<official-title>To authorize the establishment of domestic violence court systems from amounts available for grants to combat violence against women.</official-title>

<section section-type="section-one" id="H46B69947860A452A0000007001F9A9A3" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Domestic Violence Courts Assistance Act</short-title></quote>.</text></section> 
<section id="HDD1734D30AB04C2FB9C34C4797AB316F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H33CE304EFFE54FDCBE391E1C9818C23F"><enum>(1)</enum><text>Nearly one-third of American women report being physically or sexually abused by a husband or boyfriend at some point in their lives.</text></paragraph> 
<paragraph id="HA4C4E12F847943E8B3681E8F009D086C"><enum>(2)</enum><text>Family violence costs the nation between $5,000,000,000 and $10,000,000,000 each year in medical expenses, police and court costs, shelters and foster care, sick leave, absenteeism, and nonproductivity.</text></paragraph> 
<paragraph id="HFC0AB9857A714E64986DD705920397D1"><enum>(3)</enum><text>The Nation’s first specialized domestic violence court was established in Chicago in the early 1980s to centralize the prosecution of domestic violence offenders.</text></paragraph> 
<paragraph id="HD168364A91534FBD9300942D13279E54"><enum>(4)</enum><text>There are presently more than 300 domestic violence courts in at least 23 States nationwide.</text></paragraph> 
<paragraph id="H5A7140BA09284C29A252C06CDEEFA283"><enum>(5)</enum><text>Specialized domestic violence courts in several communities have resulted in cutting the processing time of domestic violence, reducing a backlog of existing domestic violence cases and raising the conviction rate.</text></paragraph> 
<paragraph id="H96F4C6C1168E41B18B943458FD068830"><enum>(6)</enum><text>Specialized domestic violence courts allow judges, prosecutors and defense attorneys to focus on the intricacies of domestic violence cases, especially with regards to repeat offenders.</text></paragraph></section> 
<section id="HF06763BD2779409DB39E71B00038F9C2"><enum>3.</enum><header>Establishment of domestic violence court systems from amounts available for grants to combat violence against women</header> 
<subsection id="HB092B8F0A0F84A7ABC2CE5C935F1ADB4"><enum>(a)</enum><header>In general</header><text>Part T of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (relating to grants to combat violent crimes against women) is amended as follows:</text> 
<paragraph id="HAA147F95029B46B79450384FDE3C6B12"><enum>(1)</enum><header>Purposes for which grants may be used</header><text>Section 2001(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3796gg">42 U.S.C. 3796gg(b)</external-xref>) is amended—</text> 
<subparagraph id="HE80D26A6D1844FF88F676CFE62A6C5B"><enum>(A)</enum><text>in paragraph (10), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H120D01DD5055408883FC41D7400B83F"><enum>(B)</enum><text>in paragraph (11), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HE0E5C15954924940856B04E7EC8B3844"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H9082AC45600249F781BA0264FDEA81D7"><enum>(12)</enum><text>providing the resources to establish and maintain a court system dedicated to the adjudication of domestic violence cases, including providing such resources as—</text> 
<subparagraph id="H79C1CB1D2D4A4F36990619FC9BBD7F32"><enum>(A)</enum><text>prosecutors and court personnel, including those who perform interpretation and translation services;</text></subparagraph> 
<subparagraph id="HBF93A8FF59BD4063811332C31B4EA361"><enum>(B)</enum><text>technical assistance and counseling;</text></subparagraph> 
<subparagraph id="H4A3AED20E3F24F3F951D472F9537EE6B"><enum>(C)</enum><text>training of attorneys, judges, and court personnel, including those who perform interpretation and translation services (which should be carried out in consultation with local domestic violence advocates, State domestic violence coalitions, or both);</text></subparagraph> 
<subparagraph id="HFCB7EC19805B4149B78BBFE6364CA38"><enum>(D)</enum><text>technological improvements and data collection; and</text></subparagraph> 
<subparagraph id="H2A6D99024DF74F509B7EABE774725F"><enum>(E)</enum><text>improvement of court facilities, including the creation of safe waiting areas and improved security.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3FFF1F37A1904099A456FD6196F314FA"><enum>(2)</enum><header>Qualification for funds</header><text>Section 2002(c)(3)(C) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3796gg-1">42 U.S.C. 3796gg–1(c)(3)(C)</external-xref>) is amended by inserting after <quote>including juvenile courts</quote> the following: <quote>and specialized domestic violence courts</quote>.</text></paragraph></subsection> 
<subsection id="HB395911480EC4246B7C2660091C92C6D"><enum>(b)</enum><header>Attorney General report</header><text>Not later than thirty days after the expiration of the third fiscal year beginning after the date of the enactment of this Act, the Attorney General shall submit to Congress a report on the implementation and effectiveness of the amendments made by subsection (b), including the effectiveness of grants made under such amendments in reducing the rates of domestic violence and shortening the period of judicial review in domestic violence cases.</text></subsection> 
<subsection id="HF107C92BC6EA40278694A80071ED7FFF"><enum>(c)</enum><header>State justice institute</header><text>Section 206(c) of the State Justice Institute Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10705">42 U.S.C. 10705(c)</external-xref>) is amended—</text> 
<paragraph id="HFDC11B488C684525B402C154D8ADF800"><enum>(1)</enum><text>in paragraph (14) by striking <quote>and</quote>;</text></paragraph> 
<paragraph id="H5D4F68FDF1DA4E67005CD7248CCDA79"><enum>(2)</enum><text>in paragraph (15) by striking the period at the end and inserting a semicolon; and</text></paragraph> 
<paragraph id="H14A551EDACC1449E9020ECD31ED506C2"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text>

<paragraph id="HD6A84D7BF24B4DCD895C1C292D139400"><enum>(16)</enum><text>implement and evaluate court-based approaches to adjudicating domestic violence cases in State courts, including—</text> 
<subparagraph id="H64E781EC21E04DFAA1568B6361111BE0"><enum>(A)</enum><text>domestic violence courts;</text></subparagraph> 
<subparagraph id="HF68C84F5217D44408DDA8F10A0C7A0A4"><enum>(B)</enum><text>integrated case management information systems;</text></subparagraph> 
<subparagraph id="H120082323B594872B05BB44EAD960065"><enum>(C)</enum><text>collaborations among courts, law enforcement agencies, social service agencies, women’s shelters, and victims of crime support organizations; and</text></subparagraph> 
<subparagraph id="H5AD82AD47369486B9C743519E120783F"><enum>(D)</enum><text>any other innovative practices likely to improve the criminal justice system’s response to domestic violence; and</text></subparagraph></paragraph> 
<paragraph id="HD2C6F258CE9D40778575A461F92C7881"><enum>(17)</enum><text>provide technical assistance to State courts to facilitate the development and adoption of improved practices in the adjudication of domestic violence cases.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7FCDF51CD815453286197F93C1360058"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out paragraphs (16) and (17) of section 206(c) of the State Justice Institute Act of 1984, as added by subsection (c), $1,500,000 for each of fiscal years 2006 through 2009.</text></subsection></section>
