<official-title>To authorize the Secretary of the Treasury to issue Disaster Recovery Bonds for disaster relief and recovery efforts.</official-title>

<section id="H5D942438A3DC4A32BEBE33E91F87F1DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Recovery Act of 2005</short-title></quote>. </text></section> 
<section id="H1F4E20D62AB84B81A658D028687633BF"><enum>2.</enum><header>Disaster Recovery Bonds and Trust Fund</header> 
<subsection id="H0F144D6FA37F44EDBCDDC8104003066"><enum>(a)</enum><header>Authority to issue Disaster Recovery Bonds</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/3102">Section 3102</external-xref> of title 31, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="HA77AD88BE68842BAAECFBCE780E3AE16"><enum>(f)</enum><header>Disaster Recovery Bonds</header> 
<paragraph id="HEF3440D1877E418B9E626BEE22505227"><enum>(1)</enum><header>In general</header><text>The Secretary is authorized to issue bonds under this section, to be known as <quote>Disaster Recovery Bonds</quote>.</text></paragraph> 
<paragraph id="H99C1FF6F4EA7418600CEB7128FC4D657"><enum>(2)</enum><header>Form</header><text>The bonds authorized by paragraph (1) shall be in such form and denominations, and shall be subject to such terms and conditions of issue, conversion, redemption, maturation, payment, and rate of interest as the Secretary may prescribe.</text></paragraph> 
<paragraph id="H274F5A5D84004C36956156AD46436B83"><enum>(3)</enum><header>Marketing</header><text>The Secretary shall carry out a program to encourage sales of Disaster Recovery Bonds, including activities to facilitate the purchase of such bonds through payroll deductions and incremental stamp programs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6C09E71BE4CF486FA696EC44C5407209"><enum>(b)</enum><header>Disaster Recovery Trust Fund</header> 
<paragraph id="H88C03F4A1F0C48AF8E40B3D3C06814B8"><enum>(1)</enum><header>Establishment of trust fund</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Disaster Recovery Trust Fund</quote>, consisting of such amounts as may be appropriated, credited, or transferred to such Trust Fund as provided in this section or other provision of law.</text></paragraph> 
<paragraph id="H9EA1E0E5FCE3422B83974C946495D5F6"><enum>(2)</enum><header>Transfers to trust fund</header><text>There are hereby appropriated to the Disaster Recovery Trust Fund amounts equivalent to all revenues derived from the sale and issuance of Disaster Recovery Bonds issued under <external-xref legal-doc="usc" parsable-cite="usc/31/3102">section 3102</external-xref> of title 31, United States Code.</text></paragraph> 
<paragraph id="H339178791B63423A91A8DB99C9D800AC"><enum>(3)</enum><header>Expenditures from trust fund</header> 
<subparagraph id="H6ED313F4E6604EB0BB00CDE5821EE235"><enum>(A)</enum><header>In general</header><text>Amounts in the Disaster Recovery Trust Fund shall be available only as provided for in appropriation Acts and only for purposes of making expenditures to carry out relief and recovery efforts related to a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.</text></subparagraph> 
<subparagraph id="HB313C3825EA14ABFAE2888EB009313A4"><enum>(B)</enum><header>Limitations</header> 
<clause id="H8AA690F9FBA64103BD3B93AA8B292B8D"><enum>(i)</enum><header>Per disaster limitation</header><text>Not more than 50 percent of the balance of the trust fund shall be available for any single disaster. For purposes of this clause, the balance of the trust fund shall be determined as of the beginning of the calendar year in which such disaster is declared.</text></clause> 
<clause id="H867E5DAC99E4466CAEA25DEB752931A6"><enum>(ii)</enum><header>Annual limitation</header><text>Not more than 75 percent of the balance of the trust fund shall be available for disasters declared in single calendar year. For purposes of this clause, the balance of the trust fund shall be determined as of the beginning of such calendar year.</text></clause></subparagraph></paragraph></subsection></section>
