<official-title>To amend part D of title XVIII of the Social Security Act to delay for 2 years implementation of the Medicare prescription drug benefit for individuals who are not lowest-income subsidy eligible individuals.</official-title>

<section id="H9D512D8615E342899118392E6460DD45" section-type="section-one"><enum>1.</enum><header>Delay in implementation of medicare prescription drug program for all but lowest-income subsidy eligible individuals</header> 
<subsection id="HC7812746A7304CEF89F60071F0C0CF68"><enum>(a)</enum><header>In general</header><text>Section 1860D–1(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w-101(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HA08F5D5DD51541D3A04633EFB56E4D9"><enum>(4)</enum><header>Limitation during 2006 and 2007</header> 
<subparagraph id="HFA23C983896547A5BE8556B07BC6E4E"><enum>(A)</enum><header>In general</header><text>With respect to benefits during 2006 and 2007, no individual shall be treated as a part D eligible individual unless the individual is described in section 1860D–14(a)(1).</text></subparagraph> 
<subparagraph id="H53FB8FF2F0D94154888929C54F63D2A5"><enum>(B)</enum><header>Transition</header><text>For individuals who would be part D eligible individuals but for subparagraph (A), the enrollment-related provisions of this part (and related provisions of part C) shall be applied as if any dates otherwise specified had been delayed for 2 years.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4BAF2B7360774DED8DE342A63F2F5C4B"><enum>(b)</enum><header>Continuation of drug discount card program for nonqualifying individuals</header><text>Section 1860D–31(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-141">42 U.S.C. 1395w-141(a)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HAB483E1AF91F4F8A0061CFAD4CCA8700"><enum>(D)</enum><header>Continuation for certain individuals</header><text>Notwithstanding any other provision of this section, this section shall continue to operate during 2006 and 2007 in the same manner it operated during 2005 in the case of discount card eligible individuals who would be part D eligible individuals during such period but for the application of section 1860D–1(a)(4)(A).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H68D287A5256647E3AE197CA5E77D890"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall be effective as if included in the enactment of Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text> </subsection></section>
