<official-title>To provide emergency assistance for families receiving assistance under part A of title IV of the Social Security Act and low-income working families.</official-title>

<section section-type="section-one" id="H1D79A4F4F4BD483EA46E15DA6EC39C1B" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Low-Income Gasoline Assistance Program Act</short-title></quote>.</text></section> 
<section id="HA8408AB63BC540C8B49BCC182D84C060"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to create new emergency assistance programs to assist families receiving assistance under part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> and low-income working families to meet the increasing price of gasoline.</text></section> 
<section id="H9CFE259892124B4C8137DF017E00B18"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H02904493D14F45BF8402B5A006191B00"><enum>(1)</enum><header>Covered activities</header><text>The term <term>covered activities</term> means—</text> 
<subparagraph id="HC4D90760AF5647788181D5B92D507952"><enum>(A)</enum><text>work activities;</text></subparagraph> 
<subparagraph id="HEA84CAED8B784826809C3D92977E9FB7"><enum>(B)</enum><text>education directly related to employment; or</text></subparagraph> 
<subparagraph id="H390317B140324A72BBC8B7320317038"><enum>(C)</enum><text>activities related to necessary scheduled medical treatment.</text></subparagraph></paragraph> 
<paragraph id="H4BE7D6E401BD4B968500DF33A92BEFD7"><enum>(2)</enum><header>Gasoline</header><text>The term <term>gasoline</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/4082">section 4082</external-xref> of the Internal Revenue Code of 1986.</text></paragraph> 
<paragraph id="HC5DE97297DED42F0A1599C685BC1259D"><enum>(3)</enum><header>Household</header><text>The term <term>household</term> has the meaning given the term in section 2603 of the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8622">42 U.S.C. 8622</external-xref>).</text></paragraph> 
<paragraph id="HD64E4540326A4A7183CF19E8D00B671"><enum>(4)</enum><header>Poverty level; State median income</header><text>The terms <term>poverty level</term> and <term>State median income</term> have the meanings given the terms in section 2603 of the Low-Income Home Energy Assistance Act of 1981.</text></paragraph> 
<paragraph id="HC338793532994FAD93C9B771E588B6B5"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph> 
<paragraph id="H30CD3FB91D6345BFA5C299647F0000A3"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and the Commonwealth of Puerto Rico.</text></paragraph> 
<paragraph id="HD3A946B17CC5433191212F5B1CE37C80"><enum>(7)</enum><header>Work activities</header><text>The term <term>work activities</term> has the meaning given the term in section 407(d) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(d)</external-xref>).</text></paragraph></section> 
<section id="H865E015A15AC47C99933EAEF6C86BDD2"><enum>4.</enum><header>Emergency assistance programs</header><text display-inline="no-display-inline">The Secretary shall make grants to States, from allotments made under section 5, to enable the States to establish emergency assistance programs and to provide, through the programs, payments to eligible households to enable the households to purchase gasoline.</text></section> 
<section id="HBF79473186E54C83830798CBB9B82476"><enum>5.</enum><header>State allotments</header><text display-inline="no-display-inline">From the funds appropriated under section 13 for a fiscal year and remaining after the reservation made in section 12, the Secretary shall allot to each State an amount that bears the same relation to such remainder as the amount the State receives under section 675B of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9906">42 U.S.C. 9906</external-xref>) for that year bears to the amount all States receive under that section for that year.</text></section> 
<section id="HF4C0A4DADE104B9493F6AA302FFAA6BE"><enum>6.</enum><header>State applications</header> 
<subsection id="H27D8CF27F5DE44ECBC8F84E5FBD8D083"><enum>(a)</enum><header>In general</header><text>To be eligible to receive a grant under this Act, a State shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> 
<subsection id="H178209A05B794B70B1CDED3AA2FA150"><enum>(b)</enum><header>Contents</header><text>At a minimum, the application shall contain—</text> 
<paragraph id="HD1075D98941C41B29CD9D5481339004D"><enum>(1)</enum><text>information designating a State agency to carry out the emergency assistance program in the State, which shall be—</text> 
<subparagraph id="H0D704E589EFD4496AAEB97BCD2A6E1EC"><enum>(A)</enum><text>the State agency specified in the State plan submitted under section 402 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602</external-xref>); or</text></subparagraph> 
<subparagraph id="HD889D2F5DF3342B9A1F12D31F7EAF1A5"><enum>(B)</enum><text>the State agency designated under section 676(a) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9908">42 U.S.C. 9908(a)</external-xref>); and</text></subparagraph></paragraph> 
<paragraph id="H171FAA8EF52B431DB9009C468DBBD5E"><enum>(2)</enum><text>information describing the emergency assistance program to be carried out in the State.</text></paragraph></subsection></section> 
<section id="H7B16DF10C4C249C2910010CD2519EF96"><enum>7.</enum><header>Participation of Indian tribes</header> 
<subsection id="H6EF8B212607C4596A7F0C441232D962D"><enum>(a)</enum><header>Reservation</header><text display-inline="yes-display-inline">If, with respect to a State, the Secretary—</text> 
<paragraph id="HB792F2C0B83B48819F27DC0091CA792"><enum>(1)</enum><text>receives a request from the governing body of an Indian tribe or tribal organization in the State that assistance under this Act be made directly to the tribe or organization; and</text></paragraph> 
<paragraph id="HD4B437E90195487687BE48F6E5000010"><enum>(2)</enum><text display-inline="yes-display-inline">determines that the members of the tribe or organization would be better served by means of grants made directly to provide benefits under this Act,</text></paragraph><continuation-text continuation-text-level="subsection">the Secretary shall reserve from amounts that would otherwise be allotted to the State under section 5 for the fiscal year the amount determined under subsection (b) of this section.</continuation-text></subsection> 
<subsection id="HCBE61D127232459E8FF30700F2F0A767"><enum>(b)</enum><header>Determination of reserved amount</header><text display-inline="yes-display-inline">The Secretary shall reserve from amounts that would otherwise be allotted to the State, not less than 100 percent of an amount that bears the same ratio to the State allotment for the fiscal year involved as the population of all eligible Indians for whom a determination has been made under subsection (a) bears to the population of all individuals in the State who are eligible for assistance through a grant made under this Act.</text></subsection> 
<subsection id="H3B727AA415AD49D1AE453E4C4FB834E2"><enum>(c)</enum><header>Awards</header><text display-inline="yes-display-inline">The sums reserved by the Secretary on the basis of a determination made under subsection (a) shall be made available by grant to the Indian tribe or tribal organization serving the individuals for whom such a determination has been made.</text></subsection> 
<subsection id="H0F81C2B62C204865A761EF325FF6A853"><enum>(d)</enum><header>Plan</header><text display-inline="yes-display-inline">In order for an Indian tribe or tribal organization to be eligible for a grant award for a fiscal year under this section, the tribe or organization shall submit to the Secretary a plan for the fiscal year that meets such criteria as the Secretary may prescribe by regulation.</text></subsection> 
<subsection id="H76DACC45003342C5B7FDB659CF21524B"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H07D2AD7F94A748F5A5C3734B18085739"><enum>(1)</enum><header>Indian tribe; tribal organization</header><text display-inline="yes-display-inline">The terms <quote>Indian tribe</quote> and <quote>tribal organization</quote> mean a tribe, band, or other organized group recognized in the State in which the tribe, band, or group resides, or considered by the Secretary of the Interior, to be an Indian tribe or an Indian organization for any purpose.</text></paragraph> 
<paragraph id="HE350068769B34FBA82039EDD9B7F52A6"><enum>(2)</enum><header>Indian</header><text display-inline="yes-display-inline">The term <quote>Indian</quote> means a member of an Indian tribe or of a tribal organization.</text></paragraph></subsection></section> 
<section id="H5D8FAA4FCD2C4620BA00A05425F92B6D"><enum>8.</enum><header>Eligible households</header> 
<subsection id="HDF7EBEF35D7A47569BCC08DFC431B73"><enum>(a)</enum><header>In general</header><text>To be eligible to receive a payment from a State under this Act, a household shall submit an application to the State at such time, in such manner, and containing such information as the State may require.</text></subsection> 
<subsection id="HAC88DA9F5974409D8E2D5CCF1E85E25E"><enum>(b)</enum><header>Contents</header><text>The applicant shall include in the application information demonstrating that—</text> 
<paragraph id="H7735222EAC8246D084763B6204CBB7CC"><enum>(1)</enum><text>in the case of a household that is not located in Hawaii, 1 or more individuals in the applicant’s household individually drive not less than 30 miles per day, or not less than 150 miles per week, to or from covered activities; and</text></paragraph> 
<paragraph id="H5E161FB00BD544C0981DD5F77138965"><enum>(2)</enum> 
<subparagraph id="H13C7BC01580C4FD394E2F53798ACCA48" display-inline="yes-display-inline"><enum>(A)</enum><text>the household meets the eligibility requirements of section 2605(b)(2)(A) of the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8624">42 U.S.C. 8624(b)(2)(A)</external-xref>), other than clause (i) of that section; or</text></subparagraph> 
<subparagraph indent="up1" id="HEFF79CA8CAFF42DE8CE83694851EC8CF"><enum>(B)</enum><text>the household income for the household does not exceed the greater of—</text> 
<clause id="H5A32679F49F744E88E2B1EDF3826B114"><enum>(i)</enum><text>an amount equal to 150 percent of the poverty level for the State involved; or</text></clause> 
<clause id="H7E00A77B50EB4FE5AC795705E2337D00"><enum>(ii)</enum><text>an amount equal to 60 percent of the State median income.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H2DC6A13B33374E2EB33577F300F000D7"><enum>(c)</enum><header>Rule</header><text>For purposes of subsection (b)(2)(B), a State—</text> 
<paragraph id="H216204994825400EB1C2C4C672BADAB"><enum>(1)</enum><text>may not exclude a household from eligibility for a fiscal year solely on the basis of household income if such income is less than 110 percent of the poverty level for such State; but</text></paragraph> 
<paragraph id="H6223500080874AADA0E6C4A9CA1680C0"><enum>(2)</enum><text>may give priority to those households with the highest gasoline costs or needs in relation to household income.</text></paragraph></subsection></section> 
<section id="H6AD30CF920EC4B7C8E232D43198374F2"><enum>9.</enum><header>Program requirements</header> 
<subsection id="H00C3CAD013AE45CF93ADDC6BD43CBF51"><enum>(a)</enum><header>Determination of trigger amount</header> 
<paragraph id="HC01E71B891A0427FB9D5255BC3FFAA29"><enum>(1)</enum><header>Determination of gasoline</header><text>The Secretary of Health and Human Services, in consultation with the Secretary of Energy, shall determine a grade of gasoline for which price determinations will be made under this subsection, which shall be a type of gasoline that has a specified octane rating or other specified characteristic.</text></paragraph> 
<paragraph id="H9E58AF650CBE43CA8F2CC7545B861341"><enum>(2)</enum><header>Determination of calculation</header><text>The Secretary of Health and Human Services, in consultation with the Secretary of Energy, shall determine a method for calculating the average per gallon price of the covered grade of gasoline in each State.</text></paragraph> 
<paragraph id="H72A39FA4366A47BFAC1DD2A6C7993237"><enum>(3)</enum><header>Baseline</header><text>The Secretary of Health and Human Services, in consultation with the Secretary of Energy, shall calculate, in accordance with paragraph (2), the average per gallon price of the covered grade of gasoline in each State for January 2005.</text></paragraph> 
<paragraph id="H03E12C0D7B4746F5A7ABA704E3F591FD"><enum>(4)</enum><header>Trigger and release prices</header><text>The Secretary of Health and Human Services, in consultation with the Secretary of Energy, shall calculate—</text> 
<subparagraph id="HF9DF8B37387A4A4DAA9E26BF62794840"><enum>(A)</enum><text>the trigger price for each State by multiplying the price calculated under paragraph (3) by 115 percent; and</text></subparagraph> 
<subparagraph id="H80C2465AF05C4F17ACEEB85E03F6E78D"><enum>(B)</enum><text>the release price for each State by multiplying the price calculated under paragraph (3) by 110 percent.</text></subparagraph></paragraph></subsection> 
<subsection id="HCC2223FD95ED460ABD282793004FCB8F"><enum>(b)</enum><header>Payments</header> 
<paragraph id="H348EB7309DF64A618599C7753366C203"><enum>(1)</enum><header>Availability</header> 
<subparagraph id="H1A113238BAF242DB8544C6A105DCED32"><enum>(A)</enum><header>Monthly price calculation</header><text>The Secretary of Health and Human Services, in consultation with the Secretary of Energy, shall calculate, in accordance with subsection (a)(2), the average per gallon price of the covered grade of gasoline in each State for each month.</text></subparagraph> 
<subparagraph id="H282FFE27D6DD42378E4E039400368023"><enum>(B)</enum><header>Determination</header><text>If the Secretary of Health and Human Services, in consultation with the Secretary of Energy, determines that the price in a State calculated under subparagraph (A) for a month—</text> 
<clause id="H6EC6EDD1B2454983AEAD771F6001D500"><enum>(i)</enum><text>is more than the trigger price for the State, the State shall provide payments in accordance with this subsection for the following month; and</text></clause> 
<clause id="HA50C2DB75D7B49A7BB68D231E6A0589B"><enum>(ii)</enum><text>is less than the release price for the State, the State shall suspend provision of the payments, not earlier than 30 days after the date of the determination, for the following month.</text></clause></subparagraph></paragraph> 
<paragraph id="H5F11E7685DF148E0B440136BACDC5B00"><enum>(2)</enum><header>General authority</header><text>Except as provided in subsection (c), the State shall use funds received through a grant made under section 4 (including a grant increased under section 11(2)) and any funds made available to the State under section 404(d)(4) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604(d)(4)</external-xref>) to make payments under this Act to eligible households.</text></paragraph> 
<paragraph id="HD04EE94AC62343EDA459E84C91E2EC3"><enum>(3)</enum><header>Period</header><text>An eligible household with an application approved under section 7 may receive payments under this Act for not more than 3 months. The household may submit additional applications under section 7, and may receive payments under this Act for not more than 3 months for each such application approved by the State.</text></paragraph> 
<paragraph id="H26B3109FC3084618B53C008B32916271"><enum>(4)</enum><header>Amount</header><text>The State shall make the payments in amounts of not less than $25, and not more than $75, per month. The State may determine the amount of the payments on a sliding scale, taking into consideration the household income of the eligible households.</text></paragraph></subsection> 
<subsection id="HA336EF2C954D4AEB9B69866038E6DDAF"><enum>(c)</enum><header>State administration</header><text>The State may use not more than 10 percent of the funds described in subsection (b)(2) to pay for the cost of administering this Act.</text></subsection> 
<subsection id="H1C0BC950A957495F8D61E761DEE8948B"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H8AB892A929904AD1A400407C6031913E"><enum>(1)</enum><header>Covered grade</header><text>The term <term>covered grade</term> means the grade of gasoline determined under subsection (a)(1).</text></paragraph> 
<paragraph id="H36E4FDE02B994DF9809CCD531C0795F"><enum>(2)</enum><header>Release price</header><text>The term <term>release price</term> means the release price calculated under subsection (a)(4)(B).</text></paragraph> 
<paragraph id="H7DE88F6845F5472193EA5712F876C802"><enum>(3)</enum><header>Trigger price</header><text>The term <term>trigger price</term> means the trigger price calculated under subsection (a)(4)(A).</text></paragraph></subsection></section> 
<section id="H9DECCBACF0AD43ABAC6016D043CF00EB"><enum>10.</enum><header>Treatment of benefits</header> 
<subsection id="H3646C093AB6F427B86F33838002E082C"><enum>(a)</enum><header>Income or resources</header><text>Notwithstanding any other law, the value of any payment provided under this Act shall not be treated as income or resources for purposes of—</text> 
<paragraph id="HB90840B4CD6D461D9324F9F500BE1871"><enum>(1)</enum><text>any other Federal or federally assisted program that bases eligibility, or the amount of benefits, on need; or</text></paragraph> 
<paragraph id="HF665E183E6D24E119592B5CBAABCB966"><enum>(2)</enum><text>the Internal Revenue Code of 1986.</text></paragraph></subsection> 
<subsection id="H1DAFD21053F7487EBBF3FCDF2F58D759"><enum>(b)</enum><header>TANF assistance</header><text>For purposes of part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>), a payment provided under this Act shall not be considered to be assistance provided by a State under that part, regardless of whether the State uses funds made available under section 404(d)(4) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604(d)(4)</external-xref>) to make payments under this Act. The period for which such payments are provided under this Act shall not be considered to be part of the 60-month period described in section 408(a)(7) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)(7)</external-xref>).</text></subsection></section> 
<section id="H06BD6101EE744C7DA37FD76737FD61B5"><enum>11.</enum><header>Authority to use funds for temporary assistance for needy families</header><text display-inline="no-display-inline">Section 404(d) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/604">42 U.S.C. 604(d)</external-xref>) is amended—</text> 
<paragraph id="HE3050408230942F1A0E9883691462515"><enum>(1)</enum><text>in paragraph (3)(A), by striking <quote>paragraph (1)</quote> and inserting <quote>paragraph (1) or (4)</quote>; and</text></paragraph> 
<paragraph id="H1362E7BC9BFB420088F9A690FE178FA7"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HCD7CF4FD394A42808DDE23AA09FB8BCE"> 
<paragraph id="HE61DB8D596BA40FDB15E38AB40BF0077"><enum>(4)</enum><header>Other State programs</header><text>A State may use funds from any grant made to the State under section 403(a) for a fiscal year to carry out a State program pursuant to the Low-Income Gasoline Assistance Program Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HE94A079141E844E3862800A3BAEA66B6"><enum>12.</enum><header>Discretionary activities by the Secretary</header><text display-inline="no-display-inline">The Secretary of Health and Human Services may reserve not more than 5 percent of the funds appropriated under section 13 for a fiscal year—</text> 
<paragraph id="HA93A206CDB414FB38802E85605151300"><enum>(1)</enum><text>to pay for the cost of administering this Act; and</text></paragraph> 
<paragraph id="H592CDF176641435C90097C26ED5C13E4"><enum>(2)</enum><text>to increase the cost of a grant made to a State under section 4, in any case in which the Secretary determines that emergency conditions relating to gasoline prices exist in that State.</text></paragraph></section> 
<section id="HF5885933466E446CBE91CFE79FBD4C2B"><enum>13.</enum><header>Authorization of appropriations</header> 
<subsection id="HFCE8374881FA448F8864A86B854FD585"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this Act $500,000,000 for fiscal year 2006 and each subsequent fiscal year.</text></subsection> 
<subsection id="HEC44E7E955A149BFA17088F5CBF18FA9"><enum>(b)</enum><header>Availability</header><text>Any sums appropriated under subsection (a) for a fiscal year shall remain available until the end of the succeeding fiscal year.</text></subsection></section>
