<official-title>To authorize the Community Development Financial Institutions Fund to conduct a special round of funding in fiscal year 2006 for assistance in areas affected by Hurricane Katrina, and for other purposes.</official-title>

<section id="H788AE2E86305480A8FDE15A2B21101BD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Implementing Katrina Disaster Relief Through the CDFI Fund Act</short-title></quote>.</text></section> 
<section id="H059679A58B774F5198C1868BEA2E81A8"><enum>2.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">In addition to amounts appropriated to the Community Development Financial Institutions Fund (hereafter in this Act referred to as the <quote>Fund</quote>) for fiscal year 2006 to carry out the purposes of the Community Development Banking and Financial Institutions Act of 1994, there are authorized to be appropriated to the Fund (which may be derived by transfer from funds appropriated for <quote>Disaster Relief</quote> in <external-xref legal-doc="public-law" parsable-cite="pl/109/62">Public Law 109–62</external-xref>), such sums as may be necessary for fiscal year 2006 to carry out such Act for the purposes of, and in the manner provided in, this Act.</text></section> 
<section id="HF888D37C42844366A37578BAB59CEF7"><enum>3.</enum><header>Assistance provided by the Fund for Hurricane Katrina assistance</header> 
<subsection id="H1355EE0D36AB46B6BC65FE9754CBA3CE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts appropriated pursuant to the authorization under section 2 shall be available to the Fund under the Community Development Banking and Financial Institutions Act of 1994 for the purposes of such Act, including technical and training assistance, awards under the Bank Enterprise Act of 1991, equity investments, deposits, and other forms of financial assistance to community development financial institutions, in accordance with subsection (b).</text></subsection> 
<subsection id="H01509794B96B440AAFD7A2B9F1D4DA0"><enum>(b)</enum><header>Adjustments to criteria</header><text>In providing assistance under subsection (a), the Community Development Banking and Financial Institutions Act of 1994 shall be applied with the following adjustments:</text> 
<paragraph id="H1243991DC72D42888051A500B4ADD844"><enum>(1)</enum><header>Designation of assisted areas</header><text display-inline="yes-display-inline">Notwithstanding section 107(b) of the Community Development Banking and Financial Institutions Act of 1994, the Fund shall limit the selection of community development financial institution applicants for assistance pursuant to this section to any financial institution that—</text> 
<subparagraph id="HF7D95437BCDD4EF489ACCEF6CD9987C9"><enum>(A)</enum><text display-inline="yes-display-inline">is located in a Hurricane Katrina affected area; or</text></subparagraph> 
<subparagraph id="HA1B1A0B2D8E34F859BA01CCD3D28C9FD"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrates to the satisfaction of the Fund that the financial institution has the ability to provide capital, credit or financial services within the Hurricane Katrina affected area.</text></subparagraph></paragraph> 
<paragraph id="HA0CDBF51D3524C7D0021B095A318F81E"><enum>(2)</enum><header>Waiver of matching requirements</header><text display-inline="yes-display-inline">In the case of an applicant with severe constraints on available sources of matching funds, the Fund may reduce or waive the matching requirements of section 108(e)(1) of the Community Development Banking and Financial Institutions Act of 1994 for such applicant for purposes of this section.</text></paragraph> 
<paragraph id="H3B3D4B71783F45E698AF9EA742B727F"><enum>(3)</enum><header>Waiver of limitations on certain forms of assistance</header><text>The limitation contained in section 113(c) of the Community Development Banking and Financial Institutions Act of 1994 shall not apply to assistance provided under this section in accordance with section 113 of such Act.</text></paragraph> 
<paragraph id="H48AE7B20C35C492FA8CCD9C290F8EEB8"><enum>(4)</enum><header>Application of Bank Enterprise Act of 1991</header><text>In making assistance under this section available in the manner provided in section 114 of the Community Development Banking and Financial Institutions Act of 1994, the Bank Enterprise Act of 1991 shall be applied under section 114(a)(2)—</text> 
<subparagraph id="H53DDDD78272D4F1DB53800E17B74263B"><enum>(A)</enum><text>by substituting <quote>Hurricane Katrina affected area</quote>, as defined in subsection (c), for <quote>qualified distressed community</quote>; and</text></subparagraph> 
<subparagraph id="H15D7B64BD8224AC9A55BECD60200C2B"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to life line accounts, by taking into account only life line accounts offered in an Hurricane Katrina affected area.</text></subparagraph></paragraph></subsection> 
<subsection id="H6702C41E961D4511BDABD0C2B9D027AE"><enum>(c)</enum><header>Hurricane Katrina affected area defined</header><text>For purposes of this section, the term <quote>Hurricane Katrina affected area</quote> means any county (as defined in <external-xref legal-doc="usc" parsable-cite="usc/1/2">section 2</external-xref> of title 1, United States Code) that—</text> 
<paragraph id="H8D8389E2902749CC9045A200F9007B46"><enum>(1)</enum><text display-inline="yes-display-inline">is within an area in which the President, pursuant to section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, has determined, on or after August 28, 2005, that a major disaster exists due to Hurricane Katrina; and</text></paragraph> 
<paragraph id="HD792D49E3B0F4AFBAB46D1A57721632F"><enum>(2)</enum><text display-inline="yes-display-inline">has been designated by the Federal Emergency Management Agency as an area in which public assistance or individual assistance is available as a result of Hurricane Katrina. </text> </paragraph></subsection></section>
