<official-title>To amend title XVIII of the Social Security Act to provide certain Medicare beneficiaries living abroad a special Medicare part B enrollment period during which the late enrollment penalty is waived and a special Medigap open enrollment period during which no underwriting is permitted.</official-title>

<section section-type="section-one" id="HEC36E9B53C294EF3008F447D2303685C" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>International U.S. Seniors Act of 2005</short-title></quote>.</text></section> 
<section id="H945BB43A0141453F85D10BB4BE173E4"><enum>2.</enum><header>Medicare part <enum-in-header>B</enum-in-header> special enrollment period and waiver of part <enum-in-header>B</enum-in-header> late enrollment penalty and Medigap special open enrollment period for certain individuals residing abroad</header> 
<subsection id="H5CBC6D64D06A4256A14C004893D6052F"><enum>(a)</enum><header>Medicare part <enum-in-header>B</enum-in-header> special enrollment period; waiver of part <enum-in-header>B</enum-in-header> penalty for late enrollment</header> 
<paragraph id="H33CBC223CE874111814CB4ACB7B3E70"><enum>(1)</enum><header>In general</header><text>In the case of any eligible individual (as defined in subsection (c)(1)), the Secretary of Health and Human Services shall provide for a special enrollment period during which the individual may enroll under part B of title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name>. Such period shall be for a period of 8 months and shall begin with the first month that begins on or after the date the eligible individual first resides in the United States after the time described in subsection (c)(1)(B).</text></paragraph> 
<paragraph id="H910A2EBF8B5C4534BC6812439DEE79CC"><enum>(2)</enum><header>Coverage period</header><text>In the case of an eligible individual who enrolls during the special enrollment period provided under paragraph (1), the coverage period under part B of title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> shall begin on the first day of the month following the month in which the individual enrolls.</text></paragraph> 
<paragraph id="H4F0374DBC6484E18AE209D32F2D69D6B"><enum>(3)</enum><header>Waiver of part b late enrollment penalty</header><text>In the case of an eligible individual who enrolls during the special enrollment period provided under paragraph (1), there shall be no increase pursuant to section 1839(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r(b)</external-xref>) in the monthly premium under part B of title XVIII of such Act.</text></paragraph></subsection> 
<subsection id="HA1C850A206474ACBB31C4092A0A42F8F"><enum>(b)</enum><header>Medigap special open enrollment period</header><text>Notwithstanding any other provision of law, an issuer of a medicare supplemental policy (as defined in section 1882(g) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ss">42 U.S.C. 1395ss(g)</external-xref>)—</text> 
<paragraph id="H87F5F864584040C191E726FCD371F2B3"><enum>(1)</enum><text>may not deny or condition the issuance or effectiveness of a medicare supplemental policy; and</text></paragraph> 
<paragraph id="HF43FF7E1D5A847CA98B9A4D53E77E7E4"><enum>(2)</enum><text>may not discriminate in the pricing of the policy on the basis of the individual’s health status, medical condition (including both physical and mental illnesses), claims experience, receipt of health care, medical history, genetic information, evidence of insurability (including conditions arising out of acts of domestic violence), or disability;</text></paragraph><continuation-text continuation-text-level="subsection">in the case of an eligible individual who seeks to enroll during the 6-month period described in subsection (a)(1).</continuation-text></subsection> 
<subsection id="HFD89732F1B68455197878E169F3FDE28"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H9ED8309BE2D44A429351AF1C62CEDB94"><enum>(1)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> means an individual—</text> 
<subparagraph id="H5A07518BEED0407581B6412B684EA78"><enum>(A)</enum><text>who, as of the date of the enactment of this Act, has attained 65 years of age and was eligible to enroll under part B of title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name>, and</text></subparagraph> 
<subparagraph id="H6C28EDB330F9403793213131927987EF"><enum>(B)</enum><text>who at the time the individual first satisfied paragraph (1) or (2) of section 1836 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395o">42 U.S.C. 1395o</external-xref>)—</text> 
<clause id="H9F5BFE83695F495399DFF93421805902"><enum>(i)</enum><text>was not residing in a State (as determined by the Secretary of Health and Human Services for purposes of such section 1836), and</text></clause> 
<clause id="H15B1CAAA8D48464FAD9EDEA250E97F21"><enum>(ii)</enum><text>did not elect to enroll (or to be deemed enrolled) under section 1837 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p</external-xref>) during the individual’s initial enrollment period.</text></clause></subparagraph></paragraph> 
<paragraph id="H20132EAFBD834D9EB027229554F5D962"><enum>(2)</enum><header>State</header><text>The term <term>State</term> has the meaning given that term in section 410(5) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/610">42 U.S.C. 610(5)</external-xref>), and includes the Commonwealth of the Northern Marianas and the Trust Territory of the Pacific Islands.</text></paragraph></subsection></section> 
<section id="HC8E81F39BED34EEAB8CCC21E85EB3CB6"><enum>3.</enum><header>Sense of the Congress on the need for an international convention for reimbursement of the costs of health care coverage for foreign senior citizens</header><text display-inline="no-display-inline">It is the sense of the Congress that the United States should enter into an international convention with respect to individuals aged 65 or older who live abroad under which the nation of which the individual is a citizen agrees to reimburse another nation in which the individual lawfully resides for the costs of health care furnished to the individual while residing in that nation.</text></section>
