<official-title>To amend title 18, United States Code, to prohibit profiteering and fraud relating to relief or reconstruction efforts provided in response to a presidentially declared major disaster or emergency, and for other purposes.</official-title>

<section id="H47A6775D296145108C96B5923780CF79" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Disaster Profiteering Prevention Act of 2005</short-title></quote>.</text></section> 
<section id="HA1F1CC380B2041BD8836B5FDE617CFF3"><enum>2.</enum><header>Prohibition of profiteering</header> 
<subsection id="H2DF4412B1F6C429484AFF9592685F9E2"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/63">Chapter 63</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="H2DF19F4093034F08904223F5D98064F0"><enum>1351.</enum><header>Profiteering and fraud relating to relief or reconstruction efforts provided in response to a presidentially declared major disaster or emergency</header> 
<subsection id="HB85FBF174F5845BC8DF1A67337E382E6"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Whoever, in any matter involving a contract with the Federal Government for the provision of goods or services, directly or indirectly, in connection with relief or reconstruction efforts provided in response to a presidentially declared major disaster or emergency, knowingly and willfully—</text> 
<paragraph id="H00F27EE1B3F94002939D759ED5AD05A2"><enum>(1)</enum><text>executes or attempts to execute a scheme or artifice to defraud the United States;</text></paragraph> 
<paragraph id="H8D80B9680E28424E87E87F976145E1AB"><enum>(2)</enum><text>falsifies, conceals, or covers up by any trick, scheme, or device a material fact;</text></paragraph> 
<paragraph id="H0E655C6474B84B9B9E00019F3EB2EDE4"><enum>(3)</enum><text>makes any materially false, fictitious, or fraudulent statements or representations, or makes or uses any materially false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry; or</text></paragraph> 
<paragraph id="HD1F6DADBFBDE44FDAAFD96E65BDCA29"><enum>(4)</enum><text>materially overvalues any good or service with the specific intent to excessively profit from the federal disaster or emergency; shall be fined under subsection (b), imprisoned not more than 20 years, or both.</text></paragraph></subsection> 
<subsection id="HC383C9AA047D46E4A19479359D3B3818"><enum>(b)</enum><header>Fine</header><text>A person convicted of an offense under subsection (a) may be fined the greater of—</text> 
<paragraph id="HFD9E2A947F3F4BDE868700B52B24EFB2"><enum>(1)</enum><text>$1,000,000; or</text></paragraph> 
<paragraph id="H1F56D1ACB925415695833833DE808300"><enum>(2)</enum><text>if such person derives profits or other proceeds from the offense, not more than 3 times the gross profits or other proceeds.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2787004E7597416096B7ED9EF1016E4F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/63">chapter 63</external-xref> of title 18, United States Code, is amended by adding at the end the following new item:</text>

<section id="HBA19D3E151CF4E7000C7967917C9D402"><enum>3.</enum><header>Increased criminal penalties for engaging in Internet fraud during and relation to a presidentially declared major disaster or emergency</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1343">Section 1343</external-xref> of title 18, United States Code, is amended by inserting: <quote>occurs during and in relation to a presidentially declared major disaster or emergency, or</quote> after <quote>If the violation</quote>. </text> </section>
