<section id="HB27604FC9D8D433CA3A5085BE19DCF3F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Our Homes Act</short-title></quote>.</text></section> 
<section id="H1469365BB60E4D18803D0014A64BF496"><enum>2.</enum><header>Limitations on use of eminent domain</header> 
<subsection id="H519A562FA90642169F101209CADED19E"><enum>(a)</enum><header>In General</header><text>No Federal, State, or local governmental entity may use the power of eminent domain to take private property for economic development purposes unless the entity meets the conditions of subsection (b).</text></subsection> 
<subsection id="HE03CBB6907164605B4B29EDD79123FB8"><enum>(b)</enum><header>Conditions</header><text>To meet the conditions of this subsection, a Federal, State, or local governmental entity must be able to demonstrate the following:</text> 
<paragraph id="H1C77F7ECB4814D2E008609753B645B6B"><enum>(1)</enum><text>The property that is subject to the taking constitutes a significant public health or safety risk.</text></paragraph> 
<paragraph id="HB08F53F0863347529D9D9E839775F000"><enum>(2)</enum><text>The entity has examined all reasonable alternatives to the taking, and has set forth its findings in a series of public hearings.</text></paragraph> 
<paragraph id="H7039232F5DDC435288634B581DD9FB4C"><enum>(3)</enum><text>The entity has provided notice of the taking and an opportunity for public comment.</text></paragraph> 
<paragraph id="HFDB1EC634E64448888CADD2B47145672"><enum>(4)</enum><text>If the property is to be used for residential development, the entity has required that the development include affordable housing for individuals, families, and seniors in an amount proportional to the number of residences condemned.</text></paragraph> 
<paragraph id="H28C7AD3AE8CB4AA2A347954ECBF68516"><enum>(5)</enum><text>If the property is to be used for commercial development, the entity has required the availability of additional affordable housing for individuals, families, and seniors in an amount proportional to the number of residences condemned to be located in a comparable housing market. </text></paragraph> 
<paragraph id="HD4165B3C02454B109C0005262C702DC4"><enum>(6)</enum><text>The entity has provided just compensation for the property reflecting the following:</text> 
<subparagraph id="HCF088D6640AC4DF5864892EBD63C8CE6"><enum>(A)</enum><text>Fair market value.</text></subparagraph> 
<subparagraph id="H9746053C04254204A042468CBC49F0C7"><enum>(B)</enum><text>Relocation costs consistent with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/42/4601">42 U.S.C. 4601 et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="HBA2B1FF505E74BDB9C84E6CE164C9EBF"><enum>(C)</enum><text>Projected market value of the property after redevelopment.</text></subparagraph></paragraph> 
<paragraph id="H18A18B565C2B4CDEB0B50004B9002344"><enum>(7)</enum><text>The entity has disclosed its basis for determining the amount of compensation specified in paragraph (6).</text></paragraph> 
<paragraph id="H9761130C259343709871305BB4ED94C0"><enum>(8)</enum><text>The entity has provided a process by which the affected community may petition to put the proposed development to a ballot initiative at the earliest practicable time.</text></paragraph></subsection></section> 
<section id="H49BDDBB41F9D4E20B02F96D53400CA96"><enum>3.</enum><header>Enforcement</header> 
<subsection id="H0CDA3E72B9174BA3B9F15DF58CFDBB9"><enum>(a)</enum><header>Ineligibility for Federal funds</header><text>Failure to comply with the requirements of section 2 renders a State or local governmental entity ineligible for Federal financial assistance under any program administered by the Department of Housing and Urban Development.</text> </subsection> 
<subsection id="H3E444C16FCF045A48900BF03B014F0E2"><enum>(b)</enum><header>Noncompliance</header><text>The Secretary of Housing and Urban Development shall provide for enforcement of the limitation contained in subsection (a).</text></subsection></section>
