<official-title>To prohibit offering homebuilding purchase contracts that contain in a single document both a mandatory arbitration agreement and other contract provisions, and to prohibit requiring purchasers to consent to a mandatory arbitration agreement as a condition precedent to entering into a homebuilding purchase contract.</official-title>

<section section-type="section-one" id="HEE9FFC107D204B40A66313CC77EC155C" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Homebuyers Protection Act</short-title></quote>.</text></section> 
<section id="H9FC58FF3CBEA458F9800C1C9DE7F4E74"><enum>2.</enum><header>Mandatory arbitration agreements</header> 
<subsection id="HD7F93D9FA86A4E40B7E09C00665020A"><enum>(a)</enum><header>In General</header><text>No person engaged in the construction of new houses may require a purchaser to enter into a mandatory arbitration agreement as a condition precedent to entering into a contract for the purchase of a new house.</text></subsection> 
<subsection id="H6742AC1649634B8C97F6E4AECE438FCA"><enum>(b)</enum><header>Separate Documents Required</header><text>No person engaged in the construction of new houses may offer a purchaser a contract for the purchase of a new house which includes an agreement on mandatory arbitration unless such agreement is a separate document which contains only language pertaining to the mandatory arbitration agreement. The separate document containing the mandatory arbitration agreement shall also contain the following statement: <quote>By Agreeing to Binding Arbitration You Are Giving Up Your Right To Go To Court</quote>.</text></subsection> 
<subsection id="H6DD4008C2122411B9E1141D0E2CE6F0"><enum>(c)</enum><header>Arbitrator</header><text>The mandatory arbitration agreement shall not name an independent arbitrator and shall contain a procedure that adequately guarantees the purchaser an opportunity to participate in the selection of an arbitrator which shall occur only after a dispute regarding the homebuilding contract has arisen.</text></subsection> 
<subsection id="H19006B059EBA4842A0F5E6703C46BF5D"><enum>(d)</enum><header>Enforcement</header><text>If any person violates subsection (a), (b), or (c), the agreement on mandatory arbitration will be of no effect.</text></subsection></section>
