<official-title>To amend the Immigration and Nationality Act to improve enforcement of restrictions on employment in the United States of unauthorized aliens.</official-title>

<section id="H55C66DDC568F419EB2E6769745A9816D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unlawful Employers Accountability Act of 2005</short-title></quote>.</text></section>
<section id="HCD6994BE51114298B73122FAFD760958"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H91C726D4ADF44AEE8723AB69CA4ECF"><enum>(1)</enum><text display-inline="yes-display-inline">Current efforts to stem the tide of illegal immigrants crossing into the United States have fallen far short of need.</text></paragraph>
<paragraph id="HDB158C087C21442DA09000B6F2AF7C26"><enum>(2)</enum><text display-inline="yes-display-inline">The number of illegal immigrants currently in the United States is approximating 11 million.</text></paragraph>
<paragraph id="H227F4474ACB044A4BE63215100C4C522"><enum>(3)</enum><text display-inline="yes-display-inline">Cities, counties, and States are forced to absorb the costs of illegal immigration without compensation from the Federal Government or employers.</text></paragraph>
<paragraph id="HA52FDFA3BADE471582CD718BEFC8DAD4"><enum>(4)</enum><text>United States companies continue to recruit and hire illegal immigrants and thereby aid in the erosion of the border security of the United States.</text></paragraph>
<paragraph id="H70F28DFB49DF47E3A1938BB2283753ED"><enum>(5)</enum><text>The hiring of illegal immigrants has had a negative impact on the employment opportunities of legal immigrants and United States citizens.</text></paragraph>
<paragraph id="H56E4F71F9DB54871AF008C78A44F5DB5"><enum>(6)</enum><text>Federal law expressly prohibits the hiring of illegal immigrants.</text></paragraph>
<paragraph id="H6A598C2F5F9F4104880020FBC5C1ACD1"><enum>(7)</enum><text>In 2004, only three United States companies were cited for hiring illegal immigrants.</text></paragraph></section> 
<section id="HD8738BE838FC4B6EA7F4C26BE7E395C9"><enum>3.</enum><header>Compliance with respect to the unlawful employment of aliens</header> 
<subsection id="HCCC5C821482A48218365BF071BCF2CE9"><enum>(a)</enum><header>Civil penalty</header><text display-inline="yes-display-inline">Paragraph (4) of subsection (e) of section 274A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H38E782A633084430A8F4DFEBC800D6F5" display-inline="no-display-inline"> 
<paragraph id="H563041086EE74BF3B8C3B9DAB65D9971"><enum>(4)</enum><header>Cease and desist order with civil money penalty for hiring, recruiting, and referral violations</header> 
<subparagraph id="H161D99A9C73E4A4A00FC7413D5437FAE"><enum>(A)</enum><header>In general</header><text>With respect to a violation by any person or other entity of subsection (a)(1)(A) or (a)(2), the Secretary of Homeland Security shall require the person or entity to cease and desist from such violations and to pay a civil penalty in the amount specified in subparagraph (B).</text></subparagraph> 
<subparagraph id="H2B92A9A0F04E4F6186A5CD52441766D1"><enum>(B)</enum><header>Amount of civil penalty</header><text display-inline="yes-display-inline">A civil penalty under this paragraph shall not be less than $50,000 for each occurrence of a violation described in subsection (a)(1)(A) or (a)(2) with respect to the alien referred to in such subsection, plus, in the event of the removal of such alien from the United States based on findings developed in connection with the assessment or collection of such penalty, the costs incurred by the Federal Government, cooperating State and local governments, and State and local law enforcement agencies, in connection with such removal.</text></subparagraph> 
<subparagraph id="H1B820E74B67248628EB47060A1C8AE8E"><enum>(C)</enum><header>distribution of penalties to State and local governments</header> 
<clause id="HFA6BD42F29E3405FA12051E34F239675"><enum>(i)</enum><header>In general</header><text>Penalties collected under this paragraph from a person or entity shall be distributed as follows:</text> 
<subclause id="HF82EA5583F9A45A0BFCBF96EC3835CA6"><enum>(I)</enum><text>25 percent of such amount shall be distributed to the State in which the person or entity is located.</text></subclause> 
<subclause id="H62556E19D14D45AA88806E6E13A51291" commented="no"><enum>(II)</enum><text>25 percent of such amount shall be distributed to the county in which the person or entity is located.</text></subclause> 
<subclause id="H7A087AE80AD94A6C89FA91433FBC3F48" commented="no"><enum>(III)</enum><text>25 percent of such amount shall be distributed to the municipality, if any, in which the person or entity is located, or, in the absence of such a municipality, to the county described in subclause (II).</text></subclause></clause> </subparagraph> 
<subparagraph id="HF2C3E634634D436CA1EF102634A686F9"><enum>(D)</enum><header>Limitation on use of funds</header><text>Amounts paid to a State, county, or municipality under subparagraph (C) may only be used for costs incurred by such State, county, or municipality in providing public services to aliens not lawfully present in the United States.</text></subparagraph> 
<subparagraph id="H1CBF88CA9F9141ECA6703F7D54247003"><enum>(E)</enum><header>Distinct, physically separate subdivisions</header><text>In applying this subsection in the case of a person or other entity composed of distinct, physically separate subdivisions each of which provides separately for the hiring, recruiting, or referring for employment, without reference to the practices of, and not under the control of or common control with, another subdivision, each such subdivision shall be considered a separate person or other entity.</text> </subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE206BDDD9732412DAF441723A4D369D"><enum>(b)</enum><header>Denial of agricultural assistance for violators</header><text>Such section is further amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HDDA35DA03F914946A0FF2F1654E5807F" display-inline="no-display-inline"> 
<subsection id="H4C15AA1491F745729541FC750852659C"><enum>(i)</enum><header>Denial of agricultural assistance for violators</header><text display-inline="yes-display-inline">In the case of a violation of subsection (a)(1)(A) or (a)(2) by an agricultural association, agricultural employer, or farm labor contractor (as defined in section 3 of the Migrant and Seasonal Agricultural Worker Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1802">29 U.S.C. 1802</external-xref>)), such association, employer, or contractor shall be ineligible for agricultural assistance described in paragraphs (1), (2), and (3) of section 1211(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3811">16 U.S.C. 3811(a)</external-xref>) for a period not to exceed five years.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1D9BB6EB5A6E47F091461EFE38AF5163"><enum>(c)</enum><header>Good faith defense</header>
<paragraph id="HC72262FDBFA14829BFFEDAAB60DCC57C"><enum>(1)</enum><header>In general</header><text>Such section is further amended—</text>
<subparagraph id="H745D590546464542A5B3355C4B6C3F02"><enum>(A)</enum><text>by striking subsection (a)(3); and</text></subparagraph>
<subparagraph id="H2DAC35BFEB1D45A099AA471EA62F2D42"><enum>(B)</enum><text>by striking subsection (b)(6).</text> </subparagraph></paragraph> 
<paragraph id="H642432CD3C8F4B24A159F1A163D137EE"><enum>(2)</enum><header>Conforming amendments</header><text>Such section is further amended—</text> 
<subparagraph id="H410F88D11CB04FD08E60221EE9995D8E"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(5), by striking <quote>paragraphs (1)(B) and (3)</quote> and inserting <quote>paragraph (1)(B)</quote>; and</text></subparagraph>
<subparagraph id="H48030DE742B1422A97D37D5EE95C3BC9"><enum>(B)</enum><text>in subsection (b)—</text>
<clause id="HE7EB0C9DDE2E410E9CFF46E120B2AE6C"><enum>(i)</enum><text>in the matter preceding paragraph (1), by striking <quote>paragraphs (1)(B) and (3)</quote> and inserting <quote>paragraph (1)(B)</quote>; and</text></clause>
<clause id="H6B6FB69E7DC442F988A978364ECE04B5"><enum>(ii)</enum><text>by striking paragraph (6).</text></clause></subparagraph> </paragraph></subsection> 
<subsection id="HD48CECEB12C248E100CAACBDC18ED146"><enum>(d)</enum><header>Employee whistleblower protection</header><text>It shall be unlawful for any employer, including an employer primarily engaged in agriculture, or any labor contractor to intimidate, threaten, restrain, coerce, retaliate, discharge, demote, or in any other manner discriminate against an employee or former employee, regardless of the immigration status of such employee or former employee, because such employee or former employee—</text> 
<paragraph id="HB8D142C59E43405C803F5CE9EDD0F300"><enum>(1)</enum><text>has disclosed, is disclosing, or seeks to disclose to Federal, State, or local law enforcement authorities information related to a violation of an applicable Federal labor law as defined by the Secretary of Labor; or</text></paragraph> 
<paragraph id="H1FADA947E02542529C19286F4D85AB83"><enum>(2)</enum><text>has cooperated, is cooperating, or seeks to cooperate in an investigation or other proceeding concerning compliance with such an applicable Federal labor law.</text></paragraph></subsection> 
<subsection id="H381DF5AF91064A0DA95BDB3E82E52E72"><enum>(e)</enum><header>Disclosure requirements</header> 
<paragraph id="H33D80FC1B254434DB3FB911271724E1D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall establish, maintain, and regularly update a publicly accessible website that contains a list of persons or other entities that the Secretary has determined to have been in violation of subsection (a)(1)(A) or (a)(2) of section 274A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref>) in the preceding five years.</text></paragraph> 
<paragraph id="HF7E36897F2D943F8A8AD881BC83CFB5F"><enum>(2)</enum><header>Contents of website</header><text>Such website shall contain, with respect to each such person or entity, the following information:</text> 
<subparagraph id="H21C2B3EB290F425697960099C9093195"><enum>(A)</enum><text>The name, address, and telephone number of the person or entity.</text></subparagraph> 
<subparagraph id="HFC2D535764EB401890AEED1730D96700"><enum>(B)</enum><text>The names of the owners, chief executive officers, or other similar officers of the person or entity.</text></subparagraph> 
<subparagraph id="H7750B3FC98EC411E8BED704CB273CFF"><enum>(C)</enum><text>The number of unauthorized aliens (as defined in subsection (h)(3) of such section) found to be employed by the person or entity.</text></subparagraph> 
<subparagraph id="HE910D8C42FE64AF98C10D7ECA9862D7"><enum>(D)</enum><text>The aggregate dollar amount that the person or entity has received in the preceding five years under any Federal contract.</text></subparagraph></paragraph></subsection> 
<subsection id="H112AD7C6EF1A438780AF7219DADE10BD"><enum>(f)</enum><header>Effective date</header><text>The amendments made by subsections (a), (b), and (c) shall take effect 30 days after the date of the enactment of this Act and shall apply to violations occurring on or after such effective date.</text></subsection></section>
