<subsection id="H9B4929FABAB44883B03E890030279716"><enum>(a)</enum><header>Reduction of retail sales threshold</header><text>Section 102(39)(A)(iv)(II) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(39)(A)(iv)(II)</external-xref>) is amended by striking <quote>shall be 9 grams</quote> and all that follows and inserting the following: <quote>shall be any quantity of pseudoephedrine over 3.6 grams in a single transaction, or any quantity of phenylpropanolamine over 3.6 grams in a single transaction, and in addition shall be, in the case of such products in nonliquid form, that the products be packaged in blister packs, each blister containing not more than 2 dosage units, or where the use of blister packs is technically infeasible, packaged in unit dose packets or pouches.</quote> </text> </subsection>

<paragraph id="H1272503B69584072AD647BCE49B8856E"><enum>(1)</enum><header>Regulated transaction</header><text>Section 102(39)(A)(iv)(I)(aa) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(39)(A)(iv)(I)(aa)</external-xref>) is amended by striking <quote>, except that</quote> and all that follows through <quote>1996)</quote>.</text></paragraph> 
<paragraph id="H5F9CACD984794BA5A9E9776BF48F08DB"><enum>(2)</enum><header>Definition; conforming amendments</header><text display-inline="yes-display-inline">The <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended—</text>

<subsection id="H324658D8D29E43369400AF5388E4406D" commented="no"><enum>(c)</enum><header>Public Law 104–237</header><text display-inline="yes-display-inline">Section 401 of the Comprehensive Methamphetamine Control Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref> note) (<external-xref legal-doc="public-law" parsable-cite="pl/104/237">Public Law 104–237</external-xref>) is amended by striking subsections (d), (e), and (f).</text> </subsection> 
<subsection id="H0EC80D2A31CE44498164ABD25E8286E9"><enum>(d)</enum><header>Combinations involving derivatives</header><text>Section 102(39) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(39)</external-xref>) is amended—</text> 
<paragraph id="HE37B18B27813475CBC003998F88D731E"><enum>(1)</enum><text> in subparagraph (A)(iv)(I)(aa), by striking <quote>the drug contains</quote> and all that follows through <quote>unless otherwise provided</quote> and inserting the following: <quote>the drug contains ephedrine, pseudoephedrine, or phenylpropanolamine unless otherwise provided</quote>; and</text></paragraph> 
<paragraph id="HDB0BCAA4709041B684EB6F2E226BD11B"><enum>(2)</enum><text>by inserting after and below subparagraph (B) the following:</text>

<paragraph id="HDF3B1BE16E13433EAB53E936730950BA"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting <quote>or for ephedrine, pseudoephedrine, or phenylpropanolamine</quote> after <quote>for each basic class of controlled substance in schedule I or II</quote> each place such term appears;</text></paragraph>

<section id="H4EAF493BF4BA4769AF1B8369F4CB40CC"><enum>103.</enum><header>Penalties; authority for manufacturing; quota</header><text display-inline="no-display-inline">Section 402(b) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/842">21 U.S.C. 842(b)</external-xref>) is amended by inserting after <quote>manufacture a controlled substance in schedule I or II</quote> the following: <quote>, or ephedrine, pseudoephedrine, or phenylpropanolamine or any of the salts, optical isomers, or salts of optical isomers of such chemical,</quote>. </text></section> 
<section id="HE33CF1428AA341E9AD4D7D59CD00AC6B"><enum>104.</enum><header>Restrictions on importation; authority to permit imports for medical, scientific, or other legitimate purposes</header> <text display-inline="no-display-inline">Section 1002(a) of the <act-name parsable-cite="CSA">Controlled Substances Import and Export Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/952">21 U.S.C. 952(a)</external-xref>) is amended—</text> 
<paragraph id="HB1690D1B01EF47D5B6B3ADC8CDA8C4F"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>or ephedrine, pseudoephedrine, or phenylpropanolamine,</quote> after <quote>schedule III, IV, or V of title II,</quote>;</text></paragraph> 
<paragraph id="H2D5394A100814FF980998D44008FED2F"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>, and of ephedrine, pseudoephedrine, and phenylpropanolamine, </quote> after <quote>coca leaves</quote>; and</text></paragraph> 
<paragraph id="HEC361AFF7A0C494AB2FD4D9B9B5C7CA9"><enum>(3)</enum><text>by adding at the end the following subsections:</text>

<subsection id="H221DBE05F4FA4EC6AAE631BB953EC1F"><enum>(d)</enum> 
<paragraph id="H65304EA3E27246EBA606ECE005F9869" display-inline="yes-display-inline"><enum>(1)</enum><text>With respect to a registrant under section 1008 who is authorized under subsection (a)(1) to import ephedrine, pseudoephedrine, or phenylpropanolamine, at any time during the year the registrant may apply for an increase in the amount of such chemical that the registrant is authorized to import, and the Attorney General may approve the application if the Attorney General determines that the approval is necessary to provide for medical, scientific, or other legitimate purposes regarding the chemical.</text></paragraph> 
<paragraph id="HD89C66293EFC48448D30478C77A2CCD2" indent="up1"><enum>(2)</enum><text>With respect to the application under paragraph (1):</text> 
<subparagraph id="H569B3FE099CB443DB98362B3925EB1F"><enum>(A)</enum><text>Not later than 60 days after receiving the application, the Attorney General shall approve or deny the application.</text></subparagraph> 
<subparagraph id="H7820D7B787684007BBE9F7AD82675694"><enum>(B)</enum><text>In approving the application, the Attorney General shall specify the period of time for which the approval is in effect, or shall provide that the approval is effective until the registrant involved is notified in writing by the Attorney General that the approval is terminated.</text></subparagraph> 
<subparagraph id="HF829F7F5328E4784BABF835320080F9"><enum>(C)</enum><text>If the Attorney General does not approve or deny the application before the expiration of the 60-day period under subparagraph (A), the application is deemed to be approved, and such approval remains in effect until the Attorney General notifies the registrant in writing that the approval is terminated.</text></subparagraph></paragraph></subsection> 
<subsection id="H300474678E0D4FB2ADD345B5321FEAE4"><enum>(e)</enum><text>Each reference in this section to ephedrine, pseudoephedrine, or phenylpropanolamine includes each of the salts, optical isomers, and salts of optical isomers of such chemical.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HE249A7B9B2C9456F8DCF53613833E2F0"><enum>105.</enum><header>Notice of importation or exportation; approval of sale or transfer by importer or exporter</header> 
<subsection id="H36D8DCF1E811413C89A437CCEB5B2F81"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1018 of the <act-name parsable-cite="CSA">Controlled Substances Import and Export Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/971">21 U.S.C. 971</external-xref>) is amended—</text> 
<paragraph id="H917C653347AF41BDA650EABC2321C130"><enum>(1)</enum><text>in subsection (b)(1), in the first sentence, by striking <quote>or to an importation by a regular importer</quote> and inserting <quote>or to a transaction that is an importation by a regular importer</quote>; </text> </paragraph> 
<paragraph id="H7FEF44C76B024749ABE66053DF99FE60"><enum>(2)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text></paragraph> 
<paragraph id="H56894EED5C374496ACC9A656CF3217AD"><enum>(3)</enum><text>by inserting after subsection (c) the following subsection:</text>

<paragraph id="H5DF380D9E305495BB46BA9633F21BE74" display-inline="yes-display-inline"><enum>(1)</enum> 
<subparagraph id="HB3C1F416D7D14562B553019C5BE0F452" display-inline="yes-display-inline"><enum>(A)</enum><text>Information provided in a notice under subsection (a) or (b) shall include the name of the person to whom the importer or exporter involved intends to transfer the listed chemical involved.</text></subparagraph> 
<subparagraph id="HB55086026B7C442B89E14C411C7B12B3" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of a notice under subsection (b) submitted by a regular importer, if the transferee identified in the notice is not a regular customer, such importer may not transfer the listed chemical until after the expiration of the 15-day period beginning on the date on which the notice is submitted to the Attorney General.</text></subparagraph> 
<subparagraph id="H7EA3A7F359194BB1A775721D1EC88049" indent="up2"><enum>(C)</enum><text>After a notice under subsection (a) or (b) is submitted to the Attorney General, if circumstances change and the importer or exporter will not be transferring the listed chemical to the transferee identified in the notice, the importer or exporter shall update the notice to identify the most recent prospective transferee and may not transfer the listed chemical until after the expiration of the 15-day period beginning on the date on which the update is submitted to the Attorney General, except that such 15-day restriction does not apply if the prospective transferee identified in the update is a regular customer. The preceding sentence applies with respect to changing circumstances regarding a transferee identified in an update to the same extent and in the same manner as such sentence applies with respect to changing circumstances regarding a transferee identified in the original notice under subsection (a) or (b).</text></subparagraph> 
<subparagraph id="HCE84AF193BB94AE5A7434842F1B44B9C" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">In the case of a transfer of a listed chemical that is subject to a 15-day restriction under subparagraph (B) or (C), the transferee involved shall, upon the expiration of the 15-day period, be considered to qualify as a regular customer, unless the Attorney General otherwise notifies the importer or exporter involved in writing.</text></subparagraph> </paragraph> 
<paragraph id="HA984A461962741699D00022741C87267" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to a transfer of a listed chemical with which a notice or update referred to in paragraph (1) is concerned:</text> 
<subparagraph id="H5E8CCDFAB46C4F368859430052337133" commented="no"><enum>(A)</enum><text>The Attorney General, in accordance with the same procedures as apply under subsection (c)(2)—</text> 
<clause id="H6CC92C7CDBAE4A05A5B8DE22859F551" commented="no"><enum>(i)</enum><text>may order the suspension of the transfer of the listed chemical by the importer or exporter involved, except for a transfer to a regular customer, on the ground that the chemical may be diverted to the illegal or clandestine manufacture of a controlled substance, subject to the Attorney General ordering such suspension before the expiration of the 15-day period referred to in paragraph (1) with respect to the importation or exportation (in any case in which such a period applies); and</text></clause> 
<clause id="H421B6584A97C4A93A37CAC81FBB0AD00" commented="no"><enum>(ii)</enum><text>may, for purposes of clause (i) and paragraph (1), disqualify a regular customer on such ground.</text></clause></subparagraph> 
<subparagraph id="HB874AC43675E4B5400855D1DDAE001AF" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">From and after the time when the Attorney General provides written notice of the order under subparagraph (A) (including a statement of the legal and factual basis for the order) to the importer or exporter, the importer or exporter may not carry out the transfer.</text></subparagraph></paragraph> 
<paragraph id="H2B746CA3003D4C4481DA5E7E81DC3C33" indent="up1"><enum>(3)</enum><text>For purposes of this subsection:</text> 
<subparagraph id="HBB68C9F63A7243169EF6D51ED64EBA9B" commented="no"><enum>(A)</enum><text>The terms <quote>importer</quote> and <quote>exporter</quote> mean a regulated person who imports or exports a listed chemical, respectively.</text></subparagraph> 
<subparagraph id="H21B190B89DE6458EBCF170518147A92F"><enum>(B)</enum><text>The term <quote>transfer</quote>, with respect to a listed chemical, includes the sale of the chemical.</text> </subparagraph> 
<subparagraph id="H2089CF0B3D6C49FFB17C17FA5B1CE685"><enum>(C)</enum><text>The term <quote>transferee</quote> means a person to whom an importer or exporter transfers a listed chemical.</text></subparagraph> </paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H09E0F4CE0A054C12A6AFE5E462CE1563"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="HA76658B116D9485CAC126F0039D8FB95"><enum>(1)</enum><header>In general</header><text>Section 1010(d)(5) of the <act-name parsable-cite="CSA">Controlled Substances Import and Export Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(d)(5)</external-xref>) is amended by striking <quote>section 1018(e)(2) or (3)</quote> and inserting <quote>paragraph (2) or (3) of section 1018(f)</quote>.</text></paragraph>

<title id="H56314AA39C0241AB85BC37B566E30000"><enum>II</enum><header>International regulation of precursor chemicals</header> 
<section id="H18EE13FC270240EFAB567EC0EEF6CA69"><enum>201.</enum><header>Information on foreign chain of distribution; import restrictions regarding failure of distributors to cooperate</header><text display-inline="no-display-inline">Section 1018 of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/971">21 U.S.C. 971</external-xref>), as amended by section 105(a) of this Act, is further amended by adding at the end the following subsection:</text> 
<quoted-block id="H56F8665EFD654352AAF3C1CFE256FF6E" style="OLC"> 
<subsection id="H350818F7AEFE43B696C2BC26E5BA283C"><enum>(g)</enum> 
<paragraph id="H82C642DE710B4F9AA6C7B94BD55F8BC" display-inline="yes-display-inline"><enum>(1)</enum><text>With respect to a registered person importing ephedrine, pseudoephedrine, or phenylpropanolamine (referred to in this section as an <quote>importer</quote>), a notice of importation under subsection (a) or (b) shall include all information known to the importer on the chain of distribution of such chemical from the manufacturer to the importer.</text></paragraph> 
<paragraph id="HD1E33E19DB9844F99DEEFE4158BFAAB7" indent="up1"><enum>(2)</enum><text>For the purpose of preventing or responding to the diversion of ephedrine, pseudoephedrine, or phenylpropanolamine for use in the illicit production of methamphetamine, the Attorney General may, in the case of any person who is a manufacturer or distributor of such chemical in the chain of distribution referred to in paragraph (1) (which person is referred to in this subsection as a <quote>foreign-chain distributor</quote>), request that such distributor provide to the Attorney General information known to the distributor on the distribution of the chemical, including sales.</text></paragraph> 
<paragraph id="HE1278464AEA2497BA9E9DCAE7EC8A604" indent="up1"><enum>(3)</enum><text>If the Attorney General determines that a foreign-chain distributor is refusing to cooperate with the Attorney General in obtaining the information referred to in paragraph (2), the Attorney General may, in accordance with procedures that apply under subsection (c), issue an order prohibiting the importation of ephedrine, pseudoephedrine, or phenylpropanolamine in any case in which such distributor is part of the chain of distribution for such chemical. Not later than 60 days prior to issuing the order, the Attorney General shall publish in the Federal Register a notice of intent to issue the order. During such 60-day period, imports of the chemical with respect to such distributor may not be restricted under this paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H021C634BA2814C17B5A0F174855BBC97" section-type="subsequent-section" display-inline="no-display-inline"><enum>202.</enum><header>Requirements relating to the largest exporting and importing countries of certain precursor chemicals</header> 
<subsection id="H06B769ACDC07475C91F760289E612F1"><enum>(a)</enum><header>Reporting requirements</header><text>Section 489(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291h">22 U.S.C. 2291h(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HDD337DDD22D74107B7516D4D929353B7" display-inline="no-display-inline"> 
<paragraph id="H8FA16F32EFE84C05B27E114FEB76C110"><enum>(8)(A)</enum><text display-inline="yes-display-inline">A separate section that contains the following:</text> 
<subparagraph id="H713D1D50797149B8971E1C1F46D4207B"><enum>(i)</enum><text>An identification of the five countries that exported the largest amount of pseudoephedrine, ephedrine, and phenylpropanolamine (including the salts, optical isomers, or salts of optical isomers of such chemicals, and also including any products or substances containing such chemicals) during the preceding calendar year. </text></subparagraph> 
<subparagraph id="HF543F2C554744E56A954ADFA9632F347"><enum>(ii)</enum><text>An identification of the five countries that imported the largest amount of the chemicals described in clause (i) during the preceding calendar year and have the highest rate of diversion of such chemicals for use in the illicit production of methamphetamine (either in that country or in another country).</text></subparagraph> 
<subparagraph id="H1FC7CEE508DF4894AA7BB7F6E876C504"><enum>(iii)</enum><text>An economic analysis of the total worldwide production of the chemicals described in clause (i) as compared to the legitimate demand for such chemicals worldwide.</text></subparagraph></paragraph> 
<paragraph id="H94F0CD80E78E4DAEB515E58156270000"><enum>(B)</enum><text>The identification of countries that imported the largest amount of chemicals under subparagraph (A)(ii) shall be based on the following:</text> 
<subparagraph id="HBED2B6AE584F4EA296B631B2EB7475C7"><enum>(i)</enum><text>An economic analysis that estimates the legitimate demand for such chemicals in such countries as compared to the actual or estimated amount of such chemicals that is imported into such countries.</text></subparagraph> 
<subparagraph id="H7DBB06CCF5954F90BED217C7CB7863A8"><enum>(ii)</enum><text>The best available data and other information regarding the production of methamphetamine in such countries and the diversion of such chemicals for use in the production of methamphetamine.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H123AD6E7B39F4779A597DE0A962DD"><enum>(b)</enum><header>Annual certification procedures</header><text>Section 490(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j">22 U.S.C. 2291j(a)</external-xref>) is amended—</text> 
<paragraph id="H77FD990A5D804471BAE88E9D3F33D2E1"><enum>(1)</enum><text>in paragraph (1), by striking <quote>major illicit drug producing country or major drug-transit country</quote> and inserting <quote>major illicit drug producing country, major drug-transit country, or country identified pursuant to clause (i) or (ii) of section 489(a)(8)(A) of this Act</quote>; and</text></paragraph> 
<paragraph id="H93F8229D24B947CCAD9BD4DC63B1DD18"><enum>(2)</enum><text>in paragraph (2), by inserting after <quote>(as determined under subsection (h))</quote> the following: <quote>or country identified pursuant to clause (i) or (ii) of section 489(a)(8)(A) of this Act</quote>.</text></paragraph></subsection> 
<subsection id="HE05A019B301B45B38B3943BDF7DC4CB6"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 706 of the Foreign Relations Authorization Act, Fiscal Year 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j-1">22 U.S.C. 2291j-1</external-xref>) is amended in paragraph (5) by adding at the end the following:</text> 
<quoted-block style="OLC" id="H95A78C78D63F40B7941400E12D544DE4" display-inline="no-display-inline"> 
<subparagraph id="H07B5DDA28A0340AAB12778B8E79933D8" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Nothing in this section shall affect the requirements of section 490 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j">22 U.S.C. 2291j</external-xref>) with respect to countries identified pursuant to section clause (i) or (ii) of 489(a)(8)(A) of the Foreign Assistance Act of 1961.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA3B9DC2E45554BB9BA5F99ADC5171CFC"><enum>(d)</enum><header>Plan to address diversion of precursor chemicals</header><text display-inline="yes-display-inline">In the case of each country identified pursuant to clause (i) or (ii) of section 489(a)(8)(A) of the Foreign Assistance Act of 1961 (as added by subsection (a)) with respect to which the President has not transmitted to Congress a certification under section 490(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j">22 U.S.C. 2291j(b)</external-xref>), the Secretary of State, in consultation with the Attorney General, shall, not later than 180 days after the date on which the President transmits the report required by section 489(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2291h">22 U.S.C. 2291h(a)</external-xref>), submit to Congress a comprehensive plan to address the diversion of the chemicals described in section 489(a)(8)(A)(i) of such Act to the illicit production of methamphetamine in such country or in another country, including the establishment, expansion, and enhancement of regulatory, law enforcement, and other investigative efforts to prevent such diversion. </text></subsection> 
<subsection id="H6C4AC40A7CF04FB2A668D2BB7732DE3"><enum>(e)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to the Secretary of State to carry out section 489(a)(8) of the Foreign Assistance Act of 1961 (as added by subsection (a)) $1,000,000 for each of the fiscal years 2006 and 2007.</text></subsection></section> 
<section id="H513D23E9F98240648EE559CD8D3569EA" section-type="subsequent-section" display-inline="no-display-inline"><enum>203.</enum><header>Prevention of smuggling of methamphetamine into the United States from Mexico</header> 
<subsection id="HAB0FC60077EF4051AA4700BA5B1587ED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State, acting through the Assistant Secretary of the Bureau for International Narcotics and Law Enforcement Affairs, shall take such actions as are necessary to prevent the smuggling of methamphetamine into the United States from Mexico.</text></subsection> 
<subsection id="HA07A3A40764248119F8C7FD8B5677383"><enum>(b)</enum><header>Specific Actions</header><text>In carrying out subsection (a), the Secretary shall—</text> 
<paragraph id="H5051D8D749894833A51E00A341BD6D50"><enum>(1)</enum><text>improve bilateral efforts at the United States-Mexico border to prevent the smuggling of methamphetamine into the United States from Mexico;</text></paragraph> 
<paragraph id="HEB6D0A9DDF534F52A9DAD363FA60A032"><enum>(2)</enum><text display-inline="yes-display-inline">seek to work with Mexican law enforcement authorities to improve the ability of such authorities to combat the production and trafficking of methamphetamine, including by providing equipment and technical assistance, as appropriate; and</text></paragraph> 
<paragraph id="H404B31E7FBFB432788DA60D3DD992834"><enum>(3)</enum><text display-inline="yes-display-inline">encourage the Government of Mexico to take immediate action to reduce the diversion of pseudoephedrine by drug trafficking organizations for the production and trafficking of methamphetamine.</text></paragraph></subsection> 
<subsection id="HFB6D0FB7679644D99EDA28CFABBDCFC"><enum>(c)</enum><header>Report</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter, the Secretary shall submit to the appropriate congressional committees a report on the implementation of this section for the prior year.</text></subsection> 
<subsection id="H2D5A11735C994F948C7F07C6096C00A6"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary to carry out this section $4,000,000 for each of the fiscal years 2006 and 2007.</text></subsection></section> </title> 
<title id="HA47A8FC5EFEC4B29B3D595F495F58619"><enum>III</enum><header>Enhanced criminal penalties for methamphetamine production and trafficking</header> 
<section id="H47BF5140BDC648CCB4E000F25993464F"><enum>301.</enum><header>Enhanced penalties for methamphetamine production, possession, or trafficking</header> 
<subsection id="H9367819F86994B01B1DDDB29AFA8008B"><enum>(a)</enum><header>Manufacture, distribution, dispensation, or certain possession of methamphetamine</header><text>Section 401 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841</external-xref>) is amended—</text> 
<paragraph id="H784EF98CD5DC45DB89681498B53DCE"><enum>(1)</enum><text>in subsection (b)(1)(A)(viii)—</text> 
<subparagraph id="H76C6FFA4236746DB8FEF1D90E1953B52"><enum>(A)</enum><text>by striking <quote>50 grams</quote> and inserting <quote>5 grams</quote>; and</text></subparagraph> 
<subparagraph id="HB2975F267AC5476F8197D20391E64806"><enum>(B)</enum><text>by striking <quote>500 grams</quote> and inserting <quote>50 grams</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HBD6E9AE6FE1F4F978699940077007D89"><enum>(2)</enum><text>in subsection (b)(1)(b)(viii)—</text>

<section id="HC20DDC26D5F747398BDBFB34838671EB"><enum>302.</enum><header>Smuggling methamphetamine or methamphetamine precursor chemicals into the united states while using facilitated entry programs</header> 
<subsection id="HE27E8DC820E44EF1A6793D0024353949"><enum>(a)</enum><header>Enhanced prison sentence</header><text>The sentence of imprisonment imposed on a person convicted of an offense under the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) or the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/951">21 U.S.C. 951 et seq.</external-xref>), involving methamphetamine or any listed chemical that is defined in section 102(33) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(33)</external-xref>, shall, if the offense is committed under the circumstance described in subsection (b), be increased by a consecutive term of imprisonment of not more than 15 years.</text></subsection> 
<subsection id="H3B148D9725AB44E8BA05E2B558D51300"><enum>(b)</enum><header>Circumstances</header><text>For purposes of subsection (a), the circumstance described in this subsection is that the offense described in subsection (a) was committed by a person who—</text> 
<paragraph id="H20E57D89C46246738481AE86AF3E342"><enum>(1)</enum><text>was enrolled in, or who was acting on behalf of any person or entity enrolled in, any dedicated commuter lane, alternative or accelerated inspection system, or other facilitated entry program administered or approved by the Federal Government for use in entering the United States; and</text></paragraph> 
<paragraph id="H10F7C7460ACA4F018E8B3EDB57F0E51E"><enum>(2)</enum><text>committed the offense while entering the United States, using such lane, system, or program.</text></paragraph></subsection> 
<subsection id="H0192CE32AE90496BBADCF4601D951F7B"><enum>(c)</enum><header>Permanent ineligibility</header><text>Any person whose term of imprisonment is increased under subsection (a) shall be permanently and irrevocably barred from being eligible for or using any lane, system, or program described in subsection (b)(1).</text></subsection></section> 
<section id="H9C06A8015A6445B2A36BE9007ED26318"><enum>303.</enum><header>Manufacturing controlled substances on Federal property</header><text display-inline="no-display-inline">Subsection (b) of section 401 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)</external-xref>) is amended in paragraph (5) by inserting <quote>or manufacturing</quote> after <quote>cultivating</quote>.</text></section> 
<section id="H508A129A24F042EA9363D193C483BC1"><enum>304.</enum><header>Increased punishment for methamphetamine kingpins</header><text display-inline="no-display-inline">Section 408 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/848">21 U.S.C. 848</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HC630BFED78AF45929708690837C593A2"><enum>(s)</enum><header>Special provision for methamphetamine</header><text display-inline="yes-display-inline">For the purposes of subsection (b), in the case of continuing criminal enterprise involving methamphetamine or its salts, isomers, or salts of isomers, paragraph (2)(A) shall be applied by substituting <quote>100</quote> for <quote>300</quote>, and paragraph (2)(B) shall be applied by substituting <quote>$1,000,000</quote> for <quote>$10 million dollars</quote>.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title> 
<title id="HCC1F7A9150AE4F4182577769A0934600"><enum>IV</enum><header>Enhanced environmental regulation of methamphetamine by-products</header> 
<section id="H92A6A60DB5694007A011BF7D75DA95BE"><enum>401.</enum><header>Designation of by-products of methamphetamine laboratories as hazardous materials and waste under Hazardous Materials Transportation Act and <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name></header> 
<subsection id="H160E932F29164CC7B672AC7C54D3FFF4"><enum>(a)</enum><header>Hazardous Materials Transportation Act</header><text display-inline="yes-display-inline">The Secretary of Transportation, after consultation with the Attorney General, shall utilize the authority provided by <external-xref legal-doc="usc" parsable-cite="usc/49/5103">section 5103</external-xref> of title 49, United States Code, to designate as hazardous materials for purposes of chapter 51 of such title those by-products of the methamphetamine-production process that the Secretary determines may pose an unreasonable risk to health and safety or property when transported in commerce in a particular amount and form.</text></subsection> 
<subsection id="H904779E3013349B7B8C5ED7645E200FF"><enum>(b)</enum><header><act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name></header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency, after consultation with the Attorney General, shall utilize the authority provided by section 3001 of the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6921">42 U.S.C. 6921</external-xref>) to designate as hazardous waste for purposes of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>) those by-products of the methamphetamine-production process that the Administrator determines are likely to cause long-term harm to the environment in the event of improper disposal and inadequate remediation.</text></subsection> 
<subsection id="H458F310530034DCD90119C8B007D37FC"><enum>(c)</enum><header>Time for designation; additional designations</header><text display-inline="yes-display-inline">The designations required by subsections (a) and (b) shall be completed not later than 18 months after the date of the enactment of this Act. After the expiration of such 18-month period, if the Secretary of Transportation or the Administrator of the Environmental Protection Agency determines that additional by-products of the methamphetamine-production process meet the criteria for designation pursuant to subsection (a) or (b), respectively, then the Secretary or the Administrator (as the case may be), after consultation with the Attorney General, shall designate the by-products accordingly.</text></subsection></section> 
<section id="H47502EB6273E433DBCB51C0085DEF5CB"><enum>402.</enum><header>Cleanup costs</header><text display-inline="no-display-inline">Section 413(q) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/853">21 U.S.C. 853(q)</external-xref>) is amended—</text> 
<paragraph id="HCBDED4E3F55045D7A2FB38C4A9F338DB"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>, the possession, or the possession with intent to distribute, </quote> after <quote>manufacture</quote>; and</text></paragraph> 
<paragraph id="H5EFA880B762A4F12AF278145009B0191"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>, or on premises or in property that the defendant owns, resides, or does business in</quote> after <quote>by the defendant</quote>. </text> </paragraph></section></title>
