<official-title>To authorize the Forest Service and the Bureau of Land Management to carry out a series of pilot projects to encourage collaborative approaches to, and to provide research on, the rehabilitation of forest ecosystem health following uncharacteristic disturbances of forested Federal lands, to be conducted in a manner that protects wildlife habitat, water quality, and forest resiliency while also promoting social and economic opportunities in nearby communities, and for other purposes.</official-title>

<section id="HD1618BCB144044CCA2431E56D289A4EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Forests Rehabilitation and Recovery Act of 2005</short-title></quote>.</text></section> 
<section id="HF700DC512BD84BE88807A3DA154FDAC6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H35B0C45B37474FE6B1AE62902DA41F15"><enum>(1)</enum><text display-inline="yes-display-inline">In enacting the Healthy Forest Restoration Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/148">Public Law 108–148</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/16/6501">16 U.S.C. 6501 et seq.</external-xref>), Congress clearly recognized the priority of reducing wildfire risks to communities through active hazardous fuels reduction treatment of adjacent forested Federal lands.</text></paragraph> 
<paragraph id="HFD1AC593199B49D29FFD6638D291AEF2"><enum>(2)</enum><text display-inline="yes-display-inline">Because of funding limitations, the Secretary of Agriculture and the Secretary of the Interior have been unable to fully implement the necessary hazardous fuels reductions anticipated by the Healthy Forest Restoration Act of 2003, and many communities in the vicinity of forested Federal lands remain at risk for wildland fire.</text></paragraph> 
<paragraph id="HC2AE0E196FAF4F7FB4F809E3028568CD"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture and the Secretary of the Interior should increase efforts to prioritize and aggressively pursue hazardous fuel reduction in communities at risk in the wildland-urban interface.</text></paragraph> 
<paragraph id="H4596EF99772F4C0E945635230022E187"><enum>(4)</enum><text display-inline="yes-display-inline">Many communities are still at risk from unnatural accumulation of fuels, and, for such at-risk communities, it is important to pro-actively consider scenarios for the rehabilitation of Federal land near these communities, should an uncharacteristic disturbance occur.</text></paragraph> 
<paragraph id="H630ABBA867C847E59DF8A353287E9BE4"><enum>(5)</enum><text>While significant scientific research exists on the short-term and long-term impacts of vegetative removal following a fire, it is essential to test various approaches to post-disturbance management to determine whether and how trees of commercial value can be removed during the post-disturbance period while ensuring the best and fastest recovery to a resilient state that will ensure long-term protection for both forest ecosystems and forest communities.</text></paragraph> 
<paragraph id="H9A932F156A1141B3BF1D5D4486FAC9E"><enum>(6)</enum><text>Community collaboration has shown great promise in resolving controversial issues prior to, and as part of, the process required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>), and the Healthy Forest Restoration Act of 2003 recognized the promise of collaboration by encouraging the development of community wildfire protection plans.</text></paragraph> 
<paragraph id="H526E5C2348564568A6F70085A0712711"><enum>(7)</enum><text display-inline="yes-display-inline">It is important to promote pro-active planning and collaboration to accelerate the approval of restoration projects following wildland fire or other uncharacteristic disturbance events.</text></paragraph></section> 
<section id="H8E7DE6DE598E4982B2A5054C00A86924"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this section:</text> 
<paragraph id="H74B8D97C203447539132DC003C9F17CD"><enum>(1)</enum><header>Collaboration</header><text display-inline="yes-display-inline">The term <quote>collaboration</quote> means an inclusive and open process of bringing together interested persons, including local elected officials, State and Federal agencies, and emergency responders, to develop a consensus on a particular natural resource issue.</text> </paragraph> 
<paragraph id="H2E535AE8003949A583CC91533C70394F" display-inline="no-display-inline"><enum>(2)</enum><header>Community wildfire protection plan</header><text display-inline="yes-display-inline">The term <term>community wildfire protection plan</term> has the meaning given that term in section 101(3) of the Healthy Forest Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511(3)</external-xref>), which is further described by the Western Governors Association in the document entitled <quote>Preparing a Community Wildfire Protection Plan: A Handbook for Wildland-Interface Communities</quote> and dated March 2004.</text></paragraph> 
<paragraph id="H63A5367A561E42878B1EFB8BE967F77"><enum>(3)</enum><header>Federal land</header><text display-inline="yes-display-inline">The term <term>Federal land</term> means—</text> 
<subparagraph id="HFB5CB7533E3548FE0008F029A4088880"><enum>(A)</enum><text>land of the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)) administered by the Secretary of Agriculture, acting through the Chief of the Forest Service; and</text></subparagraph> 
<subparagraph id="H4EAD750322BC48AD80B3E5DF005BD372"><enum>(B)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)), the surface of which is administered by the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></subparagraph></paragraph> 
<paragraph id="H50548ED3E88744CAAEF2EF0400E1F0"><enum>(4)</enum><header>Federal land forest community</header><text display-inline="yes-display-inline">The term <term>Federal land forest community</term> means a town, city, county, Indian tribe, or collaborative group—</text> 
<subparagraph id="HC5D6103D6D174F2C94D539ED62514E81"><enum>(A)</enum><text>located adjacent to (or, in the case of a county, containing) Federal land; and</text></subparagraph> 
<subparagraph id="HCBEA672DCFCD4B3B9EAA764C344CAD4D"><enum>(B)</enum><text>whose residents (or, in the case of an Indian tribe or collaborative group, whose members) have a history of deriving income and employment from recreation, grazing, timber harvesting, or other activities involving Federal land.</text></subparagraph></paragraph> 
<paragraph id="HC1475669F3264277AF8677293D0030F3"><enum>(5)</enum><header>Inventoried roadless area</header><text display-inline="yes-display-inline">The term <quote>Inventoried roadless area</quote> means one of the areas identified in the set of inventoried roadless areas maps contained in the Forest Service Roadless Areas Conservation, Final Environmental Impact Statement, Volume 2, dated November 2000. </text></paragraph> 
<paragraph id="HBE6106ADFB57499C811DD4DBF37ECDE"><enum>(6)</enum><header>Pilot project</header><text display-inline="yes-display-inline">The term <term>pilot project</term> means one of the post-disturbance rehabilitation pilot projects authorized by this Act. </text></paragraph> 
<paragraph id="H59F9F600832E48989189AFACCCCF6383"><enum>(7)</enum><header>Pilot project site</header><text>The term <term>pilot project site</term> means an area of Federal land designated by the Secretary concerned under section 4 as a location in which a pilot project will be carried out.</text></paragraph> 
<paragraph id="H4F4D0ED3014A4AB3931316E728C10800"><enum>(8)</enum><header>Post-disturbance</header><text display-inline="yes-display-inline">The term <quote>Post-disturbance</quote> means a period of three years immediately following an uncharacteristic disturbance. </text></paragraph> 
<paragraph id="H18560552D67641EE957F7624F75DFB9"><enum>(9)</enum><header>Rehabilitation plan</header><text display-inline="yes-display-inline">The term <term>rehabilitation plan</term> means a plan developed under section 5 to address the post-disturbance rehabilitation of a pilot project site.</text> </paragraph> 
<paragraph id="H04E862B93DFE4D329F07740556EBCC6"><enum>(10)</enum><header>Secretary concerned</header><text display-inline="yes-display-inline">The term <term>Secretary concerned</term> means—</text> 
<subparagraph id="HF5EBB57733C844B3BD7F3FD74D38E937"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to land of the National Forest System described in paragraph (3)(A); and</text></subparagraph> 
<subparagraph id="H35657A9599294499ABAC9C3577C22751"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands described in paragraph (3)(B).</text></subparagraph></paragraph> 
<paragraph id="HFE0D944922DA40D4AE95F6C2281D78B5"><enum>(11)</enum><header>Uncharacteristic disturbance</header><text display-inline="yes-display-inline">The term <quote>uncharacteristic disturbance</quote> means a relatively discrete event, such as forest fire, insect infestation, or hurricane, that significantly alters the structure, composition, function, or successional trajectory of an ecological system. </text></paragraph> </section> 
<section id="HC957428DBCCB4F93AADA00A9A2578856"><enum>4.</enum><header>Post-disturbance rehabilitation pilot projects for Federal land forest communities</header> 
<subsection id="H7948F872E3CF44F1B66054D0312FE500"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">On the basis of applications submitted by Federal land forest communities, the Secretary of Agriculture and the Secretary of the Interior may each establish not more than five post-disturbance rehabilitation pilot projects involving Federal land for the purpose of encouraging post-disturbance rehabilitation of the pilot project site in a manner that—</text> 
<paragraph id="HF180DF381F1840F39E18C56CF5C2FA99"><enum>(1)</enum><text>reflects the common ground identified by diverse interests within a Federal land forest community;</text></paragraph> 
<paragraph id="HFD7F76B5E6224A5D8DF413B3A625FB75"><enum>(2)</enum><text>restores the forest ecosystem health and diversity of the pilot project site; and</text></paragraph> 
<paragraph id="H1EC58F905CDD440393BDB39365154E3E"><enum>(3)</enum><text display-inline="yes-display-inline">will benefit the Federal land forest community.</text></paragraph></subsection> 
<subsection id="H03B8748414FE451093D0EB4CC07FAF15"><enum>(b)</enum><header>Application process</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary concerned shall develop an application process by which Federal land forest communities may seek the designation of an area of Federal land as a pilot project site for use of the authorities provided by this Act.</text></subsection> 
<subsection id="H0085DBDA013F49CA87D89F19C7CED49C"><enum>(c)</enum><header>Eligibility criteria</header><text>An area of Federal land must satisfy at least one of the following criteria before the Secretary concerned may designate the area as a pilot project site:</text> 
<paragraph id="H0B871307B59146BE9D048862FEE58B5D"><enum>(1)</enum><text display-inline="yes-display-inline">The area is covered by a community wildfire protection plan or a collaborative working group or infrastructure, in existence as of the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HD328E90A110A4DFD97DDE8D3BC4E6430"><enum>(2)</enum><text display-inline="yes-display-inline">Federal lands that are demonstrably at serious risk from the impacts of uncharacteristically intense wildland fire, a severe blow down, or other catastrophic events, such as hurricanes with associated windfall, beyond the range of historic variability.</text></paragraph> 
<paragraph id="HA6B831683AA54769BB43E16C3700DFF5"><enum>(3)</enum><text display-inline="yes-display-inline">The area is in the vicinity of a Federal land forest community or communities that have worked to address forest health across land ownership types.</text></paragraph> 
<paragraph id="H460324F65E6B450A8DF1864D46A65EAE"><enum>(4)</enum><text display-inline="yes-display-inline">The area is adjacent to, or intermingled with, communities, and the area has had an unnatural buildup of fuels due to a long history of fire suppression or has become an unnatural ecosystem due to past management practices.</text></paragraph> </subsection> 
<subsection id="HFB8A5617F5464D6692855907876CBB1E"><enum>(d)</enum><header>Special consideration for eligibility for pilot projects</header><text display-inline="yes-display-inline">In evaluating the application submitted by a Federal land forest community for the designation of a pilot project site, the Secretary concerned shall give special consideration to the following:</text> 
<paragraph id="H8507C90B93384892A0BCD15DC18BBE46"><enum>(1)</enum><text>Documented support for the application from a diversity of interested persons in the community.</text></paragraph> 
<paragraph id="HD5FA5ACA25754F338D097B071C1500B2"><enum>(2)</enum><text>The community has a proven track record of working in a collaborative manner to resolve natural resource issues.</text></paragraph> 
<paragraph id="H3ACD2279D35B48EC8BF6CA7D079D3EF8"><enum>(3)</enum><text>The community has worked to address forest health issues through comprehensive watershed assessments.</text></paragraph> 
<paragraph id="H52D66F50DF594996A2638CEDBD6D041F"><enum>(4)</enum><text>The community, or entities in the community, are already receiving grants or working with the Secretary of Agriculture through one or more programs under the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2101">16 U.S.C. 2101 et seq.</external-xref>).</text></paragraph></subsection> 
<subsection id="HF465F39C0BA54A1EBC2399631356EA4"><enum>(e)</enum><header>Exclusion of certain federal land</header><text display-inline="yes-display-inline">Notwithstanding subsection (c), the following Federal land may not be included within a pilot project site:</text> 
<paragraph id="HCED5262407B141FB9D96B1BDB7005346"><enum>(1)</enum><text display-inline="yes-display-inline">Federal land containing old growth forest or late successional forest.</text></paragraph> 
<paragraph id="H187E4715AB6C4065BC4FC876CCDD6BCE"><enum>(2)</enum><text display-inline="yes-display-inline">Federal land on which the removal of vegetation is prohibited, including components of the National Wilderness Preservation System.</text></paragraph> 
<paragraph id="HC476F9E6B9864D329194B234187DD5E1"><enum>(3)</enum><text>Wilderness Study Areas.</text></paragraph> 
<paragraph id="H6AD6C0FB7BB246CCAEF64384B2D78D00"><enum>(4)</enum><text>Inventoried roadless areas.</text></paragraph> 
<paragraph id="HE9D3138E40ED4B10941EC3D3CAB2451D"><enum>(5)</enum><text display-inline="yes-display-inline">Federal land included in a land allocation made by an Act of Congress or the Secretary concerned for the special protection of natural, historical, cultural, recreational, or other public values and regarding which trees located on the land is not scheduled to contribute to the regular timber sale program</text></paragraph></subsection> 
<subsection id="HF4A5B72C2A6F4997BCA33232F831279F"><enum>(f)</enum><header>Acreage limitations</header><text display-inline="yes-display-inline">A pilot project site may not exceed 10,000 acres. The total acreage encompassed by all pilot project sites designated by the Secretary concerned may not exceed 50,000 acres.</text></subsection> 
<subsection id="HA5D98E2C94C04B2CA07BCBFB019BC107"><enum>(g)</enum><header>Duration of designation authority</header><text display-inline="yes-display-inline">The authority of the Secretary concerned to designate pilot project sites expires at the end of the three-year period beginning on the date of the enactment of this Act. The expiration of such authority shall not affect the use of the authorities provided by this Act in pilot project sites designated before the end of such period.</text></subsection></section> 
<section id="H4A2A91CE0B9F46B48DC8942D56DE8D1"><enum>5.</enum><header>Post-disturbance rehabilitation plan for designated Federal land forest communities</header> 
<subsection id="HFDBB9A46E9934B81BFB0E771300B89"><enum>(a)</enum><header>Plan required</header> 
<paragraph id="HA0181D2B42474045BB954C0475287194"><enum>(1)</enum><header>Development of plan</header><text display-inline="yes-display-inline">Once an area of Federal land is designated as a pilot project site, the Federal land forest community that applied for the designation of the pilot project site shall develop and submit to the Secretary concerned a plan to address post-disturbance rehabilitation of the pilot project site, whether the uncharacteristic disturbance is caused by a wildfire or nonfire-related uncharacteristic disturbance event.</text></paragraph> 
<paragraph id="H8D3F2C5A2D5B4E919D22E2C0540080DB"><enum>(2)</enum><header>Community wildfire protection plan amendment</header><text display-inline="yes-display-inline">If an area of Federal land designated as a pilot project site is already covered by a community wildfire protection plan, the rehabilitation plan may be developed as an amendment to the community wildfire protection plan.</text></paragraph> 
<paragraph id="H41A859E89E7C476589A54F5779FE9B78"><enum>(3)</enum><header>Addressing non-fire-related disturbance events</header><text display-inline="yes-display-inline">A rehabilitation plan intended to address nonfire-related uncharacteristic disturbance events shall be developed in accordance with the direction provided for community wildfire protection plans pursuant to the Healthy Forest Restoration Act of 2003.</text></paragraph></subsection> 
<subsection id="H91DD37B993934C48A7EF7FABAB088E96"><enum>(b)</enum><header>Technical and financial assistance</header><text display-inline="yes-display-inline">The Secretary concerned may provide technical and financial assistance to Federal land forest communities to assist in their efforts to develop a rehabilitation plan or amend a community wildfire protection plan to include a rehabilitation plan.</text></subsection> 
<subsection id="H14DD9E0E47504CE2B119C497CF3E57ED"><enum>(c)</enum><header>Contents of plan</header><text display-inline="yes-display-inline">A rehabilitation plan, whether developed as an amendment to a community wildfire protection plan or as a separate plan, shall specifically address the following:</text> 
<paragraph id="HE16DF35710364766AFFA811185E55B9F"><enum>(1)</enum><text display-inline="yes-display-inline">Any anticipated temporary road use or road decommissioning.</text></paragraph> 
<paragraph id="HB47093684BE54F4600F43D9F6EA386EA"><enum>(2)</enum><text>Reducing the standing dead hazardous fuels and surface hazardous fuels to levels described in the existing land management plan or returning the area to a condition class 1 or 2 fire regime.</text></paragraph> 
<paragraph id="H5A74CD38E34141EF0020A7222C46EEA"><enum>(3)</enum><text>Measures for protection of fragile soils and rehabilitation of soil integrity.</text></paragraph> 
<paragraph id="H7FAC94BF5EE04F97A9066F39F93158FE"><enum>(4)</enum><text>Water quality and quantity protection and restoration.</text></paragraph> 
<paragraph id="HAAFEE0AA83014DA7ADEF00902CF1FC9E"><enum>(5)</enum><text>Wildlife and fish habitat and restoration.</text></paragraph> 
<paragraph id="H6F1CFBB49B574ED483DBE78FF4D18932"><enum>(6)</enum><text>Management to prevent adverse impacts to soils and wildlife and fish habitat.</text></paragraph> 
<paragraph id="H0D22E3413F5A48B2867490BFBE00002F"><enum>(7)</enum><text>Guidance directing projects to avoid steep slopes and erosion-prone areas.</text></paragraph> 
<paragraph id="HBBF70D449A8A4142B8A629F236D5066"><enum>(8)</enum><text display-inline="yes-display-inline">Utilization and marketing of material removed to ensure economic benefit to the Federal land forest community.</text></paragraph> 
<paragraph id="H4E87A725ACD742CC8EB60000EDE56F74"><enum>(9)</enum><text display-inline="yes-display-inline">Replanting needs, with an emphasis on native vegetation.</text></paragraph></subsection> 
<subsection id="H75BB63C55D1B442E8622F16F5FA39089"><enum>(d)</enum><header>Fire planning, grazing, and tree removal</header> 
<paragraph id="H7E32736D8751485A985FF14BBFC820C0"><enum>(1)</enum><header>Fire planning</header><text>To be considered to adequately address fire planning, post disturbance rehabilitation projects under a rehabilitation plan must conform to the strategic restoration objectives provided by the applicable Fire Management Plan.</text></paragraph> 
<paragraph id="HC787E1E517CC41DB83904BC88B53E373"><enum>(2)</enum><header>Grazing</header><text display-inline="yes-display-inline">To be considered to adequately address grazing, the rehabilitation plan for a pilot project site must design and adjust allotment management plans (including grazing deferrals) to optimize recovery of a disturbed area.</text></paragraph> 
<paragraph id="H4A1CD8396DF2407485ADDF7BFA4B2EB"><enum>(3)</enum><header>Tree removal</header><text display-inline="yes-display-inline">If standing trees are proposed for removal at a pilot project site, the rehabilitation plan for the site shall—</text> 
<subparagraph id="H6C74598EB6924E68B92457DDEB238C73"><enum>(A)</enum><text>focus on small diameter trees and thinning from below; </text></subparagraph> 
<subparagraph id="H69238610FAC6444CA37E269EE049599E"><enum>(B)</enum><text>maximize the retention of legacy trees to promote recovery of a natural composition of native plant and wildlife species; and</text></subparagraph> 
<subparagraph id="HFE2E67C56BC24ADD96AEE5A563EF14A"><enum>(C)</enum><text>vary treatment intensities, and avoid even-aged management, to ensure forest health</text></subparagraph></paragraph> </subsection> 
<subsection id="H8246915C67124198A809007406D3D12"><enum>(e)</enum><header>Expedited consideration of rehabilitation plan and uncharacteristic disturbance responses</header> 
<paragraph id="HFF9B70A693FA4258999C8F3CDE46A6ED"><enum>(1)</enum><header>Response to uncharacteristic disturbance</header><text display-inline="yes-display-inline">After an uncharacteristic disturbance occurs on a pilot project site that is covered by a rehabilitation plan accepted by the Secretary concerned, and at the request of the Federal land forest community that developed the redevelopment plan, the Secretary concerned shall initiate a process under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) for the purpose of deciding what, if any, management activities to take to respond to the uncharacteristic disturbance.</text> </paragraph> 
<paragraph id="H3A1F2F2882324313A9FE24AB37B2A861"><enum>(2)</enum><header>Scoping; preferred alternative</header><text display-inline="yes-display-inline">Development of a qualifying rehabilitation plan is considered to meet the scoping requirements of the National Environmental Policy Act of 1969. Among those alternatives considered in the process initiated under such Act, the rehabilitation plan shall be proposed (with any necessary refinement) as the preferred alternative.</text></paragraph> 
<paragraph id="H5C7A882DFE2A476AA2046E2319A13DD7"><enum>(3)</enum><header>Environmental documentation</header><text display-inline="yes-display-inline">To the extent practicable, the Secretary concerned shall make the environmental documentation available to the public—</text> 
<subparagraph id="H014C9AED79AC47F1B1B6F9F852DB47B9"><enum>(A)</enum><text>within 60 days after the end of the uncharacteristic disturbance; or</text></subparagraph> 
<subparagraph id="HB8C997FA3C1C4D6E00082F59DF1C0073"><enum>(B)</enum><text>in the case of an ongoing uncharacteristic disturbance, such as an insect infestation, as soon as practicable.</text></subparagraph></paragraph> 
<paragraph id="HA5792A76A43A4080BF899C5E51A7B26C"><enum>(4)</enum><header>Public comment</header><text display-inline="yes-display-inline">The Secretary concerned shall provide for a period of public comment of not less than—</text> 
<subparagraph id="H38AFE9AD697A4E1499AE63BDFBE330A1"><enum>(A)</enum><text>30 days, in the case of an environmental assessment; and</text></subparagraph> 
<subparagraph id="H121C71D88F214F2995BCFED4DB872F00"><enum>(B)</enum><text display-inline="yes-display-inline">45 days, in the case of a draft environmental impact statement or final environmental impact statement.</text></subparagraph></paragraph> 
<paragraph id="HDE885CC9606C41F0000458B2BD855515"><enum>(5)</enum><header>Record of decision</header><text display-inline="yes-display-inline">The Secretary concerned shall issue a record of decision not later than 30 days after the close of the public comment period.</text></paragraph> 
<paragraph id="H1875CBD3F9714BF2B4BAF6D450A17967"><enum>(6)</enum><header>Appeal</header><text display-inline="yes-display-inline">To the extent practicable, decisions on appeals should be made within 30 days.</text></paragraph></subsection> 
<subsection id="H3A13D90F80714D4F97882151DE4CC916"><enum>(f)</enum><header>Independent monitoring</header><text display-inline="yes-display-inline">In order to have the most effective projects within a pilot project site, projects shall have independent third-party monitoring (or at the request of the Federal land forest community, local level multi-party monitoring) to evaluate the impacts of the post-disturbance rehabilitation work. A plan for monitoring shall be established at the earliest stages of collaboration and shall be incorporated into project design and implementation and shall be linked to the participatory research efforts directed in this Act.</text></subsection> 
<subsection id="H7F0BF2977D6B42178BC7D35BDC2F0705"><enum>(g)</enum><header>Oversight committee</header> 
<paragraph id="H960680F051D0403E953E1D42CB111FAB"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary concerned shall establish a national oversight committee to provide independent scientific and socio-economic monitoring of the pilot projects and activities carried out at the pilot project sites.</text></paragraph> 
<paragraph id="H57148DCCDEEE46F599E531004BAAE3D1"><enum>(2)</enum><header>Membership</header><text display-inline="yes-display-inline">The national oversight committee shall be set up under the auspices of the National Academy of Sciences and shall consist of five members who are scientists with expertise in evaluating the biological, ecological, hydrogeological, and socioeconomic components of the pilot projects.</text></paragraph> 
<paragraph id="H4C2FEC1285D343078BAA1B5E806C3C3E"><enum>(3)</enum><header>Accountability</header><text display-inline="yes-display-inline">The oversight committee shall conduct independent scientific and socio-economic monitoring under subsection (f) and submit reports to Congress on the short- and long-term results of the pilot project. Specifically, the reports should evaluate improvements in forest diversity, soil stability, reduction of fire risk, and local economic indicators.</text></paragraph></subsection> 
<subsection id="H08DF40715DF74FA7AE675B5F54706BFB"><enum>(h)</enum><header>Reports of federal land forest community</header><text display-inline="yes-display-inline">The Federal land forest community that applied for the designation of an approved pilot project site shall submit to the national oversight committee two reports regarding the results of the pilot project for that pilot project site. An initial report shall be submitted at the halfway point of their pilot project and a final report shall be submitted at the end of their pilot project.</text></subsection></section>
