<subtitle id="H6690B252198A4A1A84126C2D722800F3"><enum>A</enum><header>Elementary and secondary educational programs</header> 
<section id="H14B11AAF00534B51A0458C680076B74"><enum>101.</enum><header>Charter schools</header><text display-inline="no-display-inline">The Secretary of Education shall encourage States—</text> 
<paragraph id="HEE6FF8438AFF4FA3852E00A96A1ED54"><enum>(1)</enum><text>to include charter schools in Gulf hurricane disaster relief efforts;</text></paragraph> 
<paragraph id="HE601AF34442247DFB41841D5D5005DCF"><enum>(2)</enum><text>to provide support to charter schools that are serving individuals adversely affected by a Gulf hurricane disaster; and</text></paragraph> 
<paragraph id="HBBD55CD8CE8747C1B76B5F108D1E6D6B"><enum>(3)</enum><text>to facilitate the enrollment of students displaced by a Gulf hurricane disaster in charter schools, including by—</text> 
<subparagraph id="H8996021984C5474C85CCE36543BC5DC"><enum>(A)</enum><text>waiving any requirement relating to whether a student has resided in the geographic area of the charter school;</text></subparagraph> 
<subparagraph id="H02C3902C729F4E38B135B19291A66DD1"><enum>(B)</enum><text>increasing the number of students who may attend a charter school; and</text></subparagraph> 
<subparagraph id="H4F209E9A069A4036BFEFE6B835366FEF"><enum>(C)</enum><text>removing any other relevant restrictions.</text></subparagraph> </paragraph></section></subtitle> 
<subtitle id="H72B79548411A48FE8445DC7671A100"><enum>B</enum><header>Teacher flexibility</header> 
<section id="H502913B8D4104EFE836DA1980557A55E" section-type="subsequent-section" display-inline="no-display-inline"><enum>111.</enum><header>Treatment of highly qualified teachers</header><text display-inline="no-display-inline">For purposes of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301 et. seq.), and the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>), an individual who was employed as a teacher on August 29, 2005, by a local educational agency in a State, and who was highly qualified for such employment on such date, may be considered by another State, during the 2005-2006 school year, to be highly qualified in the same core academic subjects for purposes of subsequent employment as a teacher by a local educational agency in such other State, if—</text> 
<paragraph id="H857E7916480A49699E20DB18B5FEE608"><enum>(1)</enum><text>the local educational agency employing the teacher on August 29, 2005, serves an area affected by a Gulf hurricane disaster; and</text></paragraph> 
<paragraph id="HB6B402DD4C2B496EAE21DEA5DA6244A4"><enum>(2)</enum><text>the local educational agency subsequently employing the teacher hired the teacher due to needs created by the enrollment of displaced students.</text></paragraph></section></subtitle> 
<subtitle id="H6933D322466144F8BF049CC115FE08AE"><enum>C</enum><header>Educational programs for children with disabilities</header> 
<section id="HAD89C92495004731A5C136A4EC48A280" section-type="subsequent-section"><enum>121.</enum><header>Agreements to extend certain deadlines of the Individuals with Disabilities Education Act to facilitate the provision of educational services to children with disabilities</header> 
<subsection id="HDE3F006E2FE14690AF283C56E379F713"><enum>(a)</enum><header>Authority</header><text>The Secretary of Education may enter into an agreement described in subsection (b) with an eligible entity to extend certain deadlines under the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>) related to providing special education and related services, including early intervention services, to individuals adversely affected by a Gulf hurricane disaster.</text></subsection> 
<subsection id="H84C69667F3CE4DDA8E4EE3E18C09FF60"><enum>(b)</enum><header>Terms of agreements</header><text>An agreement referred to in subsection (a) is an agreement with an eligible entity made in accordance with subsection (e) that may extend the applicable deadlines under one or more of the following sections:</text> 
<paragraph id="H14799C374283421D8BE7666F5D158B08"><enum>(1)</enum><text>Section 611(e)(3)(C)(ii) of such Act, by extending up to an additional 60 days the 90 day deadline for developing a State plan for the high cost fund.</text></paragraph> 
<paragraph id="H9423B75F4FCA46B988FB49EAE9A3C946"><enum>(2)</enum><text display-inline="yes-display-inline">Section 612(a)(15)(C) of such Act, by extending up to an additional 60 days the deadline for submission of the annual report to the Secretary of Education and the public regarding the progress of the State and of children with disabilities in the State.</text></paragraph> 
<paragraph id="HA671E20B2AD849E3967B1D78A012A628"><enum>(3)</enum><text display-inline="yes-display-inline">Section 612(a)(16)(D) of such Act, by extending up to an additional 60 days the deadline for making available reports regarding the participation in assessments and the performance on such assessments of children with disabilities.</text></paragraph> 
<paragraph id="H1CE26A46FF884DED84D67DF701BA3E39"><enum>(4)</enum><text display-inline="yes-display-inline">Section 614(a)(1)(C)(i)(I) of such Act, by extending up to an additional 30 days the 60 day deadline for the initial evaluation to determine whether a child is a child with a disability for purposes of the provision of special education and related services to such child.</text></paragraph> 
<paragraph id="H435FB310844F4D03B96CDC9938E40041"><enum>(5)</enum><text display-inline="yes-display-inline">Section 616(b)(1)(A) of such Act, by extending up to an additional 60 days the deadline for finalization of the State performance plan.</text></paragraph> 
<paragraph id="H2400B9BE4F6C4B75967FA269E0DE66C9"><enum>(6)</enum><text display-inline="yes-display-inline">Section 641(e)(1)(D) of such Act, by extending up to an additional 60 days the deadline for submission to the Governor of a State and the Secretary of Education of the report on the status of early intervention programs for infants and toddlers with disabilities and their families operated within the State.</text></paragraph> </subsection> 
<subsection id="HC45A8091CEEC4643A541EBD5D8AB31A"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed—</text> 
<paragraph id="H90BAC910ECB149199C2688F46543A7E8"><enum>(1)</enum><text>as permitting the waiver of—</text> 
<subparagraph id="HB68326DDCD7944659FDBBF00E7DCB5E9"><enum>(A)</enum><text>any applicable Federal civil rights law;</text></subparagraph> 
<subparagraph id="H491E46E86136459CA377EDD583B94721"><enum>(B)</enum><text>any student or family privacy protections, including provisions requiring parental consent for evaluations and services;</text></subparagraph> 
<subparagraph id="HC8B27C7E56E24C5A8EB95F23DB8D6C90"><enum>(C)</enum><text>any procedural safeguards required under section 615 or section 639 of the Individuals with Disabilities Education Act; or</text></subparagraph> 
<subparagraph id="H1118005056EE485DA182C6BEDFCB081B"><enum>(D)</enum><text>any requirements not specified in subsection (b)(1) of this section; or</text></subparagraph></paragraph> 
<paragraph id="HFB8353D079534AC488A163C9BD7B58A9"><enum>(2)</enum><text>as removing the obligation of the eligible entity to provide a child with a disability or an infant or toddler with a disability and their families—</text> 
<subparagraph id="H7385FA3897DA4D0A9D414591F321B22F"><enum>(A)</enum><text>a free appropriate public education under part B of the Individuals with Disabilities Education Act; or</text></subparagraph> 
<subparagraph id="H751CDF4F63DF4012837E01D78D7289C"><enum>(B)</enum><text>early intervention services under part C of such Act.</text></subparagraph></paragraph></subsection> 
<subsection id="H88F24AF8D6EA4859B0CA1FC9008F71FD"><enum>(d)</enum><header>Duration of agreement</header><text>An agreement under this section shall terminate at the conclusion of the 2005–2006 academic year.</text></subsection> 
<subsection id="HFBC5921426E948EAB220903207B6668"><enum>(e)</enum><header>Request to enter into agreement</header><text>To enter into an agreement under this section, an eligible entity shall submit a request to the Secretary of Education at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> </section> 
<section id="H549DEE2C8AC94A1FAC155B779E5DAC02" display-inline="no-display-inline" section-type="subsequent-section"><enum>122.</enum><header>Paperwork reduction pilot program participation for affected States</header> 
<subsection id="HBF211181D55B4960B183526290DB82F1"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">To identify ways to reduce paperwork burdens and other administrative duties that are directly associated with the requirements of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>) in order to increase the time and resources available for instruction and other activities aimed at improving educational and functional results for children with disabilities, the Secretary of Education is authorized to permit an affected State to participate in the paperwork reduction pilot program described in section 609(a) of such Act.</text></subsection> 
<subsection id="H7BAA0425F8F24ADB9DB5DA4E2905023D"><enum>(b)</enum><header>Participation by affected States</header><text>Participation in the paperwork reduction pilot program by an affected State shall be in addition to the maximum number of States that may so participate in accordance with section 609(a)(2)(A) of such Act.</text></subsection> 
<subsection id="HECFF7CB818D64D38A0496B3FCAD46694"><enum>(c)</enum><header>Proposal</header> 
<paragraph id="H3A0B5EDD71FC4E9DB8CC42F6A7DB1E0"><enum>(1)</enum><header>In general</header><text>An affected State desiring to participate in the paperwork reduction pilot program described in section 609(a) of such Act shall submit a proposal to the Secretary in accordance with section 609(a)(3) of such Act, subject to paragraph (2) of this subsection.</text></paragraph> 
<paragraph id="H9107E70BF3DB4CE1AFA0542FD9AAB344"><enum>(2)</enum><header>Simplification</header><text display-inline="yes-display-inline">The Secretary may simplify the proposal process for an affected State to participate in the program if the Secretary determines that such simplification is appropriate.</text></paragraph></subsection> 
<subsection id="H8F07A4AD93CF49DE89D6910607E0219"><enum>(d)</enum><header>Rule of construction</header><text>The requirements and authorities described in section 609(a) of such Act that are not modified by this section with respect to an affected State shall apply to such State.</text></subsection> </section></subtitle> 
<subtitle id="HB58E331026E6469AA6E788D6665A040"><enum>D</enum><header>Higher education relief</header> 
<section id="H6B08A2434CD94A44A8D80972513F29F6" commented="no" section-type="subsequent-section" display-inline="no-display-inline"><enum>131.</enum><header>Waivers and modifications</header><text display-inline="no-display-inline">Notwithstanding any other provision of law unless enacted with specific reference to this section, the Secretary of Education is authorized to waive or modify any statutory or regulatory provision applicable to the student financial assistance programs under title IV of the Higher Education Act of 1965, or any student or institutional eligibility provisions in such Act, as the Secretary of Education deems necessary to ensure that the calculation of expected family contribution (under section 474 of such Act) used in the determination of need for student financial assistance under such title for any affected student (and the determination of such need for his or her family, if applicable), is modified to reflect any changes in the financial condition of such affected student and his or her family resulting from a Gulf hurricane disaster.</text></section> 
<section id="HB4D3FFB13CA84798A1C183AB299ED2A8" commented="no"><enum>132.</enum><header>Transfer of credit</header> 
<subsection id="H361533918D2641B381424EDCB35058D6" commented="no"><enum>(a)</enum><header>Policy disclosure</header><text display-inline="yes-display-inline">For periods of enrollment beginning in calendar year 2006, each institution of higher education shall establish and publicize policies of the institution regarding the acceptance or denial of academic credit earned at another institution of higher education, which shall include a statement that such decisions will not be based solely on the source of accreditation of a sending institution, provided that the sending institution is accredited by an agency or association that is recognized by the Secretary of Education pursuant to section 496 of the Higher Education Act of 1965 to be a reliable authority as to the quality of the education or training offered.</text></subsection> 
<subsection id="HEABF47090B44479FBF806696064416BD" commented="no"><enum>(b)</enum><header>Rule of Construction</header><text>Nothing in this section shall be construed to—</text> 
<paragraph id="H59D0C2DCC60148B500B7ACC40E61E58" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">authorize an officer or employee of the Department of Education to exercise any direction, supervision, or control over the curriculum, program of instruction, administration, or personnel of any institution of higher education, or over any accrediting agency or association;</text></paragraph> 
<paragraph id="HB25138C1B24F4FAC967376FA146FE4B2" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">limit the application of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1221">20 U.S.C. 1221 et seq.</external-xref>); or</text></paragraph> 
<paragraph id="H6F65ABA1FC42461B93650279964680B9" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">create any legally enforceable right. </text></paragraph></subsection></section> 
<section id="HB93182A280674F6FA186454BA3109977"><enum>133.</enum><header>Expanding information dissemination regarding eligibility for Pell Grants</header> 
<subsection id="H8B54ED6B9A6449939E36462C897B7798"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Education shall—</text> 
<paragraph id="H8101A8BF44ED4B3EA18E4BE029B7A8C"><enum>(1)</enum><text>make special efforts, in conjunction with State efforts, to notify affected students and, if applicable, their parents, who qualify for a means-tested Federal benefit program, of their potential eligibility for a maximum Pell Grant; and</text></paragraph> 
<paragraph id="H9F355DF2952B4629944F7666A2EF5B64"><enum>(2)</enum><text>disseminate informational materials regarding such eligibility as the Secretary of Education deems appropriate.</text></paragraph></subsection> 
<subsection id="HD5CEC67948FC4CB1807E713C613B86FF"><enum>(b)</enum><header>Means-Tested Federal Benefit Program</header><text display-inline="yes-display-inline">For the purpose of this section, the term <quote>means-tested Federal benefit program</quote>—</text> 
<paragraph id="H6425FEA400EA493598FF94B7C7C58CC3"><enum>(1)</enum><text>means a mandatory spending program of the Federal Government, other than a program under the Higher Education Act of 1965, in which eligibility for the program’s benefits, or the amount of such benefits, or both, are determined on the basis of income or resources of the individual or family seeking the benefit; and</text></paragraph> 
<paragraph id="H41FD7C5FF80D40BDB06C2EB45B705BC5"><enum>(2)</enum><text>may include—</text> 
<subparagraph id="H94082241F5F742DD90107BD1FBCA6915"><enum>(A)</enum><text>the supplemental security income program under title XVI of the Social Security Act;</text></subparagraph> 
<subparagraph id="H498D210A8AB84B24B77EE69D96CFABD"><enum>(B)</enum><text>the food stamp program under the Food Stamp Act of 1977;</text></subparagraph> 
<subparagraph id="H571CCACF6C5F410CB6FBB1962EB5F738"><enum>(C)</enum><text>the free and reduced price school lunch program established under the Richard B. Russell National School Lunch Act;</text></subparagraph> 
<subparagraph id="H729009D03DAC4D89A8093D05DA4CC695"><enum>(D)</enum><text>the temporary assistance to needy families program established under part A of title IV of the Social Security Act;</text></subparagraph> 
<subparagraph id="H26503C80705548B792C92C22709D14F5"><enum>(E)</enum><text>the women, infants, and children program established under section 17 of the Child Nutrition Act of 1966; and</text></subparagraph> 
<subparagraph id="H69090D10097549428828F371CD25F037"><enum>(F)</enum><text>other programs identified by the Secretary of Education.</text></subparagraph></paragraph></subsection></section> 
<section id="HD92CB3BBEAA4455E9316D495C5444F29"><enum>134.</enum><header>Procedures; termination of authority</header> 
<subsection id="HDD1C2ACFCA9A43579D2D022E8E674968"><enum>(a)</enum><header>Deadlines and procedures</header><text>Sections 482(c) and 492 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1089">20 U.S.C. 1089(c)</external-xref>, 1098(a)) shall not apply to any waivers, modifications, or actions initiated by the Secretary of Education under this subtitle.</text></subsection> 
<subsection id="H3FEC66C0EBBF4BC7A2F2C494DD5E362F" commented="no"><enum>(b)</enum><header>Case-by-Case basis</header><text>The Secretary of Education is not required to exercise any waiver or modification authority under this subtitle on a case-by-case basis.</text></subsection> 
<subsection id="H27C64F36238D42ABA9D675F7675998C"><enum>(c)</enum><header>Termination of authority</header><text>The authority of the Secretary of Education to issue waivers or modifications under this subtitle shall expire at the conclusion of the 2005-2006 academic year, but the expiration of such authority shall not affect the continuing validity of any such waivers or modifications after such academic year.</text></subsection></section></subtitle> 
<subtitle id="HD9C86746F4F148D3901C95E797AD6FC4"><enum>E</enum><header>Regulatory relief</header> 
<section id="HD420D763A2084DBDA4B7B945A162538E"><enum>151.</enum><header>Regulatory and financial relief</header> 
<subsection id="H740D1C00C00C462ABCEBF3DE46721BB1"><enum>(a)</enum><header>Waiver authority</header><text>Subject to subsections (b) and (c), in providing any grant or other assistance, directly or indirectly, to an entity in an affected State, the Secretary of Education may, as applicable, waive or modify in order to ease fiscal burdens any requirement relating to the following:</text> 
<paragraph id="H78AFF72B80DF4E84BA0622AAF8ECEB38"><enum>(1)</enum><text display-inline="yes-display-inline"> Maintenance of effort.</text></paragraph> 
<paragraph id="H5B286E83ACD54A2F8EB17E8DFD81C94B"><enum>(2)</enum><text>The use of Federal funds to supplement, not supplant, non-Federal funds.</text> </paragraph> 
<paragraph id="H54559A2865A14896A71E077FBB55A559"><enum>(3)</enum><text>Any non-Federal share or capital contribution required to match Federal funds provided under programs administered by the Secretary of Education.</text></paragraph></subsection> 
<subsection id="H74CEDF5665D14BF48DDC3484CF1B248" commented="no"><enum>(b)</enum><header>Duration</header><text>A waiver under this section shall be for the 2006 fiscal year.</text></subsection> 
<subsection id="H247A9CC84A9C476EBD438E396EC4DDC8"><enum>(c)</enum><header>Limitations</header> 
<paragraph id="H322E5A05A41C4BC0817BCF82D18FE173"><enum>(1)</enum><header>Relation to IDEA</header><text>This section does not authorize the waiver or modification of any provision of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HBE650AC5F23B4922A42B40E0057E515" commented="no"><enum>(2)</enum><header>Maintenance of effort</header><text display-inline="yes-display-inline">If the Secretary grants a waiver or modification under this section waiving a requirement relating to maintenance of effort for a fiscal year, the level of effort required for the following fiscal year shall not be reduced because of the waiver.</text></paragraph></subsection> </section></subtitle></title> 
<title id="HF06C6F49C9C446CFB5EF2C06FF89FA29"><enum>II</enum><header>Health and human services</header> 
<subtitle id="H29143EB7CF6D44E6B519003E6F4BC06"><enum>A</enum><header>Community services</header> 
<section id="H54DC87DA70E04894A8344D38AEC04985" section-type="subsequent-section"><enum>201.</enum><header>Secretary authority</header> <text display-inline="no-display-inline">The Secretary of Health and Human Services may waive with respect to any affected State for up to 90 days after the enactment of this Act the filing deadline under section 676(b) of the Community Services Block Grant Act.</text></section> 
<section id="HBE47F3D541304067B21B13396509345C"><enum>202.</enum><header>State authority</header> 
<subsection id="H0BF12ABDE9F2419D939D75239B3FADD9"><enum>(a)</enum><header>Transfer of Funding</header><text>A State that receives a payment or allotment under section 675A or 675B of the Community Services Block Grant Act may transfer a portion of the payment or allotment available for expenditure under section 675C(b) (including sums available for administrative expenses under paragraph (2) of such section 675C(b)) to an affected State.</text></subsection> 
<subsection id="HA1157C1902D54DEB95DB04F31B934205"><enum>(b)</enum><header>Staff</header><text>A State lead agency designated under section 676(a)(1) of the Community Services Block Grant Act or an eligible entity (as defined in section 673 of such Act) may send an employee of the State lead agency, or of an eligible entity, to an area affected by a Gulf hurricane disaster to help in providing disaster assistance.</text></subsection> 
<subsection id="H8B366ACF72A14267A95F89AA30B14040"><enum>(c)</enum><header>Eligible Entity</header><text display-inline="yes-display-inline">A State lead agency in an affected State may temporarily fund an eligible entity in a contiguous area, or if such entity is not available to provide such services, may temporarily fund alternative service providers (notwithstanding the definition of an eligible entity as defined in section 673 of the Community Services Block Grant Act) when the currently funded eligible entity is no longer able to provide services due to a Gulf hurricane disaster in order to meet the immediate needs of individuals adversely affected by a Gulf hurricane disaster (provided that in the meantime the State is assisting such current eligible entity in becoming operational).</text></subsection> 
<subsection id="HCD01B8916EA24B9C863D75D500869DAD"><enum>(d)</enum><header>Recapture and Redistribution of Unobligated Funds</header><text>Notwithstanding any other provision of law, an affected State may apply the recapture and redistribution of unobligated funds provisions under section 675C(a)(3) of the Community Services Block Grant Act provided that the State consults with the eligible entity involved.</text></subsection></section></subtitle> 
<subtitle id="HD4038E1D8ED64C4B829DBB57A8005BFF"><enum>B</enum><header>Head Start</header> 
<section id="H0288772480DF4E3581FAD4AEE65F44DB" display-inline="no-display-inline" section-type="subsequent-section"><enum>211.</enum><header>Head start and early head start children affected by a Gulf hurricane disaster</header> 
<subsection id="H7AEACCF1EB674BF2913411E69BAA3010"><enum>(a)</enum><header>Technical assistance, guidance, and resources</header><text>The Secretary of Health and Human Services shall provide technical assistance, guidance, and resources through the Region 4 and Region 6 offices of the Administration for Children and Families (and may provide technical assistance, guidance, and resources, through other regional offices of the Administration, at the request of such offices, that administer affected Head Start agencies) to Head Start agencies in areas in which a major disaster has been declared, and to affected Head Start agencies, to assist the agencies involved in providing Head Start services and Early Head Start services to children affected by a Gulf hurricane disaster.</text></subsection> 
<subsection id="HBDC8EFFC0ABA4124B6E2EE5666DAE62"><enum>(b)</enum><header>Waiver</header><text>For such period up to June 30, 2006, and to such extent as the Secretary considers appropriate, the Secretary of Health and Human Services—</text> 
<paragraph id="H9F3692223CB84542A2E763FCCFF4AE86"><enum>(1)</enum><text>may waive section 640(b) of the <act-name parsable-cite="HSA">Head Start Act</act-name> for Head Start agencies located in an area affected by a Gulf Hurricane disaster and other affected Head Start agencies; and</text></paragraph> 
<paragraph id="HA3163A4217A344CCBE67035B0137327D"><enum>(2)</enum><text>shall waive requirements of documentation for an individual adversely affected by a Gulf hurricane disaster who participates in a Head Start program or an Early Head Start program funded under the <act-name parsable-cite="HSA">Head Start Act</act-name>.</text></paragraph></subsection></section></subtitle> 
<subtitle id="H6100EDE5CB69424583EAF3BCD75D72D1"><enum>C</enum><header>Child care services</header> 
<section id="H9C5E842159F14DC38F041CCDFB094FEE" display-inline="no-display-inline" section-type="subsequent-section"><enum>221.</enum><header>Waiver authority to expand the availability of services under Child Care and Development Block Grant Act of 1990</header><text display-inline="no-display-inline">For such period up to June 30, 2006, and to such extent as the Secretary considers to be appropriate, the Secretary of Health and Human Service may waive or modify, for any affected State, and any State serving significant numbers of individuals adversely affected by a Gulf hurricane disaster, provisions of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>)—</text> 
<paragraph id="H70864296BCD645D2906560F78848B76F"><enum>(1)</enum><text>relating to Federal income limitations on eligibility to receive child care services for which assistance is provided under such Act,</text></paragraph> 
<paragraph id="H5AAC8476973C42B0AB2BFB623C1656E"><enum>(2)</enum><text display-inline="yes-display-inline">relating to work requirements applicable to eligibility to receive child care services for which assistance is provided under such Act,</text></paragraph> 
<paragraph id="H298885A97B9A4DF4BC008641813965BE"><enum>(3)</enum><text display-inline="yes-display-inline">relating to limitations on the use of funds under section 658G of the Child Care and Development Block Grant Act of 1990,</text></paragraph> 
<paragraph id="H63EBC0B04B574E3500FA89F74F722800"><enum>(4)</enum><text display-inline="yes-display-inline">preventing children designated as evacuees from receiving priority for child care services provided under such Act, except that children residing in a State and currently receiving services should not lose such services in order to accommodate evacuee children, and</text></paragraph> 
<paragraph id="HCAB63CD1A7A44C21A0FF22EB9026312F"><enum>(5)</enum><text display-inline="yes-display-inline">relating to any non-Federal or capital contribution required to match Federal funds provided under programs administered by the Secretary of Health and Human Services,</text></paragraph><continuation-text continuation-text-level="subsection">for purposes of easing State fiscal burdens and providing child care services to children orphaned, or of families displaced, as a result of a Gulf hurricane disaster.</continuation-text></section></subtitle></title> 
<title id="H93EAEF37D2EE4EEF80DCD48F3E60E881"><enum>III</enum><header>Labor</header> 
<subtitle id="H0F06CE6147F94715AFEC86E49F96FDCC"><enum>A</enum><header>Pension Flexibility for Displaced Workers Act of 2005</header> 
<section id="HBF4F9420E11049288D16C8B758909574"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This subtitle may be cited as the <quote><short-title>Pension Flexibility for Displaced Workers Act of 2005</short-title></quote>. </text></section> 
<section id="HA5242AD9E61044CFA8001E29EC15E01E" section-type="subsequent-section" display-inline="no-display-inline"><enum>302.</enum><header>Authority to prescribe guidance by reason of the Presidentially declared disasters caused by Hurricane Katrina and Hurricane Rita</header> 
<subsection id="HCA2DA26F054E44A7967C5CF8F2CB1B88"><enum>(a)</enum><header>Waivers, suspensions, or exemptions</header><text display-inline="yes-display-inline">In the case of any pension plan which is an individual account plan, or any participant or beneficiary, plan sponsor, administrator, fiduciary, service provider, or other person with respect to such plan, affected by Hurricane Katrina or Hurricane Rita, or any service provider or other person dealing with such plan, the Secretary of Labor may, notwithstanding any provision of title I of the Employee Retirement Income Security Act of 1974, prescribe, by notice or otherwise, a waiver, suspension, or exemption from any provision of such title which is under the regulatory authority of such Secretary, or from regulations issued under any such provision, that such Secretary determines appropriate to facilitate the distribution or loan of assets from such plan to participants and beneficiaries of such plan. At the time of the issuance of such waiver, suspension, or exemption, such Secretary shall publish in the Federal Register the terms of such waiver, suspension, or exemption.</text></subsection> 
<subsection id="HD5C74BB20CFB44C48500B957E67BCFD6"><enum>(b)</enum><header>Exemption from liability for acts or omissions covered by waiver, suspension, or exemption</header><text>No person shall be liable for any violation of title I of the Employee Retirement Income Security Act of 1974, or of any regulations issued under such title, based upon any act or omission covered by a waiver, suspension, or exemption issued under subsection (a) if such act or omission is in compliance with the terms of the waiver, suspension, or exemption.</text></subsection> 
<subsection id="HE437FB067AEC4BC796D37EF65CB0ED6"><enum>(c)</enum><header>Plan terms subject to waiver, suspension, or exemption</header><text>Notwithstanding any provision of the plan to the contrary and to the extent provided in any waiver, suspension, or exemption issued by the Secretary of Labor pursuant to subsection (a), no plan shall be treated as failing to be operated in accordance with its terms solely as a result of acts or omissions which are in compliance with the terms of such waiver, suspension, or exemption.</text></subsection> 
<subsection id="HD5110DDCD5F64386AC1D3EF69BD937AB"><enum>(d)</enum><header>Expiration of authority</header><text>This section shall apply only with respect to waivers, suspensions, or exemptions issued by the Secretary of Labor during the 1-year period following the date of the enactment of this Act.</text></subsection> 
<subsection id="HEF0B413158E64E6AA1273746A22EC406"><enum>(e)</enum><header>Definitions</header><text>Terms used in this section shall have the meanings provided such terms in section 3 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002</external-xref>).</text></subsection></section> 
<section id="H22F26B5FD2F941E8BC9950D7004EEEC3"><enum>303.</enum><header>Authority in the event of Presidentially declared disaster or terroristic or military actions</header><text display-inline="no-display-inline">Section 518 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1148">29 U.S.C. 1148</external-xref>) is amended by inserting <quote>, under any regulation issued thereunder, or under any plan provision</quote> after <quote>under this Act</quote>. </text></section></subtitle> 
<subtitle id="H57CFDA0A70DE4417A900A38C8200BF2C"><enum>B</enum><header>Occupational safety and health</header> 
<section id="H3440EE44C5B34162A195ECAABE48E03F" section-type="subsequent-section"><enum>311.</enum><header>Authorization for volunteers</header> 
<subsection id="H72B1E438C0164788A63D23B9003515AA"><enum>(a)</enum><header>Authority to recruit, train, and utilize</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Labor (hereafter <quote>the Secretary</quote>) may recruit, train, accept, and utilize, without regard to the civil service classification laws, rules, or regulations, the services of volunteer individuals to aid in or facilitate the activities administered by the Secretary through the Occupational Safety and Health Administration for projects related to worker safety and health in response to the effects of Hurricane Katrina and Hurricane Rita.</text></subsection> 
<subsection id="H62FF4159FA0B44AF9672D395B3BDDFCD"><enum>(b)</enum><header>Provision of services and costs</header><text display-inline="yes-display-inline">The Secretary may provide for services and costs incidental to the utilization of volunteers under subsection (a), including transportation, supplies, equipment (including personal protective equipment), uniforms, lodging, subsistence (without regard to place of residence), recruiting, training, supervision, and awards and recognition (including nominal cash awards).</text></subsection> 
<subsection id="H476169FA02054667A1E6B0DAE41F2853"><enum>(c)</enum><header>Federal employment status of volunteers</header> 
<paragraph id="H974BC83A82BB4CEEAB7BF2BA84A0FC6C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a volunteer under this section shall not be considered a Federal employee and shall not be subject to the provisions of law relating to Federal employment, including those provisions relating to hours of work, rates of compensation, leave, unemployment compensation, and Federal employee benefits.</text></paragraph> 
<paragraph id="H2886B46643CA43E299AF85D92D8D007C"><enum>(2)</enum><header>Exception</header><text>A volunteer under this section shall be considered a Federal employee for the purposes of—</text> 
<subparagraph id="HD92D9EEDE1CB475DAB4427BE184E6DFF"><enum>(A)</enum><text display-inline="yes-display-inline">required Federal agency safety and health programs under section 19 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/668">29 U.S.C. 668</external-xref>), Executive Order 12196 (45 Fed. Reg. 12769) and part 1960 of title 29, Code of Federal Regulations; and </text></subparagraph> 
<subparagraph id="HFF7D4433793449D589E46DD00FFF859"><enum>(B)</enum><text>the standards of ethical conduct provisions of part 2635 of title 5, Code of Federal Regulations.</text></subparagraph></paragraph></subsection> 
<subsection id="H3874F9DA303E48FA9F8DFF39B746D445" commented="no"><enum>(d)</enum><header>Limitation</header><text>No volunteer authorized under this section may aid in or facilitate any inspection or investigation relating to, or the enforcement of, the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>).</text></subsection></section> 
<section id="HEAE2981FD10B41ACA6E94B5D88D8405"><enum>312.</enum><header>Purchase and distribution of equipment</header><text display-inline="no-display-inline">The Secretary is authorized to purchase and distribute equipment and supplies to public or private entities and individuals for projects administered by the Occupational Safety and Health Administration related to worker safety and health in response to the effects of Hurricane Katrina and Hurricane Rita.</text></section> 
<section id="HE93376ECC40042C79B9C52D5DC416437"><enum>313.</enum><header>State assistance and matching fund restrictions</header> 
<subsection id="H0438A20359D44147BD38DBC4AC8642DE"><enum>(a)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, States that administer State plans under section 18 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667</external-xref>), or cooperative agreements under section 21(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/670">29 U.S.C. 670(d)</external-xref>) may use grant funds awarded under section 21 or 23 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/670">29 U.S.C. 670</external-xref>; 672) to provide assistance to the Occupational Safety and Health Administration for projects related to worker safety and health in response to the effects of Hurricane Katrina and Hurricane Rita. </text></subsection> 
<subsection id="H16F83F5A73044AC69814DF00C7921309"><enum>(b)</enum><header>Matching fund requirement</header><text>Notwithstanding the matching share requirements of section 23 of such Act or any other provision of law, the Secretary may increase the size of a grant to any State providing assistance under subsection (a) by an amount of up to 100 percent of the cost of travel and subsistence, overtime, and other administrative expenses incurred by the State in providing such assistance.</text></subsection></section> 
<section id="H3F6DB180A41B43E2B97BE0EE213C7DFF"><enum>314.</enum><header>Expiration</header><text display-inline="no-display-inline">This authorities granted in this title shall terminate on December 31, 2006.</text> </section></subtitle> </title> 
<title id="H3CA030ED33BC45E8BDD700AB6F48B254"><enum>IV</enum><header>General provisions</header> 
<section id="HF0EC1F53DA3247A881C1242883FF6800" section-type="subsequent-section"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, except as otherwise specifically provided in this Act, the following terms have the following meanings:</text> 
<paragraph id="H22B05901D059472F9544B0A44C382579"><enum>(1)</enum><header>Affected head start agencies</header><text>The term <quote>affected Head Start Agencies</quote> means a Head Start agency receiving a significant number of children from an area in which a Gulf hurricane disaster has been declared.</text></paragraph> 
<paragraph id="HA72EEAE3B1AB4CCAA358258D6C3D7DD3"><enum>(2)</enum><header>Affected State</header><text>The term <quote>affected State</quote> means the State of Alabama, Florida, Louisiana, Mississippi, or Texas.</text></paragraph> 
<paragraph id="HE66A9330A92C4D95A2F8F9A17EC39820"><enum>(3)</enum><header>Affected student</header><text>The term <quote>affected student</quote> means an individual who has applied for or received student financial assistance under title IV of the Higher Education Act of 1965, and who—</text> 
<subparagraph id="HA6BEBBE677A34F50B41DEDFDA2BC7E4"><enum>(A)</enum><text>was enrolled or accepted for enrollment, as of August 29, 2005, at an institution of higher education in an area affected by a Gulf hurricane disaster;</text></subparagraph> 
<subparagraph id="HFEA977858AF94992821D30C4067D6002"><enum>(B)</enum><text>was a dependent student enrolled or accepted for enrollment at an institution of higher education that is not in an area affected by a Gulf hurricane disaster, but whose parents resided or were employed, as of August 29, 2005, in an area affected by a Gulf hurricane disaster; or</text></subparagraph> 
<subparagraph id="HBF361D2A5EE74CFA8BC64046ECDA3071"><enum>(C)</enum><text display-inline="yes-display-inline">was enrolled or accepted for enrollment at an institution of higher education, as of August 29, 2005, and whose attendance was interrupted because of a Gulf hurricane disaster.</text></subparagraph></paragraph> 
<paragraph id="HD2F4642B048E4194A5F5C900C488673"><enum>(4)</enum><header>Area affected by a Gulf hurricane disaster</header><text>The term <quote>area affected by a Gulf hurricane disaster</quote> means a county or parish, in an affected State, that has been designated by the Federal Emergency Management Agency for disaster assistance for individuals and households as a result of Hurricane Katrina or Hurricane Rita.</text></paragraph> 
<paragraph id="H3EE7DEDF144D42078C128956ABCD7021"><enum>(5)</enum><header>Charter school</header><text>The term <quote>charter school</quote> has the meaning given to that term in section 5210 of the Elementary and Secondary Education Act of 1965.</text></paragraph> 
<paragraph id="HCCCB1C5A231744B88BFA00ECA5573C3C"><enum>(6)</enum><header>Child with a disability</header><text>The term <quote>child with a disability</quote> has the meaning given such term in section 602(3) of the Individuals with Disabilities Education Act.</text></paragraph> 
<paragraph id="H263FA0A318294D83AABD8BA853C9BA80"><enum>(7)</enum><header>Displaced student</header><text>The term <quote>displaced student</quote> means an individual who—</text> 
<subparagraph id="H4567AC98B71943FEAD471D5691F6B268"><enum>(A)</enum><text>but for a Gulf hurricane disaster, would be enrolled during a school year in an elementary or secondary school in an affected State;</text></subparagraph> 
<subparagraph id="HB8C2D0FF0B9F4A978EA0BEC99113AE32"><enum>(B)</enum><text>is unable, due to such disaster, to access the education and pupil services that the child otherwise would be receiving at such school; and</text></subparagraph> 
<subparagraph id="H58BE338599044E709DAA6E83DC13ACDA"><enum>(C)</enum><text>due to such disaster, is enrolled at a public elementary or secondary school in a different geographic location in a State.</text></subparagraph></paragraph> 
<paragraph id="H4170B145839448CE82F83128D1304E86"><enum>(8)</enum><header>Elementary school</header><text>The term <quote>elementary school</quote> has the meaning given such term in section 9101 of the Elementary and Secondary Education Act of 1965.</text></paragraph> 
<paragraph id="HD3DA5123BAC04942952BB0D8061CD58B"><enum>(9)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text> 
<subparagraph id="HAF12FBB1D9734BCF8B9BBE4D3EC8A829"><enum>(A)</enum><text>a local educational agency (as defined in section 602(19) of the Individuals with Disabilities Education Act) if such agency is located in a State or in an area of a State with respect to which the President has declared that a Gulf hurricane disaster exists;</text></subparagraph> 
<subparagraph id="HC742D0C48A7C4A5D83A26F1288C8352E"><enum>(B)</enum><text>a State educational agency (as defined in section 602(32) of such Act) if such agency is located in a State with respect to which the President has declared that a Gulf hurricane disaster exists; or</text></subparagraph> 
<subparagraph id="H7C1B0472D3FC4D78A6D1F76669BCEE9"><enum>(C)</enum><text>a State interagency coordinating council established under section 641 of such Act if such council is located in a State with respect to which the President has declared that a Gulf hurricane disaster exists.</text></subparagraph> </paragraph> 
<paragraph id="H800990F3FB1B45DC8D9FB15793FF4627"><enum>(10)</enum><header>Gulf hurricane disaster</header><text>The term <quote>Gulf hurricane disaster</quote> means a major disaster that the President declared to exist, in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, and that was caused by Hurricane Katrina or Hurricane Rita.</text></paragraph> 
<paragraph id="H9FA0F47716464E66ADA877006615E831"><enum>(11)</enum><header>Highly qualified</header><text>The term <quote>highly qualified</quote>—</text> 
<subparagraph id="H1212850BC2D9456584486DC46393AC74"><enum>(A)</enum><text>in the case of a special education teacher, has the meaning given such term in section 602 of the Individuals with Disabilities Education Act; and</text></subparagraph> 
<subparagraph id="H8A6DB4ADDF494F64A39CF4C141262044"><enum>(B)</enum><text>in the case of any other elementary, middle, or secondary school teacher, has the meaning given such term in section 9101 of the Elementary and Secondary Education Act of 1965.</text></subparagraph></paragraph> 
<paragraph id="HBD971CAA5B5B4F999052B17F94104DB1"><enum>(12)</enum><header>Individual adversely affected by a Gulf hurricane disaster</header><text>The term <quote>individual adversely affected by a Gulf hurricane disaster</quote> means an individual who, on August 29, 2005, was living, working, or attending school in an area in which the President has declared to exist a Gulf hurricane disaster.</text></paragraph> 
<paragraph id="HC255FFF3821F41AB8F1F1D7F66337D05"><enum>(13)</enum><header>Infant or toddler with a disability</header><text>The term <quote>infant or toddler with a disability</quote> has the meaning given such term in section 632(5) of the Individuals with Disabilities Education Act.</text></paragraph> 
<paragraph id="HCBCA783F7B0A482689B5461F81C37239"><enum>(14)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 102 of the Higher Education Act of 1965, except that the term does not include institutions under subsection (a)(1)(C) of that section.</text></paragraph>

<subsection id="H50CBA5B8D3A74994AE583C671B97332E" commented="no"><enum>(a)</enum><header>Publication</header> 
<paragraph id="H46D01F3CF3064DCE9D00005405B1A116" commented="no"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 437 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232">20 U.S.C. 1232</external-xref>) and <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, the Secretary of Education shall make publicly available the waivers or modifications of statutory and regulatory provisions and other actions the Secretary of Education issues pursuant to this title.</text></paragraph> 
<paragraph id="HFEE1EE9ED7A1494EAC95B681D530C485" commented="no"><enum>(2)</enum><header>Terms and conditions</header><text>The notice under <internal-xref idref="H46D01F3CF3064DCE9D00005405B1A116" legis-path="9.(a)(1)">paragraph (1)</internal-xref> shall include the terms and conditions to be applied in lieu of such statutory and regulatory provisions.</text></paragraph></subsection> </section> 
<section id="HD339393F4CEE44B5B406F7279CE73484"><enum>403.</enum><header>Reporting requirements</header> 
<subsection id="H61886B98DC1B40C6B2233F8C61EF1D00"><enum>(a)</enum><header>Contents of report</header><text>Not later than September 30, 2006, each State that exercises any authority provided in this Act shall submit to the Secretary of jurisdiction a report containing such information as the Secretary may require, including information identifying—</text> 
<paragraph id="H3CA6561404214036BE2421E2FAB09669"><enum>(1)</enum><text>how flexibility provided under this Act is used to provide assistance to individuals adversely affected by a Gulf hurricane disaster, including the number of such individuals assisted;</text></paragraph> 
<paragraph id="HCC01C110492D4C57A75BC7E700326DDC"><enum>(2)</enum><text>how such individuals were assisted;</text></paragraph> 
<paragraph id="HFE038F9E1FD64AF7AF19C88E818B3F51"><enum>(3)</enum><text>if any staff was sent to an area adversely affected by a Gulf hurricane disaster under title II, subtitle A;</text></paragraph> 
<paragraph id="H49988F4538534F969FCDF810BF79B9F"><enum>(4)</enum><text>specifying how an affected State exercised its waiver authority under this Act to assist individuals adversely affected by a Gulf hurricane disaster, including waivers received under section 331;</text></paragraph> 
<paragraph id="H95D45AB2B113460D95A35FA81159E300"><enum>(5)</enum><text>the amount of funding transferred among programs specified in section 331;</text></paragraph> 
<paragraph id="HC4576CCCC30C470495B4A26E8BD1D1CA"><enum>(6)</enum><text>the amount of funding, if any, transferred to an affected State under subtitle A of title II and how such funds were distributed;</text></paragraph> 
<paragraph id="H7A8827BDE2204563A63BED42438D99C3"><enum>(7)</enum><text>how additional alternative service providers were chosen by such State to provide immediate assistance under subtitle A of title II; and</text></paragraph> 
<paragraph id="H47897DFEF46F4FDE850887396D50C599"><enum>(8)</enum><text>the number and location of teachers considered to be highly qualified for purposes of subsequent employment as a teacher by a local educational agency that hired the teachers due to needs created by the enrollment of displaced students under section 111.</text></paragraph></subsection> 
<subsection id="H5293C361632247FCA1AC33E4E100D0B6"><enum>(b)</enum><header>Report to Congress</header><text>Not later October 30, 2006, the Secretary shall submit to the Committee on Education and the Workforce of the House of Representatives, the Committee on Health, Education, Labor, and Pensions of the Senate, and the respective Committees on Appropriations the report described in subsection (a), and any comments the Secretary may have with respect to such report.</text></subsection></section></title>
