3.In this Act:
(1)The term child means any person within the age limits for which the State in which the person is located provides free public education.
(2)The term relocated student means a child who—
(A)is a homeless child or youth as those terms are used in the McKinney-Vento Homeless Assistance Act (42 U.S.C. 11421 et seq.);
(B)but for Hurricane Katrina or Hurricane Rita, would be enrolled in an elementary or secondary school in an area for which, due to the hurricane, a major disaster has been declared under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.); and
(C)because of Hurricane Katrina or Hurricane Rita—
(i)is unable to access the education and related services that the child otherwise would be receiving at such school; and
(ii)is enrolled at a public elementary school or secondary school in a different geographical location in a State.
(3)The term elementary school has the meaning given to that term in section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801) and includes a public elementary charter school.
(4)The term impacted local educational agency means a local educational agency serving an area for which, due to Hurricane Katrina or Hurricane Rita, a major disaster has been declared under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.).
(5)The term local educational agency has the meaning given to that term in section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).
(6)The terms pupil services and pupil services personnel have the meanings given to those terms in section 9101 of the Elementary and Secondary Education Act of 1965 (8 U.S.C. 7801).
(7)The term receiving local educational agency means a local educational agency enrolling relocated students.
(8)The term secondary school has the meaning given to that term in section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801) and includes a public secondary charter school.
(9)The term Secretary means the Secretary of Education.
(10)The term State has the meaning given to that term in section 9101 of the Elementary and Secondary Education Act of 1965 (8 U.S.C. 7801).
4.Funds made available pursuant to this Act shall be used to supplement, not supplant, any funds made available through the Federal Emergency Management Agency.
5. Not later than December 31, 2005, and each 6 months thereafter through December 31, 2007, the Secretary shall submit to the Committee on Education and the Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report on grants made under this Act, including the uses to which such grants were put, the effectiveness of such grants in accomplishing the purposes for which they were made, and the number of students impacted, including the number of students counted under section 1124(c) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6333(c)).
<enum>I</enum><header>Immediate Aid to Restart Public School Operations</header>
<section id="HDF85497CC8C54D2FA8C0BB2D08B850EA"><enum>101.</enum><header>Immediate Aid to Restart Public School Operations</header>
<subsection id="H9C1F061BB68C461B994FC6955B00208F"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary of Education shall award grants to impacted local educational agencies for the purposes of—</text>
<paragraph id="HE1D18E45AFF746CD80BBA82DAD51248C"><enum>(1)</enum><text display-inline="yes-display-inline">providing immediate and direct assistance to impacted local educational agencies;</text></paragraph>
<paragraph id="H86AF4CE24D8B4F6D85D7ACEC5ECC3C5"><enum>(2)</enum><text>assisting administrators and other personnel in such agencies who are working to restart public elementary school and secondary school operations; and</text></paragraph>
<paragraph id="HFFC862B331744728B766E54DD7BAB5C"><enum>(3)</enum><text>facilitating the reopening of public elementary schools and secondary schools served by such agencies and the reenrollment of students in such schools as soon as possible.</text></paragraph></subsection>
<subsection id="H5AF510C684C942B680C674F12BEBA07B"><enum>(b)</enum><header>Amount</header><text display-inline="yes-display-inline">The Secretary shall determine the amount of a local educational agency’s grant under this section based upon the agency’s need for funds to fulfill the purposes described in subsection (a).</text></subsection>
<subsection id="HD7875608A63E4759BDF9F8724F11D2C0"><enum>(c)</enum><header>Use of Funds</header><text display-inline="yes-display-inline">Each local educational agency that receives a grant under this section shall use the grant to restart public elementary school and secondary school operations and resume the instruction that was halted as a result of Hurricane Katrina or Hurricane Rita, which uses may include—</text>
<paragraph id="H07382FB903424E0793BA0882FE78C6DD"><enum>(1)</enum><text display-inline="yes-display-inline">recovery of student and personnel data and other information;</text></paragraph>
<paragraph id="H84EE6D6F5A4B4C9B9CCA5186B63BEB06"><enum>(2)</enum><text>replacement of school district information systems, including longitudinal data systems, including hardware and software;</text></paragraph>
<paragraph id="HA40BB7AB95CF4DB298B1FC6E3E225400"><enum>(3)</enum><text>financial operations;</text></paragraph>
<paragraph id="HF4B415F2F9C54B38938FE1B028FC4EDB"><enum>(4)</enum><text>damage assessments, decontamination, and refurbishment in the agency’s school and administration buildings;</text></paragraph>
<paragraph id="H3128370A0ABB4E0B8E98609EF5A2392F"><enum>(5)</enum><text>rental of portable classroom units and facilities;</text></paragraph>
<paragraph id="H9FEF02DF859042DE862D00413D0064B9"><enum>(6)</enum><text>replacement of instructional materials and equipment;</text></paragraph>
<paragraph id="H45E6BC3026744F10989C9E5990A3A84E"><enum>(7)</enum><text>redeveloping instructional plans;</text></paragraph>
<paragraph id="H0F81D5DD4FA14836B1003DD7036D3E"><enum>(8)</enum><text>student transportation services;</text></paragraph>
<paragraph id="H341BAA69956B4E209DA8A90068B70034"><enum>(9)</enum><text>continued payment of salaries and benefits to teachers and other staff; and</text></paragraph>
<paragraph id="HE694938E9EC4461E9676FDA888AF2B6D"><enum>(10)</enum><text>such other activities as may be necessary to fulfill the purposes described in subsection (a), including activities authorized by title I of the Elementary and Secondary Education Act of 1965 and parts B and C of the Individuals with Disabilities Act.</text></paragraph></subsection>
<subsection id="HDA406ADDF667441FB83528442940B7F"><enum>(d)</enum><header>Application</header><text>To seek a grant under this section, a local educational agency shall submit an application to the Secretary at such time, in such manner, and containing or accompanied by such information as the Secretary may reasonably require.</text></subsection>
<subsection id="H3B2D2B8B87C84F80B297BFBB11009593"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section, there are authorized to be appropriated $4,000,000,000 for fiscal year 2006 and such sums as are necessary for fiscal year 2007.</text></subsection></section>
<enum>II</enum><header>Education and pupil services for relocated students</header>
<section id="H9BCAE1FC6F1948E8AE7D99CB05CC8199"><enum>201.</enum><header>Education and pupil services for elementary and secondary relocated students</header>
<subsection id="H8E52DD6F2C7845CF8EB4AEE24EC507F"><enum>(a)</enum><header>In general</header><text>The Secretary shall award grants to receiving local educational agencies for the purpose of facilitating the enrollment, attendance, and success in public elementary schools and secondary schools of relocated students.</text></subsection>
<subsection id="H016C99D46B4E49188E3E44B121E9BE01"><enum>(b)</enum><header>Maximum grant amount</header><text>The maximum amount of a grant to a local educational agency under this section for any fiscal year shall be—</text>
<paragraph id="H3F1725E6815A470DA964454C8445FF86"><enum>(1)</enum><text>$8,314; multiplied by</text></paragraph>
<paragraph id="H031A278FE3704912ADE1D0E8337C434E"><enum>(2)</enum><text display-inline="yes-display-inline">the number of students who have relocated to the area served by the local educational agency as a result of Hurricane Katrina or Hurricane Rita.</text></paragraph> </subsection>
<subsection id="H28DD97FF5F1247A1A8EFDA087D7E76CA"><enum>(c)</enum><header>Use of funds</header><text>A local educational agency receiving funds under this section shall use such funds for education and pupil services. Such services may include the following:</text>
<paragraph id="HF4746A08074A4AC9A616864009B9B4BF"><enum>(1)</enum><text>Outreach to families affected by a specified hurricane disaster in order to facilitate such families in enrolling relocated students in school.</text></paragraph>
<paragraph id="HAB5F7871324F4282A103D1CB4EB5F0C5"><enum>(2)</enum><text display-inline="yes-display-inline">Hiring and training additional teachers, paraprofessionals, pupil services personnel, and school health personnel required due to the enrollment of such students.</text></paragraph>
<paragraph id="HEBC5289B97604F08A4E6D06695FC547E"><enum>(3)</enum><text>Procurement of additional equipment and classroom supplies required due to the enrollment of such students.</text></paragraph>
<paragraph id="HEAB3C78CBEAC4C81B4B2B0E3B1C89BCB"><enum>(4)</enum><text>Procurement of additional classroom space required due to the enrollment of such students.</text></paragraph>
<paragraph id="HBDBA0671CFCC43AA816E3D8DECDF24FA"><enum>(5)</enum><text>Transportation services provided to such students.</text></paragraph>
<paragraph id="H9EFD4900B9454125932335F7E46C1611"><enum>(6)</enum><text>Counseling and other mental health services for such students.</text></paragraph>
<paragraph id="HDCF2EEFF08CC4A588920F43F54C22B86"><enum>(7)</enum><text>Activities authorized by title I of the Elementary and Secondary Education Act of 1965.</text></paragraph></subsection>
<subsection id="H0D14DF1587D549C399A500A4C9A5B1B2"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">To seek a grant under this section, a local educational agency shall submit an application to the Secretary at such time, in such manner, and containing or accompanied by such information as the Secretary may reasonably require.</text></subsection>
<subsection id="HDF7128A05620407D8DFA7939B0D53F65"><enum>(e)</enum><header>School lunches</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a student who has relocated as a result of Hurricane Katrina or Hurricane Rita is deemed eligible for free lunches under section 9 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref>).</text></subsection>
<subsection id="H7D772F8D652946128597C429B00506DB"><enum>(f)</enum><header>Reports</header><text>Not later than 6 months after the date of the enactment of this Act, and every 6 months thereafter, the Secretary shall submit reports to the appropriate committees of the Congress concerning the implementation of this section.</text></subsection>
<subsection id="H57DCA45377F84216AE937963FE6D961F"><enum>(g)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated $3,500,000,000 for fiscal year 2006 and such sums as may be necessary for fiscal year 2007. </text></subsection></section>
<enum>III</enum><header>Relocated children with disabilities</header>
<section id="H92F29FAA81974E12AFE4AC63B710E8CC" commented="no"><enum>301.</enum><header>Grants for LEA’s serving relocated children with disabilities</header>
<subsection id="HD5D3BAABF62141DDB28B504900BC1DF6" commented="no"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary shall make grants to receiving local educational agencies for the purpose of assisting public elementary schools and secondary schools in such agencies to provide special education and related services to students with disabilities who have relocated to the area served by the local educational agency as a result of Hurricane Katrina or Hurricane Rita in accordance with parts B and C of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>).</text></subsection>
<subsection id="HE719737E60984FA48727BB5D96B16892" commented="no"><enum>(b)</enum><header>Maximum amount</header><text>The maximum amount of a grant to a local educational agency under this section for any fiscal year shall be—</text>
<paragraph id="HE7DDD4EDBC6F40E49524867779FECBC"><enum>(1)</enum><text display-inline="yes-display-inline">the amount that is 40 percent of the average per-pupil expenditure in public elementary schools and secondary schools in the United States; multiplied by</text></paragraph>
<paragraph id="H94640EF964834ED1981C3BBD44A4B8EA"><enum>(2)</enum><text display-inline="yes-display-inline">the number of students with disabilities described in subsection (a) who—</text>
<subparagraph id="H60FCAE5BEDCB489FAE7B9E34A42D3300"><enum>(A)</enum><text>are receiving special education and related services from the agency; and</text></subparagraph>
<subparagraph id="H22A83383C0BC4A40B74E10A45741BF6F" commented="no"><enum>(B)</enum><text>are—</text>
<clause id="HE392E1CA284342C0A4A400395B5EB4C6"><enum>(i)</enum><text>3 through 5 years of age if the State in which the agency is located is eligible for a grant under section 619 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1419">20 U.S.C. 1419</external-xref>); or</text></clause>
<clause id="H5E6AF2A0DBDB456EAA0024D136D7A29"><enum>(ii)</enum><text>6 through 21 years of age. </text></clause></subparagraph></paragraph> </subsection>
<subsection id="H4DEBA7FC52F14B61B5E6D55BEF19B9F3" commented="no"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A local educational agency receiving funds under this section may use such funds for any purpose authorized under part B or C of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>).</text></subsection>
<subsection id="HF8CA6840BE77441D9177D16B02D90952"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">To seek a grant under this section, a local educational agency shall submit an application to the Secretary at such time, in such manner, and containing or accompanied by such information as the Secretary may reasonably require.</text></subsection>
<subsection id="H9B5F1B99454346289D476F4D2641C00"><enum>(e)</enum><header>Relation to IDEA</header><text display-inline="yes-display-inline">Subject to any waivers granted by the Secretary, local educational agency receiving funds under this section shall be subject to the same provisions that would apply to the receipt of such funds under part B or C of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>), except that this section shall not be interpreted to grant the Secretary any new waiver authority.</text></subsection>
<subsection id="HCAD9DCBE7AC04BB2AC11D0A000E86466" commented="no"><enum>(f)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated $250,000,000 for fiscal year 2006 and such sums as may be necessary for fiscal year 2007.</text></subsection></section>
<enum>IV</enum><header>Community learning centers</header>
<section id="H3788BB4F2BDC4C5400149CC670425DB1"><enum>401.</enum><header>Grants for activities at community learning centers</header>
<subsection id="H62BA4F5BECE642FF87276E0093A56CFD"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary shall make grants to eligible entities for the purpose of assisting such agencies to carry out activities authorized by part B of title IV of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7171">20 U.S.C. 7171 et seq.</external-xref>).</text></subsection>
<subsection id="H5017E87063C343F1939839C2E45ED5D"><enum>(b)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">In this section, the term <quote>eligible entity</quote> means an eligible entity (as that term is defined in section 4201 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7171">20 U.S.C. 7171</external-xref>)) in a geographical area served by an impacted or receiving local educational agency.</text></subsection>
<subsection id="HAB97E5D6E950493EAAF44E30071482"><enum>(c)</enum><header>Maximum amount</header><text>The maximum amount of a grant to an eligible entity under this section for any fiscal year shall be—</text>
<paragraph id="H0ACF5DDB8CE04E3C89142306D5B6C995"><enum>(1)</enum><text>$1000; multiplied by</text></paragraph>
<paragraph id="H0D701BCF0CC446BE8791F01FBC322503"><enum>(2)</enum><text>the number of additional students expected to be served by the entity as a result of Hurricane Katrina or Hurricane Rita.</text></paragraph></subsection>
<subsection id="H862827472A32481DA7FC8D8774344EE2"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity receiving funds under this section may use such funds for any purpose authorized under part B of title IV of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7171">20 U.S.C. 7171 et seq.</external-xref>).</text></subsection>
<subsection id="HE231721B93984071B134AEDAECF55D00"><enum>(e)</enum><header>Application</header><text>To seek a grant under this section, an eligible entity shall submit an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection>
<subsection id="H95AC258DE1C348CABF36051368A32570"><enum>(f)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated $400,000,000 for fiscal year 2006 and such sums as may be necessary for fiscal year 2007.</text></subsection></section>
<enum>V</enum><header>Improving Educational Infrastructure</header>
<section id="H997EA53408B64CDC9629F22ED10078D8"><enum>501.</enum><header>Grants for construction, modernization, or repair of school facilities</header><text display-inline="no-display-inline">The Secretary of Education shall make grants to impacted local educational agencies and receiving local educational agencies for the purpose of constructing, modernizing, or repairing public kindergarten, elementary, and secondary educational facilities, including the appropriate portion of shared-use facilities, that are safe, healthy, and technology-ready.</text></section>
<section id="H043B19BFE1044C8E868E00F5354C926B"><enum>502.</enum><header>Allowable uses of funds</header><text display-inline="no-display-inline">A local educational agency receiving a grant under this title may use the grant for the following:</text>
<paragraph id="H539E17DCB36040A992EC90799299A29"><enum>(1)</enum><text>Construction of new public school facilities that ensure the health and safety of students and staff, are energy-efficient, and include up-to-date educational technology infrastructure, including where such construction is economically or otherwise more feasible than large scale modernization or repair of existing facilities.</text></paragraph>
<paragraph id="H283233A50AAF49188887F657A5EA362"><enum>(2)</enum><text>Repair or modernization of public school facilities to ensure the health and safety of students and staff, including—</text>
<subparagraph id="H63C44AD4DDFA48F8AA99C211248B0166"><enum>(A)</enum><text>repairing, replacing, or installing roofs, electrical wiring, plumbing systems, sewage systems, windows, or doors;</text></subparagraph>
<subparagraph id="H136AF7C86ABC438BA0F9E77091900AF"><enum>(B)</enum><text>repairing, replacing, or installing heating, ventilation, or air conditioning systems (including insulation); and</text></subparagraph>
<subparagraph id="H5F72F678CCB4400885E5E73C625ECDF5"><enum>(C)</enum><text>bringing public schools into compliance with fire and safety codes.</text></subparagraph></paragraph>
<paragraph id="H2E65D9B56B40433388176674CE8A034"><enum>(3)</enum><text>Upgrading or installation of educational technology infrastructure to ensure that students have access to up-to-date educational technology.</text></paragraph>
<paragraph id="H3ED7404545C54EA781CB23AF1346AF8"><enum>(4)</enum><text>Upgrading school facilities to make them energy-efficient.</text></paragraph>
<paragraph id="H7168C324DE1D489EA8326B8D28D5D365"><enum>(5)</enum><text>Modifications necessary to make public school facilities accessible to comply with the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>) and section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>), except that such modifications shall not be the primary use of the grant.</text></paragraph>
<paragraph id="H44DB8DF9202848FB87E8CFE1A2CF0B"><enum>(6)</enum><text>Asbestos abatement or removal from public school facilities.</text></paragraph>
<paragraph id="H6327A9B06B19475CAECD1CA662971935"><enum>(7)</enum><text>Implementation of measures designed to reduce or eliminate human exposure to lead-based paint hazards though methods including interim controls, abatement, or a combination of each.</text></paragraph> </section>
<section id="H498CB79F031C46A1B75686422BA569FA" commented="no"><enum>503.</enum><header>Application for grant</header>
<subsection id="H5FA83840AA9A49088749ED183D07476C" commented="no"><enum>(a)</enum><header>Applications required</header><text>A local educational agency desiring to receive a grant under this title shall submit an application to the Secretary as such time, in such manner, and containing such information as the Secretary may reasonably require.</text></subsection>
<subsection id="H8FDDF30E3A2346A99EB01128C7F2E6C8" commented="no"><enum>(b)</enum><header>Application contents</header><text>Each application described in subsection (a) shall contain—</text>
<paragraph id="HDF40A3548EC24B3DBA389C11E54E6CFE" commented="no"><enum>(1)</enum><text>an assurance that the application was developed in consultation with parents and classroom teachers, to the extent practicable;</text></paragraph>
<paragraph id="HEBB5ACC2D5254A88BEB9F840005B5828" commented="no"><enum>(2)</enum><text>a description of the overall condition of the local educational agency’s school facilities, including health and safety problems;</text></paragraph>
<paragraph id="HCB9EFFA20CA3479684FE989B8D43BDD9" commented="no"><enum>(3)</enum><text>a description of the capacity of the local educational agency’s schools to house current and projected enrollments;</text></paragraph>
<paragraph id="HDCFF3CC897254B278C9597E768114FD4" commented="no"><enum>(4)</enum><text>a description of the improvements to be supported with funds provided under this title;</text></paragraph>
<paragraph id="HA784E2F40BCF4FFCAB7900002FE98113" commented="no"><enum>(5)</enum><text>a cost estimate of the proposed improvements;</text></paragraph>
<paragraph id="HE4ADCEBD788F4FF78105FA2B76B3BCB" commented="no"><enum>(6)</enum><text>an identification of other resources that are available to carry out the activities for which funds are requested under this title;</text></paragraph>
<paragraph id="H27A9D597E51543C8A9AF1FEE70AEDAC9"><enum>(7)</enum><text>in the case of a local educational agency that proposes to fund a construction, renovation, or repair project for one or more public charter schools, the extent to which the schools have access to funding for the project through the financing methods available to other public schools or local educational agencies in the State; and</text></paragraph>
<paragraph id="H213AB09581CA490E9663CC4D7427EE64" commented="no"><enum>(8)</enum><text>such other information and assurances as the Secretary may reasonably require.</text></paragraph></subsection></section>
<section id="H59B7434519394769A71B89E9D6A4473E"><enum>504.</enum><header>Special rule</header><text display-inline="no-display-inline">Each local educational agency receiving a grant under this title shall ensure that, if the agency carries out construction, modernization, or repair through a contract, the process for any such contract ensures the maximum number of qualified bidders, including small, minority, and women-owned businesses, through full and open competition.</text></section>
<section id="H33211AFE255A4D2CAADCFDBA21BB174"><enum>505.</enum><header>Fair wages</header><text display-inline="no-display-inline">All laborers and mechanics employed by contractors or subcontractors in the performance of any contract or subcontract for the repair, modernization, alteration, or construction, including painting and decorating, of any building or work that is financed in whole or in part by a grant under this title shall be paid wages not less than those determined by the Secretary of Labor in accordance with sections 3141 through 3144 and 3146 of title 40, United States Code (commonly known as the Davis-Bacon Act). The Secretary of Labor shall have the authority and functions set forth in Reorganization Plan No. 14 of 1950 (15 FR 3176; 64 Stat. 1267) and <external-xref legal-doc="usc" parsable-cite="usc/40/3145">section 3145</external-xref> of title 40, United States Code (commonly known as the Copeland Anti-Kickback Act). Notwithstanding any other provision of law, this section may not be waived or suspended.</text></section>
<section id="H479C315292AB4C72A1A21FC48659EBDF"><enum>506.</enum><header>Authorization of appropriations</header> <text display-inline="no-display-inline">To carry out this title, there are authorized to be appropriated such sums as may be necessary for each of fiscal years 2006 and 2007. </text></section>
