<official-title display="yes">To amend the Marine Mammal Protection Act of 1972 to provide for better understanding and protection of marine mammals, and for other purposes.</official-title>

<section id="H25D15DCF058E4AE581A29EA071BF5CAA" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marine Mammal Protection Act Amendments of 2006</short-title></quote>.</text></section> 
<section id="H54881D6785B64C89BB244452E949DF31" display-inline="no-display-inline"><enum>2.</enum><header>Amendment references</header><text display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to such section or other provision of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>).</text></section> 
<section id="H50957F0653704E1E8904D7EB5EAD0045" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Technical corrections</header> 
<subsection id="H61D8C6370D68497CBCDDD3EA5BB5548D"><enum>(a)</enum><header>Committee references</header><text>The Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>) is amended by striking <quote>Committee on Merchant Marine and Fisheries</quote> each place it appears and inserting <quote>Committee on Resources</quote>.</text></subsection> 
<subsection id="HEC81943856BD4DA68D66CA15B87200EC"><enum>(b)</enum><header>Obsolete reference to section</header><text>Section 118(c)(3)(A)(i) (<external-xref legal-doc="usc" parsable-cite="usc/16/1387">16 U.S.C. 1387(c)(3)(A)(i)</external-xref>) is amended by striking <quote>, except that</quote> and all that follows through <quote>is valid</quote>.</text></subsection></section>

<subsection id="H009E2DB361064F11000034BEC1DAEFA4"><enum>(a)</enum><header>In general</header><text>Section 101(a)(6) (<external-xref legal-doc="usc" parsable-cite="usc/16/1371">16 U.S.C. 1371(a)(6)</external-xref>) is amended by redesignating subparagraph (B) as subparagraph (C), and by inserting after subparagraph (A) the following:</text>

<subparagraph indent="up1" id="HDC259152643D4B1BB56B81E775846C40"><enum>(B)</enum><text>A marine mammal product may be exported from the United States if the product—</text> 
<clause id="H7AF666EAAC6A4E18BD3D07A30067444F"><enum>(i)</enum><text>is legally possessed, and exported by, a citizen of the United States for noncommercial purposes in conjunction with travel outside the United States and the product is imported into the United States by the same person upon the termination of travel;</text></clause> 
<clause id="HF839F51E594945CDBF05C6281C54BC4B"><enum>(ii)</enum><text>is legally possessed, and exported by, a person that is not a citizen of the United States for noncommercial purposes;</text></clause> 
<clause id="HABAB2488AA4C4F189D83840000336BC7"><enum>(iii)</enum><text>is legally possessed and exported as part of a cultural exchange, by an Indian, Aleut, or Eskimo residing in Alaska; or</text></clause> 
<clause id="H51E80058708C4B7EB3B862B209238E00"><enum>(iv)</enum><text>is owned by a Native inhabitant of Russia, Canada, or Greenland and is exported for noncommercial purposes—</text> 
<subclause id="H1BBB96C5A05C4329818DFA1F36476900"><enum>(I)</enum><text>in conjunction with, and upon the completion of, travel within the United States; or</text></subclause> 
<subclause id="H26B2613670B5457BACB8120318E78D8"><enum>(II)</enum><text>as part of a cultural exchange with an Indian, Aleut, or Eskimo residing in Alaska.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H185D7D6DC8FF4A3FB94C5400B5FA19DE"><enum>(b)</enum><header>Conforming amendment</header><text>Section 101(a)(6)(A)(i) (<external-xref legal-doc="usc" parsable-cite="usc/16/1371">16 U.S.C. 1371(a)(6)(A)(i)</external-xref>) is amended by inserting <quote>for noncommercial purposes</quote> after <quote>United States</quote> the first place it appears.</text></subsection></section> 
<section id="H675C3CBD705D4C46B2DC008398BFF805" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header>Captive release prohibition</header><text display-inline="no-display-inline">Section 102(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1372">16 U.S.C. 1372(a)</external-xref>) is amended—</text> 
<paragraph id="HFC63AC89A0FB4202B6D959FB3900F1D4"><enum>(1)</enum><text>in paragraph (4) by striking <quote>subsection 104(c); and</quote> and inserting <quote>section 104(c);</quote>;</text></paragraph> 
<paragraph id="H203DFD92E53B456CAA7F09C685CEAD7D"><enum>(2)</enum><text>in paragraph (5) by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HBDA11EFC659B4A689ECB867D0052E614"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="HE395CABA4AC34903A0E7AD61181A3A5"><enum>(6)</enum><text>for any person that is subject to the jurisdiction of the United States to release any captive marine mammal unless specifically authorized to do so under section 104(c)(3)(A), 104(c)(4)(A), or 109(h), except that this paragraph shall not apply to the temporary release of any marine mammal that is maintained in captivity under <external-xref legal-doc="usc" parsable-cite="usc/10/7524">section 7524</external-xref> of title 10, United States Code (including any progeny of a marine mammal maintained under that section).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H4DFA7AB19A44420A96DA1FE400832600" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Annual report requirement</header><text display-inline="no-display-inline">Section 103(f) (<external-xref legal-doc="usc" parsable-cite="usc/16/1373">16 U.S.C. 1373(f)</external-xref>) is amended in the first sentence, by inserting <quote>and notwithstanding <external-xref legal-doc="public-law" parsable-cite="pl/104/66">Public Law 104–66</external-xref></quote> after <quote>thereafter</quote>.</text> </section> 
<section id="H698F8819193744ACA3564C563B00C59"><enum>7.</enum><header>Permit clarifications</header> 
<subsection id="H2B58BC644D8A423591334EA144C1EC9"><enum>(a)</enum><header>Clarifications</header><text>Section 104 (<external-xref legal-doc="usc" parsable-cite="usc/16/1374">16 U.S.C. 1374</external-xref>) is amended as follows:</text> 
<paragraph id="H8313C97EED074C1DA763AEC14356852E"><enum>(1)</enum><text>Subsection (c)(7) is amended by inserting <quote>notwithstanding any other provision of law</quote> after <quote>requesting the permit</quote>.</text></paragraph> 
<paragraph id="HE2713E009A214112AD12582CD858F700"><enum>(2)</enum><text>Subsection (c)(9) is amended to read as follows:</text>

<clause id="H2FE7F81CB21547EEA1FB674D711213C1"><enum>(i)</enum><text>for the purpose of public display, unless the Secretary of Agriculture evaluates and verifies, and thereafter notifies the Secretary, that the receiving facility meets standards that are comparable to the requirements that a person must meet to receive a permit under this subsection for that purpose; or</text></clause> 
<clause id="HDDCBD84BE4BE4EE88E914337B4D04FDA"><enum>(ii)</enum><text>for the purpose of scientific research or enhancing the survival or recovery of a species or stock, unless the receiving facility meets standards that are comparable to the requirements that a person must meet to receive a permit under this subsection for that purpose.</text></clause></subparagraph> 
<subparagraph id="HBF945A4497B045CD9F9277FD35A21658" indent="up1"><enum>(B)</enum><text>The Secretary may not require or request, through comity or any other means, that any marine mammal or its progeny remain subject to the jurisdiction of the United States when located in waters or on lands that are subject to the jurisdiction of another country.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H180F2EDA33634415AC996BB530A5FB5F"><enum>(3)</enum><text>Subsection (c)(10) is amended—</text> 
<subparagraph id="HF815B728574842E99212AC92C8B4D86"><enum>(A)</enum><text>in the first sentence by inserting <quote>held within the lands and waters of the United States</quote> after <quote>marine mammals</quote> each place it appears;</text></subparagraph> 
<subparagraph id="H14A67BCB69674EC894527E134E24EBE1"><enum>(B)</enum><text>by inserting after the first sentence the following: <quote>The Secretary shall update the inventory on an annual basis.</quote>; and </text></subparagraph> 
<subparagraph id="HBCD66A3E2EBC4D419FB26E00285F3789"><enum>(C)</enum><text>in subparagraph (D) by inserting <quote>ownership, or other</quote> after <quote>date of</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H1241772853764C6E837105BF214CF061"><enum>(b)</enum><header>Review and report regarding inventory</header><text></text> 
<paragraph id="HBBB125A3CB2440AB9DD2EB418380443"><enum>(1)</enum><header>Review</header><text>The Secretaries of Commerce and the Interior shall, by not later than 12 months after date of the enactment of this Act, jointly conduct a review of the inventory maintained under section 104(c)(10) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1374">16 U.S.C. 1374(c)(10)</external-xref>), the use of the information in the inventory, and the costs, benefits, and issues associated with the development of an online inventory.</text></paragraph> 
<paragraph id="H5D6D345851114575BA1947CE94BAB1C"><enum>(2)</enum><header>Consultation</header><text>In conducting the review, the Secretary shall consult and solicit input from persons who are required to provide information for the inventory.</text></paragraph> 
<paragraph id="HBC0A98CFF87E4D3A80007D123BC0B1D0"><enum>(3)</enum><header>Report</header><text>The Secretary shall submit a report to Committee on Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the findings of the review under this subsection. The report shall include the following:</text> 
<subparagraph id="H3B9D84D32A01432296849E40C5B497CB"><enum>(A)</enum><text>Recommendations on whether the inventory should be maintained by the Secretary or by another person under contract. </text></subparagraph> 
<subparagraph id="HAC13B0B157E0421DAFB200A85701E1A7"><enum>(B)</enum><text>How the Secretary would oversee maintenance of the inventory carried out under contract. </text></subparagraph> 
<subparagraph id="H54A1ECBB821E4E7282EE410E6839877"><enum>(C)</enum><text>How public access and access by Federal agencies to the inventory can be maintained if the inventory is maintained under contract. </text></subparagraph> 
<subparagraph id="H2B9DD825787C4916ACD550E91BEA343"><enum>(D)</enum><text>How the Secretary can minimize duplication on the information the Secretary receives from public display facilities and reduce the paper work burden on those facilities. </text></subparagraph> 
<subparagraph id="HB4B31115A5B64B02AD67414022A781A8"><enum>(E)</enum><text>An estimate of the cost of maintaining the inventory.</text></subparagraph> 
<subparagraph id="HF9A2A3F66E074308803F5EDF9D481291"><enum>(F)</enum><text>A description of how the Secretary will ensure the secure maintenance of the data in the inventory.</text></subparagraph> 
<subparagraph id="HEB2EAEA106A1461DA525E4B619B22883"><enum>(G)</enum><text>An analysis of the potential that online availability of the information in the inventory could adversely affect the safety of the animals.</text></subparagraph></paragraph></subsection> 
<subsection id="HA4065D264A124CFD89F5737F16A9F108"><enum>(c)</enum><header>Limitation on notification requirements</header><text display-inline="yes-display-inline">Section 104(c) (<external-xref legal-doc="usc" parsable-cite="usc/16/1374">16 U.S.C. 1374(c)</external-xref>) is amended in paragraph (2)(E) in the first sentence, and in paragraph (8)(B)(i)(II), by inserting before the period at the end the following: <quote>, except that if the transport is for purposes of public display and the transfer is between facilities where the ownership and care of the marine mammal will be under the same license or registration issued under the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2131">7 U.S.C. 2131 et seq.</external-xref>) then only a notice of transport is required</quote>.</text></subsection></section> 
<section id="HF8B383DC7C7E429AA83453734ED654D0" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Fines and penalties</header> 
<subsection id="H4ABB6C9736C149DABEB3093398769D38"><enum>(a)</enum><header>Fines and penalties, generally</header><text>Section 105 (<external-xref legal-doc="usc" parsable-cite="usc/16/1375">16 U.S.C. 1375</external-xref>) is amended—</text> 
<paragraph id="H2011BF400EA0414F94E9AFDB5295841"><enum>(1)</enum><text>in subsection (a)(1) by striking <quote>$10,000</quote> and inserting <quote>$20,000</quote>; and</text></paragraph> 
<paragraph id="HDB75D28EE911481BA78D728E3EFDEB81"><enum>(2)</enum><text>in subsection (b) by striking <quote>$20,000</quote> and inserting <quote>$30,000</quote>.</text></paragraph></subsection> 
<subsection id="HF2882D7447754C4B9E49E9C4E1DBBF1B"><enum>(b)</enum><header>Vessel penalty</header><text>Section 106(b) (<external-xref legal-doc="usc" parsable-cite="usc/16/1376">16 U.S.C. 1376(b)</external-xref>) is amended by striking <quote>$25,000</quote> and inserting <quote>$35,000</quote>.</text></subsection></section> 
<section id="H77DB3B4C4A3B41B38C34F9F3A1AFA359" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header>Marine mammal grants</header><text display-inline="no-display-inline">Section 110(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1380">16 U.S.C. 1380(a)</external-xref>) is amended to read as follows:</text>

<subsection id="H6C1A9827D5E449619C24556E6200F5E6"><enum>(a)</enum><header>Authorization of assistance; annual report</header> 
<paragraph id="H5BE11A61CB924DE8AFB600F9A2B70021"><enum>(1)</enum><header>Authorization of assistance</header><text>The Secretary may make grants, or provide financial assistance in such other form as the Secretary considers appropriate, to any Federal or State agency, public or private institution, or other person for the purpose of assisting such agency, institution, or person to undertake research in subjects that are relevant to the protection and conservation of marine mammals.</text></paragraph> 
<paragraph id="H60712C018BD842C594F6A6673FA887A9"><enum>(2)</enum><header>Reports</header> 
<subparagraph id="H29B7F288EB854E9AA294E3DA35AFE015"><enum>(A)</enum><header>Reports by Secretary</header><text>The Secretary shall include a description of the results of research carried out with assistance under this section in the annual report required under section 103(f).</text></subparagraph> 
<subparagraph id="HE275E2BF66824FC1B3B6DA126144FAD"><enum>(B)</enum><header>Reports by Federal agencies</header><text>The head of each Federal agency that conducts and provides funds for research on marine mammals shall report annually to the Committee on Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on funding provided and research conducted regarding marine mammals during the preceding year.</text></subparagraph></paragraph> 
<paragraph id="H59D316D04B4743B5855E446B18F5007F"><enum>(3)</enum><header>Contributions</header><text>For purposes of carrying out this section, the Secretary may accept, solicit, receive, hold, administer, and use gifts, devises, and bequests.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="H81445C1759F7400B802913E6FB74ADC8" display-inline="no-display-inline" section-type="subsequent-section"><enum>10.</enum><header>Fisheries gear development</header><text display-inline="no-display-inline">Section 111 (<external-xref legal-doc="usc" parsable-cite="usc/16/1381">16 U.S.C. 1381</external-xref>) is amended as follows:</text> 
<paragraph id="H467FA6D20D334C7FB8DBCEE111FE1F16"><enum>(1)</enum><text>Subsection (a) is amended to read as follows:</text>

<subsection id="H341C010ED6514B67BF06A15E7EE7C9BA"><enum>(a)</enum><header>Fishing gear development program</header> 
<paragraph id="H8915F61BE46749F0A43F1242A0CEAF1D"><enum>(1)</enum><header>In general</header><text>The Secretary of Commerce (in this section referred to as the <quote>Secretary</quote>) shall—</text> 
<subparagraph id="HF3032E340B1D4705A7AD0200F27C6D49"><enum>(A)</enum><text>carry out a program for the purpose of devising improved fishing gear and methods so as to reduce to the maximum extent practicable the incidental taking of marine mammals in connection with fishing operations; and</text></subparagraph> 
<subparagraph id="H45C2BCC05551468DBFDFF09DABDFABCF"><enum>(B)</enum><text>make every practicable effort to develop, evaluate, and make available to owners and operators of fishing vessels such gear and fishing method improvements as quickly as possible.</text></subparagraph></paragraph> 
<paragraph id="HC5D0D00B938B44AAB95251625450ED0"><enum>(2)</enum><header>Coordination with other countries</header><text>The Secretary may coordinate with other countries to foster gear technology transfer initiatives to reduce to the maximum extent practicable the incidental mortality and serious injury of marine mammals throughout the full extent of their range.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HCEAE1C16ADF94E0DAA005F00E958D1EC"><enum>(2)</enum><text>By adding at the end the following:</text> 
<quoted-block id="HB596CD8DD37F4A9D97C5264CC9282E2"> 
<subsection id="HF51175ACFDFE44F38D7DF3CEFE940074"><enum>(e)</enum><header>Gear improvement mini-grant program</header> 
<paragraph id="HEFE56F6FE70148708B8B197F9751D75"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary may establish a grant program to provide financial assistance for developing, manufacturing, testing, or designing new types of fishing gear designed to reduce to the maximum extent practicable the incidental taking (including incidental mortality and serious injury) of marine mammals.</text></paragraph> 
<paragraph id="H5FF5402197084A77AD3917601D5D6C20"><enum>(2)</enum><header>Grant amount and purposes</header><text>The amount of a grant under this subsection may not exceed $20,000.</text></paragraph> 
<paragraph id="H62DD63AD451447CB9D72D1B5789C4BF"><enum>(3)</enum><header>Grant applications</header><text>To receive a grant under this section, an applicant must submit an application in such form and manner as the Secretary may prescribe.</text></paragraph> 
<paragraph id="H6F93198672F141FA86E964A0182B2222"><enum>(4)</enum><header>Consultation regarding criteria</header><text>The Secretary shall consult with the Secretary of the Interior and the Marine Mammal Commission regarding the development of criteria for the awarding of grants under this subsection.</text></paragraph> 
<paragraph id="HD6D535EF21BA45AB9E52B19C54DD4261"><enum>(5)</enum><header>Administrative costs</header><text>Of amounts available each fiscal year to carry out this subsection, the Secretary may expend not more than $40,000 to pay the administrative expenses necessary to carry out this subsection.</text></paragraph> 
<paragraph id="H87BC94924F714CF4A7827B0752E0027"><enum>(6)</enum><header>Contributions</header><text>For purposes of carrying out this section, the Secretary may accept, solicit, receive, hold, administer, and use gifts, devises, and bequests.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HCD05E8FD663C4199962F035627958807" display-inline="no-display-inline" section-type="subsequent-section"><enum>11.</enum><header>Conforming amendment</header><text display-inline="no-display-inline">Subsection (c) of the Dolphin Protection Consumer Information Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1385">16 U.S.C. 1385</external-xref>) is amended in paragraph (2) by striking <quote>160 degrees west longitude</quote> and inserting <quote>150 degrees west longitude</quote>.</text></section>

<subsection id="H166CC725C5EF460DAB21A3EE44A9B486"><enum>(a)</enum><header>In general</header><text>Section 118 (<external-xref legal-doc="usc" parsable-cite="usc/16/1387">16 U.S.C. 1387</external-xref>) is amended as follows:</text>

<subparagraph indent="up1" id="H1DD30BDEA13648B7BFE73C03B11BF001"><enum>(A)</enum><text>publish in the Federal Register for public comment, for a period of not less than 90 days, any necessary changes to the Secretary’s list of fisheries published under section 114(b)(1) in the Federal Register on August 24, 1994 (along with an explanation of such changes and a statement describing the marine mammal stocks interacting with, and the approximate number of vessels or persons actively involved in, each such fishery), with respect to—</text> 
<clause id="H8ED586738DA240D28F47F8EFFAA557B2"><enum>(i)</enum><text>commercial and recreational fisheries that have frequent incidental mortality and serious injury of marine mammals;</text></clause> 
<clause id="HE33962CCA1EC4A82A1EAACE24BAC296F"><enum>(ii)</enum><text>commercial and recreational fisheries that have occasional incidental mortality and serious injury of marine mammals; or</text></clause> 
<clause id="H6AA9B79FC5A44BB1BAB3C458203EC814"><enum>(iii)</enum><text>commercial fisheries that have a remote likelihood of or no known incidental mortality or serious injury of marine mammals;</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<section id="H30F900604886427DB6A300BA1E521B90" display-inline="no-display-inline" section-type="subsequent-section"><enum>13.</enum><header>Pinniped control program</header><text display-inline="no-display-inline">Section 120 (<external-xref legal-doc="usc" parsable-cite="usc/16/1389">16 U.S.C. 1389</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H138080BE5A69455E9800453BD3C05891"><enum>(k)</enum><header>Nonlethal removal and control</header> 
<paragraph display-inline="yes-display-inline" id="HD15A77E16B85433386B329B4501FDCF9"><enum>(1)</enum><text>The Secretary shall conduct a program on the nonlethal removal and control of nuisance pinnipeds. The program shall include a review of measures that have been taken to effect such removal and control, the effectiveness of these measures, and the development of new technologies to deter nuisance pinnipeds.</text></paragraph> 
<paragraph indent="up1" id="H15F63CB247B34E90A585B9E95F7062C8"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall include, among the individuals that develop the program under this subsection, representatives of the commercial and recreational fishing industries and, as appropriate, individuals with scientific proficiency, technical credentials, and expertise.</text></paragraph> 
<paragraph indent="up1" id="HDE219C50016F4D03865641BC491E57BC"><enum>(3)</enum><text>The Secretary is encouraged, where appropriate, to use independent marine mammal research institutions in developing and in conducting the program.</text></paragraph> 
<paragraph indent="up1" id="H44481F63FA4C4F419CA6FCBEDCE92930"><enum>(4)</enum><text>The Secretary shall, by December 31 of each year, submit an annual report on the results of research under this subsection to the Committee on Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph></subsection> 
<subsection id="H70395B01BCA04355A1B93C9A2D12D8F"><enum>(l)</enum><header>Qualified nonlethal control projects</header><text></text> 
<paragraph id="HF7CA04182F584D7D97FD8E6DD1BC596B"><enum>(1)</enum><header>In general</header><text>The Secretary may, to the extent amounts are available to carry out this subsection, provide a grant to any eligible applicant to carry out a qualified nonlethal control project in accordance with this subsection.</text></paragraph> 
<paragraph id="H893A787C821F4BDCAAC5F2BCD3F0EC4F"><enum>(2)</enum><header>Applications</header><text>The Secretary shall—</text> 
<subparagraph id="HE37B45BA899847BCB0F8FC6D00A0109D"><enum>(A)</enum><text>publish guidelines for and solicit applications for grants under this subsection not later than 6 months after the date of enactment of this subsection; and</text></subparagraph> 
<subparagraph id="HD0EFCC3A745D4349B0B6FEBAE482E5D5"><enum>(B)</enum><text>receive, review, evaluate, and approve applications for grants under this subsection. </text></subparagraph></paragraph> 
<paragraph id="H3019BBD3412F4FF4B8DB2CE99D6E27D2"><enum>(3)</enum><header>Eligible applicant</header><text>To be an eligible applicant for purposes of paragraph (1), an applicant must—</text> 
<subparagraph id="H85F889F11BCE42FAA170C565E2C59461"><enum>(A)</enum><text>be a State, local government, or interstate or regional agency; and</text></subparagraph> 
<subparagraph id="H062FAED44C8A490B9ED222D9F2E32018"><enum>(B)</enum><text>have adequate personnel, funding, and authority to carry out and monitor or maintain a nonlethal control of nuisance pinnipeds project.</text></subparagraph></paragraph> 
<paragraph id="HAA4664AE7DE347C4950022EC998DDAF2"><enum>(4)</enum><header>Qualified control project</header><text>To be a qualified control project under this subsection, a project must—</text> 
<subparagraph id="HE7602DFBEA4445C89BFF93C4AE61CEFB"><enum>(A)</enum><text>by humane and nonlethal means, remove, deter, and control nuisance pinnipeds in areas where they are a recurrent and persistent threat to public health and safety; and</text></subparagraph> 
<subparagraph id="H817A4E6EF4454B32916D66329E11FD71"><enum>(B)</enum><text>encourage public notice, education, and outreach on project activities in the affected community.</text></subparagraph></paragraph> 
<paragraph id="H1FBC8C34AC1449859B43EAAF0611615E"><enum>(5)</enum><header>Grant duration</header><text>Each grant under this subsection shall be to provide funding for the Federal share of the cost of a project carried out with the grant for up to 2 fiscal years.</text></paragraph> 
<paragraph id="HCC7198E9147148DAAD64DADCD9DB3E1E"><enum>(6)</enum><header>Reporting by grantee</header> 
<subparagraph id="H619FB0F8F9804090AF62C5B554D53101"><enum>(A)</enum><header>In general</header><text>A grantee carrying out a control project with a grant under this subsection shall report to the Secretary at the expiration of the grant. </text></subparagraph> 
<subparagraph id="H7039F6BFAE664398A1FCC573445B006F"><enum>(B)</enum><header>Report contents</header><text>Each report under this subsection shall include specific information on the methods and techniques used to control nuisance pinniped species in the project area, and on the ensuing results.</text></subparagraph></paragraph> 
<paragraph id="H835F1A5DF7A24FCC9F714C42CFDFFB6F"><enum>(7)</enum><header>Cost sharing</header><text></text> 
<subparagraph id="HF599B76258684D6ABEC6B2123CA7D9B"><enum>(A)</enum><header>Federal share</header><text>Except as provided in paragraphs (2) and (3), the Federal share of the cost of a project carried out with a grant under this subsection shall not exceed 75 percent of such cost.</text></subparagraph> 
<subparagraph id="H3512AEE39B56403D91E8E653ED3C2D80"><enum>(B)</enum><header>Application of in-kind contributions</header><text>The Secretary may apply to the non-Federal share of costs of a control project carried out with a grant under this subsection the fair market value of services or any other form of in-kind contribution to the project made by non-Federal interests that the Secretary determines to be an appropriate contribution equivalent to the monetary amount required for the non-Federal share of the activity. </text></subparagraph> 
<subparagraph id="HD980737319AF4FF4BC7B34B4794169D8"><enum>(C)</enum><header>Derivation of non-federal share</header><text>The non-Federal share of the cost of a control project carried out with a grant under this subsection may not be derived from a Federal grant program or other Federal funds. </text></subparagraph></paragraph> 
<paragraph id="H253B84E6FD304083B2D7F638DB4FC5EC"><enum>(8)</enum><header>Clarification</header><text>Nothing in this subsection shall be interpreted as suspending or waiving any requirement under any other provision of this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<paragraph id="H36469244EBA24C1E9912FF2500B2934B"><enum>(1)</enum><header>Agreement</header><text>The term <quote>Agreement</quote> means the Agreement Between the Government of the United States of America and the Government of the Russian Federation on the Conservation and Management of the Alaska-Chukotka Polar Bear Population, signed at Washington, D.C., on October 16, 2000.</text></paragraph> 
<paragraph id="HF4FBF9FC27E74FC2B6E338D760069C05"><enum>(2)</enum><header>Alaska Nanuuq Commission</header><text>The term <quote>Alaska Nanuuq Commission</quote> means the Alaska Native entity, in existence on the date of enactment of this title, that represents all villages in the State of Alaska that engage in the annual subsistence taking of polar bears from the Alaska-Chukotka population and any successor entity.</text></paragraph> 
<paragraph id="H71E08BE81BB54FE4877994415C911B08"><enum>(3)</enum><header>Import</header><text>The term <quote>import</quote> means to land on, bring into, or introduce into, or attempt to land on, bring into, or introduce into, any place subject to the jurisdiction of the United States, without regard to whether the landing, bringing, or introduction constitutes an importation within the meaning of the customs laws of the United States.</text></paragraph> 
<paragraph id="H5EB4351BCC35475F896CAE98F2ACA100"><enum>(4)</enum><header>Polar bear part or product</header><text>The term <quote>part or product of a polar bear</quote> means any polar bear part or product, including the gall bile and gall bladder.</text></paragraph> 
<paragraph id="H5083977626154F769DEA2D08157CD72B"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="H4975ECA389054152BC99E12EAA5D7963"><enum>(6)</enum><header>Taking</header><text>The term <quote>taking</quote> has the meaning given the term in the Agreement.</text></paragraph> 
<paragraph id="H2D088DCB98C249569BD4EC70908882D7"><enum>(7)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the commission established under article 8 of the Agreement.</text></paragraph></section> 
<section id="H917A1BB079A447BEAC4D39CD1946009D"><enum>502.</enum><header>Prohibitions</header> 
<subsection id="H94DC5F5D0B574939ABF241CCFC2CD8F5"><enum>(a)</enum><header>In general</header><text>It is unlawful for any person who is subject to the jurisdiction of the United States—</text> 
<paragraph id="H227FBFBEC6964F89BF00A4060241B94"><enum>(1)</enum><text>to take any polar bear in violation of the Agreement;</text></paragraph> 
<paragraph id="H7C6271EF88114D7D00D334DD00C225BF"><enum>(2)</enum><text>to take any polar bear in violation of the Agreement or any annual taking limit or other restriction on the taking of polar bears that is adopted by the Commission pursuant to the Agreement;</text> </paragraph> 
<paragraph id="H7E8CF88E4A3D4878A92379C3BE354E13"><enum>(3)</enum><text>to import, export, possess, transport, sell, receive, acquire, or purchase, exchange, barter, or offer to sell, purchase, exchange, or barter any polar bear, or any part or product of a polar bear, that is taken in violation of paragraph (2);</text></paragraph> 
<paragraph id="HAFE3383E7FAF4324B44F9013174B007E"><enum>(4)</enum><text>to import, export, sell, purchase, exchange, barter, or offer to sell, purchase, exchange, or barter, any polar bear gall bile or polar bear gall bladder;</text></paragraph> 
<paragraph id="HD98DF3838D1043B0943664D365D3E693"><enum>(5)</enum><text>to commit, solicit another person to commit, or cause to be committed, any offense under this subsection; or</text></paragraph> 
<paragraph id="H9B270084992D40C1A92FF43785CF3793"><enum>(6)</enum><text>to violate any regulation promulgated by the Secretary to implement any of the prohibitions established in this subsection.</text></paragraph></subsection> 
<subsection id="H6327D28821C34530B359CFBB76973329"><enum>(b)</enum><header>Exceptions</header><text>For the purpose of forensic testing or any other law enforcement purpose, the Secretary, and Federal law enforcement officials, and any State or local law enforcement official authorized by the Secretary, may import a polar bear or any part or product of a polar bear.</text></subsection></section> 
<section id="H8E70EF2C17324AEF94D9DFCD04A02440"><enum>503.</enum><header>Administration</header> 
<subsection id="HF78F7ECEB0AF41959F5237B38BF855D2"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the United States Fish and Wildlife Service, shall do all things necessary and appropriate, including the promulgation of regulations, to implement, enforce, and administer the provisions of the Agreement on behalf of the United States. The Secretary shall consult with the Secretary of State and the Alaska Nanuuq Commission on matters involving the implementation of the Agreement.</text></subsection> 
<subsection id="H97E1EA8CCD1A4F4EA2AB83014C5BAD2"><enum>(b)</enum><header>Utilization of other government resources and authorities</header> 
<paragraph id="HF5DA73B486174E34BDA28990A2879574"><enum>(1)</enum><header>Other government resources</header><text>The Secretary may utilize by agreement, with or without reimbursement, the personnel, services, and facilities of any other Federal agency, any State agency, or the Alaska Nanuuq Commission for purposes of carrying out this title or the Agreement.</text></paragraph> 
<paragraph id="H44BCACCF14514596B0FFAF2D151DF82C"><enum>(2)</enum><header>Other powers and authorities</header><text>Any person authorized by the Secretary under this subsection to enforce this title or the Agreement shall have the authorities that are enumerated in section 6(b) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3375">16 U.S.C. 3375(b)</external-xref>).</text></paragraph></subsection> 
<subsection id="HE24E6545306941B5BE3BCAE415E50547"><enum>(c)</enum><header>Ensuring compliance</header><text></text> 
<paragraph id="HE388145C0FC14A0FAC14D8A189D0072"><enum>(1)</enum><header>Title I authorities</header><text>The Secretary may use authorities granted under title I to enforce this title. </text> </paragraph> 
<paragraph id="H9611AA7729BF42BC92B471C1B496DCB6"><enum>(2)</enum><header>Additional authorities</header><text>Any gun, trap, net, or other equipment used, to aid in the violation or attempted violation of this title shall be subject to seizure and forfeiture under section 106. </text> </paragraph> </subsection> 
<subsection id="HAF28CBE3FFD54F1F94ACE79FBAD82572"><enum>(d)</enum><header>Regulations</header> 
<paragraph id="H35C4AF2B6C9B4DEF9EBC9889ECAD7F4C"><enum>(1)</enum><header>In general</header><text>The Secretary shall promulgate such regulations as are necessary to carry out this title and the Agreement.</text></paragraph> 
<paragraph id="HE5FF48CEBAB149299CFA85B143249F12"><enum>(2)</enum><header>Ordinances and regulations</header><text>If necessary to carry out this title and the Agreement, and to improve compliance with any annual taking limit or other restriction on taking adopted by the Commission and implemented by the Secretary in accordance with this title, the Secretary may promulgate regulations that adopt any ordinance or regulation that restricts the taking of polar bears for subsistence purposes if the ordinance or regulation has been promulgated by the Alaska Nanuuq Commission.</text></paragraph></subsection> </section> 
<section id="H977047F346A240269E53BC14CCCFCC50"><enum>504.</enum><header>Cooperative management agreement; authority to delegate enforcement authority</header> 
<subsection id="H991BEFB3FE96453AAA8BF61827AC7797"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Director of the United States Fish and Wildlife Service, may share authority under this title for the management of the taking of polar bears for subsistence purposes with the Alaska Nanuuq Commission if such commission is eligible under subsection (b).</text></subsection> 
<subsection id="H24BD1F156827459D83114847D6416120"><enum>(b)</enum><header>Delegation</header><text>To be eligible for the management authority described in subsection (a), the Alaska Nanuuq Commission shall—</text> 
<paragraph id="HB2DD4D6982EE48B9A9E2C449EE25324D"><enum>(1)</enum><text>enter into a cooperative agreement with the Secretary under section 119 for the conservation of polar bears;</text></paragraph> 
<paragraph id="HBB1BBBF29DCA422D81F314EEA45ED979"><enum>(2)</enum><text>meaningfully monitor compliance with this title and the Agreement by Alaska Natives; and</text></paragraph> 
<paragraph id="H25B851FB16AC4216B471AEA9C9BF74E8"><enum>(3)</enum><text>administer its co-management program for polar bears in accordance with—</text> 
<subparagraph id="H041F438512114C839BCF73AF83000364"><enum>(A)</enum><text>this title; and</text></subparagraph> 
<subparagraph id="HBDC18892BAEE4FD58839D8E5BEDE00B0"><enum>(B)</enum><text>the Agreement.</text></subparagraph></paragraph></subsection></section> 
<section id="H1EA569E8C0464EB5B4007888FC645EE7"><enum>505.</enum><header>Commission appointments; compensation, travel expenses, and claims</header> 
<subsection id="H2289A715DBF0484983556D9DB58E4FFA"><enum>(a)</enum><header>Appointment of U.S. Commissioners</header><text></text> 
<paragraph id="HA125F5425E754F1CA3B4B19943A01E21"><enum>(1)</enum><header>Appointment</header><text>The United States commissioners on the Commission shall be appointed by the President, in accordance with paragraph 2 of article 8 of the Agreement, after taking into consideration the recommendations of—</text> 
<subparagraph id="H3A668530D4414FDBBAECA3CC2907E2C"><enum>(A)</enum><text>the Secretary;</text></subparagraph> 
<subparagraph id="HC32E1E891E99475084005D5B88A9539E"><enum>(B)</enum><text>the Secretary of State; and</text></subparagraph> 
<subparagraph id="HD56BD5FBBF5E4174A59C009F1C29EDA1"><enum>(C)</enum><text>the Alaska Nanuuq Commission.</text></subparagraph></paragraph> 
<paragraph id="HAD13C9161B8A460000AD3BC2B307CD74"><enum>(2)</enum><header>Qualifications</header><text>Both of the United States commissioners shall have knowledge or expertise in polar bears.</text> </paragraph> 
<paragraph id="H0C0BA5CBD2E444B9922B4365FB371327"><enum>(3)</enum><header>Service and term</header><text>Each United States commissioner shall serve—</text> 
<subparagraph id="H2575D547CC6D4A2AACA335E49CEC9D8D"><enum>(A)</enum><text>at the pleasure of the President; and</text></subparagraph> 
<subparagraph id="H3CD6D2833EBD4485B9FDEFB08DFF5EED"><enum>(B)</enum><text>for an initial 4-year term and such additional terms as the President shall determine.</text></subparagraph></paragraph> 
<paragraph id="H760FF3BBF3764D9EB5E139E5785A2ED"><enum>(4)</enum><header>Vacancies</header> 
<subparagraph id="H6718C7E7F81048E8966DAEAFE9F2834"><enum>(A)</enum><header>In general</header><text>Any individual appointed to fill a vacancy occurring before the expiration of any term of office of a United States commissioner shall be appointed for the remainder of that term.</text></subparagraph> 
<subparagraph id="H2CAB90FB3B8543E7AF2BF25F88B9C6C8"><enum>(B)</enum><header>Manner</header><text>Any vacancy on the Commission shall be filled in the same manner as the original appointment.</text></subparagraph></paragraph></subsection> 
<subsection id="H08EA5BD0BEB8483BA0CD004BCAA8B86C"><enum>(b)</enum><header>Alternate commissioners</header> 
<paragraph id="H3494961393154B78B7A5B0954DD3067"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Secretary of State and the Alaska Nanuuq Commission, shall designate an alternate commissioner for each member of the United States section.</text></paragraph> 
<paragraph id="H06003075DA2F433782D1A30305805B9"><enum>(2)</enum><header>Duties</header><text>In the absence of a United States commissioner, an alternate commissioner may exercise all functions of the United States commissioner at any meetings of the Commission or of the United States section.</text></paragraph> 
<paragraph id="H6D8CAC3D2B5E459788F24D7EFEC1364B"><enum>(3)</enum><header>Reappointment</header><text>An alternate commissioner—</text> 
<subparagraph id="HC2D29CB2FFE24535955884035C17BFE4"><enum>(A)</enum><text>shall be eligible for reappointment by the President; and</text></subparagraph> 
<subparagraph id="HD34235D8411941BABF80501D8262425F"><enum>(B)</enum><text>may attend all meetings of the United States section.</text></subparagraph></paragraph></subsection> 
<subsection id="HEEFF6A0A595448CFB7DD21F5E2DABB4F"><enum>(c)</enum><header>Duties</header><text>The members of the United States section may carry out the functions and responsibilities described in article 8 of the Agreement in accordance with this title and the Agreement.</text></subsection> 
<subsection id="HA9F7C3BE0D9447EDAF87C3662069EC72"><enum>(d)</enum><header>Compensation and expenses</header> 
<paragraph id="H02557289CF5B419798A89099AC7C50C6"><enum>(1)</enum><header>Compensation</header><text>A member of the United States section shall serve without compensation.</text></paragraph> 
<paragraph id="H8F9493BD22DA46088DCEE5E440DFB4B"><enum>(2)</enum><header>Travel expenses</header><text>A member of the United States section shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the United States-Russia Polar Bear Commission.</text></paragraph></subsection> 
<subsection id="H4B8BC92EEBBD44FCB08E659D50FE8966"><enum>(e)</enum><header>Agency designation</header><text>The United States section shall, for the purpose of title 28, United States Code, relating to claims against the United States and tort claims procedure, be considered to be a Federal agency.</text></subsection></section> 
<section id="HF1B18B5F8C56450E94F81C80C0A5AF75"><enum>506.</enum><header>Votes taken by the United States Section on matters before the Commission</header><text display-inline="no-display-inline">In accordance with paragraph 3 of article 8 of the Agreement, the United States section , made up of commissioners appointed by the President, shall vote on any issue before the United States-Russia Polar Bear Commission only if there is no disagreement between the United States commissioners regarding the vote.</text></section> 
<section id="H5D6E4942292E4B63907F7B1474F3FDAE"><enum>507.</enum><header>Implementation of actions taken by the Commission</header> 
<subsection id="H5BFC967C265043E48DAFDC87C400276E"><enum>(a)</enum><header>In general</header><text>The Secretary shall take all necessary actions to implement the decisions and determinations of the Commission under paragraph 7 of article 8 of the Agreement.</text> </subsection> 
<subsection id="H4B994B4900214140BE00819BE2957426"><enum>(b)</enum><header>Taking limitation</header><text>Not later than 60 days after the date on which the Secretary receives notice of the determination of the Commission of an annual taking limit, or of the adoption by the Commission of other restriction on the taking of polar bears for subsistence purposes, the Secretary shall publish a notice in the Federal Register announcing the determination or restriction.</text></subsection></section> 
<section id="H5C22D27BBB5A45DD9FA8CA4027A5B9D7"><enum>508.</enum><header>Application with other titles of Act</header><text display-inline="no-display-inline">The authority of the Secretary under this title is in addition to, and shall not affect the authority of the Secretary under, the other titles of this Act or the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371 et seq.</external-xref>) or the exemption for Alaskan natives under section 101(b) of this Act.</text></section> 
<section id="HA6DB74BC229E4463A07C39608393A826"><enum>509.</enum><header>Authorization of appropriations</header> <text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary to carry out this title and the Agreement $2,000,000 for each of fiscal years 2007 through 2010.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H39F8CFB895F5458AB5958C61EE5F9D25"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in the first section of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>) is amended by adding at the end the following:</text>
