<official-title>To expedite payments of certain Federal emergency assistance authorized pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act, and to direct the Secretary of Homeland Security to exercise certain authority provided under that Act.</official-title>

<section id="HA3302E26A68E4D0D80FCE17DC7BF0000" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Debris Removal Act of 2005</short-title></quote>.</text></section> 
<section changed="not-changed" id="HFA63BA1CBC784634B12FBB58E216FC19"><enum>2.</enum><header>Expedited payments</header> 
<subsection changed="not-changed" id="H3ADB84DB12404554A094F1ECC7FD62D9"><enum>(a)</enum><header>Expedited Payments Authorized</header><text>Notwithstanding the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) (including any regulation promulgated pursuant to that Act), the Secretary of Homeland Security, acting through the Director of the Federal Emergency Management Agency, shall pay to an eligible applicant, in accordance with subsection (b), 50 percent of the Federal share of assistance that the applicant is eligible to receive under section 407 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5173">42 U.S.C. 5173</external-xref>).</text></subsection> 
<subsection changed="not-changed" id="H1E7AE51929C04D15BE6D60EC87CC00AD"><enum>(b)</enum><header>Date of Payment</header><text>A claim described in subsection (a) shall be paid not later than 60 days after the date on which the applicant files an eligible claim for assistance.</text></subsection></section> 
<section changed="not-changed" id="HACFB2FFBAAD34C2ABDC46303DD4119A2"><enum>3.</enum><header>Debris clearance, removal, and disposal from emergency access roads</header> 
<subsection changed="not-changed" id="H98A93A75B8934FD48342524719FCE15E"><enum>(a)</enum><header>Definition of Emergency Access Road</header><text>In this section, the term <term>emergency access road</term> means a road that requires access by emergency personnel, including firefighters, police, emergency medical personnel, or any other entity identified by the Secretary of Homeland Security that provides an emergency service after a declaration of an emergency or major disaster (as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)).</text></subsection> 
<subsection changed="not-changed" id="HF94669C6564448A7A5C70398A29F525C"><enum>(b)</enum><header>Reimbursement Authorized</header><text>Any reimbursement authorized under section 407 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5173">42 U.S.C. 5173</external-xref>) for clearing and removing debris may include reimbursement for clearing, removing, and disposing of debris from any emergency access road.</text></subsection></section> 
<section changed="not-changed" id="H0683684EA1EC4624B834D8F1307F9880"><enum>4.</enum><header>Inclusion of debris removal as eligible claim for Federal assistance</header><text display-inline="no-display-inline">Section 408(c)(2)(A) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174(c)(2)(A)</external-xref>) is amended—</text> 
<paragraph changed="not-changed" id="HF1744C3E3A634BD9B618008CF5DBBFEC"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph changed="not-changed" id="H99652B55664849C585CDD2FAC8F9E1AA"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph changed="not-changed" id="H94A1609E9F914862994B849BB85DC53C"><enum>(3)</enum><text>by inserting after clause (ii) the following:</text> 
<quoted-block id="HB8C66906C9F44F908B559566AA22924" style="OLC"> 
<clause changed="not-changed" id="H6950A97D3A714B5000451491DE064FCC"><enum>(iii)</enum><text>the removal of debris and wreckage resulting from a major disaster from owner occupied private residential property, utilities, and residential infrastructure (such as a private access route) as necessary for a safe and sanitary living or functioning condition.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H6C87FF30D92E43489B6D7ED3E295D2C"><enum>5.</enum><header>Cost share</header><text display-inline="no-display-inline">For a period of not less than 180 days after the date of declaration of an emergency or major disaster (as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)) during the period beginning on August 25, 2005 through December 31, 2005, the Federal share of assistance provided to eligible applicants for debris removal under section 407 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5173">42 U.S.C. 5173</external-xref>) shall be 100 percent.</text></section> 
<section id="H23F6FA5C8A8E478E958304C6A6C85B9C"><enum>6.</enum><header>Guidelines for reimbursement</header><text display-inline="no-display-inline">In light of concerns regarding inconsistent policy memoranda and guidelines issued to counties and communities affected by the 2004 hurricane season, the Secretary of Homeland Security, acting through the Under Secretary for Emergency Preparedness and Response, shall provide clear, concise, and uniform guidelines for the reimbursement to any county or government entity affected by a hurricane of the costs of hurricane debris removal.</text></section> 
<section id="H9D81DAC8EFD34441009C8E48790042E3"><enum>7.</enum><header>Applicability; termination of authority</header><text display-inline="no-display-inline">This Act and the authority provided by this Act (including by any amendment made by this Act) shall—</text> 
<paragraph changed="not-changed" id="HE1FB984E0E564122B0F010E7AC14A47"><enum>(1)</enum><text>apply to each major disaster declared in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) during calendar year 2005; and</text></paragraph> 
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H3D23854F5C9744C1BFE6FE70E9E9D0D8"><enum>(2)</enum><text>terminate on the date that is 1 year after the date of enactment of this Act.</text></paragraph></section>
