<official-title>To amend title 38, United States Code, to provide authority, in certain cases, for the Secretary of Veterans Affairs to provide care for the newborn children of veterans who have been provided maternity care by the Department of Veterans Affairs.</official-title>

<section id="H208699C201DD467283908F113CC17818" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Care for newborn children of veterans receiving maternity care</header> 
<subsection id="H9D8BC31A8DDA402C9FCF791687F9CE1"><enum>(a)</enum><header>Authority to provide newborn infant care</header><text>Subchapter VIII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block style="USC" id="HBA7228F1CDB542949D7EC1BD0644867D"> 
<section id="HFA7BEBA3825145FBB7617ED9B99F3FF"><enum>1786.</enum><header>Care for newborn children of veterans receiving maternity care</header> 
<subsection id="H09B116D270B84390A1F6A2A7494C721B"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">When a veteran who is enrolled in the system of patient enrollment established under section 1705 of this title is receiving maternity care from the Department and gives birth to a child in a Department facility, or in a non-Department facility in a case in which the expenses of the care of the veteran are covered under a Department contract, the Secretary may furnish care to the newborn child, subject to subsections (b) and (c).</text></subsection> 
<subsection id="HCECC0AEBF30D4117BB7B1F0063006D3C"><enum>(b)</enum><header>Care in a Department facility</header><text>In a case in which a newborn child covered by subsection (a) is born in a Department facility, care furnished to the child at that facility shall be furnished without charge to the veteran who gave birth to the child.</text></subsection> 
<subsection id="H7CC4CDAF822E4A5500DC08D64BCDC500"><enum>(c)</enum><header>Care in a non-department facility</header> 
<paragraph display-inline="yes-display-inline" id="HF3DC98E19049484BA1EFF59B993B4ED7"><enum>(1)</enum><text>In a case in which a newborn child covered by subsection (a) is born in a non-Department facility or is provided care in a non-Department facility following birth in a Department facility and transfer from that facility, the Secretary shall provide for the payment of the cost of care and services for the newborn child for which the veteran is personally liable, subject to the regulations prescribed pursuant to paragraph (3).</text></paragraph> 
<paragraph indent="up1" id="HFC1A4ED797D942E19507782F4D2C5472"><enum>(2)</enum><text>For purposes of paragraph (1), a veteran shall be considered to be personally liable for an amount for the cost of care and services furnished to a newborn child only if—</text> 
<subparagraph id="H62482243534444919CAC17C5E2D976F4"><enum>(A)</enum><text>the veteran is financially liable to the provider for such amount;</text></subparagraph> 
<subparagraph id="H836CF43E3E7F4D0D8DEA47F7BCB3705F"><enum>(B)</enum><text>the newborn child has no eligibility for coverage for care or services under a health-plan contract determined, in the case of a health-plan contract referred to in subparagraph (A), (B), or (C) of section 1725(f)(2) of this title, without regard to any requirement or limitation relating to eligibility for care or services from any department or agency of the United States); and</text></subparagraph> 
<subparagraph id="H33D48A5073F64E839648E976A9561900"><enum>(C)</enum><text>the veteran has no other contractual or legal recourse against a third party that would, in whole or in part, extinguish the veteran’s liability to the provider for such amount.</text></subparagraph></paragraph> 
<paragraph id="H414BD6FD9E8543A4B37900C763368964" indent="up1"><enum>(3)</enum><text>The Secretary shall prescribe regulations to—</text>
<subparagraph id="HF812F29262D24FFF929B29AE2DCDE69B"><enum>(A)</enum><text>establish the maximum amount payable under paragraph (1), which may not exceed the amount payable for the same care and services under the State plan for medical assistance approved under title XIX of the <act-name parsable-cite="SSA">Social Security Act</act-name> of the State in which the newborn child is born;</text></subparagraph>
<subparagraph id="H8A5A5FF601EE4CFD8998005FE9D99146"><enum>(B)</enum><text>provide that in no event may a payment under paragraph (1) include any amount for which the veteran is not personally liable; and</text></subparagraph>
<subparagraph id="HD75B99FAD787400DAFB723B500A9F168"><enum>(C)</enum><text>delineate the scope of care and services for which payment may be made under paragraph (1), but in no case may such care and services be furnished after the month following the month in which the child is born.</text> </subparagraph></paragraph>
<paragraph id="HA3E3FE5039254BA59B301D7353182827" indent="up1"><enum>(4)</enum><text>Payment of an amount by the Secretary under paragraph (1) on behalf of a veteran to a provider of care and services to a newborn child delivered by that veteran shall, unless rejected and refunded by the provider within 30 days of receipt, extinguish any liability on the part of the veteran for the cost of such care and services. </text></paragraph> 
<paragraph indent="up1" id="HBA0615684DCE4357A53476D3BCC3835F"><enum>(5)</enum><text>In this subsection:</text> 
<subparagraph id="H97B30AC2A97745CE8FA027517C82DE4D"><enum>(A)</enum><text>The term <term>health contract</term> has the meaning given that term in section 1725(f)(2) of this title and includes a State child health plan approved under title XXI of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1397">42 U.S.C. 1397 et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="H20620F97174749738DD84578C5DB5F00"><enum>(B)</enum><text>The term <term>third party</term> has the meaning given that term in section 1725(f)(3) of this title.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0C70F191DE3D43C98DC227ECB6CC0681"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1785 the following new item:</text>

<toc-entry level="section">1786. Care for newborn children of veterans receiving maternity care</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFED162646C704352A58800576E5792D5"><enum>(c)</enum><header>Effective Date</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1786">Section 1786</external-xref> of title 38, United States Code, as added by subsection (a), shall apply to care furnished to newborn children born on or after the date of the enactment of this Act.</text></subsection> 
<subsection id="H8FF21CB1FA7D4BA398CE503FD65D8BDD"><enum>(d)</enum><header>Deadline for regulations</header><text display-inline="yes-display-inline">Regulations to carry out <external-xref legal-doc="usc" parsable-cite="usc/38/1786">section 1786</external-xref> of title 38, United States Code, as added by subsection (a), shall be prescribed by the Secretary of Veterans Affairs not later than 180 days after the date of the enactment of this Act.</text></subsection></section>
