<official-title>To provide administrative subpoena authority to apprehend fugitives.</official-title>

<section id="HFE7D26F1B614428C88FCDD251ED1C967" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fugitive Apprehension Assistance Act of 2005</short-title></quote>.</text> </section> 
<section id="H9ACF64E2A9444346810088C91369B8F6"><enum>2.</enum><header>Administrative subpoenas to apprehend fugitives</header> 
<subsection id="H05455F79829B4F6A95E8671769C46662"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/49">Chapter 49</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="HCAF3A674FB99435EA818F7F59D955500"><enum>1075.</enum><header>Administrative subpoenas to apprehend fugitives</header> 
<subsection id="H715C88F7EBC349AAAC493BAE6659CAC2"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H8DADC09FD108487C9CBA1D3EA7216F81"><enum>(1)</enum><header>Fugitive</header><text>The term <quote>fugitive</quote>, inter alia, means a person who—</text> 
<subparagraph id="H13140DBE8A304D798F54FADC4E5C052"><enum>(A)</enum><text>having been accused of committing a felony by complaint, information, or indictment under Federal law or having been convicted of committing a felony under Federal law, flees or attempts to flee from or evades or attempts to evade the jurisdiction of the court with jurisdiction over the felony;</text></subparagraph> 
<subparagraph id="H372667C13398436680C6137F2694F4"><enum>(B)</enum><text>having been accused of committing a felony by complaint, information, or indictment under State law or having been convicted of committing a felony under State law, flees or attempts to flee from, or evades or attempts to evade, the jurisdiction of the court with jurisdiction over the felony;</text></subparagraph> 
<subparagraph id="H2E71A24E7509465DB3497DCDAE4E41C8"><enum>(C)</enum><text>escapes from lawful Federal or State custody after having been accused by complaint, information, or indictment or having been convicted of committing a felony under Federal or State law; or</text></subparagraph> 
<subparagraph id="HFB0CE7C141E24323B6C8ACEE420003F1"><enum>(D)</enum><text>is in violation of subparagraph (2) or (3) of the first undesignated paragraph of section 1073.</text></subparagraph></paragraph> 
<paragraph id="HD156ADC8320F4E0C8D4305899EC4BDD5"><enum>(2)</enum><header>Investigation</header><text>The term <quote>investigation</quote> means, with respect to a State fugitive described in subparagraph (B) or (C) in paragraph (1), an investigation in which there is reason to believe that the fugitive fled from or evaded, or attempted to flee from or evade, the jurisdiction of the court, or escaped from custody, in or affecting, or using any facility of, interstate or foreign commerce, or as to whom an appropriate law enforcement officer or official of a State or political subdivision has requested the Attorney General to assist in the investigation, and the Attorney General finds that the particular circumstances of the request give rise to a Federal interest sufficient for the exercise of Federal jurisdiction pursuant to section 1075.</text></paragraph> 
<paragraph id="H4E458EEAF0FC4889BE5D47FD5CF8AD60"><enum>(3)</enum><header>State</header><text>The term <quote>State</quote> means a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph></subsection> 
<subsection id="H7B0DCBC79C6449858D0265A5AD839336"><enum>(b)</enum><header>Subpoenas and witnesses</header> 
<paragraph id="HD18F721914734D9C8427D89F56CE3810"><enum>(1)</enum><header>Subpoenas</header><text display-inline="yes-display-inline">In any investigation with respect to the apprehension of a fugitive, the Attorney General may subpoena witnesses for the purpose of the production of any records (including books, papers, documents, electronic data, and other tangible and intangible items that constitute or contain evidence) that the Attorney General finds, based on articulable facts, are relevant to discerning the whereabouts of the fugitive. A subpoena under this subsection shall describe the records or items required to be produced and prescribe a return date within a reasonable period of time within which the records or items can be assembled and made available: <italic>Provided, however</italic>, That procedures other than subpoenas shall be used to obtain documents and information from Federal agencies.</text></paragraph> 
<paragraph id="H4D2BBD5D22734DB8ADCDD7B4B8D1D96"><enum>(2)</enum><header>Witnesses</header><text>The attendance of witnesses and the production of records may be required from any place in any State or other place subject to the jurisdiction of the United States at any designated place where the witness was served with a subpoena, except that a witness shall not be required to appear more than 500 miles distant from the person’s residence or from the place where the witness was served. Witnesses summoned under this section shall be paid the same fees and mileage that are paid witnesses in the courts of the United States.</text></paragraph> 
<paragraph id="HB95FCD2FE45C49B4A500238FA9CF5424"><enum>(3)</enum><header>Prohibitions</header><text>Nothing in this section shall require the attendance of witnesses or the production of records whose attendance or production is otherwise prohibited by law.</text></paragraph></subsection> 
<subsection id="H193F14729AC1413F8037781591AC9F86"><enum>(c)</enum><header>Service</header> 
<paragraph id="H4F55E9CDC3094E6BA00043AD8FA297CE"><enum>(1)</enum><header>Agent</header><text>A subpoena issued under this section may be served by any person designated in the subpoena as the agent of service.</text></paragraph> 
<paragraph id="H334F514EAC1243DE9CD01C42B9FAE907"><enum>(2)</enum><header>Natural person</header><text>Service upon a natural person may be made by personal delivery of the subpoena to that person or by certified mail with return receipt requested.</text></paragraph> 
<paragraph id="H48DB26D88EFC4859A94956F37564BBC5"><enum>(3)</enum><header>Corporation</header><text>Service may be made upon a domestic or foreign corporation or upon a partnership or other unincorporated association that is subject to suit under a common name, by delivering the subpoena to an officer, to a managing or general agent, or to any other agent authorized by appointment or by law to receive service of process.</text></paragraph> 
<paragraph id="HF822B8E1D68D49738193B824F305E4BF"><enum>(4)</enum><header>Affidavit</header><text>The affidavit of the person serving the subpoena entered on a true copy thereof by the person serving it shall be proof of service.</text></paragraph></subsection> 
<subsection id="H19621728B7A643EB89ADB5BEB93458AF"><enum>(d)</enum><header>Contumacy or refusal</header> 
<paragraph id="H8572E4357A57413589F4E270B970F36B"><enum>(1)</enum><header>In general</header><text>In the case of the contumacy by or refusal to obey a subpoena issued to any person, the Attorney General may invoke the aid of any court of the United States within the jurisdiction in which the investigation is carried on or of which the subpoenaed person is an inhabitant, or in which he carries on business or may be found, to compel compliance with the subpoena. The court may issue an order requiring the subpoenaed person to appear before the Attorney General to produce records if so ordered.</text></paragraph> 
<paragraph id="HA6185D23C8F24123AF44AE7F635DF8EF"><enum>(2)</enum><header>Contempt</header><text>Any failure to obey the order of the court may be punishable by the court as contempt thereof.</text></paragraph> 
<paragraph id="H9183CA390D84489592CCEFB892D9001C"><enum>(3)</enum><header>Process</header><text>All process in any case to enforce an order under this subsection may be served in any judicial district in which the person may be found.</text></paragraph> 
<paragraph id="H3AE611DB17D847189F65DE559D95002B"><enum>(4)</enum><header>Rights of subpoena recipient</header><text>Not later than 20 days after the date of service of an administrative subpoena under this section upon any person, or 10 days before the return date specified in the subpoena, whichever period is shorter, such person may file, in the district within which such person resides, is found, or transacts business, a petition to modify or quash such subpoena on grounds that—</text> 
<subparagraph id="H3BB0880746EC46B99F4BC174916000C"><enum>(A)</enum><text>the terms of the subpoena are unreasonable or unnecessary;</text></subparagraph> 
<subparagraph id="H3082D8924E374D5989B83044E919256E"><enum>(B)</enum><text>the subpoena fails to meet the requirements of this section; or</text></subparagraph> 
<subparagraph id="H15BC172415CC4DCC817697F4F661F3E"><enum>(C)</enum><text>The subpoena violates the constitutional rights or any other legal rights or privilege of the subpoenaed party.</text></subparagraph></paragraph></subsection> 
<subsection id="HACEADA6C85D144D89FBBB64C737EF00"><enum>(e)</enum><header>Guidelines</header> 
<paragraph id="H20BEB84FA8004CD7ADF0AD423962F2F4"><enum>(1)</enum><header>In general</header><text>The Attorney General shall issue guidelines governing the issuance of administrative subpoenas pursuant to this section.</text></paragraph> 
<paragraph id="H9441F12D0879480283524363F17BDD4"><enum>(2)</enum><header>Review</header><text>The guidelines required by this subsection shall mandate that administrative subpoenas may be issued only after review and approval of senior supervisory personnel, as determined by the Attorney General, of the relevant component of the Department of Justice, as the case may be.</text></paragraph></subsection> 
<subsection id="HF9FF9E11ECA547C6B3F5EE977018ADC6"><enum>(f)</enum><header>Delayed notice</header> 
<paragraph id="HE47E660AF93F4151B3C2B9A7BE712922"><enum>(1)</enum><header>In general</header><text>Where an administrative subpoena is issued under this section to a provider of electronic communication service, (as defined in section 2510 of this title) or remote computing service (as defined in section 2711 of this title), the Attorney General may—</text> 
<subparagraph id="H70267C86D419463E8D76438407D9CB2B"><enum>(A)</enum><text>In accordance with section 2705(a) of this title, delay notification to the subscriber or customer to whom the record pertains; and </text></subparagraph> 
<subparagraph id="HA21B4B2F29CA44679666D45104A8206E"><enum>(B)</enum><text>apply to a court, in accordance with section 2705(b) of this title for an order commanding the provider of electronic communication service or remote computing service not to notify any other person of the existence of the subpoena or court order.</text></subparagraph></paragraph> 
<paragraph id="H3155C10650EF402F9B658BA79D35DEFA"><enum>(2)</enum><header>Subpoenas for financial records</header><text>If a subpoena is issued under this section to a financial institution for financial records of any customer of such institution, the Attorney General may apply to a court under section 1109 of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3409">12 U.S.C. 3409</external-xref>) for an order to delay customer notice as otherwise required.</text></paragraph> 
<paragraph id="HE1AF89AABAF34181B8A0092EBD8A251"><enum>(3)</enum><header>Nondisclosure requirements</header> 
<subparagraph id="H2E43F54F3A2D4351B6B3D6152DD7BC9C"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in paragraphs (1) and (2), the court may require the party to whom an administrative subpoena is directed to refrain from notifying any other party or person of the existence of the subpoena for 30 days.</text></subparagraph> 
<subparagraph id="H8F8B2118B10D4839BE072CAE114045C5"><enum>(B)</enum><header>Extension</header><text>The Attorney General may apply to a court for an order extending the time for such period as the court deems appropriate.</text></subparagraph> 
<subparagraph id="H514EFE73E3694347AC6B4F079360C680"><enum>(C)</enum><header>Criteria for extension</header><text>The court shall enter an order under paragraph (2) if it determines that there is reason to believe that notification of the existence of the administrative subpoena will result in—</text> 
<clause id="H63EE8DDA2AB44554B6F9867B967FD82F"><enum>(i)</enum><text>endangering the life or physical safety of an individual;</text></clause> 
<clause id="HA33D11E53B654AEAAE003F38B8629BEF"><enum>(ii)</enum><text>flight from prosecution or custody or confinement after conviction; </text></clause> 
<clause id="HD6F2A27D07A84E2A9F1B35ED39B0F9C8"><enum>(iii)</enum><text>destruction or tampering with evidence;</text></clause> 
<clause id="H4EE07A83F71246B6A86E7988BCCC7802"><enum>(iv)</enum><text>intimidation of potential witnesses; or</text></clause> 
<clause id="H02405DCE077B456E8FD86214F8B14478"><enum>(v)</enum><text>otherwise seriously jeopardizing an investigation or undue delay in trial.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HBF55BAB0FC8B44A0A96C44205153DB00"><enum>(g)</enum><header>Immunity from civil liability</header><text>Any person including officers, agents, and employees, who in good faith produce the records or items required in a subpoena shall not be liable in any court of any State or the United States to any customer or other person for such production or for nondisclosure of that production to the customer, in compliance with the terms of a court order for nondisclosure.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H517480B99E0E48FAA52E1788337E9CEE"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/49">chapter 49</external-xref> of title 18, United States Code, is amended by adding at the end of the following:</text>
