<legis-type>A BILL</legis-type> 
<official-title>To amend the Trade Act of 1974 to extend the trade adjustment assistance program to the service sector, and for other purposes.</official-title> 
</form> 
<legis-body id="H9962AA499CAF45AAB8F1683FAE4B8D93" style="OLC"> 
<section id="H2D158C11562E4E44AF7434C94022BBA8" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trade Adjustment Assistance Improvement Act</short-title></quote>.</text></section> 
<section id="H5BA538FC3A3545C1996357C4D8B7A36C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress makes the following findings:</text> 
<paragraph id="H63D3070EB5344F3AB8E7566FD4279000"><enum>(1)</enum><text>Furthering trade and economic engagement with other nations is a necessary, but not sufficient, component of a long term strategy to grow the United States economy and promote American competitiveness in the global economy.</text></paragraph> 
<paragraph id="H41E0D8FD5CD14E52BEF3832498B9E720"><enum>(2)</enum><text>A comprehensive strategy for economic growth and competitiveness of the United States must—</text> 
<subparagraph id="H72FE7B85E1F1464B805FDC48CFFE00D1"><enum>(A)</enum><text>build a strong framework of rules for international trade;</text></subparagraph> 
<subparagraph id="H3512240253F748829F243CBA4F8414BE"><enum>(B)</enum><text>open substantial new markets for American goods, services, and farm products in order to level the playing field for American workers in all sectors of the economy; and</text></subparagraph> 
<subparagraph id="H023E99134BF14D5CB8BFCA5D9BF56B70"><enum>(C)</enum><text>establish a comprehensive framework to provide training and education to Americans throughout their lives so that they may take full advantage of the opportunities of the global economy and adjust to changing technological demands.</text></subparagraph></paragraph> 
<paragraph id="H0B04BA2EAE344982A52C01327594437B"><enum>(3)</enum><text>The Trade Adjustment Assistance program provided for under the Trade Act of 1974 forms a critical component of this comprehensive strategy for American competitiveness, by helping hard-working Americans transition to the global economy and adjust to economic changes resulting from the trade policy of the United States.</text></paragraph> 
<paragraph id="H9BF8A1F572D249159F413F0094EE97C4"><enum>(4)</enum><text>As currently structured, however, the Trade Adjustment Assistance program fails to ensure that all workers negatively affected by trade have access to the assistance they need to compete in the global economy, as service workers are excluded entirely from the program, a lack of adequate funding for training leaves many dislocated workers without timely access to the training they need to find jobs, and unnecessary and burdensome hurdles prevent eligible workers from gaining access to benefits for which they are eligible.</text></paragraph></section> 
<section id="HA9F6DB6E9EC2477BBA8EC6ED9C2E69F1"><enum>3.</enum><header>Extension of trade adjustment assistance to services sector</header> 
<subsection id="HBDB714FB95B94332B07D651C51851938"><enum>(a)</enum><header>Adjustment assistance for workers</header><text>Section 221(a)(1)(A) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271(a)(1)(A)</external-xref>) is amended by striking <quote>agricultural firm)</quote> and inserting <quote>firm, and workers in a service sector firm or subdivision of a service sector firm or public agency)</quote>.</text></subsection> 
<subsection id="H81336DA625E14261878F91729674F397"><enum>(b)</enum><header>Group eligibility Requirements</header><text>Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>) is amended—</text> 
<paragraph id="H70E2348826294234A01050D39B518061"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H2E9FA8BBBD344162879408004D38B756"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>agricultural firm)</quote> and inserting <quote>agricultural firm, and workers in a service sector firm or subdivision of a service sector firm or public agency)</quote>;</text></subparagraph> 
<subparagraph id="H57E69CDA2D21491AB0604FB0ADF763D"><enum>(B)</enum><text>in paragraph (1), by inserting <quote>or public agency</quote> after <quote>of the firm</quote>; and</text></subparagraph> 
<subparagraph id="H35F1DFAF4337413598F75DA92618152"><enum>(C)</enum><text>in paragraph (2)—</text> 
<clause id="H7A91E4D6CBCE44EEB26170C940A8A9F9"><enum>(i)</enum><text>in subparagraph (A)(ii), by striking <quote>like or directly competitive with articles produced</quote> and inserting <quote>or services like or directly competitive with articles produced or services provided</quote>; and</text></clause> 
<clause id="HD2E44B82B74D4A5FBFB8C696D9A29E40"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following:</text>

<clause id="HBF41AABF086F459FB008838059383CC4" display-inline="yes-display-inline"><enum>(i)</enum><text>there has been a shift, by such workers’ firm, subdivision, or public agency to a foreign country, of production of articles, or in provision of services, like or directly competitive with articles which are produced, or services which are provided, by such firm, subdivision, or public agency; or</text></clause> 
<clause id="H834998C41C9A4445A7BFB402A604D0F" indent="up1"><enum>(ii)</enum><text>such workers’ firm, subdivision, or public agency has obtained or is likely to obtain services described in clause (i) from a foreign country.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph> 
<paragraph id="HAE32597F0E7A4612AC6EDF0660C9654E"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H32C9B5700B5B4531893339BAD073CD8B"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>agricultural firm)</quote> and inserting <quote>agricultural firm, and workers in a service sector firm or subdivision of a service sector firm or public agency)</quote>;</text></subparagraph> 
<subparagraph id="H501CDA4924B0488EA5D73C4128534656"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>or service</quote> after <quote>related to the article</quote>; and</text></subparagraph> 
<subparagraph id="HCFE277435F534329A683DB47AFC41EF8"><enum>(C)</enum><text>in paragraph (3)(A), by inserting <quote>or services</quote> after <quote>component parts</quote>;</text></subparagraph></paragraph> 
<paragraph id="H1D0D677CCE85451F9BA1D6B122C1B4F1"><enum>(3)</enum><text>in subsection (c)—</text> 
<subparagraph id="HC59DD09091F34AF7881B6D31CC612117"><enum>(A)</enum><text>in paragraph (3)—</text> 
<clause id="H0591C69B05C34FA6B8E0232DF520D7A7"><enum>(i)</enum><text>by inserting <quote>or services</quote> after <quote>value-added production processes</quote>; </text></clause> 
<clause id="HA8C4BB16DA4C4605956C43F5355D4511"><enum>(ii)</enum><text>by striking <quote>or finishing</quote> and inserting <quote>, finishing, testing, packaging, or maintenance or transportation services</quote>; </text></clause> 
<clause id="H35DB31BC48ED45AAA2CD19D517B758ED"><enum>(iii)</enum><text>by inserting <quote>or services</quote> after <quote>for articles</quote>;</text></clause> 
<clause id="H31922B2ACC22401C9ED75526BEB71CC9"><enum>(iv)</enum><text>by inserting <quote>(or subdivision)</quote> after <quote>such other firm</quote>; and </text></clause> 
<clause id="H3E02A0FD228E43C2B6A2FBA10868D00"><enum>(v)</enum><text>by striking <quote>, if the certification</quote> and all that follows through <quote>Mexico</quote>; and</text></clause></subparagraph> 
<subparagraph id="H73B84F1044114BE2BEA780E6A4F393FC"><enum>(B)</enum><text>in paragraph (4)—</text> 
<clause id="H927CE7E3D8DC4B40AE3B845815F78F00"><enum>(i)</enum><text>by striking <quote>for articles</quote> and inserting <quote>, or services, for articles or services</quote>; and</text></clause> 
<clause id="HEB7B278528D5429A9DF9C8F4AD08F700"><enum>(ii)</enum><text>by inserting <quote>(or subdivision)</quote> after <quote>such other firm</quote>; and</text></clause></subparagraph></paragraph> 
<paragraph id="HFAF0091F19994251B7E895CAAAFE6D5"><enum>(4)</enum><text>by adding at the end the following new subsections:</text>

<subsection id="H1864878E80A04CC0BF5CCB08F92E9700"><enum>(d)</enum><header>Basis for Secretary’s determinations</header> 
<paragraph id="HF26CF5463B584E31A5464000C46F5686"><enum>(1)</enum><header>Increased imports</header><text>For purposes of subsection (a)(2)(A)(ii), the Secretary may determine that increased imports of like or directly competitive articles or services exist if the workers’ firm or subdivision, or customers of the workers’ firm or subdivision accounting for not less than 20 percent of the sales of the workers’ firm or subdivision, certify to the Secretary that they are obtaining such articles or services from a foreign country.</text></paragraph> 
<paragraph id="HEC6DCFF685204C978B759FE2C37101E8"><enum>(2)</enum><header>Obtaining services abroad</header><text>For purposes of subsection (a)(2)(B)(ii), the Secretary may determine that the workers’ firm, subdivision, or public agency has obtained or is likely to obtain like or directly competitive services from a foreign country based on a certification thereof from the workers’ firm, subdivision, or public agency.</text></paragraph> 
<paragraph id="H9E1AF89F8C1F4E2596DE41F029A7DD06"><enum>(3)</enum><header>Authority of the Secretary</header><text>The Secretary may obtain the certifications under paragraphs (1) and (2) through questionnaires or such other manner as the Secretary determines is appropriate.</text></paragraph></subsection> 
<subsection id="HC15B24D7596F45EE00E71BD83C2C26B"><enum>(e)</enum><header>Additional information</header><text>In determining whether to certify a group of workers under subsection (a) or (b) pursuant to a petition filed under section 221, the Secretary should contact officials of firms and unions, employees, and any other persons, government agencies (whether Federal or State), or organizations, both public and private, as appropriate, in order to confirm information furnished in the petition and to elicit other relevant information.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB7C2208AEB6545A79CB31EE3337E726"><enum>(c)</enum><header>Training</header> 
<paragraph id="H8ECCCD153DE749CF00383C36969EFFAD"><enum>(1)</enum><header>Funding</header><text>Section 236(a)(2)(A) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2296">19 U.S.C. 2296(a)(2)(A)</external-xref>) is amended by striking <quote>for any fiscal year shall not exceed $220,000,000.</quote> and inserting </text> 
<quoted-block style="OLC" id="H5A21C0C4907445E88D5663034C10331B" display-inline="yes-display-inline"><text display-inline="yes-display-inline">shall not exceed—</text> 
<clause id="H5A993D3DE9D0456F00F3B4F3C00694B" indent="up2"><enum>(i)</enum><text>$440,000,000 in each of fiscal years 2006 and 2007;</text></clause> 
<clause id="HA6DD9FC8360348FAADDC2002E65E2EFC" indent="up2"><enum>(ii)</enum><text>$484,000,000 in fiscal year 2008;</text></clause> 
<clause id="H1407175B14394F6C9DA0C122F9BF594" indent="up2"><enum>(iii)</enum><text>$528,000,000 in fiscal year 2009;</text></clause> 
<clause id="H8B67905B90044040B7C6D2B7B9008E68" indent="up2"><enum>(iv)</enum><text>$572,000,000 in fiscal year 2010;</text></clause> 
<clause id="H8FB48D2789394BF0928F00A9AADCD5A1" indent="up2"><enum>(v)</enum><text>$616,000,000 in fiscal year 2011; and</text></clause> 
<clause id="H099A7738C96346FE9BE200EE8DF451F2" indent="up2"><enum>(vi)</enum><text>$660,000,000 in fiscal year 2012.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H34749B22FE8B4B4D8151EE3EB6DCD4AF"><enum>(2)</enum><header>Report on allocation of training funds</header><text display-inline="yes-display-inline">The Comptroller General shall, not later than 6 months after the date of the enactment of this Act, evaluate and report to the Congress on the effectiveness of the mechanism for allocating training funds between the States and among individuals under section 236(a)(2) of the Trade Act of 1974. The report shall contain—</text> 
<subparagraph id="H389BD7A1C0EA40B58DFF73CDD89E523C"><enum>(A)</enum><text>an evaluation of the adequacy of total funding for training of adversely affected workers eligible for trade adjustment assistance under chapter 2 of title II of the Trade Act of 1974, and the extent to which the allocation mechanism provides States and individuals with sufficient training funds to meet the needs of all such eligible workers; and</text></subparagraph> 
<subparagraph id="HFF18A0E9A42D4F3D965906B20055DF46"><enum>(B)</enum><text>recommendations for improving the allocation of training funds to States and individuals under section 236(a)(2) of the Trade Act of 1974.</text></subparagraph></paragraph></subsection> 
<subsection id="H3BCC3DE790E644559190BA1592E7851E"><enum>(d)</enum><header>Definitions</header><text>Section 247 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319</external-xref>) is amended—</text> 
<paragraph id="H748CCC0DB1214F1FB6A442ADE3BE0102"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HB38C52B773C2420BB5AC43B3DE2F8063"><enum>(A)</enum><text>by inserting <quote>or public agency</quote> after <quote>of a firm</quote>; and</text></subparagraph> 
<subparagraph id="H3A0222DF6904412AAC65E7D04F2B9382"><enum>(B)</enum><text>by inserting <quote>or public agency</quote> after <quote>or subdivision</quote>;</text></subparagraph></paragraph> 
<paragraph id="H497A890B000B402E999DE3AD00A4D5A2"><enum>(2)</enum><text>in paragraph (2)(B), by inserting <quote>or public agency</quote> after <quote>the firm</quote>; </text></paragraph> 
<paragraph id="H40DD62A81BD348A983A62D5463884593"><enum>(3)</enum><text>by redesignating paragraphs (8) through (17) as paragraphs (9) through (18), respectively; and</text></paragraph>

<subsection id="H5F0A383A1C11403A91D023B33D1C3D2"><enum>(e)</enum><header>Technical Amendment</header><text>Section 245(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2317">19 U.S.C. 2317(a)</external-xref>) is amended by striking <quote>, other than subchapter D</quote>.</text></subsection></section> 
<section id="H3736EFFECDDC47FE90DD86006E1E1225"><enum>4.</enum><header>Training</header> 
<subsection id="H4FA195369AF94C17AC0044F9A3881F7F"><enum>(a)</enum><header>Basis for waiver</header><text>Section 231(c)(1) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291(c)(1)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="H4B3C43610DB94042A3758BAA6BAA5400"><enum>(G)</enum><header>Advanced degree or certification</header><text>The worker possesses a postgraduate degree from an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965) or equivalent foreign institution, or has received an equivalent postgraduate certification in a specialized field, and there is a reasonable expectation of employment at equivalent wages in the foreseeable future.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H61B2DB70AA004A2FAB66035EADF0E2ED"><enum>(2)</enum><header>Health insurance</header><text>A worker described in subsection (c)(2) participating in the program established under subsection (a) is eligible to receive, for a period not to exceed 2 years, a credit for health insurance costs under <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection> 
<subsection id="H03E6D9F990E54DB3ADA4FC8150D16D00"><enum>(c)</enum><header>Eligibility</header><text>A group of workers certified under subchapter A as eligible for adjustment assistance under subchapter A is eligible for the alternative trade adjustment assistance program under this section. A worker in such a group may elect to receive benefits under the alternative trade adjustment assistance program if the worker—</text> 
<paragraph id="H24CAF49549984AC2BA63059478A4CA2"><enum>(1)</enum><text>obtains reemployment not more than 26 weeks after the date of separation from the adversely affected employment;</text></paragraph> 
<paragraph id="H1422DEEE016C4B4B82F7101FCC7FFA5"><enum>(2)</enum><text>is at least 50 years of age;</text></paragraph> 
<paragraph id="H1BAB9FBEED3A483796C6F002D4DA606"><enum>(3)</enum><text>earns not more than $50,000 each year in wages from reemployment;</text></paragraph> 
<paragraph id="H4461D527C38B497390F1C5234CFAB000"><enum>(4)</enum><text>is employed on a full-time basis as defined by State law in the State in which the worker is employed; and</text></paragraph> 
<paragraph id="H378DF1107D994E3482158BEAA9C4722C"><enum>(5)</enum><text>does not return to the employment from which the worker was separated.</text></paragraph></subsection> 
<subsection id="H76D6E48CFC074A51B49FD0BCAAC6B9D2"><enum>(d)</enum><header>Total amount of payments</header><text>The payments described in subsection (b)(1) made to a worker may not exceed $10,000 per worker during the 2-year eligibility period.</text></subsection> 
<subsection id="H5E8250B16F1C425BA00608362E21CF35"><enum>(e)</enum><header>Limitation on other benefits</header><text>Except as provided in section 238(a)(2)(B), if a worker is receiving payments pursuant to the program established under subsection (a), the worker shall not be eligible to receive any other benefits under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section>

<subparagraph id="H662587908EEC4ED8A83307DBBF7210AD" indent="up1"><enum>(C)</enum><text>Not later than 16 months after such date of enactment, the Secretary of Labor shall report to the Committee on Ways and Means of the House of Representatives, the Committee on Finance of the Senate, and any other committee of appropriate jurisdiction, on whether changes to eligibility requirements, benefits, or training funding should be made based on the data collected under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HD2234E5D7A6041B9A42F5C0561682F69"><enum>(2)</enum><header>Secretary of Commerce</header><text>Not later than 6 months after such date of enactment, the Secretary of Commerce shall, in consultation with the Secretary of Labor, conduct a study and report to the Congress on ways to improve the timeliness and coverage of data on trade in services, including methods to identify increased imports due to the relocation of United States firms to foreign countries, and increased imports due to United States firms obtaining services from firms in foreign countries.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<paragraph id="H5B57BBAD678C4901B425D31FA500074B"><enum>(1)</enum><header>In general</header><text>Upon the request of the President or the United States Trade Representative, or the resolution of either the Committee on Ways and Means of the House of Representatives or the Committee on Finance of the Senate, the Secretary shall promptly initiate an investigation under this chapter to determine the eligibility for adjustment assistance of—</text> 
<subparagraph id="H9A05F95EE34D4BD9B11B4DE8CBC6FBC6" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a group of workers (which may include workers from more than one facility or employer); or</text></subparagraph> 
<subparagraph id="H824D22D5860240A89531EF7439A0256F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">all workers in an occupation as that occupation is defined in the Bureau of Labor Statistics Standard Occupational Classification System.</text></subparagraph></paragraph> 
<paragraph id="HC76A0F7D6F6242FFB0901B959C02F8D8"><enum>(2)</enum><header>Publication</header><text display-inline="yes-display-inline">Upon making a determination of the eligibility for adjustment assistance under this chapter of a group of workers or all workers in an occupation, the Secretary shall promptly publish a summary of the determination, together with a summary of the basis for the determination, in the Federal Register and on the website of the Department of Labor.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H9B324B74350A4EE38D10369D89892FBB"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by inserting <quote>or a request or resolution filed under subsection (c),</quote> after <quote>paragraph (1),</quote>; and</text></paragraph>

<subsection id="HEA89B5F617294FB28BD5B02126EEFC3" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Applicable date</header><text display-inline="yes-display-inline">In this section, the term <term>applicable date</term> means—</text>

<section id="HCC941415B4A544B3B41C4E8E1EECE857"><enum>15.</enum><header>Trade Adjustment Assistance Advisor</header><text display-inline="no-display-inline">There is established in the Department of Labor an office to be known as the Office of the Trade Adjustment Assistance Advisor. The Office shall be headed by a Director appointed by the Secretary of Labor, who shall be responsible for the operation of a telephone hotline that workers, employers, and other entities may call to obtain information regarding eligibility criteria, procedural requirements, and benefits available under chapter 2 of title II of the Trade Act of 1974. The Director shall also coordinate with State agencies responsible for administering benefits under such chapter in order to ensure that the States are complying with their obligations under such chapter.</text></section> 
<section id="HCF26791BB68B429391A194A98F292400"><enum>16.</enum><header>Agreements with States</header><text display-inline="no-display-inline">Section 239(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2311">19 U.S.C. 2311(a)</external-xref>) is amended by striking <quote>and (4)</quote> and inserting <quote>(4) will use personnel standards on a merit basis in the administration of services and payment of benefits to adversely affected workers under this chapter, and (5)</quote>.</text></section> 
<section id="H0295A58C2D50462BB2019908C83161BF"><enum>17.</enum><header>GAO study</header><text display-inline="no-display-inline"> The Comptroller General shall, not later than 6 months after the date of the enactment of this Act, conduct, and submit to the Congress a report on, a study evaluating the extent to which—</text> 
<paragraph id="HB3B9F38CED764EB99B51152686928CF8"><enum>(1)</enum><text>States are meeting each of the obligations set forth in sections 239(f) and 221(a)(2)(A) of the Trade Act of 1974; and</text></paragraph> 
<paragraph id="H8A5897B4EF15496FBFEBBE7E7B9DCECE"><enum>(2)</enum><text>the Secretary of Labor is meeting each of the obligations set forth in section 225 of the Trade Act of 1974. </text></paragraph><continuation-text continuation-text-level="subsection">If the Comptroller General finds that any of the obligations referred to in paragraphs (1) and (2) are not being met, the Comptroller General shall include in the report an analysis of the reasons for such noncompliance.</continuation-text></section> 
<section commented="no" display-inline="no-display-inline" id="HAF046FB63EC0499AB097C938A9791DE2" section-type="subsequent-section"><enum>18.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary of the Treasury, the Secretaries of Agriculture and Labor, and the International Trade Commission may promulgate such regulations as may be necessary to carry out the amendments made by sections 3 through 16.</text></section> 
<section id="HBF3ACF9D0A9B441696891866E3FCC4DE" section-type="subsequent-section" display-inline="no-display-inline"><enum>19.</enum><header>Modifications relating to credit for health insurance costs of certain TAA and PBGC pension recipients</header> 
<subsection id="H3A8FCC670D8341689EB8AE4982CEB671"><enum>(a)</enum><header>Increase in credit percentage amount</header> 
<paragraph id="H869D3290BCDF4A42B04BE6DF7658743F"><enum>(1)</enum><header>In general</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>65 percent</quote> and inserting <quote>80 percent (100 percent in the case of the taxpayer’s first eligible coverage month)</quote>.</text></paragraph> 
<paragraph id="H2E1761737DA645A88EE88F12386F1636"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Subsection (b) of section 7527 of such Code is amended by striking <quote>65 percent</quote> and inserting <quote>80 percent (100 percent in the case of the taxpayer’s first eligible coverage month)</quote>.</text></paragraph></subsection>

<paragraph id="H5DD0E63B8EDA469F90B27557525C5A5"><enum>(1)</enum><header>In general</header><text>Subsection (c) of section 35 of such Code is amended by adding at the end the following new paragraph:</text>

<subparagraph id="H18E8652F9B0F4495A4A5C60718924335"><enum>(A)</enum><header>In general</header><text>The term <term>eligible individual</term> shall include any individual who is covered by a petition filed with the Secretary of Labor under section 221 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name>. This paragraph shall apply to any individual only with respect to months which—</text> 
<clause id="H38F5E7F1F8A24B4CB52CE462A95FAF4"><enum>(i)</enum><text>end after the date that such petition is so filed, and</text></clause> 
<clause id="HD287233BABEF4833B6FB00A4AB83EE76"><enum>(ii)</enum><text>begin before the earlier of—</text> 
<subclause id="HACB705DC2CFC4C57A84600D6FECAD2CD"><enum>(I)</enum><text>the end of the 90-day period beginning on the date that such petition is so filed,</text></subclause> 
<subclause id="HB75DED24604540B094B838E1059BBA2"><enum>(II)</enum><text>the date that the Secretary of Labor makes a final determination not to issue a certification with respect to such petition, or</text></subclause> 
<subclause id="H5E5CC7B5D3DA4DDC9165839617E718B"><enum>(III)</enum><text>the beginning of the first month that such individual is an eligible individual without regard to this paragraph.</text></subclause></clause></subparagraph> 
<subparagraph id="HDF6FECFC8D07476B86B0A9F2A18D0847"><enum>(B)</enum><header>Exception</header><text>If the Secretary, after consultation with the Secretary of Labor, determines that, at the time of the filing of such petition, there was not reasonable cause to believe that the petition would result in a certification by the Secretary of Labor, with respect to individuals covered by such petition—</text> 
<clause id="H64B79223A63E4A2EB9A221B8197C6935"><enum>(i)</enum><text>subparagraph (A) shall not apply to such individuals, and</text></clause> 
<clause id="HC04700718FF94ACAB022EBF5ACE209A7"><enum>(ii)</enum><text>in the case of any such individual on whose behalf a payment is made under section 7527 with respect to a month described in paragraph (1), the tax imposed under this subtitle for the taxable year of such individual which includes the date of such determination shall be increased by the amount of such payments.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5BBAC65CD6154D70909430D576A11DF"><enum>(2)</enum><header>Conforming amendments</header>

<subclause id="HA1241AD7B7454716B74D5724F0363C03"><enum>(I)</enum><text display-inline="yes-display-inline">the last day of the first month with respect to which such recipient becomes an eligible PBGC pension recipient, or</text></subclause>

<clause id="HDAC08717DBBC40E5BC7625B9823326B7"><enum>(ii)</enum><header>Definitions</header><text>The terms <term>TAA-eligible individual</term>, and <term>TAA-related loss of coverage</term> have the meanings given such terms in section 2205(b)(4)(c).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA70EFFEE1EC441668900053E44F1C275"><enum>(g)</enum><header>Offering of National fallback coverage</header> 
<paragraph id="H1C1ED425533E49C08C80DDEB64380149"><enum>(1)</enum><header>Provision of fallback coverage</header><text>The Director of the Office of Personnel Management jointly with the Secretary of the Treasury shall establish a program under which eligible individuals (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35(c)</external-xref> of the Internal Revenue Code of 1986) are offered enrollment under health benefit plans that are made available under FEHBP.</text></paragraph> 
<paragraph id="H85F86A929E814437BB5E2528E2600508"><enum>(2)</enum><header>Terms and conditions</header><text display-inline="yes-display-inline">The terms and conditions of health benefits plans under paragraph (1) shall be the same as the terms and coverage offered under FEHBP, except that the premium charged for such health benefit plans offered under such paragraph—</text> 
<subparagraph id="HC2B5D8D8AB014FCB9521E67D7831A772"><enum>(A)</enum><text display-inline="yes-display-inline">shall be equal to the full premium (including both employer and beneficiary share) charged for such coverage determined in the same manner, subject to subparagraph (B), it is determined for full-time employees; and</text></subparagraph> 
<subparagraph id="HF46C7DC0FAE7484C8F092BABB2278574"><enum>(B)</enum><text>shall be determined for the pool of individuals covered under this subsection, separately from the pool of individuals otherwise covered under FEHBP.</text></subparagraph></paragraph> 
<paragraph id="H6E7C568481894FAAA2D6340781E93F95"><enum>(3)</enum><header>Study</header><text>The Director of the Office of Personnel Management jointly with the Secretary of the Treasury shall conduct a study of the impact of the offering of health benefit plans under this subsection on the terms and conditions, including premiums, for health benefit plans offered under FEHBP and shall submit to Congress, not later than 2 years after the date of the enactment of this Act, a report on such study. Such report may contain such recommendations regarding the establishment of separate risk pools for individuals covered under FEHBP and eligible individuals covered this subsection as may be appropriate to protect the interests of individuals covered under FEHBP.</text></paragraph> 
<paragraph id="HF4A100ABF81648FAAE6E12003D5220E3"><enum>(4)</enum><header>FEHBP defined</header><text>For purposes of this subsection, the term <term>FEHBP</term> means the Federal Employees Health Benefits Program offered under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H53B25CE63B8C437E82A6AF63BA183CC3"><enum>(5)</enum><header>Conforming amendments</header> 
<subparagraph id="HDE4E066D3E7C4FBB8223A3E4CDEE93B2"><enum>(A)</enum><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35(e)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text>

<subparagraph id="H70BD397999D84AD6A9CD74862C543DC5"><enum>(K)</enum><text>Coverage under a health benefits plan offered under section 17(g) of the <short-title>Trade Adjustment Assistance Improvement Act</short-title>.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HB3DEC3F0937F4EE0BF78BB81C24FE44E" display-inline="no-display-inline" commented="no"><enum>(B)</enum><text>Section 173(f)(2)(A) of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2918">29 U.S.C. 2918(f)(2)(A)</external-xref>) is amended by adding at the end the following new clause:</text>

<clause id="HA28759259AEF4AA7BB0145006D5BDE2B"><enum>(xi)</enum><text>Coverage under a health benefits plan offered under section 17(g) of the <short-title>Trade Adjustment Assistance Improvement Act</short-title>.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="HDA87A90B9018471900E959CC2C459184"><enum>(h)</enum><header>Report to Congress</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary of the Treasury shall transmit to the Congress a report which includes the recommendations of the Secretary regarding increasing the number eligible individuals who are covered by qualified health insurance, including increasing such number by increasing the credit subsidy under <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35</external-xref> of the Internal Revenue Code of 1986 to make the premiums for such insurance more affordable. Terms used in this subsection which are defined in such section shall have the meaning given such terms by such section.</text></subsection> 
<subsection id="H54866619D2DB4C7DBAE0F4722BC473C7"><enum>(i)</enum><header>Effective date</header> 
<paragraph id="HE9D06FBDD6CE4D1CAFF62CD1F1844617"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by this section shall apply to months beginning after the date of the enactment of this Act in taxable years ending after such date.</text></paragraph> 
<paragraph id="H4355F74D83BE482B8600B7FC3353BFE9"><enum>(2)</enum><header>Grandfathering of individual coverage rules for current recipients</header><text>The amendments made by subsection (c) shall not apply with respect to any eligible individual (or qualifying family members with respect to such individual) for any month if such individual was an eligible individual for all previous months which began after the date of the enactment of this Act and was enrolled in coverage described in section 35(e)(1)(J) of such Code (as in effect immediately before the date of the enactment of this Act) for all such previous months.</text></paragraph></subsection></section>
