<section id="H42AB9EDC9055441BAC9BD2F6098C54A8" display-inline="no-display-inline"><enum>101.</enum><header>Special transfer in fiscal year 2006</header><text display-inline="no-display-inline">Section 903 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1103">42 U.S.C. 1103</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="other" other-style="archaic" act-name="Social" id="HC1CE4DCB31574276AD4143B3009D7FF8"> 
<subsection id="HA3EFF7BF27D843AAB59493D0079CAB7" indent="up1"><enum>(e)</enum><header>Special transfer in fiscal year 2006</header><text>Not later than 10 days after the date of the enactment of this subsection, the Secretary of the Treasury shall transfer from the Federal unemployment account—</text> 
<paragraph id="H70EED38CE6BC4CD6B2EA349C06B73494"><enum>(1)</enum><text>$15,000,000 to the account of Alabama in the Unemployment Trust Fund;</text></paragraph> 
<paragraph id="H4778669AE90A40D6AE056DC15E68ED1"><enum>(2)</enum><text>$400,000,000 to the account of Louisiana in the Unemployment Trust Fund; and</text></paragraph> 
<paragraph id="H8DD0754FB88C4FA099328308DE95379C"><enum>(3)</enum><text>$85,000,000 to the account of Mississippi in the Unemployment Trust Fund.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H75F0104DD4CB41479C35E8A57723CDF"><enum>102.</enum><header>Flexibility in unemployment compensation administration to address Hurricane Katrina</header><text display-inline="no-display-inline">Notwithstanding any provision of section 302(a) or 303(a)(8) of the Social Security Act, any State may, on or after August 28, 2005, use any amounts received by such State pursuant to title III of the Social Security Act to assist in the administration of claims for compensation on behalf of any other State if a major disaster was declared with respect to such other State or any area within such other State under the Robert T. Stafford Disaster Relief and Emergency Assistance Act by reason of Hurricane Katrina.</text></section> 
<section id="HD3683CAAB5044F34A187774DFEEAA3A3"><enum>103.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary of Labor may prescribe any operating instructions or regulations necessary to carry out this title and any amendment made by this title.</text></section> </title> 
<title id="HCF33CF4DB93D4A2DA8473E3C8EE80300"><enum>II</enum><header>Health Provisions</header> 
<section id="H4C126CE6BD8A4A67A0F1E2AD00126651" section-type="subsequent-section" display-inline="no-display-inline"><enum>201.</enum><header>Elimination of medicare coverage of drugs used for treatment of sexual or erectile dysfunction</header> 
<subsection id="HB35AC6C2E84B41A7BAE162C09C828C16"><enum>(a)</enum><header>In general</header><text>Section 1860D–2(e)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(e)(2)(A)</external-xref>) is amended—</text> 
<paragraph id="HF1603E4E76FB4AA68CA5CA7B846F3188"><enum>(1)</enum><text>by striking the period at the end and inserting <quote>, as such sections were in effect on the date of the enactment of this part.</quote>; and</text></paragraph> 
<paragraph id="H07F372AD5677439FBFFE29DBEF5B10"><enum>(2)</enum><text>by adding at the end the following: <quote>Such term also does not include a drug when used for the treatment of sexual or erectile dysfunction, unless such drug were used to treat a condition, other than sexual or erectile dysfunction, for which the drug has been approved by the Food and Drug Administration.</quote>.</text></paragraph></subsection> 
<subsection id="H9D91163F5BFA44F293DDEF9700C43961"><enum>(b)</enum><header>Construction</header><text>Nothing in this section shall be construed as preventing a prescription drug plan or an MA–PD plan from providing coverage of drugs for the treatment of sexual or erectile dysfunction as supplemental prescription drug coverage under section 1860D–2(a)(2)(A)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(a)(2)(A)(ii)</external-xref>).</text></subsection> 
<subsection id="H4513B3950471486EBD8590682F2B1EE"><enum>(c)</enum><header>Effective dates</header><text>The amendment made by subsection (a)(1) shall take effect as if included in the enactment of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>) and the amendment made by subsection (a)(2) shall apply to coverage for drugs dispensed on or after January 1, 2007.</text></subsection></section> 
<section id="H2B33D581518D462DB022E614017BD7F7"><enum>202.</enum><header>Elimination of medicaid coverage of drugs used for treatment of sexual or erectile dysfunction</header> 
<subsection id="H51205E848C3F4151AD2CD085B7E20009"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1927(d)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8(d)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="H0A4E70BE5C944520930811D05CC18FA8" display-inline="no-display-inline"> 
<subparagraph id="HDC6BF61FE04B48C0B62C33183ECA3730"><enum>(K)</enum><text display-inline="yes-display-inline">Agents when used for the treatment of sexual or erectile dysfunction, unless such agents are used to treat a condition, other than sexual or erectile dysfunction, for which the agents have been approved by the Food and Drug Administration.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H883195E016E148DA9ECD3C3C382945E2"><enum>(b)</enum><header>Elimination of federal payment under medicaid program</header><text>Section 1903(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>) is amended—</text> 
<paragraph id="H150B60910E4F4537B308F48D71BA9745"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of paragraph (19);</text></paragraph> 
<paragraph id="H7A51065DB0D840D7B055F819505DF028"><enum>(2)</enum><text>by striking the period at the end of paragraph (20) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H602EC21A82FE4E0D868D9E381882A799"><enum>(3)</enum><text>by inserting after paragraph (20) the following new paragraph:</text>

<paragraph id="H8CA555BA09FE437EA39B23319191C3D4"><enum>(21)</enum><text display-inline="yes-display-inline">with respect to amounts expended for covered outpatient drugs described in section 1927(d)(2)(K) (relating to drugs when used for treatment of sexual or erectile dysfunction).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEC15476C6E934F1EBEBC9D7DD0C9EF4" display-inline="no-display-inline"><enum>(c)</enum><header>Clarification of no effect on determination of base expenditures</header><text display-inline="yes-display-inline">Section 1935(c)(3)(B)(ii)(II) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396v">42 U.S.C. 1396v(c)(3)(B)(ii)(II)</external-xref>) is amended by inserting <quote>, including drugs described in subparagraph (K) of section 1927(d)(2)</quote> after <quote>1860D–2(e)</quote>. </text></subsection> 
<subsection id="HAE18C1F6E2C24C3386B61FA15BA47C41"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to drugs dispensed on or after January 1, 2006.</text></subsection></section> 
<section id="H848EEA008F644B5A82A3A76933105048"><enum>203.</enum><header>Extension of sunset for transitional medical assistance (TMA)</header> 
<subsection id="HB46FB85C3555418ABAFF2C7B948128"><enum>(a)</enum><header>In general</header><text>Section 1925(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-6">42 U.S.C. 1396r–6(f)</external-xref>) is amended by striking <quote>September 30, 2003</quote> and inserting <quote>December 31, 2005</quote>.</text></subsection> 
<subsection id="H3CFD47AA65D54015A91168E2D1BAC157"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1902(e)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(1)(B)</external-xref>) is amended by striking <quote>September 30, 2003</quote> and inserting <quote>the last date (if any) on which section 1925 applies under subsection (f) of that section</quote>.</text></subsection> 
<subsection id="H12FCA669A4FD40C487C4F55081834591"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall be effective as of September 30, 2005.</text></subsection></section> 
<section id="HD92FB462C0D7499781669D57B600D44E"><enum>204.</enum><header>Extension of abstinence education program</header><text display-inline="no-display-inline">Activities authorized by section 510 of the Social Security Act shall continue through December 31, 2005, in the manner authorized for fiscal year 2005, and out of any money in the Treasury of the United States not otherwise appropriated, there are hereby appropriated such sums as may be necessary for such purpose. Grants and payments may be made pursuant to this authority through the first quarter of fiscal year 2006 at the level provided for such activities through the first quarter of fiscal year 2005.</text></section> 
<section id="HAB1E8F760EF041B4A200042EB01F7E69" section-type="subsequent-section"><enum>205.</enum><header>Extension of Qualified Individual (QI) program</header> 
<subsection id="HBA164053C9EC4F529443CAC2D83D5CCC"><enum>(a)</enum><header>Through end of 2005</header><text display-inline="yes-display-inline">Section 1902(a)(10)(E)(iv) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(E)(iv)</external-xref>) is amended by striking <quote>September 2005</quote> and inserting <quote>September 2006</quote>.</text></subsection> 
<subsection id="H2479A7D7BE0C40ECAEB14D4ED900D401"><enum>(b)</enum><header>Extending total amount available for allocation</header><text display-inline="yes-display-inline">Section 1933(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-3">42 U.S.C. 1396u–3(g)</external-xref>) is amended—</text> 
<paragraph id="H67B379A27A7247F288009F7CB853E700"><enum>(1)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H017CE1C340A94709B5934400BBC5A004"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (B);</text></subparagraph> 
<subparagraph id="HA0FBE92FEA554FE0BA7300E8C2D9FB57"><enum>(B)</enum><text>by striking the period at the end of subparagraph (C) and inserting a semicolon; and</text></subparagraph> 
<subparagraph id="H0D6E9099CEBF411CBA031B4507AD9BEA"><enum>(C)</enum><text>by adding at the end the following new subparagraphs:</text> 
<quoted-block style="OLC" id="H227518927DA246E9ACFDBE88FA08F344" display-inline="no-display-inline"> 
<subparagraph id="HA613AE8B9689483387226CE5E28D8F80"><enum>(D)</enum><text display-inline="yes-display-inline">for the period that begins on October 1, 2005, and ends on December 31, 2005, the total allocation amount is $100,000,000; and</text></subparagraph> 
<subparagraph id="H1443B3235D1348F28CDDC9F000B3003B"><enum>(E)</enum><text display-inline="yes-display-inline">for the period that begins on January 1, 2006, and ends on September 30, 2006, the total allocation amount is $300,000,000.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H90D39CDC2551448EB2291BA789B32300"><enum>(2)</enum><text>in paragraph (3), in the matter preceding subparagraph (A), by inserting <quote>or (D)</quote> after <quote>subparagraph (B)</quote>. </text></paragraph></subsection> 
<subsection id="H5B494A6BE3F7431AB04061559519AD25"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall be effective as of September 30, 2005.</text></subsection></section></title> 
<title id="H6D8E10A688354B138CA53557D410B17C"><enum>III</enum><header>TANF</header> 
<section id="H5CBB7034264F463AA21F0357809D25B3" display-inline="no-display-inline" section-type="subsequent-section"><enum>301.</enum><header>Additional funding for certain States affected by Hurricane Katrina providing emergency short term benefits to assist families evacuated within the State</header> 
<subsection id="H6834908C8CF748E9A58891001FFCB377"><enum>(a)</enum><header>Eligibility for payments from the Contingency Fund</header><text display-inline="yes-display-inline">Beginning with the date of the enactment of this Act and ending with August 31, 2006, any of the States of Louisiana, Mississippi, or Alabama shall be considered a needy State for purposes of section 403(b) of the Social Security Act if—</text> 
<paragraph id="H4F305BD2E2A24581B695FF1B8DD04DA7"><enum>(1)</enum><text display-inline="yes-display-inline">the State includes an area for which a major disaster has been declared under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) as a result of Hurricane Katrina;</text></paragraph> 
<paragraph id="HE233BCBB2CF34640A34D3D68AD843EC3"><enum>(2)</enum><text display-inline="yes-display-inline">a family that resided in such an area of the State before the onset of the hurricane evacuated from their place of residence (not necessarily directly) to another part of the State as a result of the hurricane;</text></paragraph> 
<paragraph id="H76FDD365DEAE46099C86A666009553CD"><enum>(3)</enum><text>while the family was in such other part of the State as a result of the hurricane, a cash benefit under the State program funded under part A of title IV of the Social Security Act was provided to the family on a short-term, nonrecurring basis; and</text></paragraph> 
<paragraph id="H3BCA6D3698B54A379438682FB812171D"><enum>(4)</enum><text display-inline="yes-display-inline">while the cash benefit was so provided, the State determined that the family—</text> 
<subparagraph id="H5C4ED51CAA7141548C158B7839726488"><enum>(A)</enum><text>was not receiving a cash benefit from any program funded under such part (other than the cash benefit described in paragraph (3)); and</text></subparagraph> 
<subparagraph id="H3B3CED45A4354586008FE1DF85882807"><enum>(B)</enum><text>had not received a cash benefit of any kind from any such program in the 3-month period ending with the date the cash benefit was first so provided.</text></subparagraph></paragraph></subsection> 
<subsection id="HA8116860CF8046A100E777DCEDE0054" display-inline="no-display-inline"><enum>(b)</enum><header>Limitation on funding</header><text>Subject to section 403(b)(3)(C)(i) of the Social Security Act, the total amount paid under section 403(b)(3)(A) of such Act to a State which is a needy State for purposes of section 403(b) of such Act by reason of subsection (a) of this section shall not exceed the total amount of cash benefits provided as described in subsection (a)(3) of this section, to the extent that the conditions described in subsection (a)(4) of this section have been met with respect to the families involved.</text></subsection> 
<subsection id="H1DDE1D258AA0465A985CD59100DC1D60"><enum>(c)</enum><header>No State match required</header><text>Sections 403(b)(6) and 409(a)(10) of the Social Security Act shall not apply with respect to a payment made to a State by reason of this section.</text></subsection></section> </title>
