<official-title>To direct the Secretary of Education to establish a Family Education Reimbursement Account Program to assist hurricane displaced students during the 2005–2006 school year, and for other purposes.</official-title>

<section id="HD07718379BD245E59B16E90051299600" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family Education Reimbursement Act of 2005</short-title></quote>.</text></section> 
<section id="H144232B297854C038D4047499BAF7145"><enum>2.</enum><header>Family Education Reimbursement Accounts</header> 
<subsection id="HF6D7514A72254A7CA818A7E566197F4"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Education, in consultation with the Secretary of Health and Human Services, shall—</text> 
<paragraph id="H74C8BB23DFC04AA481215DCAFB8C87"><enum>(1)</enum><text>establish a Family Education Reimbursement Account Program under which, at the direction of the parent of each displaced student who signs up under subsection (d), the Secretary provides reimbursement to enable the student or preschool-age child to attend the school or preschool program of his or her parent’s choice during the 2005–2006 school year;</text></paragraph> 
<paragraph id="H598C0D7ED058499C9BA73F8148B23C72"><enum>(2)</enum><text>of the amount available to carry out this section for fiscal year 2006, use not more than one third of one percent of such amount for administrative expenses, including outreach, support services, and dissemination of information; and</text></paragraph> 
<paragraph id="H1827303EE8C941E6BB50F56FF780A408"><enum>(3)</enum><text>contract with a nongovernmental entity to administer and operate the program.</text></paragraph></subsection> 
<subsection id="H558EC1AA157949F59401B558C8A68979"><enum>(b)</enum><header>Reimbursement</header> 
<paragraph id="H1C1A137618A84C37AAC015448D4C3542"><enum>(1)</enum><header>In general</header><text>In carrying out this section, the Secretary—</text> 
<subparagraph id="H4319378FB6AC4F92ADDB0056C0392AB"><enum>(A)</enum><text display-inline="yes-display-inline">shall allow the parent of the participating displaced student to select the school or preschool program to be attended by the student during the 2005–2006 school year;</text></subparagraph> 
<subparagraph id="H66469DFF71C3478A00E1C34008B28FC"><enum>(B)</enum><text>at the direction of the parent, shall provide reimbursement to that school or preschool program on a quarterly basis; and</text></subparagraph> 
<subparagraph id="H2B16F0018A1D4BB8ABB14D4102F89738"><enum>(C)</enum><text>in the case of a public school, may provide such reimbursement to the appropriate local fiscal agent for the school.</text></subparagraph></paragraph> 
<paragraph id="H2511A8A542334DDF8BC819C9C5FA7C72"><enum>(2)</enum><header>Amount</header><text>In providing reimbursement under paragraph (1), the Secretary shall—</text> 
<subparagraph id="H9C418705D07B442D8DD3003611417722"><enum>(A)</enum><text display-inline="yes-display-inline">determine the amount of reimbursement to a school or preschool program based on the number of weeks during which the participating displaced student attended the school or preschool program during the preceding quarter;</text></subparagraph> 
<subparagraph id="HB8D524C9447943D29D466BEEDF428376"><enum>(B)</enum><text>subject to subparagraph (C), provide the same amount of reimbursement to each school and preschool program for each week of attendance by one participating displaced student;</text></subparagraph> 
<subparagraph id="H492A7C7C027D4AAF8622F534CBF86EB6"><enum>(C)</enum><text>not provide reimbursement that exceeds the actual cost of the school for educating students, or the actual cost of the preschool program, for the same period for students who are not displaced students;</text></subparagraph> 
<subparagraph id="H323E11E063C64A75BB20566FE012F5AF"><enum>(D)</enum><text display-inline="yes-display-inline">not provide reimbursement of more than $6,700 on behalf of any student for the 2005–2006 school year; and</text></subparagraph> 
<subparagraph id="H902368B093DC40B5BD4977362224967C"><enum>(E)</enum><text display-inline="yes-display-inline">discontinue reimbursement once a displaced student returns to the school he or she attended prior to August 29, 2005.</text></subparagraph></paragraph> 
<paragraph id="H0AD8323D7D084ACAB01E6F1600163B96"><enum>(3)</enum><header>Use of funds</header><text display-inline="yes-display-inline">The Secretary may provide reimbursement under paragraph (1) on behalf of a displaced student only if the school or preschool program involved agrees—</text> 
<subparagraph id="H20BC89837A7E4DBBA0D293C2F5C922E"><enum>(A)</enum><text>to use the reimbursement for providing educational and other services to the displaced student; and</text> </subparagraph> 
<subparagraph id="H2DA73C144BBC4E9395459126C0D923BC"><enum>(B)</enum><text>not to use the reimbursement for the construction or renovation of facilities.</text></subparagraph></paragraph></subsection> 
<subsection id="H5F6CAC76E7634C4293043CA27EB2B499"><enum>(c)</enum><header>Accounting of funds</header><text>The Secretary shall provide an appropriate accounting of funds for each school or program that receives a payment on behalf of one or more participating displaced students under this section.</text></subsection> 
<subsection id="H208A914093844AE8B91C09876E40DA6F"><enum>(d)</enum><header>Registration</header> 
<paragraph id="H5027A23863874FE6B8592B1859782FA9"><enum>(1)</enum><header>In general</header><text>To seek to participate in the program under this section, the parent of a displaced student shall sign up by means of the Internet site, toll-free telephone number, or paper form developed under subsection (e).</text></paragraph> 
<paragraph id="H99577CEF69294B66AE66EB509807FF00" display-inline="no-display-inline"><enum>(2)</enum><header>Account numbers</header><text>Upon completion of registration for the program under this section—</text> 
<subparagraph id="H9A0402ED8976453CA279832F38DA3629"><enum>(A)</enum><text>the displaced student shall be assigned an account number; and</text></subparagraph> 
<subparagraph id="H2EADDFEB119747A59F1EAC4F086E7CD3"><enum>(B)</enum><text>the account number shall be made available to the parent of the student.</text></subparagraph></paragraph> 
<paragraph id="HF4E179ED6F5F45DAB2A4A4CA88DA475"><enum>(3)</enum><header>Families</header><text>If a parent has more than one child who is a displaced student—</text> 
<subparagraph id="H113320565C0247FBBB1CB767BC9843"><enum>(A)</enum><text display-inline="yes-display-inline">the parent shall be allowed to register each child under this subsection at the same time; and</text></subparagraph> 
<subparagraph id="H40CD460798F74BC5BD4E3992B1206DF1"><enum>(B)</enum><text>the same account number under paragraph (2) shall be provided to each child.</text></subparagraph></paragraph></subsection> 
<subsection id="H2B5843AC44E24766A9939356AD9046EE"><enum>(e)</enum><header>FERA system development and establishment</header> 
<paragraph id="H647AD908B6314EC9BB3124F61E32836B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop and implement a web-based system—</text> 
<subparagraph id="H6F0114632CE943EA003800D0004376BC"><enum>(A)</enum><text>to support the registration in the program under this section of displaced students by means of an Internet site, toll-free telephone number, or paper form; and</text></subparagraph> 
<subparagraph id="H3832643166254A9EAC408D46C8D0D451"><enum>(B)</enum><text>to facilitate the timely payment of funds from the accounts of families participating in the program under this section to the school or preschool program authorized to be reimbursed for educational and other services rendered.</text></subparagraph></paragraph> 
<paragraph id="H64DA960AB303461FBB281DFCBFD22200"><enum>(2)</enum><header>System requirements</header> 
<subparagraph id="H6FE078C82CE74F7E8D361D0065DC8F04"><enum>(A)</enum><header>Internet site; toll-free telephone number; paper form</header><text>The Internet site and toll-free telephone number developed pursuant to paragraph (1)—</text> 
<clause id="HED7099900B1048D8AD266137EA007C12"><enum>(i)</enum><text>shall be integrated with each other;</text></clause> 
<clause id="HC27A842EDEDE4EC7B83E1E4E8319E111"><enum>(ii)</enum><text>shall, with respect to the toll-free telephone number, not be fully automated;</text></clause> 
<clause id="H9389867B96DA4E7084352F8C664FC7BC"><enum>(iii)</enum><text>shall be operational not later than 2 weeks after the date of the enactment of this section;</text></clause> 
<clause id="HDF0711944C4D46D6933CF64EDA0DE59"><enum>(iv)</enum><text>shall include privacy controls, consistent with section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>);</text></clause> 
<clause id="H81F879A9D6534A168881AFC64E277472"><enum>(v)</enum><text>shall be accessible to participating displaced students and their parents for the purpose of determining—</text> 
<subclause id="H1BF8D6068B4248B9AC636141E203EE67"><enum>(I)</enum><text>the amount expended under this section on the student’s behalf to date; and</text></subclause> 
<subclause id="HA483091166A74DC8B003A07F0135DB2"><enum>(II)</enum><text>the amount remaining for expenditure under this section on the student’s behalf;</text></subclause></clause> 
<clause id="H08BD91D2C9F94A218610CFC5A3C1E9F9"><enum>(vi)</enum><text>shall be accessible to schools and preschool programs for the purpose of facilitating reimbursement under subsection (b);</text></clause> 
<clause id="H6AC232E661C1449C8843DEF6D5A1D633"><enum>(vii)</enum><text>shall support non-English speaking parents by providing information and registration in an understandable and uniform format and, to the extent practicable, in a language the parents can understand;</text></clause> 
<clause id="H41624FC6EE854C2AB7F5C6E7025B44E"><enum>(viii)</enum><text>may use existing Federal grant management and electronic payment systems;</text></clause> 
<clause id="H145031BC4BE84320B0A005AE2DF12C00"><enum>(ix)</enum><text>shall include information technology and other controls necessary to prevent fraud and overpayment, including mechanisms to validate family and school information; and</text></clause> 
<clause id="H94A03D2281DF4E628D00813D25129FEE"><enum>(x)</enum><text>shall provide technical support services (including support for registration and processing of accounts) to the families of participating displaced students and the schools and preschool programs in which the students are enrolled.</text></clause></subparagraph> 
<subparagraph id="HB288788F85074293B048EAB4A91F2348"><enum>(B)</enum><header>Payment system</header><text>The Secretary shall ensure that—</text> 
<clause id="H4A2732AE844E440F914C001B74D20900"><enum>(i)</enum><text>the payment system required to carry out this section is operational not later than 4 weeks after the date of the enactment of this section; and</text></clause> 
<clause id="H800741C9021E426AA5FDBF3BEFCC4584"><enum>(ii)</enum><text>the first disbursements under this section are made not later than 5 weeks after the date of the enactment of this section.</text></clause></subparagraph></paragraph> 
<paragraph id="H5B3CF2FA9A454C8692F105A76002B79"><enum>(3)</enum><header>Contractor requirements</header><text display-inline="yes-display-inline">The Secretary shall award the contract required by subsection (a)(3) to a nongovernmental entity that—</text> 
<subparagraph id="H273E95A2102742908452386BBD1B2462"><enum>(A)</enum><text>has experience meeting the requirements described in paragraph (2)(A);</text></subparagraph> 
<subparagraph id="H9E98D544CAF5443E837090AA728C8384"><enum>(B)</enum><text>demonstrates expertise in the development and operation of information technology infrastructures, including the manufacture and supply of hardware and software, information management, electronic fund transfer payment systems, and customer relations management and outreach;</text></subparagraph> 
<subparagraph id="HEC0EBB70384449219C302114C7C099AF"><enum>(C)</enum><text>demonstrates significant experience in the development, implementation, and technical support for payment management systems operated by agencies of the Federal Government, including the Department of Education and the Department of Health and Human Services; and</text></subparagraph> 
<subparagraph id="H4A9E9B4DE4544E7FAF003064BF31FDE8"><enum>(D)</enum><text>is based, and operates help desk services, in the United States.</text></subparagraph></paragraph></subsection> 
<subsection id="HA67F201FD5AA41E1AD737CDA5F007C3E"><enum>(f)</enum><header>Transferring students</header> 
<paragraph id="H2A6984E292D24DC28706004C0007C7AE"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary shall continue to provide reimbursement under this section on behalf of a participating displaced student who transfers to one or more schools or preschool programs during the 2005–2006 school year.</text></paragraph> 
<paragraph id="H440EEA9D5B8E4D44A1C49E36B2D1F747"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary shall not provide reimbursement under this section on behalf of a participating displaced student with respect to any school or preschool program which the student attends for less than 2 consecutive weeks during the 2005–2006 school year.</text> </paragraph></subsection> 
<subsection id="H394595A6A5874990BB58C6FD744B4C9D"><enum>(g)</enum><header>Additional amount for administrative expenses</header><text display-inline="yes-display-inline">In providing reimbursement to an entity under this section—</text> 
<paragraph id="H8C022A74FA814452B4169E7B04CC6765"><enum>(1)</enum><text>the Secretary shall include an additional amount equal to 1 percent of the total amount of such reimbursement to the entity for the purpose of defraying administrative expenses;</text></paragraph> 
<paragraph id="HABB45813151F494F8BCB747BDAB42F2E"><enum>(2)</enum><text>such additional amount shall not be counted for purposes of the maximum reimbursement amount specified in subsections (b)(2)(C) and (b)(2)(D); and</text></paragraph> 
<paragraph id="HD325EAC5FE21410EBB041CFF60D7F5C"><enum>(3)</enum><text>of the amount specified in subsections (b)(2)(C) and (b)(2)(D), 100 percent of such amount shall be made available to the school or preschool program.</text></paragraph></subsection> 
<subsection id="HC0705807F1C74DEFAEB035D26D9D6C8D" commented="no"><enum>(h)</enum><header>Procurement</header><text>For purposes of the contract required by subsection (a)(3), the following provisions of Federal acquisition law shall not apply:</text> 
<paragraph id="H071545E80F9A4B4E9D975F9534A292DE" commented="no"><enum>(1)</enum><text>Title III of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/251">41 U.S.C. 251 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HFB35EABD6E4248BBABEA81E63989D18" commented="no"><enum>(2)</enum><text>The Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HB0EF4F948041474F8BDDA78FA045061B" commented="no"><enum>(3)</enum><text>The Federal Acquisition Streamlining Act of 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/355">Public Law 103–355</external-xref>).</text></paragraph> 
<paragraph id="HEA351C830BDA4026901B70EF0674BA40" commented="no"><enum>(4)</enum><text>The Competition in Contracting Act.</text></paragraph> 
<paragraph id="H5BDE10A69A4747119F2D98AD86BE48FE" commented="no"><enum>(5)</enum><text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/35">chapter 35</external-xref> of title 31, relating to the procurement protest system.</text></paragraph> 
<paragraph id="HE5F4E95C5D5B4A28A785A43E953CDB7D" commented="no"><enum>(6)</enum><text>The Federal Acquisition Regulation and any laws not listed in paragraphs (1) through (5) providing authority to promulgate regulations in the Federal Acquisition Regulation.</text></paragraph></subsection> 
<subsection id="H598A35E8C6D747AE95F5E385F4BF3E5"><enum>(i)</enum><header>Audit</header><text>The Secretary may provide reimbursement under this section to a school or program on behalf of a displaced student only if the school or program agrees to allow the Secretary to conduct an audit to review and verify that the school or program is using the reimbursement in accordance with subsection (b)(3).</text></subsection> 
<subsection id="H0C7AB57BF6E449058C538BEC0412776D"><enum>(j)</enum><header>Nondiscrimination</header> 
<paragraph id="H803DE8B33FE2462EB82980CEE0173B48"><enum>(1)</enum><header>In general</header><text>The Secretary may provide reimbursement under this section to a school or preschool program only if the school or program agrees not to discriminate against participating displaced students (including applicants) on the basis of race, color, national origin, religion, or sex.</text></paragraph> 
<paragraph id="HEFD0F1020B8848F1ADCAE1D9E5CF1E4F"><enum>(2)</enum><header>Applicability and single sex schools, classes, or activities</header> 
<subparagraph id="H7D08B492D5E9430B8930FDB7049C2785"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the prohibition of sex discrimination in paragraph (1) shall not apply to a school or preschool program that is operated by, supervised by, controlled by, or connected to a religious organization to the extent that the application of paragraph (1) is inconsistent with the religious tenets or beliefs of the school or program.</text></subparagraph> 
<subparagraph id="H689A065104CA4E30BAF2C372E9E5EB39"><enum>(B)</enum><header>Single sex schools, classes, or activities</header><text>Notwithstanding paragraph (1) or any other provision of law, a parent may choose and a school may offer a single sex school, class, or activity.</text></subparagraph> </paragraph> 
<paragraph id="HBF3B8ABE3B7F4F9181D6A82E30BC8C88"><enum>(3)</enum><header>Children with disabilities</header><text>Nothing in this section may be construed to alter or modify the provisions of the Individuals with Disabilities Education Act.</text></paragraph> 
<paragraph id="H7EA41493C62247149CC66C02923F355F"><enum>(4)</enum><header>Religiously affiliated schools</header> 
<subparagraph id="H455EADDC33C748BABD2EBBCE7BDD8E57"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, a school or preschool program receiving reimbursement under this section that is operated by, supervised by, controlled by, or connected to, a religious organization may exercise its right in matters of employment consistent with title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-1">42 U.S.C. 2000e–1 et seq.</external-xref>), including the exemptions in such title.</text></subparagraph> 
<subparagraph id="H50A7AF8C021C4C97B9E1F0CC43BB1718"><enum>(B)</enum><header>Maintenance of purpose</header><text>Notwithstanding any other provision of law, funds made available under this section on behalf of participating displaced students that are received by a school or preschool program, as a result of their parents' choice, shall not, consistent with the first amendment of the United States Constitution, necessitate any change in the school or program's teaching mission, require any school or program to remove religious art, icons, scriptures, or other symbols, or preclude any school or program from retaining religious terms in its name, selecting its board members on a religious basis, or including religious references in its mission statements and other chartering or governing documents.</text></subparagraph></paragraph> 
<paragraph id="H9482035B3A204523A4A3F0C0AC344E96"><enum>(5)</enum><header>Rule of construction</header><text>Reimbursement (or any other form of support provided on behalf of participating displaced students) under this section shall be considered assistance to the student and shall not be considered assistance to the school or preschool program that enrolls the student.</text></paragraph></subsection> 
<subsection id="H6A4D63654B20412BBF5E76B2C9D23D64"><enum>(k)</enum><header>Reports</header><text>At the end of each quarter described in subsection (b)(2)(A), the Secretary shall submit a report to the appropriate committees of the Congress describing the implementation and results of the program under this section. Such report shall—</text> 
<paragraph id="H656D80AD0FEA45B8827258C9D0A2A89F"><enum>(1)</enum><text>specify the number of children served, the percentage of funds used on instructional activities, and the percentage of funds used for supplemental educational services; and</text></paragraph> 
<paragraph id="H4BABC7DAA514444B96576F8FBB262581"><enum>(2)</enum><text>include information on the mobility of displaced students.</text></paragraph></subsection> 
<subsection id="H1AFD8F7C7BE64E81AFF9C65CB3851B7D"><enum>(l)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HAC28E8EA8CCE4064B363D2558E00315B"><enum>(1)</enum><text>The term <term>displaced student</term> means a student who is at least 4 years old, has not completed 12th grade, and would have attended another school or preschool program during the 2005–2006 school year, but for the fact that—</text> 
<subparagraph id="HD230BB4E029C44A8A17E03F92C3F1DF"><enum>(A)</enum><text>the school, the program, or the surrounding area was damaged by a Gulf hurricane disaster; and</text></subparagraph> 
<subparagraph id="HA243537894A046E1A0AA6179D748D28B"><enum>(B)</enum><text>the school or program could not reopen shortly after the disaster.</text> </subparagraph></paragraph> 
<paragraph id="H42C3A259E8BC4D1EA4F100109888BF2B"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>Gulf hurricane disaster</term> means a major disaster that was declared to exist by the President, in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), and was caused by Hurricane Katrina or Hurricane Rita. </text></paragraph> 
<paragraph id="H1614963B08E845D7B77EE4C15F636552"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>parent</term> has the meaning given to that term in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> 
<paragraph id="H0531B80E80034322BE738ED0B0058E"><enum>(4)</enum><text>The term <term>participating displaced student</term> means a displaced student participating in the program under this section.</text></paragraph> 
<paragraph id="HF969EF03AA3C4307BA12667140494DD8"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>preschool program</term> means a public or private program serving 4 or 5 year old children, including any such Head Start program, that is in compliance with applicable State health and safety requirements.</text></paragraph> 
<paragraph id="H20EEB7313367476CAA6EA296701D6313"><enum>(6)</enum><text>The term <term>school</term> means a public or private elementary school or secondary school (as those terms are defined in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), including a religious elementary school or secondary school, that was legally operating in the State involved before September 1, 2005.</text></paragraph> 
<paragraph id="H315235CCC57A463484344C21A0FA6EFD"><enum>(7)</enum><text>The term <term>Secretary</term> means the Secretary of Education, in consultation with the Secretary of Health and Human Services.</text></paragraph> </subsection> 
<subsection id="H16E4C10C6D6C418A81DB33E8BDC314A2"><enum>(m)</enum><header>Funding</header> 
<paragraph id="H2AAD2EAD37184F0FAB1D12E772809B69"><enum>(1)</enum><header>In general</header><text>Out of funds not otherwise appropriated, there is hereby appropriated to the Secretary of Education, to carry out this section, $2,500,000,000, to remain available through the period ending on July 31, 2006. Any such funds that are not obligated by the end of such period shall revert to the Treasury.</text></paragraph> 
<paragraph id="H0F8B4DC04CB64EE3B05B5E004BB42764"><enum>(2)</enum><header>Contributions</header><text display-inline="yes-display-inline">Under such terms and conditions as the Secretary may impose, the Secretary may, for the purpose of carrying out this section, accept and use such amounts as may be contributed by individuals, business concerns, or other entities for such purpose.</text></paragraph></subsection></section>
