<section id="H6E640FF8B23241418CD2C5FE66345D8C" section-type="section-one"><enum>1.</enum><header>Use of National Federal Write-In Absentee Ballot</header> 
<subsection id="HCF2CBD638EDB47E2B060CDD6DB51C3BE"><enum>(a)</enum><header>In General</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended—</text> 
<paragraph id="HCEEEE210143F47F4BB976C74F031B768"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306; and</text></paragraph> 
<paragraph id="H12BDD31587AB4DE4B3265FAA6CD48B7E"><enum>(2)</enum><text>by inserting after section 303 the following new section:</text>

<section id="HA600CE06020C4AF19F8EA5DF9F7EE09B"><enum>304.</enum><header>Use of National Federal write-in absentee ballot</header> 
<subsection id="H90521DBCC3CA4BE189BA31CBAF046495"><enum>(a)</enum><header>In General</header><text>Any person who is otherwise qualified to vote in a Federal election in a State shall be permitted to use the national Federal write-in absentee ballot prescribed by the Election Assistance Commission under section 247 to cast a vote in an election for Federal office.</text></subsection> 
<subsection id="HE082C0C12C0F434CB26816A178665B91"><enum>(b)</enum><header>Submission and processing</header> 
<paragraph id="H1E968025E21749CA98D41D0018C1EA5F"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this section, a national Federal write-in absentee ballot shall be submitted and processed in the manner provided under the standards prescribed by the Commission under section 247(b).</text></paragraph> 
<paragraph id="H2C9DB087234A406C83F8C9D1C14E1D1C"><enum>(2)</enum><header>Deadline</header><text>An otherwise eligible national Federal write-in absentee ballot shall be counted if postmarked or signed before the close of the polls on election day and received by the appropriate State election official on or before the date which is 10 days after the date of the election or the date provided for receipt of absentee ballots under State law, whichever is later.</text></paragraph></subsection> 
<subsection id="HC7922A703C5246409D70B9472BA1F964" display-inline="no-display-inline"><enum>(c)</enum><header>Special rules</header><text>The following rules shall apply with respect to national Federal write-in absentee ballots:</text> 
<paragraph id="H8631A66B37B340008DA61B256E9B3045"><enum>(1)</enum><text>In completing the ballot, the voter may designate a candidate by writing in the name of the candidate or by writing in the name of a political party (in which case the ballot shall be counted for the candidate of that political party).</text></paragraph> 
<paragraph id="H080CCB2133934DC89FA028271D46F2E"><enum>(2)</enum><text>In the case of the offices of President and Vice President, a vote for a named candidate or a vote by writing in the name of a political party shall be counted as a vote for the electors supporting the candidate involved.</text></paragraph> 
<paragraph id="H5D378445EA844620AADAF04F3569AF3B"><enum>(3)</enum><text>Any abbreviation, misspelling, or other minor variation in the form of the name of a candidate or a political party shall be disregarded in determining the validity of the ballot.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE101485F3640493D97CE70E84C4F9C2C" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming Amendment</header><text>Section 401 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511</external-xref>) is amended by striking <quote>and 303</quote> and inserting <quote>303, and 304</quote>.</text></subsection> 
<subsection id="HCC70EF7C4A6A4C1E85EFFB3602006DF3"><enum>(c)</enum><header>Clerical Amendment</header><text>The table of contents of the Help America Vote Act of 2002 is amended—</text> 
<paragraph id="H18E1813C840E46C589F521BD2000EAE4"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as relating to sections 305 and 306; and</text></paragraph> 
<paragraph id="H7F6883B61C944404A07B2F1CC7C67B93"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text>

<toc-entry level="section">Sec. 304. Use of national Federal write-in absentee ballot</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section> 
<section id="HA9AFEC3BF729402F9632C94302BA5B92" display-inline="no-display-inline"><enum>2.</enum><header>Establishment of Ballot and Standards</header> 
<subsection id="H4691546352A94B37BA9BF13E13D0655C"><enum>(a)</enum><header>In General</header><text>Subtitle C of title II of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15381">42 U.S.C. 15381 et seq.</external-xref>) is amended—</text> 
<paragraph id="H2C5837FD76BD47CC00999970EB9637E3"><enum>(1)</enum><text>by redesignating section 247 as section 248; and</text></paragraph> 
<paragraph id="H8649836C5C2340B900CFE5557BD1629F"><enum>(2)</enum><text>by inserting after section 246 the following new section:</text>

<section id="HF7391FA1246E499CB38D466388E50213"><enum>247.</enum><header>National Federal Write-In Absentee Ballot</header> 
<subsection id="H42918C6B03814AB992581F74CE2E511C"><enum>(a)</enum><header>Form of Ballot</header><text>The Commission shall establish a national Federal write-in absentee ballot (including a secrecy envelope and mailing envelope for such ballot) for use in elections for Federal office.</text></subsection> 
<subsection id="H13196298D7FA4DE1BC2447493C7E5FEB"><enum>(b)</enum><header>Standards</header><text>The Commission shall prescribe standards for—</text> 
<paragraph id="H4268DF6E230349098B109DC7F97DB77"><enum>(1)</enum><text>distributing the national Federal write-in absentee ballot, including standards for distributing such ballot through the Internet; and</text></paragraph> 
<paragraph id="H9DCEF3F60064482A92CCEADB6A1009C"><enum>(2)</enum><text>processing and submission of the national Federal write-in absentee ballot.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HED841664079144A7804553ABD000A200"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of contents of the Help America Vote Act of 2002 is amended—</text> 
<paragraph id="HE0F9EF8247414ECD9985DA16A3114500"><enum>(1)</enum><text>by redesignating the item relating to section 247 as relating to section 248; and</text></paragraph> 
<paragraph id="HEBA418EE43A64B368DA626DBC9B0725"><enum>(2)</enum><text>by inserting after the item relating to section 246 the following new item:</text>

<toc-entry level="section">Sec. 247. National Federal write-in absentee ballot</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H94A0E3495FE9456BB3EAEA14C3AC34AF"><enum>(c)</enum><header>Effective Date</header><text>The Election Assistance Commission shall establish a national Federal write-in absentee ballot under section 247(a) of the Help America Vote Act of 2002 (as amended by subsection (a)), and prescribe standards relating to the ballot under section 247(b) of such Act, not later than January 1, 2006.</text> </subsection></section>
