<official-title>To require owners of property to test and disclose the water quality of qualified wells before selling or leasing the property, and for other purposes.</official-title>

<section id="HC176E0BEC028430C95FF85AC05541EB4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Private Well Protection Act of 2005</short-title></quote>.</text></section> 
<section id="HFDC44E9FB7FE444F936CF123C4566E1F"><enum>2.</enum><header>Testing of qualified wells before sale or lease of property</header> 
<subsection id="HC2D613EB6965496A9DF017B62E88DA1F"><enum>(a)</enum><header>Requirements</header><text>Before selling or leasing any privately-owned property that includes a qualified well, the owner of such property shall—</text> 
<paragraph id="HB3BFDD434E7D4A8BB99E008F73BBF069"><enum>(1)</enum><text>conduct tests with respect to each such well in accordance with subsection (b);</text></paragraph> 
<paragraph id="HFAAC6F9697204FE08260DCB9001DAC00"><enum>(2)</enum><text>disclose the results of such tests to the prospective buyer or lessee of the property; and</text></paragraph> 
<paragraph id="HF50DD75765204F908770A5876154A7DF"><enum>(3)</enum><text>provide the results of such tests to the Environmental Protection Agency.</text></paragraph></subsection> 
<subsection id="H9931677EAFAA4651BC16E0C500A09331"><enum>(b)</enum><header>Testing</header><text>Tests described in subsection (a) shall be conducted in accordance with the following:</text> 
<paragraph id="HCC3CA01017844AAC9E1EAB2300A8E557"><enum>(1)</enum><text>The tests shall be conducted at the expense of the owner of the property.</text></paragraph> 
<paragraph id="HD139E8D5E8D948339174695D49AB397F"><enum>(2)</enum><text>The tests shall be conducted separately for each qualified well on the property.</text></paragraph> 
<paragraph id="HA6CD6071968C4BE28616E4A451C74BC3"><enum>(3)</enum><text>The tests shall be conducted, and the samples shall be gathered, by a laboratory that is accredited in accordance with the National Environmental Laboratory Accreditation Program.</text></paragraph> 
<paragraph id="H33187586A2CF453999E8193BFA65BFF"><enum>(4)</enum><text>The tests shall be conducted at any time during the 6-month period preceding the sale or lease involved.</text></paragraph> 
<paragraph id="H779D4E4B73954DB881FE4100CA060000"><enum>(5)</enum><text>The tests shall determine the level of contaminants in the water of each qualified well on the property. At a minimum, the tests shall be for the following contaminants:</text> 
<subparagraph id="H2A73855D09AB44B4B4B16BF337531342"><enum>(A)</enum><text>Total coliform bacteria.</text></subparagraph> 
<subparagraph id="H6892B03D757040DB8FD52D34B5CF44B4"><enum>(B)</enum><text>Iron.</text></subparagraph> 
<subparagraph id="H2237DE5A568B4FEE854E20C5090333BD"><enum>(C)</enum><text>Manganese.</text></subparagraph> 
<subparagraph id="H1FE18C95736748DFAA468629C5B75298"><enum>(D)</enum><text>pH.</text></subparagraph> 
<subparagraph id="H4DEACC3EDF1B4F1C857C7FF1D8D244BE"><enum>(E)</enum><text>All volatile organic compounds for which a maximum contaminant level has been established under the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>).</text></subparagraph> 
<subparagraph id="HB5D2CC292274425CBD0600BF6C89772"><enum>(F)</enum><text>Nitrate.</text></subparagraph> 
<subparagraph id="HD2A2E895C1C1423CAAA916AABF90F2A4"><enum>(G)</enum><text>Lead.</text></subparagraph> 
<subparagraph id="H11A1C6A777B24141AD9E20CEA864BD24"><enum>(H)</enum><text>Mercury.</text></subparagraph></paragraph></subsection> 
<subsection id="H0E3BF4EEF7A243F5BB3958C529E09246"><enum>(c)</enum><header>Civil action</header> 
<paragraph id="H8AAAAAFDBF72418799E953DE91D0369E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a person sells or leases a property in violation of subsection (a)(2), the buyer or lessee of the property may bring a civil action against such person in an appropriate United States district court or in a State court of competent jurisdiction.</text></paragraph> 
<paragraph id="H818070807A4F4DDDA35E5634F755A06E"><enum>(2)</enum><header>Damages</header><text>In any action brought under paragraph (1), if the court finds that the defendant violated subsection (a)(2), the defendant shall be liable to the plaintiff in an amount equal to the sum of—</text> 
<subparagraph id="HC39180DCE2D2412DA482D000CFDAE822"><enum>(A)</enum><text>an amount equal to 1 percent of the appraised value of the property involved or $10,000, whichever is greater;</text></subparagraph> 
<subparagraph id="H4712831746C24544A14404B7794B9EC2"><enum>(B)</enum><text>the amount of any actual, direct economic damages, including any remediation, legal, and medical costs, incurred by the plaintiff as a proximate result of any contamination which the defendant failed to disclose as required by subsection (a)(2); and</text></subparagraph> 
<subparagraph id="H668F9CCC87B74C4593CD5BE4CA006440"><enum>(C)</enum><text>the costs of the action under this subsection.</text></subparagraph></paragraph> 
<paragraph id="HD10232CDCB0443DDBA56153F15BC5A2"><enum>(3)</enum><header>Limitation</header><text>An action under this subsection must be brought not later than 5 years after the sale or lease of the property involved.</text></paragraph></subsection> 
<subsection id="H24511F164EFC48BBAF5355A80074E07D"><enum>(d)</enum><header>Civil penalty</header><text>Any person found by the Administrator of the Environmental Protection Agency, after notice and an opportunity for a hearing, to have committed a violation of subsection (a)(3) is liable to the United States Government for a civil penalty of not more than $5,000 for each such violation.</text></subsection> 
<subsection id="H2E4713B5662C4C318DE5ED5B63D5F741"><enum>(e)</enum><header>Public availability of test results</header><text>The Administrator of the Environmental Protection Agency shall—</text> 
<paragraph id="H6D716A7475F84BE8B3FDE855C9599B97"><enum>(1)</enum><text>collect, compile, and maintain the results of tests provided to the Administrator pursuant to subsection (a)(3); and</text></paragraph> 
<paragraph id="HBA5E7A7784E4481E95EADB35DA4ED4E5"><enum>(2)</enum><text>make such results available to the public by request, together with an explanation of such results in lay language if requested.</text></paragraph></subsection> 
<subsection id="HD9BD9732632B4C11843846BFDF7100AB"><enum>(f)</enum><header>Definition</header><text>In this section, the term <term>qualified well</term> means a well that—</text> 
<paragraph id="H2D6E10223A0042C7822EE4A07CFD02AD"><enum>(1)</enum><text>has fewer than 15 service connections; and</text></paragraph> 
<paragraph id="H94ABFE84399245E19C7B600025AC9232"><enum>(2)</enum><text>does not regularly serve at least 25 individuals for at least 60 days each year.</text></paragraph></subsection> 
<subsection id="H87F0EFC05EE048119FC8363C92492FED"><enum>(g)</enum><header>Effective date</header><text>This section applies only with respect to the sale or lease of a property on or after the date that is 180 days after the date of the enactment of this section.</text> </subsection></section>
