<section id="HF9D2681C30644513866104D216B761A8" section-type="section-one"><enum>1.</enum><header>Short title, findings, and purpose</header> 
<subsection id="HEAF1518A4A4842F5BE00685B41CAA822"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Rocky Flats Minerals Acquisition Act</short-title></quote>. </text></subsection> 
<subsection id="HE1FC24FB44C3483693EA96EA023FCD12"><enum>(b)</enum><header>Findings</header><text>The Congress finds the following:</text> 
<paragraph id="HA2770F6A2A274EF8AE3E00D955F5C070"><enum>(1)</enum><text>Pursuant to the Rocky Flats Wildlife Refuge Act of 2001 (subtitle F of <external-xref legal-doc="public-law" parsable-cite="pl/107/107">Public Law 107–107</external-xref>), upon completion of its cleanup and closure, the Rocky Flats Environmental Technology Site, located in Colorado, will be transferred to the Department of the Interior and managed as a unit of the National Wildlife Refuge System. </text></paragraph> 
<paragraph id="HACE9EC83972D4821AF5F34771CE436C5"><enum>(2)</enum><text>Acquisition by the United States of certain mineral rights associated with Rocky Flats is desirable in order to— </text> 
<subparagraph id="H7269565C4625483FB41B4D2431F7DA06"><enum>(A)</enum><text>further sound management of the site as a national wildlife refuge; and </text></subparagraph> 
<subparagraph id="HBD57EE6CC7614660B9A7154666105C3D"><enum>(B)</enum><text>reduce the long-term responsibility of the Department of Energy. </text></subparagraph></paragraph> 
<paragraph id="H24778DE6B1534D229382FE00E19332B"><enum>(3)</enum><text>The likelihood of acquiring such rights will be increased by providing the Secretary of the Interior additional methods for completion of the acquisition. </text></paragraph></subsection> 
<subsection id="H4E9F1DC9933441948F8FD5D2FE8794B2"><enum>(c)</enum><header>Purpose</header><text>The purpose of this Act is to authorize and facilitate acquisition of mineral and other rights associated with the Rocky Flats site. </text></subsection></section> 
<section id="H0B02844FAD4A403CA49085C9F60316D1"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H7F4CF1B001954F43A1EC37AE71F287ED"><enum>(1)</enum><header>Mineral rights</header><text>The term <term>mineral rights</term> means the right, title, and interest of parties other than the United States with respect to minerals located within the boundary of the Rocky Flats National Wildlife Refuge. </text></paragraph> 
<paragraph id="H33C13DFAA32745638DF0BE54009C9D39"><enum>(2)</enum><header>Fair market value</header><text>The term <term>fair market value</term> means the value of a mineral right, as determined by an appraisal performed by an independent, certified mineral appraiser under the Uniform Standards of Professional Appraisal Practice. </text></paragraph> 
<paragraph id="HC4652C134BA344618181F002EAE8CB1"><enum>(3)</enum><header>Natural resource damage liability claim</header><text display-inline="yes-display-inline">The term <term>natural resource damage liability claim</term> means a natural resource damage liability claim under subsections (a)(4)(C) and (f) of section 107 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9607">42 U.S.C. 9607</external-xref>) arising from hazardous substances releases at or from Rocky Flats that, as of the date of enactment of this Act, are identified in the administrative record for Rocky Flats required by the National Oil and Hazardous Substances Pollution Contingency Plan prepared under section 105 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605</external-xref>). </text></paragraph> 
<paragraph id="H6703D9DCD5904F2C99CCDE922D18FF42"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy. </text></paragraph> 
<paragraph id="H427B956331F54233B7F2E90E2E667CC"><enum>(5)</enum><header>Trustees</header><text>The term <term>Trustees</term> means the Federal and State officials designated as trustees under section 107(f)(2) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9607">42 U.S.C. 9607(f)(2)</external-xref>). </text></paragraph> 
<paragraph id="H55B6C941E1704307924CC12B03547C1B"><enum>(6)</enum><header>Rocky flats</header><text>The term <term>Rocky Flats</term> means the Department of Energy facility in the State of Colorado known as the <quote>Rocky Flats Environmental Technology Site</quote>. </text></paragraph> 
<paragraph id="H0DA2222BC3264F6A86907372E712FBDE"><enum>(7)</enum><header>Rocky flats national wildlife refuge</header><text>The term <term>Rocky Flats National Wildlife Refuge</term> has the same meaning as in the Rocky Flats National Wildlife Refuge Act (subtitle F of <external-xref legal-doc="public-law" parsable-cite="pl/107/107">Public Law 107–107</external-xref>). </text></paragraph></section> 
<section id="HCB05F5ECF2F441E78FCE6283B4B5C3C"><enum>3.</enum><header>Purchase of mineral rights</header> 
<subsection id="H622602BA5942464284005CAA880252C0"><enum>(a)</enum><header>Purchase of mineral rights</header> 
<paragraph id="H2A3C5AF4127B42030000D9DF516264EE"><enum>(1)</enum><header>In general</header><text>The Secretary may purchase mineral rights. </text></paragraph> 
<paragraph id="H9C320F2B3A614521B16D012D7F2078C"><enum>(2)</enum><header>Conditions</header><text>The Secretary shall not purchase a mineral right under paragraph (1) unless—</text> 
<subparagraph id="H6C6A4DBDACB641659D00D6DD3E9DA4C9"><enum>(A)</enum><text>the owner of the mineral right is a willing seller; and </text></subparagraph> 
<subparagraph id="HA91168AD0605459CA4F6443115D8D50"><enum>(B)</enum><text>the Secretary purchases the mineral right at fair market value. </text></subparagraph></paragraph></subsection> 
<subsection id="HBD294B4709D5409691D27232A8244720"><enum>(b)</enum><header>Consultation regarding priority</header><text>The Secretary shall consult with the Secretary of the Interior in order to identify which purchases of mineral rights should have the highest priority. </text></subsection> 
<subsection id="H2B04EA5E343D4B02A536E4B100C0ECE7"><enum>(c)</enum><header>Retention of minerals</header><text>Mineral rights purchased under this Act shall be retained by the United States, and are hereby withdrawn from disposal under the mining and mineral leasing laws of the United States. </text></subsection></section> 
<section id="HA1308D7CCD2C40F384DE3FE9CC38008E"><enum>4.</enum><header>Funding and release from liability</header> 
<subsection id="HD8E6D4C60FC24FDFA8ED4400FB972C08"><enum>(a)</enum><header>Funding</header><text>For the purpose of purchasing mineral rights under this Act, the Secretary may use—</text> 
<paragraph id="H9030256F399E4F75AD6757AC97A49B5D"><enum>(1)</enum><text>of the amounts appropriated to the Secretary for the Rocky Flats Environmental Technology Site during fiscal year 2006, $10,000,000; and </text></paragraph> 
<paragraph id="H5AFE0DD4E0804BFA812D0387CC00E457"><enum>(2)</enum><text>any other funds appropriated for such purpose. </text></paragraph></subsection> 
<subsection id="H10B88780F1184362A090EBCAFA20C5AB"><enum>(b)</enum><header>Release from liability</header><text display-inline="yes-display-inline">Notwithstanding any other law, any natural resource damage liability claim shall be considered to be satisfied by— </text> 
<paragraph id="HEAAA19BDF9914259BCC9E79599E07599"><enum>(1)</enum><text>the purchase by the Secretary of mineral rights for consideration in an amount equal to $10,000,000; </text></paragraph> 
<paragraph id="H12D367D1A8C34BC788D50C1088E4D87"><enum>(2)</enum><text>the payment by the Secretary to the Trustees of $10,000,000; or</text></paragraph> 
<paragraph id="H1791AD6C1AD3464488244965415665D9"><enum>(3)</enum><text>the purchase by the Secretary of any portion of mineral rights for— </text> 
<subparagraph id="HE5384D3D09B64D9F91E7FF6FADFEAB67"><enum>(A)</enum><text>consideration in an amount less than $10,000,000; and</text></subparagraph> 
<subparagraph id="H799DC4D88CA44826B856B07F91AE5BAC"><enum>(B)</enum><text>a payment by the Secretary to the Trustees of an amount equal to the difference between $10,000,000 and the amount paid under subparagraph (A).</text></subparagraph></paragraph></subsection> 
<subsection id="H5B639C14AF6A47E9BF69164974FB3780"><enum>(c)</enum><header>Use of funds</header> 
<paragraph id="HB48A1A4023CA421AB60676DB7909CCA4"><enum>(1)</enum><header>In general</header><text>Any amounts received by the Trustees under subsection (b) shall be used by the Trustees for the purposes described in section 107(f)(1) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9607">42 U.S.C. 9607(f)(1)</external-xref>), including—</text> 
<subparagraph id="H660592C8683F4C1798F9D65DBDB560D5"><enum>(A)</enum><text>the purchase of any additional Rocky Flats mineral rights that were not purchased by the Secretary under this subsection; and </text></subparagraph> 
<subparagraph id="H0F69626B776643E987F6F4933758F535"><enum>(B)</enum><text>the development of habitat restoration projects at Rocky Flats. </text></subparagraph></paragraph> 
<paragraph id="HF526686CB04945E58CB7371B75412506"><enum>(2)</enum><header>Condition</header><text>Any expenditure of funds under this paragraph shall be made jointly by the Trustees.</text></paragraph> 
<paragraph id="H90B5847C85E8463C8D70AB906089CD78"><enum>(3)</enum><header>Additional funds</header><text>The Trustees may use the funds received under subsection (b)(3) in conjunction with other private and public funds.</text></paragraph></subsection></section> 
<section id="HE4D62B0DF53C4AA3A6CAD33D9F7BAF7E"><enum>5.</enum><header>Transfer of management responsibilities for lands containing rocky flats minerals</header><text display-inline="no-display-inline">Notwithstanding the Rocky Flats National Wildlife Refuge Act (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/107">Public Law 107–107</external-xref>), administrative jurisdiction over lands in Rocky Flats where active development of mineral rights is occurring shall remain with the Secretary and shall not be transferred to the Secretary of the Interior until such time as mining has terminated and the lands have been reclaimed by the mineral rights holders in accordance with requirements established by the State of Colorado.</text></section> 
<section id="H6FD3005DD29B4353A74B799811F96DB5"><enum>6.</enum><header>Additional authority to acquire mineral interests</header><text display-inline="no-display-inline">Section 3174 of <external-xref legal-doc="public-law" parsable-cite="pl/107/107">Public Law 107–107</external-xref> (115 Stat. 1381) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H3102ED6A02FC4E8696A6C091D2ACE364" display-inline="no-display-inline"> 
<subsection id="H0204E9240DA14E599737DB49EDF6BA8"><enum>(g)</enum><header>Acquisition of Mineral interests and interests in lands or waters</header> 
<paragraph id="H43D536F706164B3484885254FEBE9EA5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Interior may acquire mineral interests, including interests in sand and gravel, and any other non-Federal interests in lands or waters, within Rocky Flats by—</text> 
<subparagraph id="H2F7B31A671D3464BB55026656F46F756"><enum>(A)</enum><text display-inline="yes-display-inline">purchase with funds available to the Secretary for such purpose;</text></subparagraph> 
<subparagraph id="HA815542131E5423AB75417497E9D00CF"><enum>(B)</enum><text>exchange under section 206 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>);</text></subparagraph> 
<subparagraph id="H93640C2428584C0BA004734548CBC516"><enum>(C)</enum><text>issuance of credits in an amount equal to some or all of the market value of the mineral or other interests acquired, with the concurrence of the person transferring such interests to the United States; or</text></subparagraph> 
<subparagraph id="H2839E10D48B4422E868DDF53A99BA10"><enum>(D)</enum><text display-inline="yes-display-inline">any combination of the means described in subparagraphs (A), (B), and (C).</text></subparagraph></paragraph> 
<paragraph id="HCCA78FEAAC2D458C80B9AFD20008BEEB"><enum>(2)</enum><header>Definition of credits</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>credits</quote> means appropriate legal instruments or other written documentation, or an entry in an account managed by the Secretary of the Interior, that can be used in lieu of any other monetary payment—</text> 
<subparagraph id="H9E7F77717E034A7F8576CBAC35BA2314"><enum>(A)</enum><text>for bonus bids for lease sales on the Outer Continental Shelf; or</text></subparagraph> 
<subparagraph id="H2A9B6827206F4C10919843B7E8FC9B9D"><enum>(B)</enum><text display-inline="yes-display-inline">for royalty due on oil or gas production under any lease of an area located on the Outer Continental Shelf outside the zone described in section 8(g)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(g)(2)</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H2C664519B3F44A80A4057866B5BEF419"><enum>(3)</enum><header>Transferability of credits</header><text display-inline="yes-display-inline">Any credits issued under this subsection shall be freely transferable to any other person, if the transferor notifies the Secretary of the Interior of the transfer by such method as the Secretary may specify.</text></paragraph> 
<paragraph id="H5305293566374A8982A9055400B067F5"><enum>(4)</enum><header>Expiration</header><text display-inline="yes-display-inline">Any credits issued under this subsection shall expire 10 years after the date on which they are issued.</text></paragraph> 
<paragraph id="H7C3F783EC4554EF3995506BEDAB04E7"><enum>(5)</enum><header>Acquisition through exchange</header> 
<subparagraph id="H20D980EE792D470FA31EF102D5BDFB7D"><enum>(A)</enum><header>Same-state restriction not applicable</header><text>The requirement under section 206(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>) that lands or interests exchanged under that section must be located in the same State shall not apply to land (or an interest in land) in Rocky Flats that is acquired by the United States in an exchange under that section.</text></subparagraph> 
<subparagraph id="HBF05577B109549DB8CFBE474AE3208A2"><enum>(B)</enum><header>Limitations</header> 
<clause id="H3D566DABE49A436FB585E2919BCEE48"><enum>(i)</enum><header>Suitability for disposal</header><text>Nothing in this subsection shall be construed as authorizing disposal of any public land or interest therein that has not been identified as suitable for disposal pursuant to section 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1713">43 U.S.C. 1713</external-xref>).</text></clause> 
<clause id="HB708067589E2484AB1384E6C9BFCBD86"><enum>(ii)</enum><header>Lands outside exterior boundaries</header><text display-inline="yes-display-inline">No lands (or interests therein) located outside the exterior boundaries of Rocky Flats may be acquired by the Federal Government for the purposes of this subtitle except with the consent of the owner thereof.</text></clause></subparagraph></paragraph> 
<paragraph id="HF20F8997B0294AD400A7F56EDE18FB64"><enum>(6)</enum><header>Management of acquired interests</header><text display-inline="yes-display-inline">Any interests acquired by the United States under this subsection shall be managed by the Secretary of the Interior under the standards that apply to the Rocky Flats National Wildlife Refuge. No minerals acquired under this subsection shall be subject to development or disposal by the United States or any other party under any law related to minerals owned by the United States.</text></paragraph> 
<paragraph id="HF2EFC671E7BD4BD0A420A6EC1EBFCA00"><enum>(7)</enum><header>Relation to other authority</header><text display-inline="yes-display-inline">The authorities provided to the Secretary of the Interior by this subsection are in addition to any other authority available to the Secretary with regard to acquisition of non-Federal interests located within Rocky Flats.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3817F6250F894EF8B4A2740491ED0000"><enum>7.</enum><header>Exemption</header><text display-inline="no-display-inline">No acquisition of mineral rights under this Act shall be considered to constitute a major Federal action significantly affecting the quality of the human environment for purposes of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></section>
