<official-title>To prohibit the sale of crude oil, gasoline, diesel fuel, natural gas, or petroleum distillates at an unjust or unreasonable price.</official-title>

<section id="H2644B6337B4F42EEA40333C32245B029" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Price Discipline Act of 2005</short-title></quote>.</text> </section> 
<section id="HA9699998174A41DEA7E0A8EDE5C7024C"><enum>2.</enum><header>Unjust or unreasonable fuel pricing</header> <text display-inline="no-display-inline">It shall be unlawful for any entity engaged in the petroleum or gasoline business to sell crude oil, gasoline, diesel fuel, natural gas, or petroleum distillates at an unjust or unreasonable price.</text></section> 
<section id="HBAC8AD77631545FC8C986F1C5935CE7F"><enum>3.</enum><header>Federal Trade Commission rulemaking</header><text display-inline="no-display-inline">Not later than 90 days after the the date of the enactment of this Act, the Federal Trade Commission shall promulgate any rules necessary to enforce this Act. Such rules shall establish what constitutes an unjust or unreasonable price for purposes of this Act. In promulgating such rule, the Commission shall consider the following factors:</text> 
<paragraph id="H7EF4704D759844C7906C48C2DAC29B3"><enum>(1)</enum><text>The relation of the price to the prevailing price of that commodity in the market in the same geographic region during the previous 12-month period.</text></paragraph> 
<paragraph id="H365C60921432483390894DA76F988D27"><enum>(2)</enum><text>Shipping, manufacturing, or other costs to the entity.</text></paragraph> 
<paragraph id="H409E5F89B6864425BB5EC52B4DAC44E1"><enum>(3)</enum><text>Whether there has been a national or regional disruption in the supply of the commodity.</text></paragraph> 
<paragraph id="H69F14726260D41B8BE9E0610DD965DC4"><enum>(4)</enum><text>Whether there is any indication of the entity taking unfair advantage of any circumstances.</text></paragraph></section> 
<section id="H36A2A417880B4A6EB6D206E926523D7"><enum>4.</enum><header>Enforcement by the Federal Trade Commission</header> 
<subsection id="H6FC4EB736CB44950AD807F315FD06B00"><enum>(a)</enum><header>Unfair and Deceptive Act or Practice</header><text>A violation of section 2 and the rules promulgated pursuant to this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></subsection> 
<subsection id="HD99E6BAD15244CD9941F88F400BF75CE"><enum>(b)</enum><header>Enforcement</header><text>The Federal Trade Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction as though all applicable terms and provisions of the Federal Trade Commission Act were incorporated into and made a part of this Act.</text></subsection> 
<subsection id="H3BE1AF47761C4B099F18F3009983DE42"><enum>(c)</enum><header>Priority of Enforcement Actions</header><text display-inline="yes-display-inline">In enforcing section 2, the Federal Trade Commission shall give priority to enforcement actions concerning any entity engaged in the petroleum or gasoline business earning profits in the refining, sale, exchange, or shipping of crude oil, gasoline, diesel fuel, natural gas, or petroleum distillates in excess of $500,000,000 per year.</text></subsection> 
<subsection id="H6A371618E9884701824702E01C3486A7"><enum>(d)</enum><header>civil Penalties</header><text display-inline="yes-display-inline">Consistent with section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>), an entity engaged in the petroleum or gasoline business that violates section 2 shall be subject to a fine of not more than $11,000 per violation.</text></subsection></section> 
<section id="HF6863119E9F7426C94C915A1443698F8"><enum>5.</enum><header>Criminal penalties</header><text display-inline="no-display-inline">Any person who violates section 2 shall be fined under title 18, United States Code—</text> 
<paragraph id="H21F48AF8D7D14DFF9C45B8B39BA8C86B"><enum>(1)</enum><text>if a corporation, not to exceed $100,000,000; or</text></paragraph> 
<paragraph id="H67740A1467C44C8583148DCE04C6907E"><enum>(2)</enum><text>if any other person, not to exceed $1,000,000, or imprisoned for not more than 10 years, or both.</text></paragraph></section> 
<section id="H2BF2C004E7A44BE2838F14CBFF7213E9"><enum>6.</enum><header>Definitions</header> 
<subsection id="H0C762335E66A412381AB667DDD30D9BF"><enum>(a)</enum><header>Entity</header><text>For the purpose of this Act, the term <quote>entity engaged in the petroleum or gasoline business</quote> means an individual or corporation engaged in the refining, sale, exchange, or shipping of crude oil, gasoline, diesel fuel, natural gas, or petroleum distillates.</text></subsection></section> 
<section id="HE13FA9B9C7BF49C886D79C9D8F357B71"><enum>7.</enum><header>Effect on other laws</header><text display-inline="no-display-inline">Nothing in this Act annuls, alters, or affects in any manner the meaning, scope, or applicability of the laws of any State or subdivision of a State relating to price gouging, except to the extent those laws are inconsistent with the provisions of this Act, and then only to the extent of the inconsistency.</text></section>
