<official-title>To amend the Internal Revenue Code of 1986 to waive the 10-percent additional tax on early distributions from section 401(k) plans in the case of hardship of certain employees due to facility closures, employers in bankruptcy, or plan termination proceedings.</official-title>

<section section-type="section-one" id="H77EB537AFBF84C2FA34794A44463BA00" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>401(k) Penalty Relief Act of 2005</short-title></quote>.</text></section> 
<section id="H491D76661D13489DA1CE07EA077D972"><enum>2.</enum><header>10-percent additional tax on early distributions from qualified retirement plans not to apply to certain hardship distributions from section <enum-in-header>401(k)</enum-in-header> plans</header> 
<subsection id="HD2E4761EBB7B44ED82B530E120D48B8B"><enum>(a)</enum><header>In General</header><text>Subparagraph (A) of <external-xref legal-doc="usc" parsable-cite="usc/26/72">section 72(t)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of clause (vi), by striking the period at the end of clause (vii) and inserting <quote>, or</quote>, and by adding at the end the following new clause:</text>

<clause id="H3FBBA26631554062A4EF342F7F40E444"><enum>(viii)</enum><text>made from a cash or deferred arrangement (as defined in section 401(k)) upon the hardship of the employee if the adjusted gross income of the taxpayer for the taxable year (determined without regard to such distributions) in which such distribution is received does not exceed $100,000 ($200,000 in the case of a joint return) and—</text> 
<subclause id="H37B73D8CF9C945D2A1F82657E24B69D3"><enum>(I)</enum><text>the employer maintaining the plan of which such arrangement is a part is a debtor in a title 11 or similar case (as defined in section 368(a)(3)),</text></subclause> 
<subclause id="H23AF35FDBAA5441B9E0007E870F141A7"><enum>(II)</enum><text>proceedings have been commenced under the Employee Retirement Income Security Act of 1974 to terminate such plan, or</text></subclause> 
<subclause id="H3102C25CF9E54A85928500A300B731CA"><enum>(III)</enum><text>the employee separates from employment on account of the closure of a facility of the employer.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H307B11017376434F8993BB9033913F92"><enum>(b)</enum><header>Effective Date</header><text>The amendment made by this section shall apply to distributions after the date of the enactment of this Act.</text></subsection></section>
