate the catastrophic event recovery of an area of Federal land damaged by a catastrophic event, the Secretary concerned shall issue a concise decision document that contains the following:</text>
<paragraph id="H509B747840134253B1CE94DDC353890"><enum>(1)</enum><text display-inline="yes-display-inline">A description of the pre-approved management practice to be implemented.</text></paragraph>
<paragraph id="HE1C451706A6348B191AA58A665BCDFA9" commented="no"><enum>(2)</enum><text>The rationale for the agency decision.</text></paragraph>
<paragraph id="HB106A747A430479AB4DDD0EC78FBC0CB" commented="no"><enum>(3)</enum><text>An economic analysis and justification.</text></paragraph>
<paragraph id="H50BFDB5EC382469000B09DBC37528480" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">An analysis of the environmental effects of the pre-approved management practice and how such effects will be minimized or mitigated consistent with the applicable land and resource management plan. As part of this analysis, the Secretary concerned shall consider, to the extent the Secretary concerned determines appropriate, forest type or plant association group, standing- and down-dead wood, watershed, water quality, wildlife habitat, and soils applicable to the damaged Federal land.</text></paragraph></subsection>
<subsection id="HD13785B21F814D7CB9DA2B049FA0E335" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Immediate implementation</header><text display-inline="yes-display-inline">The Secretary concerned shall implement a pre-approved management practice immediately after the issuance of the decision document under subsection (f), subject only to the availability of funds for the practice.</text></subsection>
<subsection id="H65184CFA30BC4C16AC01DE92BF3762D7" commented="no"><enum>(h)</enum><header>Monitoring</header><text display-inline="yes-display-inline">To monitor the implementation of a pre-approved management practice, the Secretary concerned may establish a third-party monitoring group, as determined to be appropriate by the Secretary. </text></subsection></section>
<section id="HE85F32E76817463CA3FB51A250ED6714" section-type="subsequent-section" display-inline="no-display-inline" commented="no"><enum>105.</enum><header>Availability and use of emergency procedures</header>
<subsection id="H597D08AA155C4149871D88740602C47B" commented="no"><enum>(a)</enum><header>Limited consideration of alternatives</header><text display-inline="yes-display-inline">If the Secretary concerned determines under section 102(e) to utilize emergency procedures to conduct a catastrophic event recovery project or catastrophic event research project, or portion of such a project, the Secretary concerned is not required to study, develop, or describe more than the proposed agency action and the alternative of no action in designing that project or the portion of the project for which the emergency procedures are utilized.</text></subsection>
<subsection id="HD1FFD8D0C3574279BF17D7D316A75FF4" commented="no"><enum>(b)</enum><header>Use for certain activities prohibited</header>
<paragraph id="HB276A0A9D782427A8E6E733C183E5CD5" commented="no"><enum>(1)</enum><header>Road construction</header><text display-inline="yes-display-inline">Emergency procedures under this section may not be used to design or conduct a catastrophic event recovery project or catastrophic event research project, or portion of such a project, that provides for any permanent road building. Any temporary road constructed as part of the project shall be obliterated upon completion of the project and the road area restored to the extent practicable.</text></paragraph>
<paragraph id="H9B43459DA7CB467D94110091DDCBEC00" commented="no"><enum>(2)</enum><header>Timber harvesting</header><text display-inline="yes-display-inline">Timber harvesting carried out as part of a catastrophic event recovery project or catastrophic event research project, or portion of such a project, for which emergency procedures under this section were used shall be limited to trees—</text>
<subparagraph id="H92D134DA093142350084B869107B666D" commented="no"><enum>(A)</enum><text>that are already down, dead, broken, or severely root sprung; </text></subparagraph>
<subparagraph id="H570CF5D8A91E4464845CCBC2BC61E7F5" commented="no"><enum>(B)</enum><text>regarding which mortality is highly probable within five years after the end of the catastrophic event; or</text></subparagraph>
<subparagraph id="HF14ADF2156604223A0EE1500368EEB2" commented="no"><enum>(C)</enum><text>that are required to be removed for worker or public safety.</text></subparagraph></paragraph></subsection>
<subsection id="H0E82B0ACFCB04A268DE648C9CC52F052"><enum>(c)</enum><header>Compliance with other laws</header>
<paragraph id="HFD3C4FBEBB2A4CA7AA4E2CD7F62833E3" commented="no"><enum>(1)</enum><header>ESA consultation</header><text display-inline="yes-display-inline">In the case of a catastrophic event recovery project or catastrophic event research project, or portion of such a project, for which emergency procedures under this section are used, the Secretary concerned may use the procedures described in <external-xref legal-doc="regulation" parsable-cite="cfr/50/402.05">section 402.05</external-xref> of title 50, Code of Federal Regulations, to comply with section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>). At the conclusion of the consultation, the statement required by subsection (b)(4) of such section shall be issued for any incidental taking that may occur under the project, which shall be effective beginning on the date the Secretary concerned initiates action under the project and shall apply to all persons assisting or cooperating with the Secretary under the project.</text></paragraph>
<paragraph id="HF18ABA8AFA1348D500E2C2E1DE8E8711"><enum>(2)</enum><header>Other required consultation</header><text display-inline="yes-display-inline">Any consultation required under other laws, such as the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>), may proceed simultaneously with the design of a catastrophic event recovery project or catastrophic event research project, or portion of such a project, for which emergency procedures under this section are used. Results of consultation shall be immediately incorporated into the project, to the extent feasible, practical, and consistent with the response, recovery, and rehabilitation objectives of the project.</text></paragraph>
<paragraph id="H1873E491444F4092887313BF74417D59"><enum>(3)</enum><header>Federal water pollution control act compliance</header><text display-inline="yes-display-inline">Compliance with any applicable requirements of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) may proceed simultaneously with the design of a catastrophic event recovery project or catastrophic event research project, or portion of such a project, for which emergency procedures under this section are used. </text></paragraph></subsection>
<subsection id="H1B4411FFC41A4F27BA64A37737DBAE84" commented="no"><enum>(d)</enum><header>Completion of emergency procedures and issuance of decision document</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Secretary concerned makes the determination under section 102(e) to develop and carry out a catastrophic event recovery project or catastrophic event research project, or portion of such a project, using emergency procedures, the Secretary concerned shall—</text>
<paragraph id="H7E97E25C2F4C4F1AADA847F693615670"><enum>(1)</enum><text display-inline="yes-display-inline">complete the emergency procedures for that catastrophic event recovery project or catastrophic event research project, or portion thereof, under this section; and</text></paragraph>
<paragraph id="H8B4AD69F4A3C444199D39982FBC540DF"><enum>(2)</enum><text display-inline="yes-display-inline">issue a concise decision document that contains the following:</text>
<subparagraph id="H141240029C9F442987ED8C9023C7359" commented="no"><enum>(A)</enum><text>The rationale for the agency decision.</text></subparagraph>
<subparagraph id="H10BA467D901949DBA4B9E07708BC107F" commented="no"><enum>(B)</enum><text>An economic analysis and justification.</text></subparagraph>
<subparagraph id="HF1926B8EB40141629111B726F4A22574" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">An analysis of the environmental effects of the project and how such effects will be minimized or mitigated consistent with the applicable land and resource management plan. As part of this analysis, the Secretary concerned shall consider, to the extent the Secretary concerned determines appropriate, forest type or plant association group, standing- and down-dead wood, watershed, water quality, wildlife habitat, and soils applicable to the damaged Federal land.</text></subparagraph></paragraph></subsection>
<subsection id="HA1741023DD1641DCB1892D4EAF8E7DAC" commented="no"><enum>(e)</enum><header>Immediate implementation</header><text display-inline="yes-display-inline">In the case of a catastrophic event recovery project or catastrophic event research project, or portion of such a project, for which the emergency procedures authorized by this section are used, the Secretary concerned shall implement the project, or portion of the project, immediately after the issuance of the decision document under subsection (d), subject only to the availability of funds for the project.</text></subsection>
<subsection id="H6AC50AD141054A6188EFEFEBA101E762" commented="no"><enum>(f)</enum><header>Monitoring</header><text display-inline="yes-display-inline">To monitor a catastrophic event recovery project or catastrophic event research project, or portion of such a project, for which the emergency procedures authorized by this section were used, the Secretary concerned may establish a third-party monitoring group, as determined to be appropriate by the Secretary. </text></subsection></section>
<section id="H8FFDB2EFB034429D9527FCBC81214CD5"><enum>106.</enum><header>Administrative and judicial review</header>
<subsection id="HF8E196747BC74D8E8851A7AEEF4B80F9"><enum>(a)</enum><header>Administrative review generally</header><text display-inline="yes-display-inline">Except as provided in subsection (b), nothing in this title affects—</text>
<paragraph id="H56A9CAF8B9FA45DA8234B7C63EEEB48C"><enum>(1)</enum><text>the notice, comment, and appeal requirements of section 322 of the Department of the Interior and Related Agencies Appropriations Act, 1993 (Public 102–381; <external-xref legal-doc="usc" parsable-cite="usc/16/1612">16 U.S.C. 1612</external-xref> note); and</text></paragraph>
<paragraph id="H56487980FB9B4D59B0A44DA684241571"><enum>(2)</enum><text><external-xref legal-doc="regulation" parsable-cite="cfr/36/215">section 215</external-xref> of title 36, Code of Federal Regulations.</text></paragraph></subsection>
<subsection id="H073D5E7EBC9649ADB284F46EFBE053C6" display-inline="no-display-inline"><enum>(b)</enum><header>Predecisional administrative notice, comment, and review</header>
<paragraph id="H4F23CEBFFEC047A2BE74E946CA070295"><enum>(1)</enum><header>Interim final regulations</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Agriculture shall promulgate interim final regulations to establish a predecisional administrative review process that will serve as the sole means by which—</text>
<subparagraph id="HB7EA8FB8C8AD4E20A0839D57F2008BE5"><enum>(A)</enum><text>the Secretary of Agriculture will provide notice of and solicit comments regarding—</text>
<clause id="HF44E20FB743243118416516208181B70" display-inline="no-display-inline"><enum>(i)</enum><text>the proposed use of a pre-approved management practice under section 104 on National Forest System land; and</text></clause>
<clause id="H50FE7774E7D84BBDB9200008C62283F2" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a catastrophic event recovery project or catastrophic event research project, or portion of such a project, for which the emergency procedures under section 105 are used on National Forest System land; and</text></clause></subparagraph>
<subparagraph id="HB13E1D7C3D4840DC925908A97F84907B"><enum>(B)</enum><text>a person can seek administrative review regarding—</text>
<clause id="HF7D93B4041494028A80000A8699FE64B"><enum>(i)</enum><text>the proposed use of a pre-approved management practice under section 104 on National Forest System land; and</text></clause>
<clause id="HB5E23DEBDEC84BF2004DDB27F6C5172E" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a catastrophic event recovery project or catastrophic event research project, or portion of such a project, for which the emergency procedures under section 105 are used on National Forest System land.</text></clause></subparagraph></paragraph>
<paragraph id="HF3CD2489CEFE4FCB90681E6FA3F0F0C7"><enum>(2)</enum><header>Period covered by review process</header><text display-inline="yes-display-inline">The review portion of the predecisional administrative review process described in paragraph (1)(B) shall occur during the period—</text>
<subparagraph id="H1C6FAEB67D71489E853B7B00A0995F71"><enum>(A)</enum><text display-inline="yes-display-inline">beginning on the date on which the Secretary of Agriculture makes a determination to use pre-approved management practices or emergency procedures under section 102(e); and</text></subparagraph>
<subparagraph id="HE2F29918DB5A413A87D61020001F6285"><enum>(B)</enum><text>ending not later than the date of the issuance of applicable decision document under section 104 or 105.</text></subparagraph></paragraph>
<paragraph id="H67C916174A8F47B28C8B395B7B80C4A5"><enum>(3)</enum><header>Effective date</header><text>The interim final regulations promulgated under paragraph (1) shall take effect on the date of promulgation of the regulations.</text></paragraph>
<paragraph id="H4B2062CD6EAF4E60861895288EDC4267"><enum>(4)</enum><header>Final regulations</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall promulgate final regulations to establish the predecisional administrative review process described in paragraph (1) as soon as practicable after the interim final regulations have been promulgated and a reasonable period of time has been provided for public comment.</text></paragraph></subsection>
<subsection id="HC79218D82D36492FB52271A3D818174"><enum>(c)</enum><header>Judicial review</header><text display-inline="yes-display-inline">Section 106 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6516">16 U.S.C. 6516</external-xref>) shall apply with respect to the implementation of a pre-approved management practice under section 104 or a catastrophic event recovery project or catastrophic event research project regarding which the applicable administrative review process has been exhausted. In any proceeding for judicial review of agency action under this subsection, attorney fees awarded to a prevailing party may not exceed the hourly rates established in <external-xref legal-doc="usc" parsable-cite="usc/18/3006A">section 3006A</external-xref> of title 18, United States Code.</text></subsection></section>
<section id="H423A5CA5A3694D499C56725B7577F99B"><enum>107.</enum><header>Guidance regarding reforestation in response to catastrophic events</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary concerned shall—</text>
<paragraph id="HEB8F8F7F27AE48108BB01F006625634E"><enum>(1)</enum><text display-inline="yes-display-inline">standardize the collection, reporting, and review procedures for data regarding more aggressive, expedited, and comprehensive reforestation in response to catastrophic events by clarifying agency-wide guidance and developing standard protocols for determining when and how reforestation can be best achieved as part of the response to catastrophic events;</text></paragraph>
<paragraph id="HE86DA10DC4554510855F7D26D217B35E"><enum>(2)</enum><text display-inline="yes-display-inline">clarify agency-wide guidance regarding reforestation in response to catastrophic events to ensure that such guidance is consistent with agency goals and budget constraints; and</text></paragraph>
<paragraph id="H1CE42FB7E052410A8D52A588200B9A9"><enum>(3)</enum><text display-inline="yes-display-inline">clarify agency-wide guidance regarding the development, during the revision of a land and resource management plan, of goals and objectives for catastrophic event recovery to ensure that such guidance addresses catastrophic event recovery objectives, by forest type or plant association group, related to standing- and down-dead wood, soil and watershed protection, wildlife habitat, and other resource values.</text></paragraph></section>
<section id="H03CC4E1802C64B24A55677F092F8AC27"><enum>108.</enum><header>Effect of title</header>
<subsection id="H14D3750FCFA84986006D5D25D282F695"><enum>(a)</enum><header>Use of other authorities</header><text display-inline="yes-display-inline">Nothing in this title affects the use by the Secretary concerned of other statutory or administrative authority, including categorical exclusions adopted to implement the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), to conduct a catastrophic event recovery project or catastrophic event research project, or portion of such a project, that is not conducted using the emergency procedures authorized by section 105.</text></subsection>
<subsection id="H6ABF539CEBF04625A95BABFB00C95C23"><enum>(b)</enum><header>Preference for local operators</header><text display-inline="yes-display-inline">In the manner provided in section 420 of the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/54">Public Law 109–54</external-xref>; 119 Stat. 553), the Secretary concerned may give consideration to local contractors in awarding a Federal contract to implement—</text>
<paragraph id="H34C2FF3BC9904A9D9D5901006E54A023"><enum>(1)</enum><text>a pre-approved management practice under section 104; or</text></paragraph>
<paragraph id="H8DF1C0B129524C6684E56B265D9EE352"><enum>(2)</enum><text display-inline="yes-display-inline">a catastrophic event recovery project or catastrophic event research project, or portions of such a project, for which the emergency procedures under section 105 are used.</text></paragraph></subsection>
<subsection id="HFE9CE14243034E0BBAAAED049D2008C"><enum>(c)</enum><header>Advisory committees</header><text display-inline="yes-display-inline">The <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) and title XVIII of the Food and Agriculture Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2281">7 U.S.C. 2281 et seq.</external-xref>) shall not apply to—</text>
<paragraph id="HEF5F228BFE644825B65923B2AD78035"><enum>(1)</enum><text display-inline="yes-display-inline">the peer review provided by scientific and land management experts under section 101(b) or 104(b);</text></paragraph>
<paragraph id="HEA7FD08DCDA64C6685CD564110158B05"><enum>(2)</enum><text>the monitoring process under section 104(h) or 105(f); and</text></paragraph>
<paragraph id="HF3EA3B2E22934799A55527C2CB045B26"><enum>(3)</enum><text>the preparation of a catastrophic event recovery evaluation or catastrophic event recovery proposal.</text></paragraph></subsection></section>
<section id="H499057DCBDE1413695754880A8056E74" display-inline="no-display-inline" section-type="subsequent-section"><enum>109.</enum><header>Standards for tree retention</header>
<subsection id="H57E665C132D34290BD9B5FDD2C9E8669"><enum>(a)</enum><header>Standing dead trees and downed wood</header><text display-inline="yes-display-inline">In planning or conducting any catastrophic event recovery project or catastrophic event research project, the Secretary concerned shall ensure that—</text>
<paragraph id="H62CC73134D264931AFD4C5927E9664A6"><enum>(1)</enum><text display-inline="yes-display-inline">standing dead tree and downed wood retention guidelines contained in the applicable land and resource management plan are applied; or</text></paragraph>
<paragraph id="H2545E83D35024FE8A0CDAA8D809EF9BD"><enum>(2)</enum><text display-inline="yes-display-inline">if the applicable land and resource management plan does not contain standing dead tree and downed wood retention guidelines, adequate standing dead trees and downed wood of the oldest age class are retained in the project area—</text>
<subparagraph id="HD987F702697E49D7B42BA075417D044C"><enum>(A)</enum><text>to provide habitat for associated species through various stages of forest development;</text></subparagraph>
<subparagraph id="HF3031E8EBB5B4191B0003C6B27BEEA88"><enum>(B)</enum><text>to provide a long-term nutrient source; and</text></subparagraph>
<subparagraph id="H3D25AF1523DA4FC5A4D7C5007E28008B"><enum>(C)</enum><text>to retain, to the extent practicable and appropriate for forest type and plant association group, the more decay-resistant species.</text></subparagraph></paragraph></subsection>
<subsection id="HED1477F43C104AB0B1998EC639D4E4C2"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">Subsection (a) shall not apply if the Secretary concerned determines that science from land-grant colleges and universities or a Forest Service Research Station provides more appropriate standing dead tree and downed wood retention guidelines for a particular catastrophic event recovery project or catastrophic event research project.</text></subsection>
<subsection id="H0B48FB19D96F415DB8114E6C19DA218B"><enum>(c)</enum><header>Plan amendment</header><text display-inline="yes-display-inline">The Secretary concerned may amend a land and resource management plan to incorporate standing dead tree and downed wood retention guidelines, specific to forest type or plant association group.</text></subsection></section></title>
<title id="HCAA28535C6FE4466B8C9D01EEB76227D"><enum>II</enum><header>Restoring Landscapes and Communities Impacted by Catastrophic Events</header>
<subtitle id="H2441A50751024807AD36183576AC1E00"><enum>A</enum><header>Cooperative Forestry Assistance Act of 1978</header>
<section id="HE41FC3601982451B8CFA92F8DD1778CC"><enum>201.</enum><header>Assistance under Cooperative Forestry Assistance Act of 1978 to restore landscapes and communities affected by catastrophic events</header>
<subsection id="HC29B528493414401BB274FAF6D6B00D6"><enum>(a)</enum><header>Assistance authorized</header><text display-inline="yes-display-inline">Section 10A of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2106c">16 U.S.C. 2106c</external-xref>) is amended—</text>
<paragraph id="H15C7074450B844B39183281F56248228"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph>
<paragraph id="H0B53C1A028A44C988E918D11576DC0C0"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection:</text>

<subsection id="H6B845214CEE846F9B8855CA9B49E78CD"><enum>(c)</enum><header>Response to catastrophic events affecting non-Federal lands</header><text></text>
<paragraph id="H86D3DDC017B0454C8EA9550666582466"><enum>(1)</enum><header>Landscape assessments</header><text display-inline="yes-display-inline">At the request of an eligible entity, the Secretary may cooperate with the eligible entity in the preparation of a landscape assessment for non-Federal lands affected by a catastrophic event. The Secretary may combine the preparation of a landscape assessment with the preparation of a catastrophic event recovery evaluation under title I of the Forest Emergency Recovery and Research Act regarding Federal land in the vicinity of the damaged non-Federal land.</text></paragraph>
<paragraph id="H8C8ED2527B0F4E5AB1B062B28D218EC"><enum>(2)</enum><header>Community assessments</header><text display-inline="yes-display-inline">At the request of an eligible entity affected by a catastrophic event, the Secretary may cooperate with the eligible entity in the preparation of a community wildfire protection plan or related plan.</text></paragraph>
<paragraph id="H2E13252F80F243FC8787A6B3C8C48F29"><enum>(3)</enum><header>Decision to provide assessment assistance</header><text display-inline="yes-display-inline">In response to the request of an eligible entity for assistance under paragraph (1) or (2), the Secretary shall make a decision, within 30 days after receiving the request, whether or not to provide such assistance. The decision rests in the sole discretion of the Secretary, but, if the Secretary rejects the request for assistance, the Secretary shall provide the eligible entity with an explanation of the reasons for the rejection.</text></paragraph>
<paragraph id="H255C0FEF934345C99CE7BDE515AACB" display-inline="no-display-inline"><enum>(4)</enum><header>Types of assistance</header><text>The Secretary concerned may provide technical and financial cost-share assistance to an eligible entity—</text>
<subparagraph id="H454E9FCFA6654CAC811C24F200392D5B"><enum>(A)</enum><text display-inline="yes-display-inline">to assist in the preparation of a landscape assessment under paragraph (1) or a community wildfire protection plan, community assessment, or community action plan under paragraph (2); and</text></subparagraph>
<subparagraph id="HAE2E400507BF469E8B9236FA7E070042"><enum>(B)</enum><text display-inline="yes-display-inline">to implement special recovery projects identified in the landscape assessment or community wildfire protection plan, community assessment, or community action plan.</text></subparagraph></paragraph>
<paragraph id="HE8A80D402D0346D6A5381CC04FA00A7" display-inline="no-display-inline"><enum>(5)</enum><header>Special recovery projects</header><text display-inline="yes-display-inline">Special recovery projects supported under paragraph (4)(B) may include projects involving—</text>
<subparagraph id="H6AB275FCDFBD443AB2890095E244A64E"><enum>(A)</enum><text display-inline="yes-display-inline">revegetation, tree planting, and other management practices the Secretary determines to be appropriate;</text></subparagraph>
<subparagraph id="H3CE674B337704C7E8CF3648818C139E2"><enum>(B)</enum><text display-inline="yes-display-inline">developing products from and markets for timber harvested in response to a catastrophic event and remaining forest resources;</text></subparagraph>
<subparagraph id="H87887DD4B8E344BA9C00622FFB2D4900"><enum>(C)</enum><text display-inline="yes-display-inline">training for the local populace for work in connection with catastrophic event recovery;</text></subparagraph>
<subparagraph id="H71B3CE5B01FD4F70A2FEA5AF7C62874C"><enum>(D)</enum><text>repair of forest roads, bridges, and trails and water supply areas affected by a catastrophic event; and</text></subparagraph>
<subparagraph id="H530AB4D6380D4918A2476EAA32DC58"><enum>(E)</enum><text>such other activities as the Secretary determines to be necessary to undertake the special recovery project.</text></subparagraph></paragraph>
<paragraph id="H1DE9164D56FC4843AEBD104881AF2157"><enum>(6)</enum><header>Additional funding sources</header><text>Amounts appropriated to the Secretary to carry out sections 8 and 10 may be used to provide assistance under this subsection.</text></paragraph>
<paragraph id="HE76AE9578ABF49BB9D65699FDA94443E"><enum>(7)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="H337682858357495FABBFAD53319DD3BE"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>eligible entity</quote> means a State Forester or equivalent State official, an Indian tribe, or local government. The term may include community-based organizations and other persons working in conjunction with a State Forester or equivalent State official, an Indian tribe, or local government.</text></subparagraph>

<section id="H2031A1FC9062479591B148D5654B96B6"><enum>211.</enum><header>Restoring landscapes</header>
<subsection id="H825247003B5C4DB6AAE5A5EB63526935"><enum>(a)</enum><header>Landscape assessments</header><text display-inline="yes-display-inline">At the request of an eligible entity, the Secretary of the Interior may cooperate with the eligible entity in the preparation of a landscape assessment for non-Federal lands affected by a catastrophic event. The Secretary may combine the preparation of a landscape assessment with the preparation of a catastrophic event recovery evaluation under title I regarding Federal land in the vicinity of the damaged non-Federal land.</text></subsection>
<subsection id="H3F9686DD87A14C218DCE06B6684650BB"><enum>(b)</enum><header>Decision to provide assessment assistance</header><text display-inline="yes-display-inline">In response to the request of an eligible entity for assistance under subsection (a), the Secretary of the Interior shall make a decision, within 30 days after receiving the request, whether or not to provide such assistance. The decision rests in the sole discretion of the Secretary, but, if the Secretary rejects the request for assistance, the Secretary shall provide the eligible entity with an explanation of the reasons for the rejection. </text></subsection>
<subsection id="H8F0B4BA316F34D92A036B7CB6EA314D5"><enum>(c)</enum><header>Types of assistance</header><text display-inline="yes-display-inline">The Secretary of the Interior may provide technical and financial cost-share assistance to an eligible entity—</text>
<paragraph id="H4AF93172B9244D05AE16E1D7CC0F118"><enum>(1)</enum><text display-inline="yes-display-inline">to assist in the preparation of a landscape assessment; and</text></paragraph>
<paragraph id="H45E86F5708574E1BBB974741E7DD055"><enum>(2)</enum><text>to implement special recovery projects identified in the landscape assessment.</text></paragraph></subsection>
<subsection id="H3039512BBDA54B84ACE8BDDDEDE84B1B"><enum>(d)</enum><header>Special recovery projects</header><text display-inline="yes-display-inline">The Secretary of the Interior may provide assistance under subsection (c)(2) for special recovery projects, including revegetation, tree planting, and other practices the Secretary determines to be appropriate.</text></subsection></section>
<section id="H6EB2F01322FD4FE4B2C068D1F24DF1D0"><enum>212.</enum><header>Restoring communities</header>
<subsection id="H7F55488BF1F24B04A61B05E2B3101C39"><enum>(a)</enum><header>Community assessments</header><text display-inline="yes-display-inline">At the request of an eligible entity affected by a catastrophic event, the Secretary of the Interior may cooperate with the eligible entity in the preparation of a community wildfire protection plan or related plan.</text></subsection>
<subsection id="HE21017AB890E4C3EAB8FE395D622D8A5" display-inline="no-display-inline"><enum>(b)</enum><header>Decision to provide assessment assistance</header><text display-inline="yes-display-inline">In response to the request of an eligible entity for assistance under subsection (a), the Secretary of the Interior shall make a decision, within 30 days after receiving the request, whether or not to provide such assistance. <paragraph id="H498007D9CD63481DB0A300D15076328D"><enum>(2)</enum><text display-inline="yes-display-inline">to implement special recovery projects identified in a community wildfire protection plan, a community assessment, or a community action plan.</text></paragraph></subsection>
<subsection id="H62FCD42CA7C94D43AF8BF615E966082"><enum>(d)</enum><header>Special recovery projects</header><text display-inline="yes-display-inline">Special recovery projects supported under subsection (c)(2) may include projects involving—</text>
<paragraph id="HDA2069E10D444AF1B8D8283802E53123"><enum>(1)</enum><text>developing products from and markets for timber harvested in response to a catastrophic event and remaining forest resources;</text></paragraph>
<paragraph id="HDFDDF59C75B94056872DDB4C794057BE"><enum>(2)</enum><text>training for the local populace for work in connection with catastrophic event recovery;</text></paragraph>
<paragraph id="H142F85E14AB84EA3860214DDBBDD4EFE"><enum>(3)</enum><text>repair of forest roads, bridges, and trails and water supply areas affected by a catastrophic event; and</text></paragraph>
<paragraph id="HD3F2E0E14FF749ADB13E13DBB8A1AF94"><enum>(4)</enum><text>such other activities as the Secretary determines to be necessary to undertake the special recovery project.</text></paragraph></subsection></section></subtitle></title>
<title id="H0FDFA872ABCC492ABFD245588D181EA5"><enum>III</enum><header>Experimental Forests</header>
<section id="H424C528DC279444AB06EDFE9B58EFE10"><enum>301.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="HB6AA7DE1696445E6B1EDB6FB4AB6EB4"><enum>(1)</enum><text display-inline="yes-display-inline">The experimental forests established pursuant to section 4 of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1643">16 U.S.C. 1643</external-xref>) or the organic administrative authorities of the Secretary of Agriculture (<external-xref legal-doc="usc" parsable-cite="usc/16/551">16 U.S.C. 551</external-xref>) serve as a natural laboratory for the Forest Service to evaluate management practices generally and specific responses to catastrophic events that can be eventually used throughout the National Forest System.</text></paragraph>
<paragraph id="H66FAA338BBD74C70BAC01997BD3040FF"><enum>(2)</enum><text display-inline="yes-display-inline">To build upon the knowledge base to be developed using catastrophic events research projects conducted under title I, the Secretary of Agriculture should be authorized to use the same authorities provided under sections 104 and 105 to design and carry out projects in the experimental forests.</text></paragraph></section>
<section id="HD69D7B63B6844FF8A57DC11BC3835BBA"><enum>302.</enum><header>Availability and use of pre-approved management practices on National Forest experimental forests</header><text display-inline="no-display-inline">Management practices included on the list of pre-approved management practices prepared under subsection (a) of section 104 may be implemented, in the manner provided by such section, in an experimental forest established pursuant to section 4 of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1643">16 U.S.C. 1643</external-xref>) or the organic administrative authorities of the Secretary of Agriculture (<external-xref legal-doc="usc" parsable-cite="usc/16/551">16 U.S.C. 551</external-xref>).</text></section>
<section id="H02157878A2334406AD202614A02251D4"><enum>303.</enum><header>Limited consideration of alternatives for projects on National Forest experimental forests</header><text display-inline="no-display-inline">Section 105(a) shall apply with respect to any individual activity or a series of activities proposed to be undertaken in an experimental forest established pursuant to section 4 of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1643">16 U.S.C. 1643</external-xref>) or the organic administrative authorities of the Secretary of Agriculture (<external-xref legal-doc="usc" parsable-cite="usc/16/551">16 U.S.C. 551</external-xref>).</text></section></title>
<title id="H7AEFF7CEAE5242A7823722CB9D67459E"><enum>IV</enum><header>General Provisions</header>
<section id="H7FA3D07721DE40B292D406CB0090AD20"><enum>401.</enum><header>Regulations</header><text display-inline="no-display-inline">Except as provided in section 106(b), the Secretary concerned is not required to promulgate regulations to implement this Act.</text></section>
<section id="H54E69569B99B49E184C4A15C80264483"><enum>402.</enum><header>Dedicated source of funds for research and monitoring</header>
<subsection id="H2E87E7026BD440C9001D82063BDD2147"><enum>(a)</enum><header>Special account</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall establish a special account in the Treasury for each Secretary concerned.</text></subsection>
<subsection id="H55699C0365B0434B9BCDC5854395D88"><enum>(b)</enum><header>Deposits</header><text display-inline="yes-display-inline">Ten percent of the gross proceeds derived by the Secretary concerned from catastrophic event recovery projects and catastrophic event research projects conducted by the Secretary concerned under title I shall—</text>
<paragraph id="H1E14707F45864C55AFE77DDD88AABBFB"><enum>(1)</enum><text>be deposited in the special account established for that Secretary; and</text></paragraph>
<paragraph id="H07BB41759EA24CE8862701B0BDBB64A6"><enum>(2)</enum><text display-inline="yes-display-inline">remain available, without further appropriation and until expended, for expenditure as provided in subsection (c).</text></paragraph></subsection>
<subsection id="H1F3E376D74244F0893AE1E07045F01BE"><enum>(c)</enum><header>Research-related use of special accounts</header><text display-inline="yes-display-inline">The Secretary concerned shall use amounts in the special account established for that Secretary—</text>
<paragraph id="HA755D3CDB28F48A889E05CD7F5DF9B44"><enum>(1)</enum><text>to develop research protocols under section 101; </text></paragraph>
<paragraph id="HC3CF31D07B2D42E996C5D001B5D9B4C"><enum>(2)</enum><text display-inline="yes-display-inline">to prepare and implement catastrophic event research projects; and</text></paragraph>
<paragraph id="HC5A1ED826EB042D58586D48354F61168"><enum>(3)</enum><text>to provide for monitoring under sections 104 and 105.</text></paragraph></subsection>
<subsection id="H5536E81064F847EFA5EF2EB5AFE435BC"><enum>(d)</enum><header>Relation to other funds</header><text display-inline="yes-display-inline">Amounts in the special account established for the Secretary concerned are in addition to other amounts available to that Secretary for the purposes described in subsection (c).</text></subsection></section>
<section id="H5E8CA666220D4470AD41889656E27D54"><enum>403.</enum><header>Other funding sources</header>
<subsection id="H3BFD51891EEB44C900381D22B67903AB"><enum>(a)</enum><header>Availability of knutson-vandenberg funds</header><text display-inline="yes-display-inline">Section 3 of the Act of June 9, 1930 (commonly known as the Knutson-Vandenberg Act; <external-xref legal-doc="usc" parsable-cite="usc/16/576b">16 U.S.C. 576b</external-xref>), is amended—</text>
<paragraph id="H678A5709DB8B409C90A8652D94E50013"><enum>(1)</enum><text>by striking <quote>Such deposits shall be covered</quote> and inserting the following:</text>
<quoted-block style="OLC" id="HEA22273D722B438196D947D23047A1DF" display-inline="no-display-inline">
<subsection id="H80F2A4822F1A4C8EAD4F77F5F516B2F9"><enum>(b)</enum><text display-inline="yes-display-inline">Amounts deposited under subsection (a) shall be covered</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H516BF77BCD304C00A4D8D5923358438F"><enum>(2)</enum><text>by inserting after <quote>national park.</quote> the following new sentence: <quote>The Secretary of Agriculture may also use excess amounts to cover the costs of activities of the Secretary under title I of the <short-title>Forest Emergency Recovery and Research Act</short-title>.</quote>; and</text></paragraph>
<paragraph id="HA5B2066FBB9F4111A621F227104B2869"><enum>(3)</enum><text>in subsection (c)—</text>
<subparagraph id="HE134A1305A26474591A1CD4F5BE6D132"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote>;</text></subparagraph>
<subparagraph id="H2B085F2E79464E598697EF3593E6EBD4"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph>
<subparagraph id="H4AD3F2A0CAF94B1792A0CB75BD8409AB"><enum>(C)</enum><text>by inserting after paragraph (1) the following new paragraph:</text>

<subsection id="H2A82FDCFF17E4BD7B0A06BC376CD95D3"><enum>(b)</enum><header>Availability of forest service salvage sale funds</header><text>Section 14(h) of the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a(h)</external-xref>) is amended—</text>
<paragraph id="H16A4E90BE3884FA5A92D20A55E000127"><enum>(1)</enum><text display-inline="yes-display-inline">in the fourth sentence, by inserting after <quote>the purposes for which deposited</quote> the following: <quote>and to cover the costs of activities of the Secretary under title I of the <short-title>Forest Emergency Recovery and Research Act</short-title></quote>; and</text></paragraph>
<paragraph id="HDEE39307F6E9408897A500C9AEAB2500"><enum>(2)</enum><text>in last proviso, by striking <quote>for which deposited on any national forest</quote> and inserting <quote>for which deposits of money are available under this subsection</quote>.</text></paragraph></subsection>
<subsection id="H953625ADA7AF4F65AE132746E7E5FC26"><enum>(c)</enum><header>Availability of BLM revolving fund derived from disposal of salvage timber</header><text display-inline="yes-display-inline">The first paragraph under the headings <quote><header-in-text level="subsection" style="OLC">Forest Ecosystems Health and Recovery</header-in-text></quote> and <quote><header-in-text level="paragraph" style="OLC">revolving fund, special account</header-in-text></quote> in title I of the Department of the Interior and Related Agencies Appropriations Act, 1993 (<external-xref legal-doc="public-law" parsable-cite="pl/102/381">Public Law 102–381</external-xref>; 106 Stat. 1376; <external-xref legal-doc="usc" parsable-cite="usc/43/1736a">43 U.S.C. 1736a</external-xref>), is amended by adding at the end the following new sentence: <quote>The money in this fund shall likewise be immediately available to cover the costs of activities of the Bureau of Land Management under title I of the <short-title>Forest Emergency Recovery and Research Act</short-title>.</quote>.</text></subsection></section>
<section id="HD7E980C167064EE5B0CFE1C00925B1D"><enum>404.</enum><header>Effect of declaration of major disaster or emergency</header>
<subsection id="H1FE44F613DE2492098DAAF95EBC866D"><enum>(a)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">If an area of non-Federal land damaged by a catastrophic event is also covered by a declaration by the President under section 401 or 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) that a major disaster or emergency exists, the Director of Federal Emergency Management Agency may use funds available for activities under that Act to reimburse the Secretary concerned for assistance in that area provided under—</text>
<paragraph id="H0F3EF0C8B64E4B389697D57CB9F6481"><enum>(1)</enum><text>subtitle B of title II; or</text></paragraph>
<paragraph id="H3602F8458DED4CAB80FD2F7D34AA8FD3"><enum>(2)</enum><text>subsection (c) of section 10A of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2106c">16 U.S.C. 2106c</external-xref>), as added by section 201.</text></paragraph></subsection>
<subsection id="H2CA067C4D98146DC9BF293BC6558A406"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">Reimbursements under subsection (a) shall be limited to those activities authorized under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122 et seq.</external-xref>) for which assistance under paragraph (1) or (2) of such subsection is provided. </text></subsection></section></title>
