<legis-type>A BILL</legis-type> 
<official-title>To accelerate the reemployment and employment of individuals affected by Hurricanes Katrina and Rita by establishing grants to eligible entities to provide worker recovery accounts to eligible individuals.</official-title>

<legis-body id="H6B9FA88BFBD74BB2B7BAA68F92373398" style="OLC"> 
<section id="HBD4BC8D7D89F4527B2F0B33DE68301B1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Worker Recovery Act of 2005</short-title></quote>.</text> </section> 
<section id="HD659C953ADC644E59F4D61364764AB00"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this act are to accelerate the reemployment and employment of individuals affected by Hurricanes Katrina and Rita, and provide such individuals with enhanced flexibility, choice, and control in obtaining intensive reemployment, training, and supportive services.</text></section> 
<section id="HAF8DF3923B594791A2779FB4D622B000"><enum>3.</enum><header>Grants to support worker recovery accounts</header><text display-inline="no-display-inline">Subtitle F of title I of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801 et seq.</external-xref>) is amended by redesignating subtitle F as subtitle G and inserting after subtitle E the following:</text> 
<quoted-block style="OLC" id="HA062702024BF4DF58271A0A705ED6316" display-inline="no-display-inline"> 
<subtitle id="H7DFA9D9035974A51A78B7CB5A3F65CA8"><enum>F</enum><header>Temporary program to provide worker recovery accounts to workers affected by a Gulf hurricane disaster</header> 
<section id="H05EB338ACA10456895F00629ACC12312"><enum>196.</enum><header>Establishment of worker recovery accounts grant program</header> 
<subsection id="H9706F5F354EA4E088FA92E9CB100FD60"><enum>(a)</enum><header>In general</header><text>The Secretary shall make grants to eligible entities to provide worker recovery accounts to eligible individuals in accordance with this subtitle in order to meet the employment and training needs of individuals affected by Hurricane Katrina or Hurricane Rita.</text></subsection> 
<subsection id="HFCF9271C10F8420CA16EA4C08F8B8960"><enum>(b)</enum><header>Eligible entities</header><text>For purposes of this subtitle, an eligible entity means—</text> 
<paragraph id="HCEA58832631D42DFAC52D747F8AD8DA9"><enum>(1)</enum><text>the States of Louisiana, Mississippi, Alabama, and Texas;</text></paragraph> 
<paragraph id="HEA39E2FC5B534972A210A7926815553D"><enum>(2)</enum><text>States to which a significant number of individuals described in subsection (d)(2)(A)(i) and (ii) have relocated; and</text></paragraph> 
<paragraph id="H72E0AFD2D4834045B7862D7C3BA8C4C7"><enum>(3)</enum><text>a local board or a consortium of local boards established in a local area or areas—</text> 
<subparagraph id="HEA27B16603E84792BE89C1355148697C"><enum>(A)</enum><text>within the boundaries of which is an area that has been declared a major disaster under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) as a result of Hurricane Katrina or Hurricane Rita and where the President has determined payment of assistance under section 410(a) of such Act is warranted; or</text></subparagraph> 
<subparagraph id="HE08E40E0906B4950001CE19460662FC8"><enum>(B)</enum><text>to which a significant number of individuals described in subsection (d)(2)(A)(i) and (ii) have relocated.</text></subparagraph></paragraph></subsection> 
<subsection id="H74B18E8186DC440DA1E7AB7C5F4C98E9"><enum>(c)</enum><header>Use of grant funds</header> 
<paragraph id="H630E03D87DA04049ABA951BA49DF9CA5"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this subtitle shall use the grant funds to provide, through a local area or areas, eligible individuals with worker recovery accounts. An eligible individual may receive only 1 worker recovery account.</text></paragraph> 
<paragraph id="H7C4AE33C69ED4B6FB280C737CEEC715C"><enum>(2)</enum><header>Amount in accounts</header><text>The eligible entity shall establish the amount to be provided for each worker recovery account, which shall be uniform throughout the State or local area and shall not be in excess of $5,000.</text></paragraph> 
<paragraph id="H0BCC50183C254B6FB2E4E725ED9A602"><enum>(3)</enum><header>Limitation on administrative costs</header><text>Of the amount awarded to an eligible entity under a grant under this subtitle, not more than 5 percent of the amount may be used for the costs of administration.</text></paragraph></subsection> 
<subsection id="H65A06A47191B423E9B76048DF917B07E"><enum>(d)</enum><header>Eligible individuals</header> 
<paragraph id="H029F44E8F2684CDDABA8A56549CCA88B"><enum>(1)</enum><header>In general</header><text>Each eligible entity shall establish eligibility criteria for individuals for worker recovery accounts in accordance with this subsection.</text></paragraph> 
<paragraph id="H61BE07BACA7A4ECA88DBCA4694CFF623"><enum>(2)</enum><header>Eligibility criteria requirements</header> 
<subparagraph id="H87B7192DC9E94916897B98D9A380B799"><enum>(A)</enum><header>In general</header><text>An individual shall be eligible to receive a worker recovery account under a grant awarded under this subtitle if the individual—</text> 
<clause id="H31A5CEC7BDD54998A134862E6135633F"><enum>(i)</enum> 
<subclause id="H8EB8C54F9B0C44BE845EC2454220646D" display-inline="yes-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">was employed in a county in Mississippi or Alabama, or a parish in Louisiana, where a major disaster has been declared under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) as a result of Hurricane Katrina and where the President has determined payment of assistance under section 410(a) of such Act is warranted; or</text></subclause> 
<subclause id="H3EF2F86D1CDF44A4928238F3FFA562FA" indent="up1"><enum>(II)</enum><text>was employed in a county in Texas or a parish in Louisiana where a major disaster has been declared under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act as a result of Hurricane Rita and where the President has determined payment of assistance under section 410(a) of such Act is warranted;</text></subclause></clause> 
<clause id="H40399F350955441CA70249B76B181700"><enum>(ii)</enum><text>has lost the employment described in clause (i) as a direct result of a Hurricane Katrina or Hurricane Rita; and</text></clause> 
<clause id="H5DF8880792BF40E4A7642BE48F44D16E"><enum>(iii)</enum><text>either</text> 
<subclause id="HFAEBEA44E8874DCCB9D6FA3FA467EFC"><enum>(I)</enum> 
<item id="HF94EE3DACDAB41FEB5C53821C335A79E" display-inline="yes-display-inline"><enum>(aa)</enum><text>has been identified by the State pursuant to section 303(j)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/503">42 U.S.C. 503(j)(1)</external-xref>) as likely to exhaust regular unemployment compensation and in need of job search assistance to make a successful transition to new employment;</text></item> 
<item id="HFA508B58390F4F6D96C91751EBB9EDA0"><enum>(bb)</enum><text>is receiving regular unemployment compensation as defined in section 205(2) of the Federal-State Extended Unemployment Compensation Act of 1970; and</text></item> 
<item id="HE8C7270AA3DE462A8B731E01CD56CECC"><enum>(cc)</enum><text>filed the claim for unemployment compensation not later than 9 months after the declaration of the major disaster described in clause (i); or</text></item></subclause> 
<subclause id="H3CF4A3C84CEF417A83F9BA151E91F6E"><enum>(II)</enum><text display-inline="yes-display-inline">is receiving disaster unemployment assistance under section 410(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5177">42 U.S.C. 5177(a)</external-xref>).</text></subclause></clause></subparagraph> 
<subparagraph id="H0D6226A3EA9D47BDB4FD7E556C34E58C"><enum>(B)</enum><header>Additional eligibility and priority criteria</header><text>An eligible entity may establish criteria that are in addition to the criteria described in subparagraph (A) for the eligibility of individuals to receive a worker recovery account under this subtitle. An eligible entity may also establish criteria for priority in the provision of a worker recovery account to such eligible individuals under a grant awarded under this subtitle.</text></subparagraph></paragraph> 
<paragraph id="H3E7290B5F8934AB699A3C0F62B024314"><enum>(3)</enum><header>No individual entitlement</header><text>Nothing in this subtitle shall be construed to entitle any individual to receive a worker recovery account.</text></paragraph></subsection> 
<subsection id="HF93DA32226B04B69B9EAA896B5B7EC2"><enum>(e)</enum><header>Administration</header> 
<paragraph id="HDB5563357C734008829C8C9F2E388CB6"><enum>(1)</enum><header>Information and attestation</header><text>Prior to the establishment of a worker recovery account for an eligible individual, the eligible entity receiving a grant, through the one-stop delivery system in the participating local area or areas, shall ensure that the individual—</text> 
<subparagraph id="H03CBE55F4253486B80D1531CD7F67396"><enum>(A)</enum><text>is informed of the requirements applicable to the worker recovery account, including the allowable uses of funds from the account, the limitations on access to services described in section 196B and a description of such services, and the conditions for receiving a reemployment bonus;</text></subparagraph> 
<subparagraph id="HED6128FCDA6A409AAB078EA2DBBD660"><enum>(B)</enum><text>has the option to develop a worker recovery plan which will identify the employment goals and appropriate combination of services selected by the individual to achieve the employment goals; and</text></subparagraph> 
<subparagraph id="HF2EA62A23775460DB51CB5D4C705DF29"><enum>(C)</enum><text>signs an attestation that the individual has been given the option to develop a worker recovery plan in accordance with subparagraph (B), will comply with the requirements under this subtitle relating to the worker recovery accounts, and will reimburse the account or, if the account has been terminated, the grant awarded under this subtitle, for any amounts expended from the account that are not allowable.</text></subparagraph></paragraph> 
<paragraph id="H3B74C80EE04741D3B100763FB6FA1B37"><enum>(2)</enum><header>Periodic interviews</header><text>If a recipient exhausts his or her rights to any unemployment compensation and the recipient has a remaining balance in his or her worker recovery account, the one-stop delivery system shall conduct periodic interviews with the recipient to assist the recipient in meeting his or her individual employment goals.</text></paragraph> 
<paragraph id="HDA6ECF69C83B4E128524B198789CC0D4"><enum>(3)</enum><header>Use of worker recovery accounts</header><text>The eligible entity receiving a grant shall ensure that eligible individuals receiving a worker recovery account use the account in accordance with section 196B.</text></paragraph></subsection></section> 
<section id="H1AA66759FDF84D0694933F2F91F424C9"><enum>196A.</enum><header>Application for grants</header><text display-inline="no-display-inline">To be eligible to receive a grant under this subtitle, an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including at a minimum—</text> 
<paragraph id="H277DD44B0C084AFBBAFA72B525B14F41"><enum>(1)</enum><text>if the eligible entity is a State—</text>
<subparagraph id="HD31A604561504AF0BE027855E4CCCDD5"><enum>(A)</enum><text>assurance that the application was developed in conjunction with the local board or boards and chief elected officials where the worker recovery accounts shall be made available; and</text></subparagraph>
<subparagraph id="H0D68CE9DCF19453000881B3D197F08A4"><enum>(B)</enum><text>a description of the methods and procedures for providing funds, including administrative funds, to local areas where the worker recovery accounts shall be made available;</text></subparagraph></paragraph>
<paragraph id="HB047D1CA34EA4FB290F94464796CB37B" display-inline="no-display-inline"><enum>(2)</enum><text>a description of the criteria and methods to be used for determining eligibility for the worker recovery account, including the additional criteria and priority for service that the eligible entity intends to apply, if any, pursuant to section 196(d)(2)(B);</text></paragraph>
<paragraph id="H9FB246E4A10841EE9733D1D68EA674E"><enum>(3)</enum><text>a description of the methods or procedures to be used to provide eligible individuals information relating to services and providers;</text></paragraph>
<paragraph id="H91FFC1C03D2E4990834FEC2296926684"><enum>(4)</enum><text>a description of safeguards to ensure that funds from the worker recovery accounts are used for purposes authorized under this subtitle and to ensure the quality and integrity of services and providers, consistent with the purpose of providing eligible individuals with enhanced flexibility, choice, and control in obtaining intensive reemployment, training, and supportive services;</text></paragraph>
<paragraph id="H68AC0B68FC434F9A99D75D2E2BC4A5C0"><enum>(5)</enum><text>a description of how the eligible entity will coordinate the activities carried out under this subtitle with the employment and training activities carried out under section 134 and other activities carried out by local boards through the one-stop delivery system in the State or local area; and</text></paragraph>
<paragraph id="H7318FA3F524246EB8E513DE4F6368150"><enum>(6)</enum><text>an assurance that the eligible entity will comply with any evaluation and reporting requirements the Secretary may require.</text> </paragraph></section> 
<section id="H7B66CCBB430B4E75838854AEEFFC2CF"><enum>196B.</enum><header>Use of worker recovery accounts</header> 
<subsection id="H6ECBB9714894480287D400C755CDF4B1"><enum>(a)</enum><header>Allowable activities</header> 
<paragraph id="HB2E4BD8F365649F6B81FA1BDBCE8AF8E"><enum>(1)</enum><header>In general</header><text>Subject to the requirements contained in paragraphs (2) and (3), a recipient of a worker recovery account may use amounts in a worker recovery account to purchase 1 or more of the following:</text> 
<subparagraph id="HF6AF384D30514443B4A4C4C3966E4D10"><enum>(A)</enum><text>Intensive services, including those type of services specified in section 134(d)(3)(C).</text></subparagraph> 
<subparagraph id="H3BC6D8AA5B78427FAED1D1635FB64273"><enum>(B)</enum><text display-inline="yes-display-inline">Training services, including those types of services specified in section 134(d)(4)(D).</text></subparagraph> 
<subparagraph id="H092E72EA66D54E848E077592409D37EE"><enum>(C)</enum><text>Supportive services (except for needs related payments) and relocation assistance.</text></subparagraph></paragraph> 
<paragraph id="H38BBE54F8F1546259177EA00CFC98DC6"><enum>(2)</enum><header>Delivery of services</header><text>The following requirements relating to delivery of services shall apply to the grants under this subtitle:</text> 
<subparagraph id="HEA7647C7D53D4EE7AB17918B00A3F7FA"><enum>(A)</enum><text>Recipients may use funds from the worker recovery account to purchase the services described in paragraph (1) through the one-stop delivery system on a fee-for-service basis, or through other providers, consistent with the safeguards described in section 196A(d).</text></subparagraph> 
<subparagraph id="H0529D3CEB8AD4B478ECD8841A846A488"><enum>(B)</enum><text>The eligible entity, through the one-stop delivery system in the participating local area or areas, may pay costs for such services directly on behalf of the recipient, through a voucher system, through arrangements with private financial institutions, or by reimbursement to the recipient upon receipt of appropriate cost documentation.</text></subparagraph> 
<subparagraph id="HC40C5162841549F1AF5335FDBBF93F8E"><enum>(C)</enum><text>Each eligible entity, through the one-stop delivery system in the participating local area or areas, shall make available to recipients information on training providers, including information specified in section 134(d)(4)(F)(ii), information available to the one-stop delivery system on providers of the intensive and supportive services described in paragraph (1), including child care, and information relating to occupations in demand in the local area and occupations in demand in the home State of an individual who has relocated.</text></subparagraph></paragraph> 
<paragraph id="HEB543BAA35C143818524949DA808B5FE"><enum>(3)</enum><header>Limitations</header><text>The following limitations shall apply with respect to worker recovery accounts under this subtitle:</text> 
<subparagraph id="H6A951586FC9A44248757B3C742DDE86"><enum>(A)</enum><text>Amounts in a worker recovery account may be used for up to 1 year from the date of the establishment of the account.</text></subparagraph> 
<subparagraph id="H273C73ACD7F844ADBB210692B095E97C"><enum>(B)</enum><text>Each recipient shall submit cost documentation as required by the one-stop delivery system.</text></subparagraph> 
<subparagraph id="H898C89A10DE0461CA706FD6F0022723D"><enum>(C)</enum><text>For the 1-year period following the establishment of the account, recipients may not receive intensive, supportive, or training services funded under title I of this Act except on a fee-for-services basis as specified in paragraph (2)(A).</text></subparagraph> 
<subparagraph id="H06C639171DE14B3DBD5DA706C626F5E6"><enum>(D)</enum><text>Amounts in a worker recovery account shall be nontransferable.</text></subparagraph></paragraph></subsection> 
<subsection id="H6171C0D55CEF4F47BE0036ABDB4DCDFF"><enum>(b)</enum><header>Reemployment bonus</header> 
<paragraph id="HE09F832FF0244C699ED49795736684DF"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), if a recipient determined eligible under section 196(d) obtains full-time employment before the 13th week of unemployment for which unemployment compensation (including disaster unemployment assistance) is paid, or if such individual was already receiving unemployment compensation (including disaster unemployment assistance) on the date of enactment of this subtitle and obtains full-time employment before the 13th week after the week in which the worker recovery account is established, the balance of his or her worker recovery account in an amount not to exceed $1,000 shall be provided directly to the recipient in cash.</text></paragraph> 
<paragraph id="H7E160F0C5B7D464C90575BC940D238D3"><enum>(2)</enum><header>Limitations</header><text>The following limitations shall apply with respect to a recipient described in paragraph (1):</text> 
<subparagraph id="H53626D7EEE0F47CDACC22314DA341271"><enum>(A)</enum><text>60 percent of the remaining worker recovery account balance as determined under paragraph (1), up to a maximum of $600, shall be paid to the recipient at the time of employment.</text></subparagraph> 
<subparagraph id="HA39C3717511B44D8AD008C51974C974C"><enum>(B)</enum><text>40 percent of the remaining worker recovery account balance as determined under paragraph (1), up to a maximum of $400, shall be paid to the recipient after 26 weeks of employment retention.</text></subparagraph></paragraph> 
<paragraph id="HFD776582AB784957A28300DF3F3E1E7"><enum>(3)</enum><header>Exception regarding subsequent employment</header><text>If a recipient described in paragraph (1) subsequently becomes unemployed due to a lack of work after receiving the portion of the reemployment bonus specified under paragraph (2)(A), the individual may use the amount remaining in the worker recovery account for the purposes described in subsection (a) but may not be eligible for additional cash payments under this subparagraph.</text></paragraph></subsection></section> 
<section id="H04A6FF67C526435FA4D52D5B728922CE"><enum>196C.</enum><header>Program information and evaluation</header> 
<subsection id="HB072D9770E17431D81CC84FCE915608F"><enum>(a)</enum><header>Information</header><text>The Secretary may require eligible entities receiving a grant under this subtitle to collect and report on such financial, performance, and other program-related information as the Secretary determines is appropriate to carry out this subtitle, including the evaluation described in subsection (b).</text></subsection> 
<subsection id="HD3A74AF11EBE4F3292574293BAFED00"><enum>(b)</enum><header>Evaluation</header> 
<paragraph id="HA9E31157909C4C19844E898C7CC23FB4"><enum>(1)</enum><header>In general</header><text>The Secretary, pursuant to the authority provided in section 172, shall, directly or through grants, contracts, or cooperative agreement with appropriate entities, conduct an evaluation of the activities carried out under any grants awarded under this subtitle.</text></paragraph> 
<paragraph id="HEEC9F5460DE34D2B96082FFD07CCC182"><enum>(2)</enum><header>Report</header><text>The Secretary shall report to Congress relating to the results of the evaluations required under paragraph (1), which shall include any recommendations the Secretary deems appropriate with respect to the use of worker recovery account as a mechanism to assist individuals in obtaining and retaining employment.</text></paragraph></subsection></section> 
<section id="HE8D6299A8A834846AD63631B17246DF7"><enum>196D.</enum><header>Authorization of appropriations</header> 
<subsection id="HF8FC3D1942D641449336E780A4D3A81B"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated to carry out this subtitle $650,000,000 for fiscal year 2006.</text></subsection> 
<subsection id="H3A975C88354A476F8BB780435E1C4E9B"><enum>(b)</enum><header>Availability of funds</header><text display-inline="yes-display-inline"> Funds authorized under this subtitle shall be available for obligation upon the date of enactment of the appropriation and shall remain available for obligation until September 30, 2006 and for expenditure until September 30, 2007.</text></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></section>
