<section id="H83B49030EAE84F24807BAB1B00D7C6A5" section-type="section-one"><enum>1.</enum><header>Small business and agricultural producer energy emergency disaster loan program</header> 
<subsection id="H6E0114AAD64E43AD8842E5F617934946"><enum>(a)</enum><header>Small business producer energy emergency disaster loan program</header><text>Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HADD405C84B034EEF89F9C7FBEBC2AD39"><enum>(4)</enum><header>Energy emergency disaster loans</header> 
<subparagraph id="HF772796F68764EF79F3DAD6BB6E94500"><enum>(A)</enum><header>Authority</header><text>The Administrator may make or guarantee a loan to a small business concern that the Administrator determines has suffered or is likely to suffer substantial economic injury as a result of a significant increase in the price of heating oil, natural gas, gasoline, transportation fuel, propane, or kerosene. </text></subparagraph> 
<subparagraph id="H65985EAF4C0C4AF88F3C56E2F57C1331"><enum>(B)</enum><header>Interest rates</header><text>Any loan or guarantee extended pursuant to this paragraph shall be made at the same interest rate as an economic injury loan made or guaranteed under paragraph (2).</text></subparagraph> 
<subparagraph id="H07359737C4F9475E82F400B761C9F15D"><enum>(C)</enum><header>Limitation</header> 
<clause id="H127F059BF2BA49C6BC075FE3FA6ED75B"><enum>(i)</enum><header>In general</header><text>No loan may be made or guaranteed under this paragraph if the total amount outstanding and committed to the borrower under this subsection would exceed $1,500,000.</text></clause> 
<clause id="HE299FA4353094E8FB0A915E83F00018C"><enum>(ii)</enum><header>Exception</header><text>The Administrator may waive the limitation under clause (i) for a borrower if the Administrator determines that the borrower constitutes a major source of employment in its surrounding area.</text></clause></subparagraph> 
<subparagraph id="H71FFC8AA8CB34EE9B56FB82337A93306"><enum>(D)</enum><header>Declarations of disaster</header><text>No assistance shall be available under this paragraph unless—</text> 
<clause id="H6299DA311DBC43DB00010007E44D244"><enum>(i)</enum><text display-inline="yes-display-inline">the President or the Administrator has made a declaration of a disaster area by reason of a significant increase in the price of heating oil, natural gas, gasoline, transportation fuel, propane, or kerosene; or</text></clause> 
<clause id="HFC71AF56C5234CD6B079F838EB6183D0"><enum>(ii)</enum><text>the Governor of a State in which a significant increase in the price of heating oil, natural gas, gasoline, transportation fuel, propane, or kerosene has occurred certifies to the Administrator that small business concerns have suffered economic injury as a result of such increase and are in need of financial assistance that is not otherwise available on reasonable terms in that State.</text></clause></subparagraph> 
<subparagraph id="HB8FE3591B1484A08B232B24FF13539EA"><enum>(E)</enum><header>Conversion to renewable or alternative energy sources</header><text>Notwithstanding any other provision of law, a small business concern receiving a loan under this paragraph may use the loan to convert from the use of heating oil, natural gas, gasoline, propane, or kerosene to a renewable or alternative energy source, including agricultural and municipal solid waste, geothermal energy, cogeneration, solar energy, wind energy, or fuel cells.</text></subparagraph> 
<subparagraph id="HC2A2D1BF94C8486695EECC4F00CF732D"><enum>(F)</enum><header>Definitions</header><text>In this paragraph, the following definitions apply:</text> 
<clause id="H4EF3B5D698A14EE2A5BE6DFF4858CB9F"><enum>(i)</enum><text>The term <quote>base price index</quote> means the moving average of the closing unit price on the New York Mercantile Exchange for heating oil, natural gas, gasoline, transportation fuel, or propane for the 10 days, in each of the most recent 2 preceding years, which correspond to the trading days described in clause (ii).</text></clause> 
<clause id="H59ED805D3CE94680817B9BD21F221712"><enum>(ii)</enum><text>The term <quote>current price index</quote> means the moving average of the closing unit price on the New York Mercantile Exchange, for the 10 most recent trading days, for contracts to purchase heating oil, natural gas, gasoline, transportation fuel, or propane during the subsequent calendar month, commonly known as the <quote>front month</quote>.</text></clause> 
<clause id="H72A510BD19374EC6B8D73E1174C1DABD"><enum>(iii)</enum><text>The term <quote>significant increase</quote> means—</text> 
<subclause id="H5AA3567E62ED4FA6ABF39331F6A5BB8E"><enum>(I)</enum><text>with respect to the price of heating oil, natural gas, gasoline, transportation fuel, or propane, an increase of the current price index over the base price index by not less than 40 percent; and</text></subclause> 
<subclause id="HCE54CDE5274344129C29173CFA4D23F2"><enum>(II)</enum><text>with respect to the price of kerosene, any increase which the Administrator, in consultation with the Secretary of Energy, determines to be significant.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H563811DC2D6341E09C0025B3005884B8"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this Act shall apply with respect to economic injury suffered on or after the date of the enactment of this Act.</text></subsection></section>
