<official-title>To amend title 5, United States Code, to provide for portal-to-portal compensation for wildland firefighters, and for other purposes.</official-title>

<section section-type="section-one" id="HC547ADB646F94702BD56FBDCDAAFC9DC" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Wildland Firefighter Emergency Response Compensation Act of 2005</short-title></quote>.</text></section> 
<section id="H9D67BD8A1FA34709AB8D49FD6552E177"><enum>2.</enum><header>Portal-to-portal compensation</header> 
<subsection id="H7A29F85F9B6242CC9F8831C9D2EF8957"><enum>(a)</enum><header>Wildland firefighter defined</header><text>For purposes of this section, the term <term>wildland firefighter</term> means an employee of the Department of the Interior or the United States Forest Service in the Department of Agriculture, the duties of whose position are primarily to perform work directly connected with the control, extinguishment, prevention, and management of wildland fires (including an employee engaged in this activity who is transferred to a supervisory or administrative position), but does not include an employee or group of employees excluded by the Office of Personnel Management under the second sentence of subsection (c).</text></subsection> 
<subsection id="H8067E5D42F8D474EAC1C03A1D023C716"><enum>(b)</enum><header>Portal-to-portal compensation</header> 
<paragraph id="HD4D1B1D9EC014B8A007EF6F49CFED9FD"><enum>(1)</enum><header>In general</header><text>For purposes of any determination of pay, a wildland firefighter is entitled to be paid for the entire period of time during which such firefighter is engaged in officially ordered or approved duties in connection with responding to a wildland fire or other emergency, subject to paragraph (2).</text></paragraph> 
<paragraph id="HE9DDF9F23DB1427F917283DC7CC512B"><enum>(2)</enum><header>Limitation</header><text>Notwithstanding any other provision of law, for any 24-hour period, the total amount in basic pay and premium pay payable to a wildland firefighter as a result of the application of this subsection may not exceed the amount equal to the sum of—</text> 
<subparagraph id="H71EFADA8E0034537B680F19EA6499D62"><enum>(A)</enum><text>16 times the firefighter’s hourly rate of basic pay; and</text></subparagraph> 
<subparagraph id="H73FC231EA2FE4131A436694425B67457"><enum>(B)</enum><text>8 times the firefighter’s overtime hourly rate of pay.</text></subparagraph></paragraph></subsection> 
<subsection id="HD4D915051E2F4B8F8EEB48819E2CDCAD"><enum>(c)</enum><header>Regulations</header><text>The Office of Personnel Management shall prescribe any regulations necessary to carry out the purposes of this section. The Office may by regulation exclude from the operation of this section an employee or group of employees appointed on a casual emergency basis.</text></subsection></section> 
<section id="HAC2FC25664F0415CBD664C206E6F427E"><enum>3.</enum><header>Hazardous duty differential to be treated as part of a firefighter’s basic pay for retirement purposes</header> 
<subsection id="H05D81279BF9C4E09A286EA14C4A663C1"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8331">Section 8331(3)</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H428290CC37CD4125A04906ED5EEE27E"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of subparagraph (G);</text></paragraph> 
<paragraph id="HC78D41DB351B4EB588F1BB0000102768"><enum>(2)</enum><text>by inserting <quote>and</quote> at the end of subparagraph (H); and</text></paragraph> 
<paragraph id="H6BD8C8F8FB5941DFAA8711C783305774"><enum>(3)</enum><text>by adding after subparagraph (H) the following:</text>

<subparagraph id="H36878606DB52420AB1C92DBEB25FCD2E"><enum>(I)</enum><text>with respect to a firefighter, any pay differential under section 5545(d);</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H71CD29F82D7842DFBFB0D1D3E5EF2085"><enum>(b)</enum><header>Conforming amendment</header><text>Section 8331(3) of such title 5 is further amended by striking <quote>(B) through (H)</quote> and inserting <quote>(B) through (I)</quote>.</text></subsection></section> 
<section id="H36216833E5FE49B39CD0CC00302EC637"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to compensation for service performed in any pay period beginning on or after the date of enactment of this Act.</text></section>
