<official-title>To amend the Internal Revenue Code of 1986 to allow the Hope Scholarship Credit to be used for elementary and secondary expenses.</official-title>

<section section-type="section-one" id="H0C5E235A74624AA6AD2D6FC883426ECE" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hope Plus Scholarship Act of 2005</short-title></quote>.</text></section> 
<section id="HCB8A512A3C094A3692849CF19301EE28"><enum>2.</enum><header>Hope Scholarship Credit available for elementary and secondary educational expenses</header> 
<subsection id="HF00B7C591F6D415780E0320C8AE6BC7"><enum>(a)</enum><header>In general</header><text>Subsection (f) of <external-xref legal-doc="usc" parsable-cite="usc/26/25A">section 25A</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>

<paragraph id="H9934AAC4B4DD4D7BB5A06705CAB5E2B2"><enum>(3)</enum><header>Special rule for Hope Scholarship Credit</header><text>In the case of the Hope Scholarship Credit, the term <term>qualified tuition and related expenses</term> shall include <quote>qualified elementary and secondary education expenses</quote> (as defined in section 530(b)(4)); except that—</text> 
<subparagraph id="H36CA99FCEDC4420C88C8D1835731C33D"><enum>(A)</enum><text>such term shall include a contribution or gift to the school (other than the home school) at which dependents of the taxpayer are attending, and</text></subparagraph> 
<subparagraph id="H1198B946F418410D933C99CD0509B9E1"><enum>(B)</enum><text>the term <term>school</term> shall include a home school.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC780D8908CCA4714ABFD6C4C5E736DF"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after December 31, 2004.</text></subsection></section>
