<official-title>To provide for waivers under certain housing assistance programs of the Department of Housing and Urban Development to assist victims of Hurricane Katrina in obtaining housing.</official-title>

<section id="H92DCA22779DE4CBA82E0F78EF997E1C" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hurricane Katrina Emergency Housing Act of 2005</short-title></quote>.</text></section> 
<section id="HFBABAA06FC8B4CEE91C069C61296A8BD"><enum>2.</enum><header>Waivers for section 8 voucher program</header> 
<subsection id="H3EF3DE4AC4AC40EBB7D1EA63005CEEA4"><enum>(a)</enum><header>In general</header><text>The Secretary of Housing and Urban Development (in this section referred to as the <quote>Secretary</quote>) shall waive any of the requirements described in subsection (b) in the connection with the provision of assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) on behalf of an individual or family if—</text> 
<paragraph id="HADE0222184EF443EA7005FA100A82440"><enum>(1)</enum><text>the individual or family resides, or resided on August 29, 2005, in any area that is subject to a declaration by the President of a major disaster or emergency under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) in connection with Hurricane Katrina; and</text></paragraph> 
<paragraph id="H469C667E010A4FC3B9BDEEC8B384FD2"><enum>(2)</enum><text>the residence of the individual or family became uninhabitable or inaccessible as result of that major disaster or emergency.</text></paragraph></subsection> 
<subsection id="HEC9CB238BDC14359AEAED35D5015B9F7" display-inline="no-display-inline"><enum>(b)</enum><header>Waiver of eligibility requirements</header><text>The requirements described in this subseciton are the requirements under—</text> 
<paragraph id="H00DC6954B9EE4138A7BDA2A4DB58A2E4"><enum>(1)</enum><text>paragraph (2) of section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(2)</external-xref>), relating to tenant contributions towards rent, except that any such waiver shall expire on an individual's return to work;</text></paragraph> 
<paragraph id="HFA614954A796451E92DD4D369792005B"><enum>(2)</enum><text>paragraph (4) of such section 8(o), relating to the eligibility of individuals to receive assistance;</text></paragraph> 
<paragraph id="H59405064D7F74A4B9909ABE9413E2183"><enum>(3)</enum><text>subsection (k) of such section 8 and paragraph (5) of such section 8(o), relating to verification of income;</text></paragraph> 
<paragraph id="H91F4BEEE28EF4E59858916CAC5EB7BF"><enum>(4)</enum><text display-inline="yes-display-inline">paragraph (7)(A) of such section 8(o), relating to the requirement that leases shall be for a term of 1 year;</text></paragraph> 
<paragraph id="H11E3B05554BD4DE5B17D5F6F64C2E7A5"><enum>(5)</enum><text display-inline="yes-display-inline">paragraph (8) of such section 8(o), relating to initial inspection of housing units by a public housing agency;</text></paragraph> 
<paragraph id="HC805A4418EB345A0BE437D7FBF068227"><enum>(6)</enum><text>subsection (r)(1)(B) of such section 8, relating to restrictions on portability;</text></paragraph> 
<paragraph id="H0953BFB2FFF04FC3A067CF78C3378325" commented="no"><enum>(7)</enum><text>any regulation, notice, or order requiring prior approval by the Secretary for the use of any lease provision that modifies, amends, or waives, or differs from, any provision in a model lease issued by the Department of Housing and Urban Development for use under the program under such section 8(o); and</text></paragraph> 
<paragraph id="H634046B9F1C94D7AA5CC953B95A356D4" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">any regulation or Executive Order providing for access to Federally funded programs by eligible persons having limited English proficiency.</text></paragraph></subsection> 
<subsection id="H79BE953D70D24611AEA1FDC23333E4B0"><enum>(c)</enum><header>Termination of authority</header><text>The authority of the Secretary to provide waivers pursuant to this section shall—</text> 
<paragraph id="H326C06BDC0A74A43852E83A6D3D11098"><enum>(1)</enum><text>apply during the 6-month period beginning on the date of enactment of this Act; and</text></paragraph> 
<paragraph id="HDC8659D1F7094FE7949D89264FD35452"><enum>(2)</enum><text>extend for an additional 6 months after that period, unless at that time the Secretary makes a determination that assistance under this section is no longer needed.</text></paragraph></subsection></section> 
<section id="HD937171400C345428EFE5FEE4BC100B5"><enum>3.</enum><header>Authority of the Secretary to directly administer vouchers when PHAs are unable to do so</header><text display-inline="no-display-inline">If the Secretary of Housing and Urban Development determines that a public housing agency is unable to implement the provisions of subsection (o) of section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) or section 2 or 3 of this Act due to the effects of Hurricane Katrina, the Secretary may—</text> 
<paragraph id="HAFA89C068670495FB20025FB1FA4759E"><enum>(1)</enum><text>directly administer any voucher program described in such subsection or in section 2 or 3 of this Act; and</text></paragraph> 
<paragraph id="HBAD9EACDA7E34C3EBCD7F42E167EEBB7"><enum>(2)</enum><text>perform the functions assigned to a public housing agency by such subsection or section 2 or 3 of this Act.</text></paragraph></section> 
<section id="HC4372175877748988F6E92D0FC71A75F"><enum>4.</enum><header>Waivers for project-based section 8 to facilitate housing of affected families</header> 
<subsection id="H7C8C08C0BC8243208005335290E94B69"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">During the period specified under subsection (c), the Secretary of Housing and Urban Development (in this section referred to as the <quote>Secretary</quote>) shall waive the applicability of any of the requirements described subsection (b) with respect to any housing provided project-based assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) for any individual or family described for any individual or family that meets the requirements of paragraphs (1) and (2) of section 2 of this Act.</text></subsection> 
<subsection id="H6A3DD25F811F478A9554D5394BD41C05"><enum>(b)</enum><header>Provisions waived</header><text display-inline="yes-display-inline">The requirements described in this subsection are—</text> 
<paragraph id="H1B0F6148F4474128919370EE955CC5A8"><enum>(1)</enum><text>section 3(a) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(a)</external-xref>), relating to tenant contributions towards rent, except that any such waiver shall expire on an individual's return to work;</text></paragraph> 
<paragraph id="HD25B84C803B442388F80AD864461CC55" display-inline="no-display-inline"><enum>(2)</enum><text>sections 3(a), 8(a), and 8(c)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(a)</external-xref>, 1437f) relating to the income eligibility of individuals to receive assistance;</text></paragraph> 
<paragraph id="HE50B177BF02A447DA6855D3B871018CA"><enum>(3)</enum><text>section 8(k) of such Act, relating to verification of income;</text></paragraph> 
<paragraph id="H3B568146CBFA4EA5A43208DDC6498581"><enum>(4)</enum><text>section 8(d)(1)(B)(i) of such Act, relating to the requirement that leases shall be for a term of 1 year;</text></paragraph> 
<paragraph id="H9DDA53AF033C4B1C961341ABE3D43011"><enum>(5)</enum><text>any requirement relating to initial inspection of housing units by a public housing agency;</text></paragraph> 
<paragraph id="HB8B0397E45884F1896CC1743F27DEAD" commented="no"><enum>(6)</enum><text>any regulation, notice, or order requiring prior approval by the Secretary for the use of any lease provision that modifies, amends, or waives, or differs from, any provision in a model lease issued by the Department of Housing and Urban Development for use under the program under this subsection; and</text></paragraph> 
<paragraph id="H3BDAC9A554C749F590B40017231B4875" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">any regulation or Executive Order providing for access to Federally funded programs by eligible persons having limited English proficiency.</text></paragraph></subsection> 
<subsection id="HAA46A8EA21384EB2A6733593DE6886CB"><enum>(c)</enum><header>Termination</header><text>The period specified under this subsection is the 12-month period beginning upon the date of the enactment of this Act, unless before the expiration of the 6-month period beginning on such date of enactment the Secretary makes a determination that the waivers under this section are no longer needed, in which case the period specified under this subsection is the 6-month period beginning on such date of enactment.</text></subsection></section> 
<section id="H739A80B4934F4776A1535FD5B7023CBD"><enum>5.</enum><header>Preservation of project-based section 8 housing assistance payments contracts for damaged or destroyed housing units</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a project-based housing assistance payments contract entered into pursuant to section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) covering a project damaged or destroyed by Hurricane Katrina shall not expire or be terminated because of the damage or destruction of dwelling units in the project. The expiration date of the contract shall be deemed to be the later of the date specified in the contract or a date ending three months after the units are first made habitable. </text></section> 
<section id="HBE0580285A264379BE9FFA8600178866"><enum>6.</enum><header>Report on inventory of availability of temporary housing</header> 
<subsection id="HFC5997E449654C3395CBEE2C654D55F7"><enum>(a)</enum><header>Compiling of inventory</header><text display-inline="yes-display-inline">Not later than 20 days after the date of the enactment of this Act—</text> 
<paragraph id="H093A41AA3FBD46A683B84E10F5E05EC2"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Housing and Urban Development, the Secretary of Defense, the Administrator of the General Services Administration, the Secretary of Agriculture, the Secretary of Veterans Affairs, and such other agency heads as the Secretary of Housing and Urban Development determines appropriate, and the Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation, shall compile an inventory of Federal civilian and defense facilities (or, in the case of the Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation, properties held by such entities) that can be used—</text> 
<subparagraph id="HCBB770831A3E45328FBB3D2FA61B9F4B"><enum>(A)</enum><text>to provide emergency housing; or</text></subparagraph> 
<subparagraph id="H128E3A1F2A4245388B220063986EDBBA"><enum>(B)</enum><text>as locations for the construction or deployment of temporary housing units; and</text></subparagraph></paragraph> 
<paragraph id="H0B10F0D0614E4EADA5C27652A689003B"><enum>(2)</enum><text>each such agency head and entity shall submit the inventory compiled pursuant to paragraph (1) to the Secretary of Housing and Urban Development.</text></paragraph></subsection> 
<subsection id="HD1ED4EC46AE0415C9016A7ECCDDDCE92"><enum>(b)</enum><header>Report to congress</header><text>Not later than 30 days after the date of the enactment of this Act, the Secretary of Housing and Urban Development shall compile and submit to the Congress an aggregate inventory comprised of the inventory compiled by the Secretary pursuant to subsection (a) and all the inventories submitted to the Secretary pursuant to such subsection.</text></subsection></section> 
<section id="H61C80B7C6CCA46989E566D31D5AAADD1"><enum>7.</enum><header>GAO report on state emergency housing plans</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to the Congress—</text> 
<paragraph id="H20807C49EFD14DBD8B24A2542DB85F2F"><enum>(1)</enum><text>identifying any States that have developed emergency housing contingency plans for use in the event of a disaster;</text></paragraph> 
<paragraph id="HBDF714E362E942889E68424FD23F178C"><enum>(2)</enum><text>describing such plans; and</text></paragraph> 
<paragraph id="H0370CE6734104DCAB694F1FF943F94EA"><enum>(3)</enum><text>assessing the effectiveness of such plans.</text></paragraph></section>
