<section id="H7D6ACEEB2449463B853189B2187536AF" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Disaster Loan Act of 2005</short-title></quote>.</text></section>
<section id="HDD49B378129345619EBB56C8033EEA83"><enum>2.</enum><header>Availability of amounts for community disaster loan program</header>
<subsection id="H4EA067CEA7A247FB88D0B5592FA1A86E"><enum>(a)</enum><header>Cost of direct loans</header>
<paragraph id="H070D8BFB77214FC791009C619404F62B"><enum>(1)</enum><header>Authority to transfer amounts</header><text>Of the amounts provided in <external-xref legal-doc="public-law" parsable-cite="pl/109/62">Public Law 109–62</external-xref> for <quote>Disaster Relief</quote>, up to $300,000,000 may be transferred to the Disaster Assistance Direct Loan Program for the cost of direct loans authorized by section 417 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5184">42 U.S.C. 5184</external-xref>) to be used to assist local governments in providing essential services.</text></paragraph>
<paragraph id="H1F1E79CC11BB4D9997255181629532FF"><enum>(2)</enum><header>Terms and conditions</header><text>Amounts transferred under paragraph (1) shall be subject to the following terms and conditions:</text>
<subparagraph id="H62CDEFC1B4BD49A0AA0068548F3E7E34"><enum>(A)</enum><text display-inline="yes-display-inline">Such amounts may be used to subsidize gross obligations for the principal amount of direct loans not to exceed $400,000,000 under section 417 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.</text></subparagraph>
<subparagraph id="HBFC7D8F753E14473B900D7A52C206979" commented="no"><enum>(B)</enum><text>Notwithstanding section 417(b) of such Act, the amount of any loan issued using such amounts may exceed $5,000,000.</text></subparagraph>
<subparagraph id="H3EE6E95917C7466F971057DA02090754" commented="no"><enum>(C)</enum><text>Notwithstanding section 417(c)(1) of such Act, repayment of all or any part of a loan issued using such amounts may not be canceled.</text></subparagraph>
<subparagraph id="HDC1891AED5954C1E889E087923CD828B"><enum>(D)</enum><text>The cost of modifying such loans shall be as defined in section 502 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>).</text></subparagraph></paragraph></subsection>
<subsection id="H2FBD4055407E4EAEA46B72374ED518E6"><enum>(b)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">Of the amounts provided in <external-xref legal-doc="public-law" parsable-cite="pl/109/62">Public Law 109–62</external-xref> for <quote>Disaster Relief</quote>, up to $1,000,000 may be transferred to the Disaster Assistance Direct Loan Program for administrative expenses to carry out the direct loan program authorized by section 417 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.</text></subsection></section>
<section id="HF02864CE3F654CAC82A8E10000F4FCBE"><enum>3.</enum><header>Community disaster loan amounts and repayment</header>
<subsection id="H5FAFC3CB76CA4EEE8EA5B300D1B846AB"><enum>(a)</enum><header>Loan amounts</header><text>Section 417(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5184">42 U.S.C. 5184(b)</external-xref>) is amended—</text>
<paragraph id="H26A4476803E14305B862D529C7E1A747" display-inline="no-display-inline"><enum>(1)</enum><text>by striking <quote>based on need, shall</quote> and inserting <quote>based on need and shall</quote>; and</text></paragraph>
<paragraph id="HEF1732AB66D94137BA3BB32F417EC987"><enum>(2)</enum><text>by striking <quote>, and shall not exceed $5,000,000</quote>.</text></paragraph></subsection>
<subsection id="HA52C9D4C54BA48EA911553539EDFBF00"><enum>(b)</enum><header>Repayment</header><text display-inline="yes-display-inline">Section 417(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5184">42 U.S.C. 5184(c)</external-xref>) is amended by striking <quote>(c) <header-in-text level="subsection" style="OLC">Repayment.—</header-in-text></quote> and all that follows through <quote>(2) <header-in-text level="paragraph" style="OLC">Condition on continuing eligibility</header-in-text>.—A local government</quote> and inserting the following: </text>

<subsection id="HC9F62B9B15314108ADD73F27BC178922"><enum>(c)</enum><header>Condition on continuing eligibility</header><text>A local government</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H9B33FC9D047742238C4850834C589C7C"><enum>(c)</enum><header>Applicability</header><text>The amendments made by subsections (a) and (b) shall apply to any loan made under section 417 of such Act after the date of enactment of this Act.</text></subsection></section>
