<official-title>To amend part B of title XVIII of the Social Security Act to establish a floor for Medicare physician payment rates for 2006 at the level for 2005.</official-title>

<section id="HCC58A772FDA44011BC153CB16639B6B5" section-type="section-one"><enum>1.</enum><header>Short title; findings; purpose</header> 
<subsection id="HD58658B9D0B8490A9762D4F277969B00"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Maintaining Medicare Access Act of 2005</short-title></quote>. </text></subsection> 
<subsection id="HACD6EAE1467F4451B93BF75DFF115BC0"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H7AA7260CA0C945A89BD4C90F68C329B"><enum>(1)</enum><text display-inline="yes-display-inline">The Medicare physician fee schedule is updated on an annual basis according to a formula specified by statute (in this subsection referred to as the <quote>SGR formula</quote>). The SGR formula requires the Centers for Medicare &amp; Medicaid Services to adjust the update depending on how actual expenditures compare to a target rate, called the sustainable growth rate.</text></paragraph> 
<paragraph id="HBE05587224344E99BEEE95C075DD83F2"><enum>(2)</enum><text>The report of the trustees of the Medicare trust funds states that under the SGR formula, physicians will receive negative payment updates for each year from 2006 through 2012 and it is projected that physician payment rates will not return to their 2002 level until after 2013.</text></paragraph> 
<paragraph id="H68161747D7E242E9AF4BA7F7102D4CE0"><enum>(3)</enum><text>The report of the trustees of the Medicare trust funds further states that under the SGR formula physician reimbursement rates could be reduced by more than 30 percent during the period between 2006 and 2013. However, the cost of providing services will rise by an estimated 20 percent during that period. </text></paragraph> 
<paragraph id="H903580F9518342A2B15FE66B00CA005B"><enum>(4)</enum><text>Such reductions of the physician reimbursement rates will inhibit physicians from providing needed services to Medicare beneficiaries because physicians will be unable to afford to treat their current Medicare patients or treat new Medicare patients.</text></paragraph> 
<paragraph id="H1C40D5B016E44E2F9CBD064CB49B0797"><enum>(5)</enum><text>Physician practices tend to be small businesses that do not have the resources necessary to absorb continued negative updates in payment for their Medicare patients.</text></paragraph> 
<paragraph id="H1EA9673C72C444CE98D9A2170000AB9F"><enum>(6)</enum><text>Lack of timely Congressional action to prevent a reduction in reimbursement rate from the 2005 rate could jeopardize Medicare patients’ ability to promptly obtain care.</text></paragraph> 
<paragraph id="H5E35ED41FBE14EEC83E2A58FAAD69D84"><enum>(7)</enum><text>Instability in next year’s physician reimbursement rate will prevent access to quality care for Medicare beneficiaries. </text></paragraph> 
<paragraph id="HC71E24F9825340F9BE39DC73BBE65C18"><enum>(8)</enum><text>Congress should replace the SGR formula with a system that properly accounts for the cost of delivering health care services to Medicare patients.</text></paragraph> 
<paragraph id="H6E4801AE44E841C8B93497006CE4C029"><enum>(9)</enum><text>The Medicare Payment Advisory Commission has found that an update in physician reimbursement rates that is based on the Medicare Economic Index (MEI) is more predictable than the SGR formula, recognizes the true costs of providing physician services to Medicare patients, recognizes inflation in physician practice costs and general wage levels, and should replace the SGR formula.</text></paragraph></subsection> 
<subsection id="H8F58E0C3E9B4493D0065CB7766DD3297"><enum>(c)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to provide a floor for the Medicare physician reimbursement rate for 2006.</text></subsection></section> 
<section id="H340CE0B6A0B742FBAC563DAADAE15761"><enum>2.</enum><header>Medicare physician payment rate floor for 2006</header> 
<subsection id="HE4027D02AB1F42ABA1B8B9DCEECD64E9"><enum>(a)</enum><header>In general</header><text>Section 1848(d)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(d)(1)</external-xref>) is amended—</text> 
<paragraph id="HFCA082F7419944378DDCADEAC68B3454"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>The conversion factor</quote> and inserting <quote>Except as otherwise provided in this subsection, the conversion factor</quote>; and </text></paragraph> 
<paragraph id="H217D32EE7A69472ABEE82BC337CA8C"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HBE29A2699A0747BE91E100798CC8D7F7" display-inline="no-display-inline"> 
<subparagraph id="H37FE1EE020A4425696AF551951AFB46D"><enum>(F)</enum><header>Floor for 2006</header><text>Except as provided in subparagraph (D), the single conversion factor for 2006 under this subsection shall in no case be less than the single conversion factor for 2005. The previous sentence shall not apply in determining the single conversion factor for any subsequent year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H68900F394F6C453A903C66505BA45C91"><enum>(b)</enum><header>Not treated as change in law and regulation in sustainable growth rate determination</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall not be treated as a change in law for purposes of applying section 1848(f)(2)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(f)(2)(D)</external-xref>).</text> </subsection></section>
