<section id="H4BFF47F53D7B4EBB867BE5E160DEF00" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Meth Lab Eradication Act</short-title></quote>.</text></section> 
<section id="H36FF51D1B92043F6A6A3634299582FC5"><enum>2.</enum><header>Transfer of ephedrine, pseudoephedrine, and phenylpropanolamine to schedule V; exception for list I pseudoephedrine products</header> 
<subsection id="H114791772ADA4CC9931BDBBF3353DB9D"><enum>(a)</enum><header>Transfer to schedule V; exception</header><text display-inline="yes-display-inline">Section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) is amended in schedule V—</text> 
<paragraph id="H5E919639B227461D9CE690F8617117C"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before <quote>Any compound</quote>; and</text></paragraph> 
<paragraph id="HA44D3BAFB08F4C1390D6F13D9799AE5B"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="traditional" id="HD4E0251CAF694C1396D142AFD1BF9D7" display-inline="no-display-inline"> 
<subsection id="H8E4083AA4928407BA9BE00A65200455F"><enum>(b)</enum><text display-inline="yes-display-inline">Unless specifically excepted or unless listed in another schedule, any of the following substances, including their salts, optical isomers, and salts of optical isomers:</text> 
<paragraph id="H9729DDA7C0C94CD78D44326130D8324C"><enum>(1)</enum><text>Ephedrine.</text></paragraph> 
<paragraph id="HD7C06F66580E459D9565A8BD4261813C"><enum>(2)</enum><text>Pseudoephedrine.</text></paragraph> 
<paragraph id="H7631979B238B4C67AF53DB7F1249B69E"><enum>(3)</enum><text>Phenlypropanolamine.</text></paragraph></subsection> 
<subsection id="H4EED0EACB1424FEA87D7430098007602"><enum>(c)</enum><text display-inline="yes-display-inline">Pseudoephedrine, including its salts, optical isomers, and salts of optical isomers, is excepted from this schedule when contained in a product that—</text> 
<paragraph id="H538855224185499A944317FB1B80ACF6"><enum>(1)</enum><text>is in the form of a liquid, liquid capsule, or liquid-filled gel capsule;</text></paragraph> 
<paragraph id="HC90512A12E2849E58600929C2352B55C"><enum>(2)</enum><text display-inline="yes-display-inline">does not contain more than 360 milligrams of pseudoephedrine; and</text></paragraph> 
<paragraph id="HE3DCA04983DF4EF1A6CFC4C6F700B627"><enum>(3)</enum><text>is approved under section 505 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act.</act-name></text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDFE766F17EF24D10A741D5B383645FEE"><enum>(b)</enum><header>Conforming amendments regarding list I chemicals</header> 
<paragraph id="H25AADBBE86734578AA2039D407732501"><enum>(1)</enum><header>Definition; striking of provisions relating to ephedrine and phenylpropanolamine</header><text display-inline="yes-display-inline">Section 102(34) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(34)</external-xref>) is amended—</text> 
<subparagraph id="HF03FF27B3B04461DB5FAEE9F62C9E4D8"><enum>(A)</enum><text>by striking subparagraphs (C) and (I);</text></subparagraph> 
<subparagraph id="H14B44276B1D548C5A4A2F51F8CDE3848"><enum>(B)</enum><text>by redesignating subparagraphs (D) through (H) as subparagraphs (C) through (G), respectively;</text></subparagraph> 
<subparagraph id="H224A39126CBE48E3A65D891BE7ECC1C3"><enum>(C)</enum><text>by redesignating subparagraphs (J) through (Y) as subparagraphs (H) through (W), respectively; and</text></subparagraph> 
<subparagraph id="H2B585FD097924167974F9B2B994DFF12"><enum>(D)</enum><text>by moving subparagraphs (N), (Q), and (S) (as so redesignated) two ems to the left.</text></subparagraph></paragraph> 
<paragraph id="H9AFF804F26D54FA6A548DE00EE67DFB2"><enum>(2)</enum><header>List I pseudoephedrine product</header><text display-inline="yes-display-inline">Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended—</text> 
<subparagraph id="HBCD3CA45BD554FF2B0CFC293E0C342C8"><enum>(A)</enum><text>in paragraph (34), by amending subparagraph (I) (as redesignated by paragraph (1)(C) of this subsection) to read as follows:</text>

<subparagraph id="H8FF8193CB12B409D82AA1700D4F005F"><enum>(C)</enum><text>in paragraph (46)—</text> 
<clause id="HA2112A9AC99B4BA2ADC7D9D0055E100"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>or phenylpropanolamine</quote>;</text></clause>

<paragraph id="HB42C1F207ADA4CBEA297F23FF7EEFA01"><enum>(3)</enum><header>Regulated transactions</header><text display-inline="yes-display-inline">The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended—</text> 
<subparagraph id="H6CBD24E651194F22A07B496FFF76D45"><enum>(A)</enum><text>in section 102(a)(39)(A), by amending clause (iv) to read as follows:</text> 
<quoted-block style="traditional" id="H124D13B92A294354B35DF3C870C45015" display-inline="no-display-inline"> 
<clause id="H9725BF7651774A9A85AEAD35F6B56540" indent="up1" commented="no"><enum>(iv)</enum> 
<subclause id="HAED10BF5819440B4AC1EF675D3F6C27B" commented="no" display-inline="yes-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">any transaction in a listed chemical that is contained in a drug that may be marketed or distributed lawfully in the United States under the Federal Food, Drug, and Cosmetic Act (other than a list I pseudoephedrine product) unless—</text> 
<item id="HDD2DC0A6E79B40F3BE889E6B7CC5B0CB" indent="up1" commented="no"><enum>(aa)</enum><text>the Attorney General has determined under section 204 that the drug or group of drugs is being diverted to obtain the listed chemical for use in the illicit production of a controlled substance; and</text></item> 
<item id="HBEC7773B6EE745278E3E83A0C01342D7" indent="up1" commented="no"><enum>(bb)</enum><text display-inline="yes-display-inline">the quantity of the listed chemical contained in the drug included in the transaction or multiple transactions equals or exceeds the threshold established for that chemical by the Attorney General; or</text></item></subclause> 
<subclause id="H3F968DAC53F24334B5D42199F144906B" indent="up1" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">any transaction in a list I pseudoephedrine product by a retail distributor, unless the Attorney General has determined under section 204 that the product is being diverted to obtain pseudoephedrine for use in the illicit production of methamphetamine; or</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H2BE9713FEAD44DBBAD1E3100015436D7"><enum>(B)</enum><text>in section 204, by striking subsection (e).</text></subparagraph></paragraph></subsection> </section> 
<section id="HBA77A3C658F442A998820300B5FDF6B"><enum>3.</enum><header>Requirements regarding list I pseudoephedrine products</header> <text display-inline="no-display-inline">Section 310 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/830">21 U.S.C. 830</external-xref>) is amended—</text> 
<paragraph id="H272927AB926C4DE9A74C25A634634596"><enum>(1)</enum><text>in subsection (b), by striking paragraph (3); and</text></paragraph> 
<paragraph id="HB39ED5507B5C4C6399C7E5A3FC0865D"><enum>(2)</enum><text>by adding at the end the following subsection:</text> 
<quoted-block style="OLC" id="HB016DE6844444A688C13A2318D152177" display-inline="no-display-inline"> 
<subsection id="H687FC6287A1A486B9B1CB14B47CC7EC0"><enum>(d)</enum><header>List I pseudoephedrine products</header> 
<paragraph id="H7AEF345484094636A33E2B8463DB6183"><enum>(1)</enum><header>Requirements regarding retail sales</header><text>Each person who sells at retail a list I pseudoephedrine product shall ensure that sales of such product are made in accordance with the following requirements:</text> 
<subparagraph id="H0D8C1D0F4E3E4EF8846645E0029F5521"><enum>(A)</enum><text>In offering the product for sale, the person places the product such that customers do not have direct access to the product before the sale is made (commonly known as behind-the-counter).</text></subparagraph> 
<subparagraph id="HD14C5406736E488ABE05ABB98A0716B" commented="no"><enum>(B)</enum><text>The person delivers the product directly to the purchaser, and not through use of the mails or any private or commercial carrier.</text></subparagraph> 
<subparagraph id="HCA23B46AF6834424888E3D1D343F5C82"><enum>(C)</enum><text display-inline="yes-display-inline">The person does not sell such a product that is in the form of a package that can be further broken down or subdivided into two or more separate and distinct packages.</text></subparagraph> 
<subparagraph id="H31F84BAB1C68424FB200593D3205DC7B"><enum>(D)</enum><text display-inline="yes-display-inline">The person does not knowingly sell to an individual more than one such product during a 24-hour period.</text></subparagraph> 
<subparagraph id="HA98A3E0386BA444282B894977971E08F"><enum>(E)</enum><text>The person maintains a written list of sales of such products that identifies the products, the purchasers, and the dates and times of the sales (which list is referred to in this paragraph as the <quote>logbook)</quote>).</text></subparagraph> 
<subparagraph id="HCBFD640529B547EAB17E842D2238CFC6"><enum>(F)</enum><text>The person does not sell such a product unless—</text> 
<clause id="H24A6592E1CFA4C2AA8429DEAEBB958DB"><enum>(i)</enum><text>the prospective purchaser—</text> 
<subclause id="HE367A42F53E448BA97513DCC65B266D"><enum>(I)</enum><text>is 18 years of age or older;</text></subclause> 
<subclause id="HA75C9C07E5E541F1AC4BD2D452067CD0"><enum>(II)</enum><text>presents an identification card that provides a photograph and is issued by a State or the Federal Government; and</text></subclause> 
<subclause id="H525B8B29E4654323B2EA83E098D344FE"><enum>(III)</enum><text> signs the logbook and legibly prints in the logbook his or her name, address, and the date and time of the sale; and</text></subclause></clause> 
<clause id="HF225753856304B5B9F5F39D0D7CE8896"><enum>(ii)</enum><text>the person determines that the name signed and printed in the logbook corresponds to the name provided on such identification and that the date and time entered are correct.</text></clause></subparagraph> 
<subparagraph id="H954D282CB8D94B2BA90095515CFA19C0"><enum>(G)</enum><text display-inline="yes-display-inline">The person maintains possession of each logbook for not fewer than two years after the date of the last sale entered in the logbook.</text></subparagraph> 
<subparagraph id="H29428DC7AECC42958EE763A78C8605C"><enum>(H)</enum><text display-inline="yes-display-inline">The person does not offer a promotion in which, as part of a purchase transaction, such a product is provided without charge.</text></subparagraph> 
<subparagraph id="H41974A3FB08F4A00A4CA001B56A606F9"><enum>(I)</enum><text display-inline="yes-display-inline">On the premises of the location involved, the person posts a clear and conspicuous notice providing as follows: <quote>Federal law prohibits the over-the-counter purchase of more than one product containing pseudoephedrine in a 24-hour period, and prohibits the over-the-counter purchase of more than 7,500 milligrams of pseudoephedrine within a 30-day period. If you make an over-the-counter purchase of such a product, you are required to sign a logbook that may be accessible to law enforcement officers.</quote></text></subparagraph></paragraph> 
<paragraph id="H558C63497F8446C28DC483B74600ED13"><enum>(2)</enum><header>Authority to require certain reports</header> 
<subparagraph id="HE1828540B84E4EA480209264567CC940"><enum>(A)</enum><header>In general</header><text>With respect to each person who manufactures a list I pseudoephedrine product, or who distributes such a product (including a sale at retail), the Attorney General may by regulation require the person to report to the Attorney General—</text> 
<clause id="H621A1050FD4F496F93050666FF4400ED"><enum>(i)</enum><text display-inline="yes-display-inline">any uncommon method of payment or delivery, or any other circumstance that the person believes may indicate that the product will be used in violation of this title;</text></clause> 
<clause id="HFF4858F83254481BBD1610AC22BE6FBC"><enum>(ii)</enum><text>any proposed transaction with an individual or organization whose description or other identifying characteristic the Attorney General furnishes in advance to the person; and</text></clause> 
<clause id="HDF5EF0C921FD45029FA12142CB5D73F"><enum>(iii)</enum><text>any unusual or excessive loss or disappearance of supplies of the product that are under the control of the person.</text></clause></subparagraph> 
<subparagraph id="H1F05136E848D41ED93F36000F39CEA25"><enum>(B)</enum><header>Additional reports for manufacturers and distributors at wholesale</header><text display-inline="yes-display-inline">With respect to each person who manufactures a list I pseudoephedrine product, or who distributes such a product at wholesale, the Attorney General may by regulation require the person to report to the Attorney General any transaction involving an extraordinary quantity of the product.</text></subparagraph> 
<subparagraph id="H4EE5AEFFDAA74C1B925D60B0BCCE62BF"><enum>(C)</enum><header>Certain regulations</header><text>Regulations under subparagraphs (A) through (C) of subsection (b)(1) apply to subparagraphs (A) and (B) of this paragraph to the extent that the provisions of such subparagraphs of subsection (b)(1) are identical to the provisions of such subparagraphs of this paragraph. Subparagraphs (A) and (B) of this paragraph do not require the Secretary to promulgate regulations with respect to such identical provisions.</text></subparagraph> 
<subparagraph id="H8124DB368AA44B659BB502B5251539D" commented="no"><enum>(D)</enum><header>Relation to certain exemption</header><text display-inline="yes-display-inline">Subparagraphs (A) and (B) apply notwithstanding the exemption for list I pseudoephedrine products under section 102(39)(A)(iv)(II).</text></subparagraph></paragraph> 
<paragraph id="HDCFAA6D46EAE4B2AA13254818C63D32" display-inline="no-display-inline"><enum>(3)</enum><header>Removal of exception regarding status as list I chemical</header> 
<subparagraph id="H6030D87E562A4D83B2D1FAF9741C9E1F"><enum>(A)</enum><header>In general</header><text>If the Attorney General determines that list I pseudoephedrine products are being diverted for use in the illicit production of methamphetamine, the Attorney General may by regulation remove the exception under schedule V(c).</text></subparagraph> 
<subparagraph id="H168A864F1C8B4666BBD32322316230D2" commented="no"><enum>(B)</enum><header>Relation to section 204</header><text>The authority established for the Attorney General under subparagraph (A) is in addition to the authority under section 204. The Attorney General may apply such section in lieu of applying subparagraph (A).</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HDFD7E815147C434D8903E0FB03AC3C3" display-inline="yes-display-inline"><enum>4.</enum><header>Requirements regarding schedule V methamphetamine-related products</header> 
<subsection id="H741BF3AC7DD84ED79C466E04425B0623"><enum>(a)</enum><header>In general</header><text>Section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>) is amended by adding at the end the following subsection:</text> 
<quoted-block style="traditional" display-inline="no-display-inline" id="H0A1499FD3B254C809824A3B715305BB3"> 
<subsection id="HD06944C83B52491A8E92453D09743158"><enum>(i)</enum><text display-inline="yes-display-inline">With respect to schedule V methamphetamine-related products that do not require prescriptions, a registration under this section for a pharmacy shall provide that, for the general physical location involved, the registration is subject to the condition that a sale of such a product at retail be made in accordance with the same requirements as apply under subparagraphs (B) through (I) of section 310(d)(1) for the sale at retail of list I pseudoephedrine products.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H23CBCB82FDA04DD5A870EEB4977F00BD"><enum>(b)</enum><header>Conforming amendment</header><text>Section 201(g)(1) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/811">21 U.S.C. 811(g)(1)</external-xref>), as amended by section 2(b)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/108/358">Public Law 108–358</external-xref> (118 Stat. 1663), is amended—</text> 
<paragraph id="H1323CCAFFFEC4B74AFA713845BE50051"><enum>(1)</enum><text>by striking <quote>titles II and III of the Comprehensive Drug Abuse Prevention and Control Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802 et seq.</external-xref>)</quote> and inserting <quote>this title and title III</quote>; and </text></paragraph> 
<paragraph id="H69A3A6A37153451CAC5540377008E7F4"><enum>(2)</enum><text>by adding at the end the following: <quote>The preceding sentence does not apply to controlled substances specified in schedule V(b).</quote>.</text></paragraph></subsection> 
<subsection id="HE050864A2ED247E6AD7370E4AE47AA92"><enum>(c)</enum><header>Definitions</header><text>Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended—</text> 
<paragraph id="HD0CDA5B5ACC1461C9B83906FB0EC3CBF"><enum>(1)</enum><text>by redesignating paragraph (46) (as amended by section 2(b)(2)(C) of this Act) as paragraph (47); and</text></paragraph> 
<paragraph id="H820D95AEBB7947EC8E87256970B135EC"><enum>(2)</enum><text>by inserting after paragraph (45) the following paragraph:</text>

<paragraph id="H4037B48A553C4E65B0C26D1FB94516AC" indent="up1"><enum>(46)</enum> 
<subparagraph id="HE8CB3B59AC44442E8CFAA6D7C16234B" display-inline="yes-display-inline" indent="up1"><enum>(A)</enum><text>The term <quote>schedule V methamphetamine-related product</quote> means a product that is approved under section 505 of the Federal Food, Drug, and Cosmetic Act and—</text> 
<clause id="H1C2570B8D032408D8583D0E3C735EE5" indent="up1"><enum>(i)</enum><text>contains ephedrine or phenylpropanolamine; or</text></clause> 
<clause id="H60FC30488AC04128A7BD609B06CAAE57" indent="up1"><enum>(ii)</enum> 
<subclause id="H694BFF2A9E7C4F0F9100C809E54CB00" display-inline="yes-display-inline"><enum>(I)</enum><text>contains pseudoephedrine; and</text></subclause> 
<subclause id="HA247DBEA2237418DADE106A051C0AE1B" indent="up1"><enum>(II)</enum><text>is not a list I pseudoephedrine product.</text></subclause></clause></subparagraph> 
<subparagraph id="H8A2B17F1A0544875B1DE556FFA4ED735" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>schedule V pseudoephedrine product</quote> means a product described in subparagraph (A) to which clause (ii) of such subparagraph applies.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> </section> 
<section id="HDCAFC0C5278D44579B6D72FDF211873F"><enum>5.</enum><header>Enforcement</header> 
<subsection id="HE6A9D33D00444847B9CAB5324EA7436B"><enum>(a)</enum><header>Sales at retail of methamphetamine-related products</header> 
<paragraph id="HDC79342B9C7C4F988E827B8FF1C54BA"><enum>(1)</enum><header>In general</header><text>Section 402 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/842">21 U.S.C. 842</external-xref>) is amended—</text> 
<subparagraph id="H45A289A548DB4F238E00F89C999E0B4"><enum>(A)</enum><text>in subsection (a)—</text>

<paragraph id="HFDEE40AD3E554424B5A9BC6427620318"><enum>(13)</enum><text display-inline="yes-display-inline">who is a pharmacy or pharmacist registered under section 303(f) to knowingly or negligently sell at retail a schedule V methamphetamine-related product in violation of any requirement under section 303(i);</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H35AA61770A414FB49D36BCF73C72B0A5"><enum>(B)</enum><text>in subsection (c)(1)(B), by inserting before the period the following: <quote>, except that this subparagraph does not apply to a violation of subsection (a) or (b) of section 310 with respect to a list I pseudoephedrine product by a person who is not a retail distributor</quote>. </text></subparagraph> </paragraph> 
<paragraph id="H462265F2347641E89C4EEAACB2C7247E" commented="no"><enum>(2)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 401 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841</external-xref>) is amended—</text> 
<subparagraph id="HAD4F0D47E1F745E3976D75012162FDF9"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)(3), in the first sentence, by inserting after <quote>shall</quote> the following: <quote>, except to the extent that section 402(a)(13) applies,</quote>; and</text></subparagraph> 
<subparagraph id="H8F4E7592114049B6ACAA3EF015AEF9D9"><enum>(B)</enum><text>in subsection (f)—</text>

<subsection id="HC9ECCA7716C3482DA9F333AF002E72AB"><enum>(b)</enum><header>Restrictions on retail purchases of pseudoephedrine products; violation of logbook requirements for methamphetamine-related products</header><text>Section 404(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/844">21 U.S.C. 844(a)</external-xref>) is amended by inserting after the second sentence the following: <quote>It shall be unlawful for any person to knowingly or intentionally purchase at retail without a prescription more than one schedule V or list I pseudoephedrine product during a 24-hour period, or more than 7,500 milligrams of pseudoephedrine in such products during a 30-day period, or to knowingly or intentionally purchase a schedule V methamphetamine-related product or a list I pseudoephedrine product without signing the appropriate logbook and printing information in accordance with section 310(d)(1)(F)(i)(III) or 303(i).</quote>.</text></subsection> 
<subsection id="H5D0DA0DDBD4C46CCACE610ADE719506D" commented="no"><enum>(c)</enum><header>Controlled substances; unauthorized manufacturing-related possession or distribution of ephedrine, pseudoephedrine, or phenylpropanolamine; distribution in general</header><text display-inline="yes-display-inline">Section 401 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841</external-xref>) is amended—</text> 
<paragraph id="H348263BFDB6E41499F3CC2210013FF06" commented="no"><enum>(1)</enum><text>in subsection (b)(3) (as amended by subsection (a)(2)(A) of this section), in the first sentence, by inserting <quote>subsection (g) or</quote> before <quote>section 402(a)(13)</quote> ; and</text></paragraph> 
<paragraph id="HFA3388CDC2754798A83C7809E71148E9" commented="no"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H7F08F5EAD94447A6B8931061DBEB6BE3"><enum>(g)</enum> 
<paragraph id="HDA0FCE987A8543C8BD00A60021B534FA" display-inline="yes-display-inline"><enum>(1)</enum><text>Any person who possesses a controlled substance specified in schedule V(b) with intent to manufacture a controlled substance except as authorized by this title, or who possesses, distributes, or dispenses such a substance knowing, or having reasonable cause to believe, that the substance will be used to manufacture a controlled substance except as authorized by this title, shall be sentenced in accordance with the same provisions as apply under subsection (c).</text></paragraph> 
<paragraph id="H87584CE5694C4C04BC775992002D088B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Any person who knowingly distributes or dispenses a controlled substance specified in schedule V(b) in violation of this title shall, except to the extent that section 402(a)(13) applies, be fined under title 18, United States Code, or imprisoned not more than 5 years, or both.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H707DECEF695C4EC000024CE7BBA8889E"><enum>6.</enum><header>Imports</header><text display-inline="no-display-inline">Section 1002(a) of the <act-name parsable-cite="CSA">Controlled Substances Import and Export Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/952">21 U.S.C. 952(a)</external-xref>) is amended—</text> 
<paragraph id="HF5C043DFE323406C94F1BC70A027CF6B"><enum>(1)</enum><text>in the heading for the section, by adding at the end the following: <quote><header-in-text level="paragraph" style="traditional">and ephedrine, pseudoephedrine, and phenylpropanolamine</header-in-text></quote>; </text></paragraph>
