<section id="HF9565CB101DD44EDA37CE978941D035E" section-type="section-one"><enum>1.</enum><header>Required minimum wage for temporary H-2A workers</header><text display-inline="no-display-inline">Section 218(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1188">8 U.S.C. 1188(b)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HB5DCEDFA1D6642C09C82EDF1F94E40B2" display-inline="no-display-inline"> 
<paragraph id="H8B06E488328F4FE8817E1720757C15F2"><enum>(5)</enum><text>The employer has not provided the Secretary with satisfactory assurances that the employer will pay the alien at least—</text> 
<subparagraph id="HC7273FADBA2B4FABAD9465402C8F78ED"><enum>(A)</enum><text display-inline="yes-display-inline">the legal Federal or State minimum wage rate, whichever is highest, for every hour or portion thereof worked during a pay period, if the alien will be paid by the hour; or</text></subparagraph> 
<subparagraph id="HEFD07014D1624E3F852BE095F927CB60"><enum>(B)</enum><text>an aggregate amount, for each pay period, that is at least equal to the amount the worker would have earned during the pay period if the alien had been paid at the hourly rate described in subparagraph (A) for each hour worked, if the worker will be paid on a piece rate basis.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
