<official-title>To temporarily suspend, for communities affected by Hurricane Katrina, certain requirements under the community development block grant program.</official-title>

<section id="H7E148E5DC6EC40B9857B576925E1A657" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hurricane Katrina Emergency Relief CDBG Flexibility Act of 2005</short-title></quote>.</text></section> 
<section id="HBCE8CF0CC3BC41129E5E85A514369FD7"><enum>2.</enum><header>Suspension of public services cap</header> 
<subsection id="H73F75E03E18D42789514F84DC44825F0"><enum>(a)</enum><header>Units of general local government</header> 
<paragraph id="H5C0A3CE5CF594AB38E7E7D3C96D42300"><enum>(1)</enum><header>Directly affected communities</header><text display-inline="yes-display-inline">The percentage limitations under paragraph (8) of section 105(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305(a)(8)</external-xref>) on the amount of assistance under title I of such Act that may be used for the provision of public services by a unit of general local government that is, or is within, a directly affected community (as such term is defined in section 4 of this Act) shall not apply with respect to any of fiscal years 2005 through 2008 for such unit of general local government.</text></paragraph> 
<paragraph id="HC6BD4BD6AC57499C93EF2527F0EFAADD"><enum>(2)</enum><header>Indirectly affected communities</header><text display-inline="yes-display-inline">For each indirectly affected community (as such term is defined in section 4 of this Act), the Secretary shall waive the applicability, for such period during the fiscal years referred to in paragraph (1) as the Secretary considers appropriate, the percentage limitations under paragraph (8) of section 105(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305(a)(8)</external-xref>) on the amount of assistance under title I of such Act that may be used for the provision of public services by a unit of general local government that is, or is within, such indirectly affected community. In determining the period for which to waive such limitations, the Secretary shall take into consideration the specific economic circumstances of each such indirectly affected community.</text></paragraph></subsection> 
<subsection id="H036E2AB0B76C40218F22C396774F2BF5"><enum>(b)</enum><header>Nonentitlement communities</header><text display-inline="yes-display-inline">Assistance provided under title I of the Housing and Community Development Act of 1974 may be used for the provision of public services in any directly affected community (as such term is defined in section 4 of this Act) without regard to the percentage limitations under paragraph (8) of section 105(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305(a)(8)</external-xref>) on the amount of assistance that may be used statewide in nonentitlement communities for such activities and any such amounts so used in any directly affected community shall not be considered for purposes of such statewide limitations.</text></subsection></section> 
<section id="HAFA40FCE9D864D9BAE293D3B4F2D5D40"><enum>3.</enum><header>Suspension of public hearing requirement</header> 
<subsection id="H9F27E068BD3F4BE0A5D3EDE42FCC539B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, with respect to a grant under section 106 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306</external-xref>) for fiscal year 2006 for any unit of general local government that is, or is located in, a directly affected community, waive or specify alternative requirements for the public hearing requirements specified under subsection (b).</text></subsection> 
<subsection id="H13E8B0E271924C5EAB1700EAA666F634"><enum>(b)</enum><header>Public hearing requirements</header><text>The public hearing requirements specified under this subsection are—</text> 
<paragraph id="HF8B4360BDA224C0EB8ABDF09398C09D"><enum>(1)</enum><text>the requirement under section 104(a)(2)(C) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304(a)(2)(C)</external-xref>) to hold public hearings;</text></paragraph> 
<paragraph id="H204FB5ED87444DCC8900B8CCB2C60102"><enum>(2)</enum><text>the requirements under subparagraphs (D) and (F) of section 104(a)(3) of such Act to make certifications in the detailed citizenship participation plan regarding public hearings; and</text></paragraph> 
<paragraph id="H3210A675F9D94A4BBE7CA57011B55979"><enum>(3)</enum><text>any requirement pursuant to section 106(d)(7)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306(d)(7)(C)</external-xref>) to hold public hearings.</text></paragraph></subsection></section> 
<section id="H27D03DFCA9D048F781354E585508D2CB"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following definitions shall apply:</text> 
<paragraph id="HF49D8D611B314ABDBDADD9DB5E47D43F"><enum>(1)</enum><header>Directly affected community</header><text display-inline="yes-display-inline">The term <quote>directly affected community</quote> means a unit of general local government or area that is located in an area for which the President has declared a major disaster as a result of Hurricane Katrina.</text></paragraph> 
<paragraph id="H21493639C8834E6B97C73EE6F7BD1339"><enum>(2)</enum><header>Indirectly affected community</header><text>The term <quote>indirectly affected community</quote> means a unit of general local government or area that—</text> 
<subparagraph id="H3C306CB1EB5342E7B609C5DC9CCA044"><enum>(A)</enum><text>is a metropolitan city or urban county (as such terms are defined in section 102(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304(a)</external-xref>);</text></subparagraph> 
<subparagraph id="H882F2455F1114BB6B6E42B35CD66E400"><enum>(B)</enum><text>is not a directly affected community; and</text></subparagraph> 
<subparagraph id="HC66E0D9334B74FB68EFA4B95C94D975"><enum>(C)</enum><text>is determined by the Secretary of Housing and Urban Development to have been significantly affected economically by the occurrence of Hurricane Katrina (including economic effects from the presence of persons evacuated from an area for which the President has declared a major disaster as a result of Hurricane Katrina).</text></subparagraph></paragraph> 
<paragraph id="H84BE2D8BAFA947E68431CA8E90D002F"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Housing and Urban Development. </text></paragraph></section>
