<section id="H337EAFB48E8D459B81982F008800C034" section-type="subsequent-section"><enum>101.</enum><header>Quadrennial Homeland Security Review</header> 
<subsection id="H1B9E8DFEC50A401D84E37F038214D66B"><enum>(a)</enum><header>Quadrennial Homeland Security Review</header><text display-inline="yes-display-inline">Title I of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/111">6 U.S.C. 111 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HFE7E80F2A64043AD938D9688F9FEED5"><enum>104.</enum><header>Quadrennial Homeland Security Review</header> 
<subsection id="H46D7C25AA89E40E0B7E4246C8911CB50"><enum>(a)</enum><header>Review required</header><text>In any year following a year evenly divisible by 4, the Secretary, acting through the Under Secretary for Policy, shall conduct a comprehensive examination of the Department to be known as a Quadrennial Homeland Security Review.</text></subsection> 
<subsection id="H66079D4976884491A7C93483FFA94E"><enum>(b)</enum><header>Functions of review</header><text>The functions of the Quadrennial Homeland Security Review shall be the following:</text> 
<paragraph id="HFB8CD3B25CE54A028DC0DA003F940072"><enum>(1)</enum><text display-inline="yes-display-inline">To establish a 10-year homeland security strategy and policy program, to be known as the National Homeland Security Strategy, which shall be consistent with this Act.</text></paragraph> 
<paragraph id="H05659E319B8944B7A4BE16529D71ACCE"><enum>(2)</enum><text>To determine, with respect to the Department, each of the following:</text> 
<subparagraph id="H3ACA5193FC4244409736E82732913B84"><enum>(A)</enum><text>Human resource capabilities and requirements.</text></subparagraph> 
<subparagraph id="H9BD41F5145C2466791099BBF17B8767C"><enum>(B)</enum><text>Organizational structure.</text></subparagraph> 
<subparagraph id="H13ED4B419313407D884C1BE9724E8079"><enum>(C)</enum><text>Innovation and improvement plans.</text></subparagraph> 
<subparagraph id="H7AB04EAA132D4545B6757C6197D55210"><enum>(D)</enum><text>Intelligence and information analysis capabilities and resources.</text></subparagraph> 
<subparagraph id="H2601B7522A5941598DD1004163DB35F6"><enum>(E)</enum><text>Infrastructure capabilities and resources.</text></subparagraph> 
<subparagraph id="HA4FFD24DCA2C448597519FEC510237CF"><enum>(F)</enum><text>Budget; technology resources, capabilities and requirements.</text></subparagraph> 
<subparagraph id="H224E011797264DA5984E3F7408B3A664"><enum>(G)</enum><text>Any other elements required to support the National Homeland Security Strategy.</text></subparagraph></paragraph> 
<paragraph id="HD35DE7D0D7294989B4F75E4B9ED4AFB2"><enum>(3)</enum><text>To identify, with respect to the Department, each of the following:</text> 
<subparagraph id="HC427623E73C14C43AA67413C45325139"><enum>(A)</enum><text>A budget plan, acquisition strategy, and procurement process to provide sufficient resources to successfully execute the responsibilities of the Department that are delineated in the National Homeland Security Strategy.</text></subparagraph> 
<subparagraph id="H94DD9CD4D5AC4080862286801119EDCB"><enum>(B)</enum><text>Any additional resources required to attain such responsibilities.</text></subparagraph></paragraph></subsection> 
<subsection id="H590181FC9D8649EDAD0634F187043B21"><enum>(c)</enum><header>Report to Congress</header> 
<paragraph id="H246A2D1140174519A32B7D2E42CE7B2F"><enum>(1)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary shall submit a report on each Quadrennial Homeland Security Review to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate. The report shall be submitted in the year following the year in which the review is conducted, but not later than the date on which the President submits the budget for the next fiscal year to Congress under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, United States Code. </text></paragraph> 
<paragraph id="HC1643248CDFA4F12A99604D5F859BF09"><enum>(2)</enum><header>Contents</header><text>The report shall include the following:</text> 
<subparagraph id="HF1035DE9DA9E4DDB8674C67600B4C350"><enum>(A)</enum><text display-inline="yes-display-inline">The results of the Review, including a comprehensive discussion of the National Homeland Security Strategy and the structure best suited to implement it.</text></subparagraph> 
<subparagraph id="H3C9E5D98CC594A5A84C850BC11C619EC"><enum>(B)</enum><text>The assumed or defined homeland security interests of the United States that inform the National Homeland Security Strategy as defined in the review.</text></subparagraph> 
<subparagraph id="H8436BE53CE2144168C3DFE567256E7D"><enum>(C)</enum><text>The threats to the assumed or defined homeland security interests of the United States examined for purposes of the review and any scenarios developed in the examination of such threats.</text></subparagraph> 
<subparagraph id="H04A6C1172778462F0000DBF8D053B934"><enum>(D)</enum><text>An explanation of any and all underlying assumptions used in the review.</text></subparagraph> 
<subparagraph id="H73ECFB783AA4478C9049F89100450218"><enum>(E)</enum><text>The effect on human resource requirements and response capabilities, identified by type of threat, including conventional, nuclear, biological, chemical, radiological, and agricultural threats, and by means of attack through traditional and non-traditional means or from traditional as well as non-traditional sources.</text></subparagraph> 
<subparagraph id="HB59FAC6A4A8E4CED843851397F89C23F"><enum>(F)</enum><text>The anticipated roles and responsibilities of the agencies, components, and organizational elements of the Department, as outlined in the National Homeland Security Strategy, and the strength, capabilities, technology and equipment necessary to assure that such agencies, components, and organizational elements can capably discharge such roles and responsibilities.</text></subparagraph> 
<subparagraph id="H77A9F56A7D714A1389DE5B0F868E0DD"><enum>(G)</enum><text>An examination of any steps taken by the Department to promote an “intelligence culture” among employees designed to develop analyses specific to the overall mission of the Department.</text></subparagraph> 
<subparagraph id="HECD5F9EE0DA14E2A94D946A3BF079BE"><enum>(H)</enum><text>The strategic and tactical air, sea, and ground transportation capabilities required to support the National Homeland Security Strategy.</text></subparagraph> 
<subparagraph id="HDAEDBF9F11884171B1C764693904A1D3"><enum>(I)</enum><text>The state of the physical infrastructure at border crossings and an examination of the resources, personnel, and time necessary to assure that such border crossing are capable of supporting the mission of the Department, as outlined in the National Homeland Security Strategy.</text></subparagraph> 
<subparagraph id="HCE6D45A9CD49450697F63662A79F821E"><enum>(J)</enum><text>The level of preparedness of first responders and an examination of the resources necessary to assure they are capable of fulfilling their responsibilities, as outlined in the National Homeland Security Strategy.</text></subparagraph> 
<subparagraph id="H8FFAE03A376B4167AA6B2C2FF310CC96"><enum>(K)</enum><text>An examination of ports, airports, and other points of transshipment to determine the necessary resources to ensure adequate security and functioning, as outline in the National Homeland Security Strategy.</text></subparagraph> 
<subparagraph id="H67A89036D21E45519643EDA745A60047"><enum>(L)</enum><text>An examination of the Nation’s rail and transit system to determine the necessary resources to ensure adequate security and functioning, as outlined in the National Homeland Security Strategy.</text></subparagraph> 
<subparagraph id="HAE03372D72D644ADAA051F165E3D2F04"><enum>(M)</enum><text>An examination and risk assessment of key resources and public and privately owned infrastructure and other facilities determined to present an increased security risk by the National Homeland Security Strategy.</text></subparagraph> 
<subparagraph id="HE7E402FC0FEC4D88B8807BD8D412DA8"><enum>(N)</enum><text>An examination of the efforts of the Department to develop a consistent policy that encourages information sharing of unclassified but security-relevant information between the government and the private sector.</text></subparagraph> 
<subparagraph id="H927C65A8351B4BD8A42746E576C46BEA"><enum>(O)</enum><text>An examination of passenger and non-passenger modes of conveyance to ensure the adequacy of precautionary policies and measures to ensure the security of the general public.</text></subparagraph> 
<subparagraph id="H23F03D46AEC54C519968AF8FB7D686C9"><enum>(P)</enum><text>An examination of the security of the computer systems and networks of the Federal Government to assure the adequacy of precautionary and protective devices.</text></subparagraph> 
<subparagraph id="HC69D964F254C48509450803564D36541"><enum>(Q)</enum><text>Any need for Department personnel or resources to be positioned outside the United States in order to support the National Homeland Security Strategy.</text></subparagraph> 
<subparagraph id="H312455039A384E369E3F29AD0014A764"><enum>(R)</enum><text>The extent to which domestic resources must be shifted in order to ensure that border crossings and ports of entry are adequately secured.</text></subparagraph> 
<subparagraph id="H15676839FA5F405DAFBB6F24149B9E13"><enum>(S)</enum><text>The effect of any technology anticipated to be available during the subsequent 8 years on the human resources capabilities, costs, efficiencies, resources, and planning of the Department.</text></subparagraph> 
<subparagraph id="H0120C4974034480683A3437E2B7CF893"><enum>(T)</enum><text>Any other matter the Secretary considers appropriate to include in the review.</text></subparagraph></paragraph> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H3A97F68E3EE24332BC1D12628F648866"><enum>(b)</enum><header>Report required</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on any congressionally required reports which he views as duplicating the requirements under section 104 of the Homeland Security Act of 2002, as added by subsection (a).</text></subsection> 
<subsection id="HE1EC7539745640E7931F858C2319895D"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by adding after the item relating to section 103 the following new item:</text>

<subsection id="H3FB424F5EC2642E6B7D09700F621423D"><enum>(a)</enum><header>Establishment and transfer of certain functions of Under Secretary for Information Analysis and Infrastructure Protection</header><text>Subtitle A of title II of such Act is amended by adding at the end the following new section:</text>

<section id="HED1A03C480D942F4A4006E3ECDB883C8"><enum>203.</enum><header>Office of Intelligence and Analysis and Chief Intelligence Officer</header> 
<subsection id="HD90879AC69864259956F8C47A9C4E3A1"><enum>(a)</enum><header>Office of Intelligence and Analysis</header><text>There shall be in the Department an Office of Intelligence and Analysis headed by a Chief Intelligence Officer, who shall be appointed by the President.</text></subsection> 
<subsection id="HC16AB93A4EFF4045A15EA251F316F914"><enum>(b)</enum><header>Transitional rule</header><text>The Assistant Secretary for Information Analysis appointed pursuant to Sec. 201(b)(1) of this Act shall serve as the Chief Intelligence Officer.</text></subsection> 
<subsection id="HA8F8737A28464693818995D6EC05B92D"><enum>(c)</enum><header>Responsibilities of Chief Intelligence Officer</header><text>Subject to the direction and control of the Secretary, the responsibilities of the Chief Intelligence Officer shall be as follows:</text> 
<paragraph id="H7A1F2DCFE5AA4C1BA958DF8450562E75"><enum>(1)</enum><text>To act as the principal intelligence advisor to the Secretary.</text></paragraph> 
<paragraph id="H65F0CDCF989644069E760221C74054AC"><enum>(2)</enum><text display-inline="yes-display-inline">To represent the Secretary to the intelligence community (as that term is defined in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>)).</text></paragraph> 
<paragraph id="HB79E1C0386E44826862517ED76881C68"><enum>(3)</enum><text>To access, receive, and analyze law enforcement information, intelligence information, and other information from other agencies of the Federal Government, State, local, and tribal government agencies (including law enforcement agencies), and private sector entities, and to integrate such information in order to—</text> 
<subparagraph id="HA8554D06CF6F47B4AA4D2EEE0008AE8E"><enum>(A)</enum><text>identify and assess the nature and scope of terrorist threats to the homeland;</text></subparagraph> 
<subparagraph id="H9551891837084D619B750000DF0019DE"><enum>(B)</enum><text>detect and identify threats of terrorism against the United States; and</text></subparagraph> 
<subparagraph id="HDBD72ECE76B34899A147EF7383042C72"><enum>(C)</enum><text>understand such threats in light of actual and potential vulnerabilities of the homeland.</text></subparagraph></paragraph> 
<paragraph id="H0F1E97E4792748F9BD0014E981535F70"><enum>(4)</enum><text>To ensure, pursuant to section 202, that the relevant personnel of the Department have timely and efficient access to any information necessary to discharge their responsibilities under this section, including obtaining such information from other agencies of the Federal Government;</text></paragraph> 
<paragraph id="HBD1A0FEE18E24E66A7B6169EDB7081FE"><enum>(5)</enum><text>To identify the intelligence-gathering components of the Department and, within each component, to promote an understanding of the intelligence function of that component;</text></paragraph> 
<paragraph id="HB3FDF84B93BA4D12AA68D24263D500B8"><enum>(6)</enum><text>To establish, in consultation with other agencies of the Federal Government, State, local, and tribal government agencies (including law enforcement and intelligence agencies), and private sector entities, a Department-wide terrorist intelligence matrix, to identify and describe—</text> 
<subparagraph id="H713E933DBD7E4EB68090234BDDF821C5"><enum>(A)</enum><text>individuals and organizations suspected of terrorist involvement; and</text></subparagraph> 
<subparagraph id="H8F8A69EF66D4443A827EB1EFFCDDA832"><enum>(B)</enum><text>current and developing terrorist capabilities, methods, plans, tactics, and threats.</text></subparagraph></paragraph> 
<paragraph id="H196410D255514259B616A6C75F348094"><enum>(7)</enum><text>To create a coordinated process for collecting and managing intelligence to be used by the intelligence-gathering components of the Department for providing relevant information for purposes of the terrorist intelligence matrix and other information needs of the Department.</text></paragraph> 
<paragraph id="H97A1AF0B9FD748FA85F55262A66ECD5C"><enum>(8)</enum><text>To administer the Homeland Security Advisory System, including—</text> 
<subparagraph id="H5C0B038CC39D4D5600883331F347A0E1"><enum>(A)</enum><text>exercising primary responsibility for public advisories related to threats to homeland security; and</text></subparagraph> 
<subparagraph id="HE04D37DD6F9A4F1100F39906004F7292"><enum>(B)</enum><text>in coordination with other agencies of the Federal Government, providing specific warning information and advice about appropriate protective measures and countermeasures, to State, local and tribal government agencies and authorities, the private sector, other entities, and the public.</text></subparagraph></paragraph> 
<paragraph id="H4C4F15C9127E4D57BB47224CB0C6B347"><enum>(9)</enum><text>To establish a streamlined process within the Department and the Office of Intelligence and Analysis to receive, integrate, and distribute threat assessment information through the Homeland Security Advisory System;</text></paragraph> 
<paragraph id="H5AFA344CA3A2404700A5CEF54D45C581"><enum>(10)</enum><text>To review, analyze, and make recommendations for improvements in the policies and procedures governing the sharing of law enforcement information, intelligence information, intelligence-related information, and other information relating to homeland security within the Federal Government and between the Federal Government and State, local, and tribal government agencies and authorities.</text></paragraph> 
<paragraph id="H2ADB85181C5448AF9F78E799796CB1D6"><enum>(11)</enum><text>To disseminate, as appropriate, information analyzed by the Department within the Department, to other agencies of the Federal Government with responsibilities relating to homeland security, and to agencies of State, local, and tribal governments and private sector entities with such responsibilities in order to assist in the deterrence, prevention, preemption of, or response to, terrorist attacks against the United States.</text></paragraph> 
<paragraph id="HA2C13F5461EE4AB38948F0796E38D71"><enum>(12)</enum><text>To consult with the Director of National Intelligence and other appropriate intelligence, law enforcement, or other elements of the Federal Government to establish collection priorities and strategies for information, including law enforcement-related information, relating to threats of terrorism against the United States through such means as the representation of the Department in discussions regarding requirements and priorities in the collection of such information.</text></paragraph> 
<paragraph id="H195DBA69698845E1886F8364C46BC4F0"><enum>(13)</enum><text>To consult with State, local, and tribal governments and private sector entities to ensure appropriate exchanges of information, including law enforcement-related information, relating to threats of terrorism against the United States;</text></paragraph> 
<paragraph id="HEFB44CA6008D4A13853545EC273CAC6C"><enum>(14)</enum><text>To ensure that—</text> 
<subparagraph id="H8A8903220667454286A00447C02E2CD4"><enum>(A)</enum><text>any material received pursuant to this Act is protected from unauthorized disclosure and handled and used only for the performance of official duties; and</text></subparagraph> 
<subparagraph id="H7166E817014A43679154ED21728E1BEE"><enum>(B)</enum><text>any intelligence information under this Act is shared, retained, and disseminated consistent with the authority of the Director of National Intelligence to protect intelligence sources and methods under the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401">50 U.S.C. 401 et seq.</external-xref>) and related procedures and, as appropriate, similar authorities of the Attorney General concerning sensitive law enforcement information.</text></subparagraph></paragraph> 
<paragraph id="H5032FD1B9BA443C58293E9D6224FD8F"><enum>(15)</enum><text>To request additional information from other agencies of the Federal Government, State, local and tribal government agencies, and the private sector relating to threats of terrorism in the United States, or relating to other areas of responsibility assigned by the Secretary, including the entry into cooperative agreements through the Secretary to obtain such information.</text></paragraph> 
<paragraph id="HE05E6C6784A64B3EAA0336BAF664C0B3"><enum>(16)</enum><text>To establish and utilize, in conjunction with the Chief Information Officer of the Department, a secure communications and information technology infrastructure, including data-mining and other advanced analytical tools, in order to access, receive, and analyze data and information in furtherance of the responsibilities under this section, and to disseminate information acquired and analyzed by the Department, as appropriate.</text></paragraph> 
<paragraph id="H381BDB3EE918467FB81707C008300E6"><enum>(17)</enum><text>To coordinate training and other support to the elements and personnel of the Department, other agencies of the Federal Government, and State, local and tribal governments that provide information to the Department, or are consumers of information provided by the Department, in order to facilitate the identification and sharing of homeland security-relevant information revealed in their ordinary duties and the optimal utilization of information received from the Department.</text></paragraph> 
<paragraph id="HA15669AE3B804458A5AB61D41DA170C2"><enum>(18)</enum><text>To provide intelligence and information analysis and support to other elements of the Department.</text></paragraph> 
<paragraph id="H1FC0B3834CFF4B9CBD80FBF2DDE92223"><enum>(19)</enum><text>To establish within the Office of Intelligence Analysis an internal continuity of operations (COOP) plan that—</text> 
<subparagraph id="HD023829593FB45E8B5DA5061D8D346E0"><enum>(A)</enum><text display-inline="yes-display-inline">assures that the capability exists to continue uninterrupted intelligence analysis, collection, and related functions during a wide range of potential emergencies, including localized acts of nature, accidents, and technological or attack-related emergencies, that is maintained at a high level of readiness and is capable of implementation with and without warning; and</text></subparagraph> 
<subparagraph id="HA6D4FBD52D3B43F6A9876FFE4BEA98E"><enum>(B)</enum><text>includes plans and procedures governing succession to office within the Office of Intelligence and Analysis, including—</text> 
<clause id="H79818EB368584F63BA6978A7E7E3700"><enum>(i)</enum><text>emergency delegations of authority (where permissible, and in accordance with applicable law);</text></clause> 
<clause id="H7E2B177A784D460BA2EF265163FD9746"><enum>(ii)</enum><text>the safekeeping of vital resources, facilities, and records;</text></clause> 
<clause id="HA412124ADE304595AFC2D952A99F076"><enum>(iii)</enum><text>the improvisation or emergency acquisition of vital resources necessary for the performance of operations of the Office; and</text></clause> 
<clause id="H0C993CB04E9C41FCAEC816A5A7D59D85"><enum>(iv)</enum><text>the capability to relocate essential personnel and functions to and to sustain the performance of the operations of the Office at an alternate work site until normal operations can be resumed.</text></clause></subparagraph></paragraph> 
<paragraph id="H5432C304A366483398A2F0A095404952"><enum>(20)</enum><text display-inline="yes-display-inline">To perform such other duties relating to such responsibilities as the Secretary may provide.</text></paragraph></subsection> 
<subsection id="HF512DD6F29E5438D838DF2D9ED0657E9"><enum>(d)</enum><header>Consultation with Assistant Secretary for Physical Infrastructure Security</header><text>Subject to the direction and control of the Secretary, the Chief Intelligence Officer shall consult with the Assistant Secretary for Physical Infrastructure Security on the following responsibilities:</text> 
<paragraph id="H9F40E488CEA74292B0ABA299E6E95E92"><enum>(1)</enum><text display-inline="yes-display-inline">To integrate relevant information, analyses, and vulnerability assessments (whether such information, analyses, or assessments are provided or produced by the Department or others) in order to identify priorities for protective and support measures by the Department, other agencies of the Federal Government, State and local government agencies.</text></paragraph> 
<paragraph id="H88D485F1D3B34AE89B5F2CD38E7C1ED8"><enum>(2)</enum><text display-inline="yes-display-inline">To ensure, in conjunction with the chief information officer of the Department, that any information databases and analytical tools developed or utilized by the Department—</text> 
<subparagraph id="HE4A4319303404B1398D7941BBD6D0746"><enum>(A)</enum><text>are compatible with one another and with relevant information databases of other agencies of the Federal Government; and</text></subparagraph> 
<subparagraph id="HB51D6E84D25E40A4A8F145D786637802"><enum>(B)</enum><text>treat information in such databases in a manner that complies with applicable Federal law on privacy.</text></subparagraph></paragraph> 
<paragraph id="H377ACD1B01D94714A5EE504CA1757E0"><enum>(3)</enum><text display-inline="yes-display-inline">To coordinate with elements of the intelligence community and with Federal, State, and local law enforcement agencies, and the private sector, as appropriate.</text></paragraph></subsection> 
<subsection id="H0370D1C054224E9A85D44C08082772D6" commented="no"><enum>(e)</enum><header>Transfer of functions</header><text display-inline="yes-display-inline">In accordance with title XV, there shall be transferred to the Chief Intelligence Officer the functions, personnel, assets, and liabilities of the Directorate for Information Analysis and Infrastructure Protection.</text></subsection> 
<subsection id="HA1D5F9405E494796ADDE85F67074FEC"><enum>(f)</enum><header>Intelligence Through Employees Generating Resources for Analytical Leadership (INTEGRAL) Program</header> 
<paragraph id="HA0571609E4024384B1F63BE749DD00F8"><enum>(1)</enum><header>Findings</header><text>Congress finds the following:</text> 
<subparagraph id="HFA2DDD68CF2D4200B039B549837E3FD8"><enum>(A)</enum><text>It is of critical importance that the Department establish an <quote>intelligence culture</quote> among all of its employees.</text></subparagraph> 
<subparagraph id="H7258103CFA2B44D38FAA196842ED44EA"><enum>(B)</enum><text>At its inception, the Department drew together 22 Federal agencies that are now united in a common homeland security mission.</text></subparagraph> 
<subparagraph id="HE1ED63112E774CE282F13DFF486DB9B0"><enum>(C)</enum><text>Most of those agencies were not intelligence agencies and were instead primarily concerned with either law enforcement or the provision of services.</text></subparagraph> 
<subparagraph id="H208EC7E3B6D34A2CAC7911E204F467EA"><enum>(D)</enum><text>Many employees who once worked for those agencies still do not view themselves as either collectors of intelligence information or contributors to the Department’s intelligence information analysis efforts.</text></subparagraph> 
<subparagraph id="H56A77706F45D468B86001B6C55A4DF1D"><enum>(E)</enum><text>The Department lacks an intelligence culture in which individuals understand that they are an integral part of a chain in which even the most seemingly insignificant piece of data can lead to the unraveling of a terrorist threat.</text></subparagraph></paragraph> 
<paragraph id="HC5C1F4F7C87B4114BA68575F027B6700"><enum>(2)</enum><header>INTEGRAL Program</header><text display-inline="yes-display-inline">The Secretary, acting through the Chief Intelligence Officer and in coordination with appropriate Department personnel, shall establish a program to be known as the Intelligence Through Employees Generating Resources for Analytical Leadership (INTEGRAL) Program that—</text> 
<subparagraph id="HBCD2700125E74529844F0095A3082D6C"><enum>(A)</enum><text display-inline="yes-display-inline">is based on evaluations of how employees, including intelligence analysts and law enforcement agents, can better collect, analyze, process, and report intelligence information relevant to the intelligence analysis employees of the Department, the Chief Intelligence Officer, the Office of Intelligence and Analysis, and the wider intelligence community (as that term is defined in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>));</text></subparagraph> 
<subparagraph id="H3A1A06012BE34D87829581F1B2D01CD6"><enum>(B)</enum><text>provides training, employee exchanges, and other educational opportunities for employees to better develop an understanding of the value of the intelligence information they collect for the intelligence analysis employees of the Department; </text></subparagraph> 
<subparagraph id="HFE077AE037A44DD9BFF44B3D38279E4C"><enum>(C)</enum><text display-inline="yes-display-inline">provides guidance on how the information Department employees collect can be used by the intelligence analysis employees of the Department and on what type of intelligence information is most useful;</text></subparagraph> 
<subparagraph id="HFDEE53386676404BB85EAA8E92BE7A"><enum>(D)</enum><text>creates mechanisms by which employees can communicate the information they gather to the intelligence analysis employees of the Department; and</text></subparagraph> 
<subparagraph id="H86E018B0B57745D4ABA4B4E362F2EAB"><enum>(E)</enum><text>establishes strategies for employees to adapt their daily work habits to promote an intelligence culture within the Department.</text></subparagraph> </paragraph> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC4DAF3206C3741C583AD803F10E1F258"><enum>(b)</enum><header>Reports</header> 
<paragraph id="H63C26295030241849900BC29A9B79B53"><enum>(1)</enum><header>Report on Office of Intelligence and Analysis and Chief Intelligence Officer</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the effectiveness and activities of the Office of Intelligence and Analysis and the Chief Intelligence Officer.</text></paragraph> 
<paragraph id="H7D660A33B5FA40C698B259058283ECB"><enum>(2)</enum><header>Report on INTEGRAL program</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to Congress a report on the development of the INTEGRAL program established under section 201(e)(4) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121(e)(4)</external-xref>).</text></paragraph></subsection>

<subsection id="H5622351EB7074BD5A26BC91E2FD4BF45" display-inline="no-display-inline"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="HADC09ABEC06B4FDFA102E1DDD578C4E1"><enum>(1)</enum><text>The vast majority of critical infrastructure located within the United States is privately owned.</text></paragraph> 
<paragraph id="HC0673801E8F5491DAA147380EB5EF7D6"><enum>(2)</enum><text>Securing this infrastructure from terrorist attack requires consistent policy and legislation that encourage the sharing of unclassified but security-relevant information between the private sector and the government.</text></paragraph></subsection> 
<subsection id="H13914D000ED541B5801B2F4114083100"><enum>(b)</enum><header>Task force</header><text>The Secretary of the Department of Homeland Security shall establish an intra-agency task force to be comprised of the Chief Intelligence Officer of the Department, the general counsel, the special assistant to the Secretary (private sector), the officer for civil liberties and civil rights, the privacy officer, and other appropriate personnel of the Department. </text></subsection> 
<subsection id="H90D3240FF2124E4E93E7949B415C5764"><enum>(c)</enum><header>Study</header><text>The task force established under paragraph (2) shall conduct a study of unclassified but security-relevant information to—</text> 
<paragraph id="HEA9A68F79BC84AA89DC12570F0EC9300"><enum>(1)</enum><text>determine—</text> 
<subparagraph id="HA695066DD26049A0B9BAE6C397BAC6B7"><enum>(A)</enum><text>what kind of information possessed by the private sector is security-relevant but unclassified information;</text></subparagraph> 
<subparagraph id="H8C92EF1A7477496492CDA2107A100A3"><enum>(B)</enum><text>how such information should be controlled; and</text></subparagraph> 
<subparagraph id="H05A669FFA0F2480A91108BE04C2D304B"><enum>(C)</enum><text>the significance of such information for national security.</text></subparagraph></paragraph> 
<paragraph id="H2723CD2F2E944FC19CDA54DE825E2C"><enum>(2)</enum><text>propose a policy to encourage the sharing of unclassified but security-relevant information between the private sector and government that—</text> 
<subparagraph id="H171172CD651A49B2B0DE37001D3EDAB"><enum>(A)</enum><text>is sensitive to the public benefit of openness and which does not unnecessarily restrict public access to information;</text></subparagraph> 
<subparagraph id="H3B0092E1D0964A4AB3EA52B1DB976135"><enum>(B)</enum><text>addresses private sector fears of business losses due to public disclosure of proprietary information, including disclosure through error, court documents, or public security announcements;</text></subparagraph> 
<subparagraph id="H86A82BF632734784821511EDA999CC3E"><enum>(C)</enum><text>addresses private sector fears of liability for disclosure; and</text></subparagraph> 
<subparagraph id="H064AFFE3066D4D21B6BF8E60571DBCB"><enum>(D)</enum><text>addresses the fears of private citizens of inappropriate and overreaching government secrecy.</text></subparagraph></paragraph></subsection> 
<subsection id="HDFCDC540CD0C4206B1E3BE0852CC6886"><enum>(d)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the task force shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report based on the study conducted under subsection (B).</text></subsection> </section>

<subparagraph id="H9863EFC405D24E13AD54DB93BE7003A0"><enum>(A)</enum><text>coordinating preparedness efforts at the Federal level, and working with all State, local, tribal, parish, and private sector emergency response providers on all matters pertaining to combating terrorism, including training, exercises, and equipment support;</text></subparagraph> 
<subparagraph id="H447372797D4C460A9D294D7600DA0808"><enum>(B)</enum><text>coordinating or, as appropriate, consolidating communications and systems of communications relating to homeland security at all levels of government;</text></subparagraph> 
<subparagraph id="HFD2014565A3B4A1990CBCDCCEC68A695"><enum>(C)</enum><text>directing and supervising terrorism preparedness grant programs of the Federal Government (other than those programs administered by the Department of Health and Human Services) for all emergency response providers;</text></subparagraph> 
<subparagraph id="H4C1529E180404328AA592CF9BCA916F8"><enum>(D)</enum><text>incorporating the Strategy priorities into planning guidance on an agency level for the preparedness efforts of the Office for Domestic Preparedness;</text></subparagraph> 
<subparagraph id="H900A45666B6A4009BE6C9786561E6574"><enum>(E)</enum><text>providing agency-specific training for agents and analysts within the Department, other agencies, and State and local agencies and international entities;</text></subparagraph> 
<subparagraph id="HD2288254182D4E09B7B2A52B078B83E2"><enum>(F)</enum><text>as the lead executive branch agency for preparedness of the United States for acts of terrorism, cooperating closely with the Federal Emergency Management Agency, which shall have the primary responsibility within the executive branch to prepare for and mitigate the effects of nonterrorist-related disasters in the United States;</text></subparagraph> 
<subparagraph id="HA912313B1C474DD98CFE5338F600BD39"><enum>(G)</enum><text>assisting and supporting the Secretary, in coordination with other Directorates and entities outside the Department, in conducting appropriate risk analysis and risk management activities of State, local, and tribal governments consistent with the mission and functions of the Directorate;</text></subparagraph> 
<subparagraph id="H20E297965DAE4F13BA55DAA106BBEDE"><enum>(H)</enum><text>those elements of the Office of National Preparedness of the Federal Emergency Management Agency which relate to terrorism, which shall be consolidated within the Department in the Office for Domestic Preparedness established under this section; and</text></subparagraph> 
<subparagraph id="HBF2BDFB869DE4838B35E2E8FF1AAA291"><enum>(I)</enum><text>helping to ensure the acquisition of interoperable communication technology by State and local governments and emergency response providers.</text></subparagraph></paragraph></subsection> 
<subsection id="H7FF8B1EFAAFE422E92F0CA55776727EE"><enum>(c)</enum><header>National Capital Region coordination</header><text display-inline="yes-display-inline">The Under Secretary of Preparedness and Response shall have primary responsibility for oversight and coordination of Federal programs for and relationships with State, local, and regional authorities in the National Capital Region, as defined under <external-xref legal-doc="usc" parsable-cite="usc/10/2674">section 2674(f)(2)</external-xref> of title 10, United States Code.</text></subsection> 
<subsection id="H6C7424E0D0BD40E798CBF339AAE965D7"><enum>(d)</enum><header>Military Liaison</header> 
<paragraph id="H19B99FD859984EFAB3DFFA176070ADAE"><enum>(1)</enum><header>Establishment</header><text>There shall be in the Directorate of Preparedness and Response a Military Liaison, who shall be appointed by the President.</text></paragraph>

<subparagraph id="HDBA88DFBED91443C923022DCB444E8EE"><enum>(A)</enum><text>the Bureau of Customs and Border Protection (CBP) of the Department of Homeland Security is responsible for managing, controlling, and protecting the borders of the United States, at and between United States ports of entry;</text></subparagraph> 
<subparagraph id="H8CC64DE246AA4F7E815F4197B8DE73BC"><enum>(B)</enum><text>U.S. Immigration and Customs Enforcement (ICE) of the Department of Homeland Security is the investigative and enforcement arm of the Department of Homeland Security responsible for hindering terrorism through the identification and resolution of violations and vulnerabilities in Federal immigration laws, customs laws, and air security laws;</text></subparagraph> 
<subparagraph id="H1CF006C9D1F24D2693BB67779997D35"><enum>(C)</enum><text>in the report titled <quote>DHS 2.0 Rethinking The Department Of Homeland Security</quote>, the Heritage Foundation recommended that a more efficient organization of border security which would be consistent with an effective homeland security program would require merging CBP and ICE;</text></subparagraph> 
<subparagraph id="H9CA25D3CB2AE48A492AC4E3B17003517"><enum>(D)</enum><text>the current separation of CBP and ICE by the Department of Homeland Security has created organizational <quote>turf battles</quote> and inefficiency; and</text></subparagraph> 
<subparagraph id="HFB6719D7D7B44C8EBDB9B61957292E59"><enum>(E)</enum><text>a combined entity containing components of CBP and ICE will bring together all of the tools for effective border and immigration enforcement.</text></subparagraph></paragraph> 
<paragraph id="H04A4DF2575D4485291C22DF7D7F6DE56"><enum>(2)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Bureau of Customs and Border Protection (CPB) and U.S. Immigration and Customs Enforcement (ICE), currently separate entities within the Department of Homeland Security, should be merged into a single operational unit within the Department of Homeland Security to better protect the borders of the United States and to conduct interior enforcement operations and investigations to increase homeland security.</text></paragraph></subsection> 
<subsection id="HBCABAC053A4646C8B133F8775E2F7E86"><enum>(b)</enum><header>Report on the functions of the Transportation Security Administration</header> 
<paragraph id="HE4B3C69A449342D90001BCFAD2385DC2"><enum>(1)</enum><header>In general</header><text>Within 120 days after the date of the enactment of this Act, the Secretary shall report to Congress the methodology and manner that the Transportation Security Administration will use to protect all modes of our Nation’s transportation systems from acts of terrorism.</text></paragraph> 
<paragraph id="HB9D8BFDB0B50431E00A5E492CD936EE"><enum>(2)</enum><header>Requirements of report</header><text>The report required under paragraph (1) shall set forth the following:</text> 
<subparagraph id="HCC25B22869CF4BC99F0041DF34891031"><enum>(A)</enum><text>Plans for the allocation of resources to manage risks, address threats, and enhance security across all transportation modes.</text></subparagraph> 
<subparagraph id="H0F7FD53D2824437EB2EE79E322DD2584"><enum>(B)</enum><text>The rationale for the allocation of resources that has resulted in non-aviation modes of transportation receiving fewer resources for security enhancements than aviation.</text></subparagraph> 
<subparagraph id="H89CF103374F844CA9DBE2047ED1CF2FF"><enum>(C)</enum><text>A methodology to resolve the disparity in resource allocation across modes of transportation.</text></subparagraph> 
<subparagraph id="HEA54849882224BCBAD58144553A0EA55"><enum>(D)</enum><text>Any structural and organizational changes necessary to ensure the effective operation and management of the Transportation Security Administration as a transportation security agency for all modes of transportation.</text></subparagraph> 
<subparagraph id="H432C5682C78745929BEC94EF9270833"><enum>(E)</enum><text>A description of ongoing and planned research and development programs for all modes of transportation, including rail and transit security, that includes the funding for such programs and efforts that have occurred since March 11, 2004.</text></subparagraph></paragraph></subsection> </section>

<subparagraph id="H03140E5427F74C4AB2C197C300E291EB"><enum>(B)</enum><text>shall make such investigations and reports relating to the administration of the programs and operations of the Department as are, in the judgment of the senior official, necessary or desirable;</text></subparagraph> 
<subparagraph id="H99E214A44BA7435B8CF0FB2DC1DAE8E"><enum>(C)</enum><text>may require by subpoena the production, by persons other than Federal agencies, of all information, documents, reports, answers, records, accounts, papers, and other data and documentary evidence necessary to performance of the functions of the senior official under this section;</text></subparagraph> 
<subparagraph id="H2123A9FC109141249FFEDA060084D534"><enum>(D)</enum><text>may administer to or take from any person an oath, affirmation, or affidavit, whenever necessary to performance of the functions of the senior official under this section; and</text></subparagraph> 
<subparagraph id="H8CB5F1D844624311003127546115B4EC"><enum>(E)</enum><text>may take any other action authorized to be taken by the Inspector General of the Department, as necessary to require employees of the Department to produce documents and answer questions relevant to performance of the functions of the senior official under this section.</text></subparagraph></paragraph> 
<paragraph id="HFA6A12CC88544A719C141F4346A3F0E3"><enum>(2)</enum><header>Enforcement of subpoenas</header><text>Any subpoena issued under paragraph (1)(C) shall, in the case of contumacy or refusal to obey, be enforceable by order of any appropriate United States district court.</text></paragraph> 
<paragraph id="H6110D77105EB4B5A82B1FF07E22B7B24"><enum>(3)</enum><header>Effect of oaths</header><text>Any oath, affirmation, or affidavit administered or taken under paragraph (1)(D) by or before an employee of the Privacy Office designated for that purpose by the senior official appointed under subsection (a) shall have the same force and effect as if administered or taken by or before an officer having a seal of office.</text></paragraph></subsection> 
<subsection id="HD306D76ED0ED4084977CBD52E88CA4C8"><enum>(c)</enum><header>Term of office</header><text>The term of appointment of a senior official under subsection (a) shall be 5 years.</text></subsection>

<subsection id="HFF0D98B891984549831EC3683C165602"><enum>(a)</enum><header>Elimination of Under Secretary for Management</header> 
<paragraph id="H2B21D221B81E47839EA3E975518466BB"><enum>(1)</enum><header>Transfer of functions</header><text display-inline="yes-display-inline">Effective as of the date of the enactment of this Act, there are transferred to the Secretary the functions performed immediately before such transfer occurs by the Under Secretary for Management pursuant to section 701(b) of the the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341(b)</external-xref>).</text></paragraph> 
<paragraph id="HF4C48D8A7A784EAA805E1FBD64AC39B1"><enum>(2)</enum><header>Repeal</header><text>Section 701 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341</external-xref>) is repealed.</text></paragraph></subsection> 
<subsection id="HB4E908D1541F44A189AAC1E77EDC377B"><enum>(b)</enum><header>Authority of Chief Financial Officer over component financial officers</header><text>Section 702 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/342">15 U.S.C. 342</external-xref>) is amended by adding at the end the following new sentence: <quote>The Chief Financial Officer shall exercise joint authority, with the component agency heads of the Department, over financial officers in the component agencies and entities of the Department.</quote> </text> </subsection> 
<subsection id="H3F55614AE3D14CD3B3B49CDED4CE9762"><enum>(c)</enum><header>Authority of Chief Information Officer over component information officers</header><text>Section 703 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/343">15 U.S.C. 343</external-xref>) is amended by adding at the end the following new sentence: <quote>The Chief Information Officer shall exercise joint authority, with the component agency heads of the Department, over information officers in the component agencies and entities of the Department.</quote> </text> </subsection> 
<subsection id="H4BEDDD1823DD475AB13414B365C1CA71"><enum>(d)</enum><header>Authority of Chief Human Capital Officer of component human capital officers</header><text>Section 704 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/344">6 U.S.C. 344</external-xref>) is amended by striking <quote>and</quote> after <quote>as the Secretary may direct</quote> and inserting the following: <quote>. The Chief Human Capital Officer shall exercise joint authority, with the component agency heads of the Department, over human capital officers in the component agencies and entities of the Department. <subsection id="H6351D0EE89DF4933A300F869BF111697"><enum>(e)</enum><header>Business transformation officer</header><text>Title VII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HB8E075E65C3B490683BAEC7C91B41626"><enum>707.</enum><header>Business Transformation Officer</header><text display-inline="no-display-inline">The Business Transformation Officer shall report to the Secretary, or to another official of the Department, as the Secretary may direct. The Business Transformation Officer shall—</text> 
<paragraph id="HFA2021558CA44F72A1B122BDAAD92459"><enum>(1)</enum><text>develop an overarching management integration strategy with recommendations and performance goals for the Department, in consultation with the Chief Procurement Officer, the Chief Human Capital Officer, the Chief Intelligence Officer, and any other appropriate official of the Department; and</text></paragraph> 
<paragraph id="H1E34664F2C574D0DA523A9002ED2D2C3"><enum>(2)</enum><text>report to the Secretary and the appropriate congressional committees of jurisdiction on a quarterly basis as to the progress of the management integration strategy of the Department.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HA56EACDABE2F493CA0BFBD7861B8395E"><enum>(a)</enum><header>In general</header><text>No covered individual may be discharged, demoted, suspended, threatened, harassed, reprimanded, investigated, or in any other manner discriminated against (including by a denial, suspension, or revocation of a security clearance or by any other security access determination) if such discrimination is due, in whole or in part, to any lawful act done, perceived to have been done, or intended to be done by the covered individual—</text> 
<paragraph id="HCC190E9B13DB48C3BC8C3534F46DD83D"><enum>(1)</enum><text>to provide information, cause information to be provided, or otherwise assist in an investigation regarding any conduct which the covered individual reasonably believes constitutes a violation of any law, rule or regulation relating to national or homeland security, which the covered individual reasonably believes constitutes a threat to national or homeland security, or which the covered individual reasonably believes constitutes fraud, waste or mismanagement of Government funds intended to be used for national or homeland security, when the information or assistance is provided to or the investigation is conducted by—</text> 
<subparagraph id="H9C3638891FB543E189C98783176C442B"><enum>(A)</enum><text>a Federal, State or local regulatory or law enforcement agency (including an office of Inspector General under the Inspector General Act of 1978);</text></subparagraph> 
<subparagraph id="HA2E96EE740894ED7AE8C3F2E72F5A100"><enum>(B)</enum><text>any Member of Congress, any committee of Congress, or the Government Accountability Office;</text></subparagraph> 
<subparagraph id="HECA62D70A57A434EAB6712228B98985B"><enum>(C)</enum><text>a person with supervisory authority over the covered individual (or such other person who has the authority to investigate, discover, or terminate misconduct); or</text></subparagraph> 
<subparagraph id="HE99BC57B0A324F7B9FC59B963EF83478"><enum>(D)</enum><text>the Privacy Officer of the Department;</text></subparagraph></paragraph> 
<paragraph id="HB6D582EA3B6345BDB571F4C3B23CBDF"><enum>(2)</enum><text>to file, cause to be filed, testify, participate in, or otherwise assist in a proceeding or action filed or about to be filed relating to an alleged violation of any law, rule or regulation relating to national or homeland security; or</text></paragraph> 
<paragraph id="H0D730C3CA25743EF83A3AD0355764E00"><enum>(3)</enum><text>to refuse to violate or assist in the violation of any law, rule, or regulation relating to national or homeland security.</text></paragraph></subsection> 
<subsection id="H7728A643BCA24A12AC27B78BF70B14F"><enum>(b)</enum><header>Enforcement action</header> 
<paragraph id="H0528992EFAE546729EBC50D3A84294D0"><enum>(1)</enum><header>In general</header><text>A covered individual who alleges discharge or other discrimination by any person in violation of subsection (a) may seek relief under subsection (c) by—</text> 
<subparagraph id="HA0095BCEE8C7432FA1F424979CA5EECB"><enum>(A)</enum><text>filing a complaint with the Secretary of Labor; or</text></subparagraph> 
<subparagraph id="H361D7F8DC5BD4B2FB44178A000E78D17"><enum>(B)</enum><text>if the Secretary has not issued a final decision within 180 days after the filing of the complaint and there is no showing that such delay is due to the bad faith of the claimant, bringing an action at law or equity for de novo review in the appropriate district court of the United States, which shall have jurisdiction over such an action without regard to the amount in controversy.</text></subparagraph></paragraph> 
<paragraph id="HFEBC6809ABC7411BB400A1D476CBE805"><enum>(2)</enum><header>Procedure</header> 
<subparagraph id="HC8556216D9F64511A30376C537C98FF5"><enum>(A)</enum><header>In general</header><text>An action under paragraph (1)(A) shall be governed under the rules and procedures set forth in <external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)</external-xref> of title 49, United States Code.</text></subparagraph> 
<subparagraph id="H08B93FED6B314F8F81289108E1838D8D"><enum>(B)</enum><header>Exception</header><text>Notification made under <external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)(1)</external-xref> of title 49, United States Code, shall be made to the person named in the complaint and to the person’s employer.</text></subparagraph> 
<subparagraph id="HB19340727B524D46B8DA8522BD580033"><enum>(C)</enum><header>Burdens of proof</header><text>An action brought under paragraph (1)(B) shall be governed by the legal burdens of proof set forth in <external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)</external-xref> of title 49, United States Code.</text></subparagraph> 
<subparagraph id="HF637167C879D4EAAAB3697B22177E403"><enum>(D)</enum><header>Statute of limitations</header><text>An action under paragraph (1) shall be commenced not later than 1 year after the date on which the violation occurs.</text></subparagraph></paragraph></subsection> 
<subsection id="HC54E18A33DB94E4FAFDF46C7C6F0805"><enum>(c)</enum><header>Remedies</header> 
<paragraph id="HEDE0D5614A3A4CCE9733A7D7E19FA445"><enum>(1)</enum><header>In general</header><text>A covered individual prevailing in any action under subsection (b)(1) shall be entitled to all relief necessary to make the covered individual whole.</text></paragraph> 
<paragraph id="H7D99FAA4079E410EB66831C2870414C7"><enum>(2)</enum><header>Damages</header><text>Relief for any action under paragraph (1) shall include—</text> 
<subparagraph id="H9DC80E4C61A54AFA8E0758EB70AF8DE9"><enum>(A)</enum><text>reinstatement with the same seniority status that the covered individual would have had, but for the discrimination;</text></subparagraph> 
<subparagraph id="H7BB4EBAA77B84674BDDAFAFF9D85B60"><enum>(B)</enum><text>the amount of any back pay, with interest; </text></subparagraph> 
<subparagraph id="H6728C6614DF7436F82697D8EE196C65E"><enum>(C)</enum><text>compensation for any special damages sustained as a result of the discrimination, including litigation costs, expert witness fees, and reasonable attorney fees; and</text></subparagraph> 
<subparagraph id="HC96014D961874AFE9EBBCCCC621980E6"><enum>(D)</enum><text>punitive damages in an amount not to exceed the greater of 3 times the amount of any compensatory damages awarded under this section. </text></subparagraph></paragraph></subsection> 
<subsection id="H1E469EC91A5841AE9C206EA8B16C20B9"><enum>(d)</enum><header>State secrets privilege</header><text>If, in any action brought under subsection (b)(1)(B), the Government asserts as a defense the privilege commonly referred to as the <quote>state secrets privilege</quote> and the assertion of such privilege prevents the plaintiff from establishing a prima facie case in support of the plaintiff’s claim, the court shall enter judgment for the plaintiff and shall determine the relief to be granted. </text></subsection> 
<subsection id="H450311BEBF7141069EED464499F13E96"><enum>(e)</enum><header>Criminal penalties</header> 
<paragraph id="H850D2309F7404D338DE8D5D27D9085DF"><enum>(1)</enum><header>In general</header><text>It shall be unlawful for any person employing a covered individual to commit an act prohibited by subsection (a). Any person violating this paragraph shall be fined under title 18 of the United States Code, imprisoned not more than 10 years, or both.</text></paragraph> 
<paragraph id="HC826021C4DEA499F8E36A5D8793EB8F7"><enum>(2)</enum><header>Reporting requirement</header><text>The Department of Justice shall submit to Congress an annual report on the enforcement of paragraph (1). Each such report shall (A) identify each case in which formal charges under paragraph (1) were brought, (B) describe the status or disposition of each such case, and (C) in any actions under subsection (b)(1)(B) in which the covered individual was the prevailing party or the substantially prevailing party, indicate whether or not any formal charges under paragraph (1) have been brought and, if not, the reasons therefor. </text></paragraph></subsection> 
<subsection id="H894E211568A94D0B8E9E35620083AF76"><enum>(f)</enum><header>Rights retained by covered individual</header><text>Nothing in this section shall be deemed to diminish the rights, privileges, or remedies of any covered individual under any Federal or State law, or under any collective bargaining agreement. The rights and remedies in this section may not be waived by any agreement, policy, form, or condition of employment.</text></subsection> 
<subsection id="HFF1472D3CBA94DCA8E1D24EFF9242476"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H9191105136A44FBDB6A6D126376662D7"><enum>(1)</enum><text>the term <quote>covered individual</quote> means an employee of—</text> 
<subparagraph id="H688638B29C7343789453FF9E07473405"><enum>(A)</enum><text>the Department of Homeland Security (which, for purposes of this section, includes the Transportation Security Administration);</text></subparagraph> 
<subparagraph id="H8FE99BFFBFEF493F8DA470CECE77E93"><enum>(B)</enum><text>a Federal contractor or subcontractor; and</text></subparagraph> 
<subparagraph id="H398855BDF7004D4983E896191F9229F"><enum>(C)</enum><text>an employer within the meaning of section 701(b) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(b)</external-xref>);</text></subparagraph></paragraph> 
<paragraph id="H3481A7151CC742F5931D3731BFB00AA"><enum>(2)</enum><text>the term <quote>lawful</quote> means not specifically prohibited by law, except that, in the case of any information the disclosure of which is specifically prohibited by law or specifically required by Executive order to be kept secret in the interest of national defense or the conduct of foreign affairs, any disclosure of such information to any Member of Congress, committee of Congress, or other recipient authorized to receive such information, shall be deemed lawful;</text> </paragraph> 
<paragraph id="HC2FC5FCE8D2142A3BCB9C6263C76671E"><enum>(3)</enum><text>the term <quote>Federal contractor</quote> means a person who has entered into a contract with the Department of Homeland Security;</text></paragraph> 
<paragraph id="HE64C58611F694269A429ED0730A2E1B"><enum>(4)</enum><text>the term <quote>employee</quote> means—</text> 
<subparagraph id="HAFC3D535177B4F83BE47879B50DB2965"><enum>(A)</enum><text>with respect to an employer referred to in paragraph (1)(A), an employee as defined by <external-xref legal-doc="usc" parsable-cite="usc/5/2105">section 2105</external-xref> of title 5, United States Code; and</text></subparagraph> 
<subparagraph id="HC1FB4DA22C1544A48E6B95F2C438C1B0"><enum>(B)</enum><text>with respect to an employer referred to in subparagraph (A) or (B) of paragraph (1), any officer, partner, employee, or agent;</text></subparagraph></paragraph> 
<paragraph id="H3789A32969A84AE494263DE94064BAF8"><enum>(5)</enum><text>the term <quote>subcontractor</quote>—</text> 
<subparagraph id="H45D207D945BD47E591E03B10E6F9296D"><enum>(A)</enum><text>means any person, other than the Federal contractor, who offers to furnish or furnishes any supplies, materials, equipment, or services of any kind under a contract with the Department of Homeland Security or a subcontract entered into in connection with such a contract; and</text></subparagraph> 
<subparagraph id="H01AB5CE1FCAF4E22BBA9B0BBD63B6C07"><enum>(B)</enum><text>includes any person who offers to furnish or furnishes general supplies to the Federal contractor or a higher tier subcontractor; and</text></subparagraph></paragraph> 
<paragraph id="H18A77BBB2129410AA83200004C42A66C"><enum>(6)</enum><text>the term <quote>person</quote> means a corporation, partnership, State entity, business association of any kind, trust, joint-stock company, or individual.</text></paragraph></subsection> 
<subsection id="HB1A48040BDDC4E35AED7005529D6C3E"><enum>(h)</enum><header>Authorization of funds</header><text>Of the amounts authorized under section 101, there is authorized to be appropriated amounts necessary for carrying out this section. Except as provided in the preceding sentence, this section shall have no force or effect.</text></subsection></section> 
<section id="H8FF985B778D34A069174208E00E8D9DF"><enum>113.</enum><header>Office of Tribal Security</header><text display-inline="no-display-inline">The Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>) is amended—</text> 
<paragraph id="H324C8AA6401649798D1E5D74F21700FC"><enum>(1)</enum><text>by inserting after section 801 the following new section:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H474E231EC2B240938210C11894197F5B"> 
<section id="H443FE19629A541FEB44DCF7D3C4E9059"><enum>802.</enum><header>Office of Tribal Security</header> 
<subsection id="HCAF4D4BC935C4EB5AC2066B5C30B778"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote>Tribal Homeland Security Act</quote>.</text></subsection> 
<subsection id="H2887FF6E89224018B1BCC27BA6030409"><enum>(b)</enum><header>Establishment</header><text>There is established within the Department of Homeland Security the Office of Tribal Security.</text></subsection> 
<subsection id="H3E96C3DA74584F22AB261607B37C8B04"><enum>(c)</enum><header>Director</header><text>The Office of Tribal Security shall be administered by a Director, who shall report to the Secretary of Homeland Security.</text></subsection> 
<subsection id="H995B0005F1DE4C749D3B565BEBFA2FC8"><enum>(d)</enum><header>Duties</header><text>The Director shall be responsible for coordinating relations between the Federal Government and federally recognized Indian tribes on issues relating to homeland security, which shall include the following duties:</text> 
<paragraph id="H533A7EFFFBB14D83B498D972F2221B65"><enum>(1)</enum><text>Providing a point of contact within Department of Homeland Security which shall be responsible for—</text> 
<subparagraph id="HFD511449111D40EBBD9351A23FAAB741"><enum>(A)</enum><text>meeting the broad and complex Federal responsibilities owed to federally recognized Indian tribes by the Department of Homeland Security; and</text></subparagraph> 
<subparagraph id="H6142F01CE8B74976970093D9F3457304"><enum>(B)</enum><text>soliciting and, where appropriate, addressing the homeland security concerns of federally recognized Indian tribes and other parties interested in Indian affairs.</text></subparagraph></paragraph> 
<paragraph id="HF44C3E02CA4E42DA87051393331CFDED"><enum>(2)</enum><text>Communicating relevant policies of the Department of Homeland Security to federally recognized Indian tribes and the public.</text></paragraph> 
<paragraph id="HD4F944FF2C4949F0BB959C0049666C23"><enum>(3)</enum><text>Promoting internal uniformity of Department of Homeland Security policies relating to Indian country (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/1151">section 1151</external-xref> of title 18, United States Code).</text></paragraph> 
<paragraph id="HC16B1B9B260F4EE3866C7B5687E33D6E"><enum>(4)</enum><text>Coordinating with the relevant offices within the Department and tribal governments to develop a comprehensive border security policy that addresses law enforcement, personnel, and funding issues in Indian country (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/1151">section 1151</external-xref> of title 18, United States Code) on the United States borders with Canada and with Mexico.</text></paragraph> 
<paragraph id="H592AB2D75F64478887F1ECFA22F9F87"><enum>(5)</enum><text>Coordinating with the Assistant Secretary for Infrastructure Protection and tribal governments to develop appropriate policies for infrastructure protection on Indian lands, as well as information sharing mechanisms with tribal governments.</text></paragraph> 
<paragraph id="HF6551C6487434F3DB6D5EC56EC31B3CF"><enum>(6)</enum><text display-inline="yes-display-inline">Coordinating with the relevant offices within the Department to help ensure that tribal governments are fully informed of, have access to, and may apply for all Department of Homeland Security grant opportunities for emergency response providers, and to develop and achieve preparedness goals for tribal governments that are consistent with national goals for terrorism preparedness, as determined by the Department.</text></paragraph> 
<paragraph id="H5EE171A877704B6FBFF00FAB48701A8"><enum>(7)</enum><text>Coordinating with the Director of Science and Technology to identify opportunities to conduct research and development of homeland security technologies or scientific understanding for tribal universities or private sector entities.</text></paragraph> 
<paragraph id="HE7C82935E0E648FBBEFBE96B95529CD9"><enum>(8)</enum><text>Coordinating with U.S. Citizenship and Immigration Services and other relevant entities within the Department of Homeland Security having immigration services- or enforcement-related functions to develop policies on issues related to citizenship and the movement of members of federally recognized Indian tribes across the United States border, taking into consideration the unique characteristics of certain federally recognized Indian tribes with jurisdiction over lands adjacent to the Canadian and Mexican borders.</text></paragraph> 
<paragraph id="H6E67B4B171AD4D23903BE199E9F07C93"><enum>(9)</enum><text>Coordinating with other offices within the Department of Homeland Security to develop and implement sound policies regarding Indian country (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/1151">section 1151</external-xref> of title 18, United States Code) and tribal governments.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HAB7D85C4068F4EA0AA07C203F727FF1"><enum>(2)</enum><text>in the table of sections, by inserting after the item relating to section 801 the following new item:</text>

<subsection id="H779AD7F8F3484518A48FF481BEB410F7"><enum>(a)</enum><header>In general</header><text>There shall be in the Directorate for Preparedness and Response a National Cybersecurity Office, which shall be headed by an Assistant Secretary for Cybersecurity and Telecommunications, who shall be appointed by the President.</text></subsection> 
<subsection id="HB8EC45CEFC9C46FBB13ED5B39E530073"><enum>(b)</enum><header>General authority</header><text display-inline="yes-display-inline">Subject to the direction and control of the Secretary, the Assistant Secretary for Cybersecurity and Telecommunications shall have primary authority within the Department for all critical infrastructure protection programs of the Department relating to cybersecurity, including with respect to policy formulation and program management.</text></subsection> 
<subsection id="H65D0404DB5FF4F149DE7A2465DCAB35"><enum>(c)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Assistant Secretary for Cybersecurity and Telecommunications shall assist the Secretary in promoting national cybersecurity and telecommunications security and the responsibilities of the Assistant Secretary shall include the following duties:</text> 
<paragraph id="HB87BD59DD4FF496D831E92A3CBE04300"><enum>(1)</enum><text>To establish and manage—</text> 
<subparagraph id="H51B9DA7A562342D299D9F2A235B25BFB"><enum>(A)</enum><text>a national cybersecurity response system that includes the ability to—</text> 
<clause id="HC62F8833BC024541BEFF85A481DBDA00"><enum>(i)</enum><text>analyze the effect of cybersecurity threat information on national critical infrastructure; and</text></clause> 
<clause id="H6A36C2B42DD24F3EA98D000186B4FD14"><enum>(ii)</enum><text>aid in the detection and warning of attacks on cybersecurity infrastructure and in the restoration of such infrastructure in the aftermath of an attack;</text></clause></subparagraph> 
<subparagraph id="HA607262B44264D8589332BC82F3FB384"><enum>(B)</enum><text>a national cybersecurity threat and vulnerability reduction program to—</text> 
<clause id="H8BF89504078049AA8F926243552C3EA2"><enum>(i)</enum><text>identify cybersecurity vulnerabilities that effect critical national infrastructure;</text></clause> 
<clause id="HBF48CA07AB5A492884B8DD09F45567B9"><enum>(ii)</enum><text>perform vulnerability assessments on information technologies; and</text></clause> 
<clause id="H5D8D9E1375204C2BB19893CECC1E0148"><enum>(iii)</enum><text>coordinate the mitigation of such vulnerabilities;</text></clause></subparagraph> 
<subparagraph id="HBCBF47BCA50D48A085A82C7B8B8DE149"><enum>(C)</enum><text>a national cybersecurity awareness and training program to promote cybersecurity awareness among the public and the private sectors and cybersecurity training and education programs;</text></subparagraph> 
<subparagraph id="HA0E1FF57398E4BB395AAD6ACB042387B"><enum>(D)</enum><text>a Government-wide cybersecurity program to coordinate and consult with Federal, State, and local governments to enhance their cybersecurity programs; and</text></subparagraph> 
<subparagraph id="H91A6C5E386894F3894678D2FF26F9289"><enum>(E)</enum><text>a national security and international cybersecurity cooperation program to help foster Federal efforts to enhance international cybersecurity awareness and cooperation.</text></subparagraph></paragraph> 
<paragraph id="H3924414B308A4E84BBDF6E20ECD378DE"><enum>(2)</enum><text>To coordinate with the private sector as appropriate and to promote cybersecurity information sharing, vulnerability assessment, and threat warning with respect to critical infrastructure.</text></paragraph> 
<paragraph id="HB199E1224797432BA89C4CF1BF043F8"><enum>(3)</enum><text>To coordinate with other directorates and offices within the Department on the cybersecurity aspects of their missions.</text></paragraph> 
<paragraph id="H656F8EDB5F7042F5A9E1E96C3331F726"><enum>(4)</enum><text>To coordinate with the Under Secretary for Policy to ensure that the national response plan developed pursuant to section 502(6) includes appropriate measures for the recovery of the cybersecurity elements of critical infrastructure.</text></paragraph> 
<paragraph id="HAB60273C9FFD43EBAE51D4A58F8FF116"><enum>(5)</enum><text>To develop processes for information sharing with the private sector, consistent with section 214, that—</text> 
<subparagraph id="H4FA28DCA5E124C40BC3781820281EA73"><enum>(A)</enum><text>promote voluntary cybersecurity best practices, standards, and benchmarks that are responsive to rapid technology changes and to the security needs of critical infrastructure; and</text></subparagraph> 
<subparagraph id="H4F5F07EB67E44AC2A9AF46D8E56BC2EC"><enum>(B)</enum><text>consider roles of Federal, State, local, and foreign governments and the private sector, including the insurance industry and auditors.</text></subparagraph></paragraph> 
<paragraph id="HC4A23F70B870411BA78D00AED1BF6894"><enum>(6)</enum><text>To coordinate with the Chief Information Officer in establishing a secure information sharing architecture and information sharing processes, including with respect to the operation centers of the Department.</text></paragraph> 
<paragraph id="H607CDF2BEACB4DA89D356C364EE213B8"><enum>(7)</enum><text>To consult with the Electronic Crimes Task Force of the United States Secret Service on private sector outreach and information activities.</text></paragraph> 
<paragraph id="HB5583114D96C497EA71F00BD780AD2E"><enum>(8)</enum><text>To consult with the Director of the Office for Domestic Preparedness to ensure that realistic cybersecurity scenarios are incorporated into tabletop and recovery exercises.</text></paragraph> 
<paragraph id="H56CBDE5305B949818D2D3F1610AB15EE"><enum>(9)</enum><text>To consult and coordinate, as appropriate, with other Federal agencies on cybersecurity-related programs, policies, and operations.</text></paragraph> 
<paragraph id="HB1197DBBABAD4050905CC20168681B61"><enum>(10)</enum><text>To consult and coordinate within the Department and, where appropriate, with other relevant Federal agencies, on security of digital control systems, such as Supervisory Control and Data Acquisition systems.</text></paragraph></subsection>

<subparagraph id="H913FE00E7AA2488BB935543669DB6331"><enum>(H)</enum><text display-inline="yes-display-inline">To carry out comprehensive assessments of the vulnerabilities of the key resources and critical infrastructure of the United States, including the performance of risk assessments to determine the risks posed by particular types of terrorist attacks within the United States (including an assessment of the probability of success of such attacks and the feasibility and potential efficacy of various countermeasures to such attacks).</text></subparagraph> 
<subparagraph id="H7B9DBEE250CC4EE88DB4A37C7059FC00"><enum>(I)</enum><text display-inline="yes-display-inline">To develop a comprehensive national plan for securing the key resources and critical infrastructure of the United States, including power production, generation, and distribution systems, information technology and telecommunications systems (including satellites), electronic financial and property record storage and transmission systems, emergency preparedness communications systems, and the physical and technological assets that support such systems.</text></subparagraph> 
<subparagraph id="H7CDBE51EBDCC4347A6A7C0D84649AD3E"><enum>(J)</enum><text display-inline="yes-display-inline">To recommend measures necessary to protect the key resources and critical infrastructure of the United States in coordination with other agencies of the Federal Government and in cooperation with State and local government agencies and authorities, the private sector, and other entities.</text></subparagraph> 
<subparagraph id="H8F6ECC4C1CE149D2A989A63E18A96760"><enum>(K)</enum><text display-inline="yes-display-inline">To perform such other duties relating to such responsibilities as the Secretary may provide.</text></subparagraph></paragraph> 
<paragraph id="HAA1AF64434924E51A7ABC1F46F33A5F8"><enum>(3)</enum><header>Consultation with Chief Intelligence Officer</header><text display-inline="yes-display-inline">Subject to the direction and control of the Secretary, the Assistant Secretary for Physical Infrastructure Security shall consult with the Chief Intelligence Officer on the following responsibilities:</text> 
<subparagraph id="H0295FFEBE8F74C239BA69CD541C107F"><enum>(A)</enum><text display-inline="yes-display-inline">To integrate relevant information, analyses, and vulnerability assessments (whether such information, analyses, or assessments are provided or produced by the Department or others) in order to identify priorities for protective and support measures by the Department, other agencies of the Federal Government, State and local government agencies.</text></subparagraph> 
<subparagraph id="HB65B4119F78D4A18903D19C3DA817FB1"><enum>(B)</enum><text display-inline="yes-display-inline">To ensure, in conjunction with the Chief Information Officer of the Department, that any information databases and analytical tools developed or utilized by the Department—</text> 
<clause id="H8A9E1E56DB424067A6EE55EB6837DCEB"><enum>(i)</enum><text>are compatible with one another and with relevant information databases of other agencies of the Federal Government; and</text></clause> 
<clause id="H08A8462D661847AF91D38114D54E8889"><enum>(ii)</enum><text>treat information in such databases in a manner that complies with applicable Federal law on privacy.</text></clause></subparagraph>

<subparagraph id="HF8644DC4ADFA42BBABCAC090869BF2C0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than December 30, 2005, the Assistant Secretary for Physical Infrastructure Security of the Department of Homeland Security, in coordination with the Chief Intelligence Officer of the Department of Homeland Security and appropriate personnel charged with infrastructure protection and emergency preparedness and response for the Department, shall submit to the President and Congress a comprehensive report assessing the vulnerabilities of the key resources and critical infrastructure of the United States.</text></subparagraph> 
<subparagraph id="H1C9A1CF7E14C40F3B0FBF819DD3AED4"><enum>(B)</enum><header>Methodology</header><text>The report shall be based on commonly accepted risk-assessment methodologies and shall prioritize vulnerabilities based upon actual and prospective threats so that appropriate protective and support measures can be taken. To the extent possible, the report should include not only a general prioritization of vulnerabilities but also a prioritization of vulnerabilities by resource and infrastructure sector.</text></subparagraph></paragraph> </subsection>

<section section-type="subsequent-section" id="H313FD77F9F2F4B4CB598355253A2119" display-inline="no-display-inline"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Secure Handling of Ammonium Nitrate Act of 2005</short-title></quote>.</text></section> 
<section id="H2234E221F9884B639699EF59688C7656"><enum>202.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H07C7D147F29E4A87BAECC5DE3C024F22"><enum>(1)</enum><text display-inline="yes-display-inline">Although ammonium nitrate is an important fertilizer used in agricultural production, in the wrong hands, ammonium nitrate can be used to create explosives and was so used in terrorist attacks conducted in in Oklahoma City, Bali, and Istanbul.</text></paragraph> 
<paragraph id="H997213A6D67E410D9F55E9CA009EBFC6"><enum>(2)</enum><text>The production, importation, storage, sale, and distribution of ammonium nitrate affects interstate and intrastate commerce.</text></paragraph> 
<paragraph id="H74F7A7A7690B46E8A24EA1D93FD3EEB"><enum>(3)</enum><text display-inline="yes-display-inline">It is necessary for the Secretary of Homeland Security to regulate the production, storage, sale, and distribution of ammonium nitrate on account of the prior use of ammonium nitrate to create explosives used in acts of terrorism and the prevent terrorists from acquiring ammonium nitrate to create explosives.</text></paragraph></section> 
<section id="H2583CFB8D6B04B3B878F00A84660BE2D"><enum>203.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H949C66A4AA964639B06CA492107360CE"><enum>(1)</enum><header>Title</header><text>The term <term>this title</term> includes regulations issued under this title.</text></paragraph> 
<paragraph id="HA3F7623113D5480296356CC9D8DB93D9"><enum>(2)</enum><header>Ammonium nitrate</header><text>The term <term>ammonium nitrate</term> means solid ammonium nitrate that is chiefly the ammonium salt of nitric acid and contains not less than 33 percent nitrogen, of which—</text> 
<subparagraph id="HEFB617155C3C48DAB3E81EE2BEB09FC"><enum>(A)</enum><text>50 percent is in ammonium form; and</text></subparagraph> 
<subparagraph id="H6C91BDE0E1954B9FB400BC2042E4D7AF"><enum>(B)</enum><text>50 percent is in nitrate form.</text></subparagraph></paragraph> 
<paragraph id="H730580E5D3AE440D92A00581B3699CF"><enum>(3)</enum><header>Facility</header><text>The term <term>facility</term> means any site where ammonium nitrate is produced, stored, or held for distribution, sale, or use. The term includes—</text> 
<subparagraph id="H99FE3F37E56C4E0B99B1AA61E3C5AE6F"><enum>(A)</enum><text>all buildings or structures used to produce, store, or hold ammonium nitrate for distribution, sale, or use at a single site; and</text></subparagraph> 
<subparagraph id="H759EFF7FAC8C4205AC1636C259FD8D4F"><enum>(B)</enum><text>multiple sites described in subparagraph (A), if the sites are—</text> 
<clause id="H1FF0CCF6D1AC44BAAEB4A081FBD199AF"><enum>(i)</enum><text>contiguous or adjacent; and</text></clause> 
<clause id="H03DF08F3DD4C433F96AD9E71E7F6D0E0"><enum>(ii)</enum><text>owned or operated by the same person.</text></clause></subparagraph></paragraph> 
<paragraph id="HDB9A3E6F587A4BE6B86FD43DBE16BBFB"><enum>(4)</enum><header>Handle</header><text>The term <term>handle</term> means to produce, store, sell, or distribute ammonium nitrate.</text></paragraph>

<paragraph id="H50F23458952D4D61936C6E930846E064"><enum>(6)</enum><header>Purchaser</header><text>The term <term>purchaser</term> means any person that purchases ammonium nitrate.</text></paragraph> 
<paragraph id="H18D4FB77DEF7447395DE34DCBACBD170"><enum>(7)</enum><header>Terrorism</header><text display-inline="yes-display-inline">The term <term>terrorism</term> has the meaning given that term in section 2(15) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101(15)</external-xref>).</text></paragraph> 
<paragraph id="H7CA9BA453D5A4AFA9B9132E3BFDB3009"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section> 
<section id="H5CB34E001C80481DAA28A734D94F939"><enum>204.</enum><header>Regulation of handling and purchase of ammonium nitrate</header> 
<subsection id="H6419819E56AE4447A6E3F11FA2519617"><enum>(a)</enum><header>In general</header><text>The Secretary may regulate the handling and purchase of ammonium nitrate to prevent the misappropriation or use of ammonium nitrate in an act of terrorism.</text></subsection> 
<subsection id="H7F783FAEC94D453AB170A24097E74DEE"><enum>(b)</enum><header>Regulations</header><text>The Secretary may promulgate regulations that require—</text> 
<paragraph id="H28AF32B1E140449C8FFA8FC1F438AFC7"><enum>(1)</enum><text>handlers—</text> 
<subparagraph id="HB1523A8F43484D1E8474B5F2C2CB84E3"><enum>(A)</enum><text>to register facilities;</text></subparagraph> 
<subparagraph id="H0D5C1F8C4A6048B094F66620AC3400EE"><enum>(B)</enum><text>to sell or distribute ammonium nitrate only to handlers and purchasers registered under this title; and</text></subparagraph> 
<subparagraph id="H993FB00A7B1248C6887F47ABF648DEDC"><enum>(C)</enum><text>to maintain records of sale or distribution that include the name, address, telephone number, and registration number of the immediate subsequent purchaser of ammonium nitrate; and</text></subparagraph></paragraph> 
<paragraph id="H0284A67177C64C3F8BC2968755CE144C"><enum>(2)</enum><text>purchasers to be registered.</text></paragraph></subsection> 
<subsection id="HFA46A1F2335E4005ABB3C0645D28F0F1"><enum>(c)</enum><header>Use of previously submitted information</header><text>Prior to requiring a facility or handler to submit new information for registration under this section, the Secretary shall—</text> 
<paragraph id="HCC1791533E2642DE86A7B29128697DE5"><enum>(1)</enum><text>request from the Attorney General, and the Attorney General shall provide, any information previously submitted to the Attorney General by the facility or handler under <external-xref legal-doc="usc" parsable-cite="usc/18/843">section 843</external-xref> of title 18, United States Code; and</text></paragraph> 
<paragraph id="HA768B821EDAB4D92803C73C01C2594BB"><enum>(2)</enum><text>at the election of the facility or handler—</text> 
<subparagraph id="H9CEAA1A3B278486B9592FD71AC7F40EE"><enum>(A)</enum><text>use the license issued under that section in lieu of requiring new information for registration under this section; and</text></subparagraph> 
<subparagraph id="HC07074C1C106474B86482000FC01ECD6"><enum>(B)</enum><text>consider the license to fully comply with the requirement for registration under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H7DC0F003C7564E84AF0938FFA0A94008"><enum>(d)</enum><header>Consultation</header><text>In promulgating regulations under this section, the Secretary shall consult with the Secretary to Agriculture to ensure that the access of agricultural producers to ammonium nitrate is not unduly burdened.</text></subsection> 
<subsection id="H452D178484564137B1402B00D7004E13"><enum>(e)</enum><header>Data confidentiality</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, or the USA PATRIOT ACT (<external-xref legal-doc="public-law" parsable-cite="pl/107/56">Public Law 107–56</external-xref>; 115 Stat. 272) or an amendment made by that Act, the Secretary may not disclose to any person any information obtained from any facility, handler, or purchaser—</text> 
<paragraph id="H551904E59F3D456FBBE9DD300419843"><enum>(1)</enum><text>regarding any action taken, or to be taken, at the facility or by the handler or purchaser to ensure the secure handling of ammonium nitrate; or</text></paragraph> 
<paragraph id="HE637DB7568594F4191EF584E74D1AE"><enum>(2)</enum><text>that would disclose—</text> 
<subparagraph id="HAC7C1EB961E949A2B5BF1BBDBC1B57A2"><enum>(A)</enum><text>the identity or address of any purchase of ammonium nitrate;</text></subparagraph> 
<subparagraph id="H6627537BA26C4656BCE427D14DD7A915"><enum>(B)</enum><text>the quantity of ammonium nitrate purchased; or</text></subparagraph> 
<subparagraph id="H44A825C089994C4D9B10A87EEB48F990"><enum>(C)</enum><text>the details of the purchase transaction.</text></subparagraph></paragraph></subsection> 
<subsection id="HCA84406A206042C1A9FC61BA4F006100"><enum>(f)</enum><header>Exceptions to data confidentiality</header><text>The Secretary may disclose any information described in subsection (e)—</text> 
<paragraph id="H4BFA3C1DCCEE410A903313050028C372"><enum>(1)</enum><text>to an officer or employee of the United States, or a person that has entered into a contract with the United States, who needs to know the information to perform the duties of the officer, employee, or person, or to a State agency pursuant to an arrangement under section 206, under appropriate arrangements to ensure the protection of the information;</text></paragraph> 
<paragraph id="HEE108DEF06974D5AAFDADF945FE1650"><enum>(2)</enum><text>to the public, to the extent the Secretary specifically finds that disclosure of particular information is required in the public interest; or</text></paragraph> 
<paragraph id="H65AD8DCBC1594CEBA592F584BE3730E4"><enum>(3)</enum><text>to the extent required by order of a Federal court in a proceeding in which the Secretary is a party, under such protective measures as the court may prescribe.</text></paragraph></subsection></section> 
<section id="H80C575509BD34007B63B5DB37B59E253"><enum>205.</enum><header>Enforcement</header> 
<subsection id="H1D75B4AED48041C8AF564D3C184C5F99"><enum>(a)</enum><header>Inspections</header><text>The Secretary, without a warrant, may enter any place during business hours that the Secretary believes may handle ammonium nitrate to determine whether the handling is being conducted in accordance with this title.</text></subsection> 
<subsection id="H49C9A206604A4D9D80B01D6142D3E883"><enum>(b)</enum><header>Prevention of sale or distribution order</header><text>In any case in which the Secretary has reason to believe that ammonium nitrate has been handled other than in accordance with this title, the Secretary may issue a written order preventing any person that owns, controls, or has custody of the ammonium nitrate from selling or distributing the ammonium nitrate.</text></subsection> 
<subsection id="H461D0BC8EBB94846A04D24D21072EE5B"><enum>(c)</enum><header>Appeal procedures</header> 
<paragraph id="HAB653AA79AA04E8F959B00C732E2124"><enum>(1)</enum><header>In general</header><text>A person subject to an order under subsection (b) may request a hearing to contest the order, under such administrative adjudication procedures as the Secretary may establish.</text></paragraph> 
<paragraph id="H15CC103367A846F782AC945818EF3118"><enum>(2)</enum><header>Rescission</header><text>If an appeal under paragraph (1) is successful, the Secretary shall rescind the order.</text></paragraph></subsection> 
<subsection id="H641C3E25EAA74E7BADEFD30051BC9FC6"><enum>(d)</enum><header>In rem proceedings</header><text>The Secretary may institute in rem proceedings in the United States district court for the district in which the ammonium nitrate is located to seize and confiscate ammonium nitrate that has been handled in violation of this title.</text></subsection></section> 
<section id="H45366F3597D44843A711D7A864259F4C"><enum>206.</enum><header>Administrative provisions</header> 
<subsection id="H5745B5821E5347D2B718BFC6D8EDE45E"><enum>(a)</enum><header>Cooperative agreements</header><text>The Secretary may enter into a cooperative agreement with the Secretary of Agriculture, or the head of any State department of agriculture or other State agency that regulates plant nutrients, to carry out this title, including cooperating in the enforcement of this title through the use of personnel or facilities.</text></subsection> 
<subsection id="H18BDFEF098244BE2A9CABBD430196FFB"><enum>(b)</enum><header>Delegation</header> 
<paragraph id="H9FAD4FE30FD04685951DD94805A00D9"><enum>(1)</enum><header>In general</header><text>The Secretary may delegate to a State the authority to assist the Secretary in the administration and enforcement of this title.</text></paragraph> 
<paragraph id="HF031217D01CA473FA76EDC695CB998"><enum>(2)</enum><header>Delegation required</header><text>On the request of a Governor of a State, the Secretary shall delegate to the State the authority to carry out section 204 or 205, on a determination by the Secretary that the State is capable of satisfactorily carrying out that section.</text></paragraph> 
<paragraph id="HF4F8D4A17BB84D96A2A846E0C3B295AC"><enum>(3)</enum><header>Funding</header><text>If the Secretary enters into an agreement with a State under this subsection to delegate functions to the State, the Secretary shall provide to the State adequate funds to enable the State to carry out the functions.</text></paragraph> 
<paragraph id="HFE221E9B83F64B5DA55906715B08C364"><enum>(4)</enum><header>Inapplicability</header><text>Notwithstanding any other provision of this subsection, this subsection does not authorize a State to carry out a function under section 204 or 205 relating to a facility or handler in the State that makes the election described in section 204(c)(2).</text></paragraph></subsection></section> 
<section id="H8D3D786E5FA14C1CAAECD0DEF526F1F7"><enum>207.</enum><header>Civil liability</header> 
<subsection id="HC40C977C03634C58BC21C586F3A4F4BB"><enum>(a)</enum><header>Unlawful acts</header><text>It is unlawful for any person—</text> 
<paragraph id="HEFA1803FD1D64BD9B064EC5B39F1F071"><enum>(1)</enum><text>to fail to perform any duty required by this title;</text></paragraph> 
<paragraph id="H422DDD7236014560A6A85DDF3905783F"><enum>(2)</enum><text>to violate the terms of registration under this title;</text></paragraph> 
<paragraph id="HA7BAAAC79CA448A2A19D74C157DD00B0"><enum>(3)</enum><text>to fail to keep any record, make any report, or allow any inspection required by this title; or</text></paragraph> 
<paragraph id="H5DADA12E52094CDF9100037ED252523D"><enum>(4)</enum><text>to violate any sale or distribution order issued under this title.</text></paragraph></subsection> 
<subsection id="H9CF0FBF3D6754E91A053003FC02B1B96"><enum>(b)</enum><header>Penalties</header> 
<paragraph id="HEBF85A34085F4688B49E046E4026DF7F"><enum>(1)</enum><header>In general</header><text>A person that violates this title may only be assessed a civil penalty by the Secretary of not more than $50,000 per violation.</text></paragraph> 
<paragraph id="H95D01D97BCD249ECA9D63F4B18FDDEAC"><enum>(2)</enum><header>Notice and opportunity for a hearing</header><text>No civil penalty shall be assessed under this title unless the person charged has been given notice and opportunity for a hearing on the charge in the county, parish, or incorporated city of residence of the person charged.</text></paragraph></subsection> 
<subsection id="H150A9CCA6D7B429DA23F031650F43239"><enum>(c)</enum><header>Jurisdiction over actions for civil damages</header><text>The district courts of the United States shall have exclusive jurisdiction over any action for civil damages against a handler for any harm or damage that is alleged to have resulted from the use of ammonium nitrate in violation of law that occurred on or after the date of enactment of this title.</text></subsection></section> 
<section id="HE1453C0ACCC24BAF804195FC6F70DA01"><enum>208.</enum><header>State law preemption</header><text display-inline="no-display-inline">This title preempts any State law that regulates the handling of ammonium nitrate to prevent the misappropriation or use of ammonium nitrate in an act of terrorism.</text></section></title>
