<section id="H9501B31759E2448AADCADE055C6F72B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Americans Safe Act of 2005</short-title></quote>.</text></section> 
<section id="H0526FC25ADA04424B46C47B3586F2FE1"><enum>2.</enum><header>Federal affirmation of State and local assistance in enforcement of Federal immigration laws</header> 
<subsection id="H40368C9D498D4D74AC39AFAF0079A1C7"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law and reaffirming the existing inherent authority of States, law enforcement personnel of a State or a political subdivision of a State have the inherent authority of a sovereign entity to investigate, apprehend, arrest, detain, or transfer to Federal custody aliens in the United States (including the transportation of such aliens across State lines to detention centers), in the course of carrying out their routine duties for the purpose of assisting in the enforcement of the immigration laws of the United States.</text></subsection> 
<subsection id="H5BE826AB09E04411813000A335CB6F1E"><enum>(b)</enum><header>Construction</header><text>Nothing in this section shall be construed to require law enforcement officers of a State or political subdivision of a State to—</text> 
<paragraph id="H1FFDC0C0CDE4416B92DF41F03936E2CB"><enum>(1)</enum><text>report the identity of victims of, or witnesses to, a criminal offense to the Secretary of Homeland Security; or</text></paragraph> 
<paragraph id="H5DCC9D9EE780418DB4005F9FF2D3A56B"><enum>(2)</enum><text>arrest such victims or witnesses for immigration violations.</text></paragraph></subsection></section> 
<section id="HF4BFA3E07B8C465BA37F13E8C89E693B"><enum>3.</enum><header>Listing of immigration violators in the National Crime Information Center (NCIC) database</header> 
<subsection id="H1C899A29A5CF4601AF6D67B744612361"><enum>(a)</enum><header>Provision of information to NCIC</header> 
<paragraph id="H52E108FAABB546E9AB5FB6BBD780957"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and continually thereafter, the Under Secretary for Border and Transportation Security of the Department of Homeland Security shall provide the National Crime Information Center of the Department of Justice with such information as the Under Secretary may have on—</text> 
<subparagraph id="H09A80AEE3AA449FDA306B2836517DBC3"><enum>(A)</enum><text>all aliens against whom a final order of removal has been issued;</text></subparagraph> 
<subparagraph id="H695C12AD13944F148C4B783721B8556B"><enum>(B)</enum><text>all aliens who have signed a voluntary departure agreement; and</text></subparagraph> 
<subparagraph id="H3C838EAB39BD4CA9B2DDD5371CA4F1C"><enum>(C)</enum><text>all aliens whose visas have been revoked.</text></subparagraph></paragraph> 
<paragraph id="HC5C3BC95DA324895A91DCCD85F2778D2"><enum>(2)</enum><header>Circumstances</header><text>The information described in paragraph (1) shall be provided to the National Crime Information Center regardless of whether—</text> 
<subparagraph id="H001046CC0B974B34B73D0928618B5305"><enum>(A)</enum><text>the alien received notice of a final order of removal; or</text></subparagraph> 
<subparagraph id="HB28C956A35564BB88D207BE8FBB67AC"><enum>(B)</enum><text>the alien has already been removed.</text></subparagraph></paragraph></subsection> 
<subsection id="HA5B88931286C4C7F943010FE075237DF"><enum>(b)</enum><header>Inclusion of information in NCIC database</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/534">Section 534(a)</external-xref> of title 28, United States Code, is amended—</text> 
<paragraph id="H135C4C0F7AAA49BEA7B2B1EFD3509824"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HBC5E0C16CADE41EE9E6C82FAB8343C3B"><enum>(2)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph> 
<paragraph id="H6E064F3DAF3E41DB91A987F21407A299"><enum>(3)</enum><text>by inserting after paragraph (3) the following:</text> 
<quoted-block id="H191041ECA7E947E881E74D343DAF0085" style="OLC"> 
<paragraph id="H7ECBD0B8BE2745EE8EB94B8BC92B1429"><enum>(4)</enum><text>acquire, collect, classify, and preserve records of violations of the immigration laws of the United States; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDB439BE8B01F48DABB8E994829D8578C"><enum>(c)</enum><header>Permission to depart voluntarily</header><text>Section 240B(a)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229c">8 U.S.C. 1229c(a)(2)(A)</external-xref>) is amended by striking <quote>120</quote> and inserting <quote>30</quote>.</text></subsection></section> 
<section id="H33E274242C7E48CBAFE8BFD46198DF6D"><enum>4.</enum><header>Federal custody of illegal aliens apprehended by State or local law enforcement</header> <text display-inline="no-display-inline">Section 241 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H0FEA82AEE9414233BF529EA699F85152" display-inline="no-display-inline"> 
<subsection id="HB8C0D890B8314933AD04C2018DA060B"><enum>(j)</enum><header>Custody of illegal aliens</header> 
<paragraph id="H4C463B3AEC3A4B5E95EBED2008DD15E6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the chief executive officer of a State or, if appropriate, a political subdivision of the State, exercising authority with respect to the apprehension of an illegal alien submits a request to the Secretary of Homeland Security that the alien be taken into Federal custody, the Secretary of Homeland Security—</text> 
<subparagraph id="HF8CADB6012FB43EBA7EC5F47EA7300A2"><enum>(A)</enum><text>shall—</text> 
<clause id="HC02955789F2A422E97E062063118268C"><enum>(i)</enum><text display-inline="yes-display-inline">not later than 48 hours after the conclusion of the State charging process or dismissal process, or if no State charging or dismissal process is required, not later than 48 hours after the illegal alien is apprehended, take the illegal alien into the custody of the Federal Government and incarcerate the alien; or </text></clause> 
<clause id="H0A3C407ADC1643E59F4157E45A9B2BC"><enum>(ii)</enum><text>request that the relevant State or local law enforcement agency temporarily incarcerate or transport the illegal alien for transfer to Federal custody; and</text></clause></subparagraph> 
<subparagraph id="H1EDED104982C4638A29C925CA4963BF7"><enum>(B)</enum><text display-inline="yes-display-inline">shall designate at least 1 Federal, State, or local prison or jail, or a private contracted prison or detention facility, within each State as the central facility for that State to transfer custody of the criminal or illegal alien to the Secretary of Homeland Security.</text></subparagraph></paragraph> 
<paragraph id="HCEF0B0726C924598945407086DCB8E93"><enum>(2)</enum><header>Reimbursement</header> 
<subparagraph id="H8E837A266FB04A0A0023E7ED0989CCDD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Department of Homeland Security shall reimburse States and political subdivisions for all reasonable expenses, as determined by the Secretary of Homeland Security, incurred by a State or political subdivision in the incarceration and transportation of an illegal alien as described in subparagraphs (A) and (B) of paragraph (1).</text></subparagraph> 
<subparagraph id="H4B91FABDE3A34D7F9F00EE02E3078B8B"><enum>(B)</enum><header>Cost computation</header><text display-inline="yes-display-inline">Compensation provided for costs incurred under subparagraphs (A) and (B) of paragraph (1) shall be the sum of—</text> 
<clause id="H2142EB0D0E704F08ACB36901238CF661"><enum>(i)</enum> 
<subclause id="HB54BC50350EF4307A2F574AA54E305D" display-inline="yes-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the average cost of incarceration of a prisoner per day in the relevant State, as determined by the chief executive officer of a State, or, as appropriate, a political subdivision of the State; multiplied by</text></subclause> 
<subclause id="H05CB4AEFA707485781C1E02231CE4F47" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">the number of days that the alien was in the custody of the State or political subdivision; and </text></subclause></clause> 
<clause id="HAD5F3BE5229C4E2288C2B82862F21603"><enum>(ii)</enum><text>the cost of transporting the criminal or illegal alien—</text> 
<subclause id="H5CA983248FE942B5BDAF1C1F01EA4EA7"><enum>(I)</enum><text>from the point of apprehension to the place of detention; and </text></subclause> 
<subclause id="H432F061D0B40436197B72C1538292BFB"><enum>(II)</enum><text>if the place of detention and place of custody are different, to the custody transfer point.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HC96BD03257354D5D92B7485CCC58CC79"><enum>(3)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out paragraph (2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H1144366125A84060B76E5C87E72E986"><enum>5.</enum><header>Felonies committed by illegal aliens</header> 
<subsection id="H1F7A4BE5D16B4C09A99E6E488CFDA4AF"><enum>(a)</enum><header>Offenses</header><text display-inline="yes-display-inline">Title 18, United States Code, is amended by inserting after chapter 51 the following new chapter:</text> 
<quoted-block style="USC" id="H1E44E51BB96F40F1A40618094D506420" display-inline="no-display-inline"> 
<chapter id="H9108497A1887467A8FD3A4E8256B000"><enum>52</enum><header>Enhanced penalties for felonies committed by illegal aliens</header></chapter> 
<section id="HBBDB6BF6549E4173891DA382FBD01E9"><enum>1131.</enum><header>Enhanced penalties for felonies committed by illegal aliens</header><text display-inline="no-display-inline">Whoever, being an alien who is unlawfully present in the United States, commits a felony shall be fined under this title and sentenced to not less than 5 years in prison. If the defendant was previously ordered removed under the Immigration and Nationality Act on the grounds of having committed a crime, the defendant shall be sentenced to not less than 15 years in prison. A sentence of imprisonment imposed under this section shall run consecutively to any other sentence of imprisonment imposed for any other crime.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAC85BA75A2074A2395CC25E190F10915"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of chapters at the beginning of part I of title 18, United States Code, is amended by inserting after the item relating to chapter 51 the following new item:</text>
